It is recommended that the Shire of Kondinin purchase two Toyota Hilux Workmate Utes from Merredin Toyota. It should be noted that recent changeovers included Hilux Utes and these vehicles have worked well as part of the Shires fleet. The current Nissan Navara has been very costly to maintain and this is another major consideration. STATUTORY ENVIRONMENT Local Government Act 1995 FINANCIAL IMPLICATIONS The Toro Lawnmower is over budget by $4,500.00 and the Prado changeover is roughly even with the budget. Matter discussed at Council meeting on 21st March 2018 where it was agreed that service be held at Kondinin Memorial Gardens and that school children from both Kondinin and Hyden be involved. MPD and RSL President, Allen Smoker held at meeting with both the school principals on the 20th September 2018 to finalise arrangements for the morning. There will be a strong focus on the Kondinin and Hyden PS students’ involvement in the service. Service scheduled to commence at 10.30am at the Memorial Gardens followed by a light lunch. Rose Garden Plaque is anticipated to be installed prior to 11th November 2018.

MPD received revised quotes for the project and West Coast Synthetic Surfaces have been engaged as the preferred supplier to undertake the works. Grant Agreement with Department of Local Government, Sport and Cultural Industries has been signed with confirmation of milestones. First and only claim of $4,221.80 from the Department of Local Government, Sport and Cultural Industries has been received. Works were completed during week beginning 10th September 2018. Final Acquittal report to be submitted to the Department of Local Government, Sport and Cultural Industries by the end of October 2018.

Wave Rock Public Art Trail

Approved and In Progress A joint grant application was submitted by the Kondinin CRC to CBH to engage a graphic designer to design and print a ‘Public Art Trail’ brochure. The brochure will include information on the various pieces of public art through Kondinin, Karlgarin and Hyden and accompanying maps. The brochure will tie in with the Pathways to Wave Rock brochure and Roe Tourism branding and will be launched to tie in with the Kondinin Art Show, but will be promoted all year round. The brochure has been completed and was launched at the Kondinin Arts Show opening night by the President of the Kondinin Artists Group, Janet Repacholi.

Submitted A grant application was submitted on 4th August 2018 to plant 1050 trees in 5 sites around the Kondinin Sports Ground and 50 edible bush tucker plants in the Kondinin Community Garden. The revegetation around the sports ground will provide a much needed wind break and wildlife corridor and will be planted with seedlings propagated from seeds collected by local Kondinin resident. Outcome of grant expected by November 2018 with planting to be undertaken in June 2019.

Upgrades to Coronation

Submitted Grant application submitted on 28 August 2018 for upgrades to Coronation Park, Hyden. Grant based on detailed plan prepared by Reality Landscapes which sets out project in 6

stages: Stage 1 (Contours & Drainage); Stage 2 (Bike Paths and Gravel Paths); Stage 3 (Updated Facilities); Stage 4 (Planting & Mulching); Stage 5 (Community Garden); and Stage

6 (Playground Shelter). In-kind support and endorsement of project received from Hyden Progress Association, Hyden Play Group, Hyden Day Care Centre, Hyden Respite Centre and

Hyden Disability Coordinator. Grant is largely for Stage 3 of the project relating to new outdoor furniture and equipment, together with concrete works for junior bike path and bollards around perimeter of park. Outcome of grant likely to be received by November

2018.

Events Summary

OCTOBER 2018

5th to 10th October 2018

Kondinin Art Show Run by the Kondinin Arts Group with financial contribution from the Shire of Kondinin, the opening night was held on Friday 5th October 2018 and well attended. This years’ judge, Roger Reading, provided a very detailed account of the works that were awarded prizes, which was much appreciated by many of those at the opening. The Shire’s Acquisition Prize was awarded to Christine Baker for her work ‘It’s Complicated’. The exhibition was open daily from 6th to 10th October 2018.

Garage Sale Trail A national event funded by the Shire of Kondinin and run in conjunction with the Kondinin and Hyden Community Resource Centres. Advertising and promotion currently underway.

Community Development Project Summary

Kondinin Community Garden

ON GOING - Busy Bees being held at the end of each month. Purchased outdoor drums for nature play area which is waiting to be installed. Early Years and Kondinin CRC are using the venue regularly for child based activities. Gourmet in the Garden Event booked again for Friday 22nd March with chef, Sophie Budd.

Wave Rock Improvements

IN PROGRESS –At its Ordinary Meeting on the 20th June 2018 the Council adopted the amended Wave Rock Improvement Plan 2018 – 2021 subject to budget funding. A site meeting was held on the 16th August 2018 with Wayfound Consultants attended by Shire Councillors, Shire Administration and Wave Rock Management Pty Ltd. The consultants submitted a scoping report including a list of recommendations to improve and streamline the signage design and location at Wave Rock. The high priority recommendations of this study are now being progressed by the consultants, including new directional and information signage within the Wave Rock Car Park area. The concepts for these new directional and information signs have been prepared and scheduled to be manufactured shortly. The Shire’s CEO and Shire President are currently investigating the development of a Bush Tucker Garden in the cleared area between the main Car Park and Wave Rock.

Hyden Streetscape Project for 2022 Centenary

IN PROGRESS – Concept Plan adopted by Council at its Ordinary Meeting on the 20th December 2017. At its Ordinary Meeting on the 20th June 2018 Council approved for Coronation Park to be the priority project for 2018/2019 as part of the Hyden Streetscape Project. Application to Lotterywest has been submitted to cover approximately half the costs of works to Coronation Park, with outcome likely to be received by November 2018. The Shire has engaged Reality Landscapes to undertake landscaping works to Coronation Park in liaison with the Shire of Kondinin and volunteer assistance where available during the 2018/2019 financial year. As part of the Hyden Streetscape Project work is also been undertaken on the design of the Hyden Swimming Pool Car Park; a grant for a continuous shared pathway along Marshall Street; upgrades to the parking and access to the shops along McPherson Street and associated drainage works in the Hyden Town Site all in line with the recommendation of the Hyden Town Revitalization Plan 2017.

Karlgarin Streetscape Project for 2020 Centenary

IN PROGRESS – Sub-Committee met on 27th September 2018. Key items discussed were; proposed granite and concrete commemorative wall; proposed granite and timber seats with interpretation; proposed map in the gazebo; research and mapping work being undertaken and change of date to early October 2020 to avoid conflict with Wave Rock Weekender. Minutes circulated following September meeting with list of actions and corresponding responsibility to be progressed before next meeting proposed for March 2019.

Roe Tourism ON GOING – New website http://www.roetourism.com.au/ is now live to promote Roe Tourism. The new amended Pathways to Wave Rock Brochures have been completed and circulated around the Shire. A new pop up banner has also been created which is available to use by the community when holding events to promote tourism in the Shire.

New Entrance Signage at Shire Boundaries

IN PROGRESS – Project has been split in two. Priority to be the boundary signs for 2018/2019. Draft designs were compiled by Connelly Imagery and tabled at the Ordinary Meeting on 15th August 2018 for discussion and were circulated to Councillors for feedback. Council supported Option C with some minor amendments at the Ordinary Meeting of Council held on the 19th September 2018. Matter to be progressed by the Shire’s Administration to finalise design of the major road and accompanying minor road signs and report back to Council for final approval. Anticipated that matter will be presented back to the November 2018 Ordinary Meeting of Council.

New Signage at Kondinin Lake

IN PROGRESS - Signage has been delivered and scheduled to be installed by early November 2018.

Interpretive Signage for Wagon and Sulky at Kondinin Information Bay

IN PROGRESS – Research and preparation of the text and accompanying photographs for the two interpretive panels has been completed and sent to sign makers for final design and manufacture. Anticipated that interpretive panels will be installed by early November 2018. A gravel pathway has been constructed between the Pioneer Wall and the shed that contains the box wagon and sulky which will assist in leading tourists to the area to read the interpretive signage.

Town Planning Projects and Matters Update

Project Status

Wind and Solar Farm Development Application has be submitted and matter is being progressed in accordance with relevant Town Planning Policy and Legislation. Responsible Authority Report to be submitted to the Department of Planning by the 25th October 2018.

Transit Park and Associated Caretakers Unit and Ticket Box

Application received 7th September 2018 and currently being advertised for public comment. To be reported to November Ordinary Meeting of Council.

BACKGROUND: In accordance with section 171A(2)(a) of the Planning and Development Act 2005 and regulation 5 of the Planning and Development (Development Assessment Panels) Regulations 2011 (the Regulations 2011) the application is classed as a mandatory Development Assessment Panel (DAP) application meaning it is required to be considered and finally determined by the Mid-West/Wheatbelt Joint Development Assessment Panel (JDAP). For more detailed background on this application, refer to Agenda Item 9.2.2 of the Ordinary Meeting of Council on the 19th September 2018 and the information detailed in the Responsible Authority Report (RAR) as shown in Attachment #1 of this Agenda Report. In accordance with r.12 of the Regulations, the Shire of Kondinin has until noon on Thursday, 25 October 2018 to provide the attached responsible authority report (RAR) and associated attachments to the DAP Secretariat. The purpose of this report is to seek Council’s endorsement of the attached Responsible Authority Report to the Midwest/Wheatbelt Joint Development Assessment Panel recommending the conditional approval of the development application received from Kondinin Energy Pty Ltd for the development and use of a new renewable energy facility on all or part of 19 separately titled freehold lots along Notting-Karlgarin Road and Brookton Highway, Kondinin. As above, the final determination of this development application is undertaken by the Mid-West/Wheatbelt Joint Development Assessment Panel (JDAP). DEVELOPMENT DETAIL The development comprises a Renewable energy facility on 19 freehold agricultural lots located approximately 5km north and north-east of the Kondinin townsite and comprising up to 46 wind turbines, a 125ha solar farm, energy storage and all associated transmission corridors and infrastructure (Kondinin Wind & Solar Farm). For more detail on the development refer to the Responsible Authority Report (RAR) as shown in Attachment #1 of this Agenda Report. Conclusion For the various reasons outlined in the Responsible Authority Report (RAR) as attached to this Agenda Report, it is asked that Council endorse the recommendation to the Midwest Wheatbelt Joint Development Assessment Panel that the development application be conditionally approved with appropriate advice

WAPC Manual – Visual Landscape Planning in Western Australia (2007) PUBLIC CONSULTATION Public consultation was undertaken by the Shire of Kondinin from the 21st August to the 14th September 2018 using the following methods:

- Publication of a notice on the Shire’s website with all accompanying plans and reports on the project;

- Public advertisements in three (3) different publications regularly circulated in the locality;

- Placement of a notice at the IGA supermarket and Shire of Kondinin Administration Centre in the Kondinin townsite;

- The erection of advertising signage on-site;

- Correspondence to all land owners in the vicinity of the proposed development; and

- Public display of the application documentation and plans at the Shire of Kondinin Administration Centre.

During the public advertising period one (1) written submission was received from an adjacent landowner who expressed their strong support for the proposal in its entirety with no issues or concerns raised. In addition to the above actions by the Shire of Kondinin, the applicant provided a presentation to all Kondinin Shire Councillors and senior staff in August 2017 and held a public exhibition at the Kondinin Community Resource Centre on the 28th September 2017. During this period the applicant liaised directly with all host landowners, other nearby landowners and local community members. A public information flyer was also prepared by the applicant which was displayed on the Shire’s website and included in local publications during the public consultation period. China Southern West Australia Flying College During the agency consultation period, which ran from 21st August to 5th October 2018, a total of fourteen (14) submissions were received. A brief summary of those submissions is outlined below with a more comprehensive summary provided in a Schedule of Submissions as shown in Attachment #3 of this Agenda Report. At the time of writing this report, information has not yet been received from the Environmental Protection Agency (EPA). Recent conversations with the EPA have indicated that the subject development application will be considered by the Chairperson of the EPA by the 19th October 2018 and that the Shire should receive advice on this before the Responsible Authority Report has to be submitted to the DAP Secretariat. This information from the EPA shall be incorporated into the Responsible Authority Report if it is received prior to the 25th October 2018. FINANCIAL IMPLICATIONS Shire of Kondinin Planning Fee - $33,836 DAP Secretariat Planning Fee - $10,486 The Shire has engaged Mr Joe Douglas of Exurban Rural & Regional Planning (Town Planning Consultants) on an hourly rate of $130.00 to assist the Shire’s Manager Planning and Development assess the application and prepare the Responsible Authority Report. Funds are available to cover these consultancy fees in the Shire’s Town Planning Expenses 2018/2019 Budget. It is to be acknowledged that Mr Douglas’ experience and expertise was invaluable in the preparation of the Responsible Authority Report. The Manager of Planning and Development was most grateful for the assistance and guidance Mr Douglas providing, resulting in a very comprehensive and thorough final document. STRATEGIC IMPLICATIONS

9.3.1 GENERAL

Construction Construction has been completed on the Hyden Norseman Road, we have also just completed widening on the East Hyden Bin Road, and this is Regional Road Group Funding. We have mobilized across to Lake Grace to carry out some private works for the Lake Grace Shire. Plant Repairs KN 65 & 66 – 8000 hour service KN 51 – 20000km Service KN 77 – PTO KN 67 – Volvo Loader 6000 hour service KN 55 – Grader Ute, Alternator Idler pulley and battery KN 61 – Grader Ute Replace nut and bolt on idler arm KN 64 – Adjust circle KN 2418 – Repair air leaks KN 2111 – Repair air leaks Maintenance Grading Has been a little dry over the past few weeks, so it has been mainly patch grading going on prior to harvest. Councillors please advise if any roads need priority due to poor condition. The recent rains and heavy traffic have created some more work out on Hyden Norseman. Maintenance We have had the Jet Paver in to patch holes in the roads prior to reseals. Parks and Gardens Water to Trembath Park has been restored and work at Coronation Park is due to start shortly. General Treasury have approved the grant for the drainage so hopefully we can make a start soon on.

9.4.2 Kondinin Drive-in

Applicant: Shire of Kondinin Author: DCEO Date: 5th October 2018 Disclosure of Interest: Nil SUMMARY/COMMENT: Last financial year the EHO and Administration discussed the dilapidated state of the old drive in building located on the corner of Gordon St and Kondinin Lake Rd, Kondinin. The building has not been used for many years and has been subject to vandalism resulting in the windows being smashed and the majority of the asbestos cladding being destroyed and spread around the site. A quote was sought from Kondinin Building Service, a licensed asbestos removalist, for the removal of the asbestos and demolition of the building. This quote was sought some time ago but due to other commitments of Kondinin Building Service the quote has only just been received. Due to regulations regarding the removal of asbestos a licensed removalist must be engaged.

Given the state of the building a decision needs to be made if it is to be demolished completely or just have the asbestos removed. It had been suggested in the past that part of the building be repurposed as a replacement site for the dog pound given the complaints received from nearby residents when a dog is housed overnight in the current pound in the Shire depot. However, due to its proximity to the existing pound it was not considered a suitable replacement site also the cost to convert was considered prohibitive. There has been a concerted effort in recent years to encourage resident and landholders to maintain tidy properties and it is believed that Council should lead by example in this case. It is recommended that the building be demolished in its entirety and that the existing entrance way to the site be retained for historical purposes if seen fit. STATUTORY ENVIRONMENT Local Government Act 1995 POLICY IMPLICATION Nil FINANCIAL IMPLICATIONS There has been no allowance in the budget for the demolition and asbestos removal at the Kondinin Drive-In site. There has however been a provisional sum of $12,500 made for asbestos remediation works at the Karlgarin Bowling Green that may not be required. Funding can come from this source if needed and the necessary adjustments made at the interim budget review. 9.4.3 CEO’s General and Project Status Report

Project Synopsis Recent Staffing We currently have a stable workforce.

Humps Standpipe Upgrade

With the Department of Water the Shire is providing a standpipe at the Intersection of Lovering and Raine Road (an existing site) that will draw water directly from the reservoir located at the Humps. Commenced December 2017.

This project was completed in September 2018.

Independent Living Units

The Wheatbelt South Aged Housing Alliance (WSAHA) is currently awaiting the outcome of its grant funding application with the federal government’s Building Better Regions Fund (BBRF).

A meeting was held between the alliance members at Shire of Wickepin to discuss the grant application for funding to undertake a new business case. This is progressing and as new information comes to hand Council will be informed.

Staff Housing Construction

Construction of Staff Housing Repacholi Parade. Commenced February 2017.

October 2018 - Work on the house is near completion with some exterior painting underway and some plumbing issues rectified.

Kondinin Community Sports

and Recreation Club Extension

Project

ACORP Construction was appointed as builders for the extension project at the Kondinin Country Club. This project commenced in April 2018

June 2018 – Demolition work has now been completed and the footings for the extension commenced. The steelwork should be onsite within the next few weeks. July 2018 – After some initial problems with the footings preparation due to a failure in the soil density tests prior to them getting poured the footings have now been completed for the major structural work. The steelworks are still being fabricated offsite and should be arriving shortly. August 2018 – The roof framing is complete and the internal brickwork construction has commenced. Once the brickwork has finished the installation of the roofing iron will commence. September 2018- Brickwork is complete. Roof cover has commenced. Electrical work has commenced. October 2018- As at 1st October construction is 54% complete. Roof and verandahs are on, gyprock on internal walls completed, plumbing run ins commenced, ceiling fixing commenced.

9.4.4 Disability Access and Inclusion Plan 2018-2023 Review

Applicant: Shire of Kondinin Author: DCEO Date: 7th September 2018 Disclosure of Interest: Nil SUMMARY/COMMENT: The Shire of Kondinin Disability Access and Inclusion Plan is due for a full review by October 2018. A Survey was sent out to the wider community in July 2018 seeking any concerns, comments or suggestions for improving access and inclusion in our shire. The response to the survey was most disappointing with only 13 responses out of a mail out in excess of 300. The response to the survey were collated and Council was advised of the results at the September Council meeting. The Shire of Kondinin Disability Access and Inclusion Plan has been prepared and the draft sent to Department of Communities, Disability Services for vetting with some minor amendments being made. The Shire of Kondinin Disability Access and Inclusion Plan has now been finalised and requires to be endorsed by Council. A copy of the DAIP has been emailed to Councillors Once the DAIP is adopted by Council it is required to be lodged with the Department of Communities, Disability Services for endorsement it is then to be publicly advertised and the strategies implemented. STATUTORY ENVIRONMENT Disability Services Regulations 2004 POLICY IMPLICATION The Shire of Kondinin Disability Access and Inclusion Plan is reviewed annually and a major review is done each 5 years. The EHO inspected the property and observed that the yards, dwelling and outbuildings were in a state of disrepair and uncleanliness. Such was the state of the property that Health Notices declaring the ‘dwelling unfit for human habitation’ and requiring the ‘removal of filth and unused items and to carry out works that would render the dwelling liveable’ were issued to the owner. The property will continue to be monitored to ensure full compliance. 53 Rankin Street, Kondinin The property and buildings were reported as being substandard in April 2018. The EHO inspected the property and observed that the yards, dwelling and outbuildings were in a state of disrepair and uncleanliness. Such was the state of the property that Health Notices declaring the ‘dwelling unfit for human habitation’ and requiring the ‘demolition of the buildings and subsequent cleaning up of the property’ were issued to the owner in April 2018. A follow up inspection of the property in September 2018 found little progress. A separate Health Notice requiring the ‘clean up and securing of the property’ by 12 October 2018 was subsequently issued. The Health Act provides the Shire with the legal option to carry out the works and recover the costs from the owner should the notice not be actioned. The property has been in a deplorable state since 2011. Should the Shire decide to carry out the works ie remove the filth and secure all openings (to prevent unauthorised persons from entering/inhabiting the dwelling), the original Health Notices will remain outstanding. The CEO and EHO will discuss further following the deadline. The property will continue to be monitored to ensure full compliance. 18 Howlett Street, Kondinin The property and buildings were reported as being substandard in June 2018. The EHO inspected the property and observed that the yards, dwelling and outbuildings were in a state of disrepair and uncleanliness. The owner was forwarded correspondence with a list of works items to complete. A follow up inspection of the property in September 2018 revealed not only a lack of progress but a deterioration of the situation, for example, exposed septic tank due to the collapse of the lid, broken waste water pipes, and an increase in filth. Such was the state of the property that Health Notices declaring the ‘dwelling unfit for human habitation’ and requiring the ‘removal of filth and unused items and to carry out works that would render the dwelling liveable’ were issued to the deceased owner’s executor. The property will continue to be monitored to ensure full compliance. Food Businesses Annual Food and Health Act reports for 2017/18 were prepared and submitted to the Department of Health.

Public Swimming Pools – Water Quality Public pools are subject to being inspected and waters being sampled and tested for both chemistry and microbial parameters in accordance with State regulations prior to opening and whilst open to the public. Preparations for the upcoming summer season are well under way. Pool Managers have been fully supported to ensure facilities comply with the regulations and codes prior to season start up. Census for 2017/18 were prepared and submitted to the Department of Water and Environmental

Regulation.

Shire of Kondinin Animals, Environment and Nuisance Amendment Local Law 2018 Following Council’s May 2018 resolution to make the above local law, a signed and sealed law was forwarded to the Chief Health Officer (CHO) for signing. The CEO received correspondence from the Department of Health (DOH) in late June 2018 seeking changes to the law. This was in direct contradiction to the DOH’s review of the law in March 2018 whereby no changes were required. Following Council’s August 2018 resolution to revoke the May 2018 decision and then make the above local law incorporating the DOH changes, a signed and sealed law was forwarded to and signed by the CHO. The law was published in the Government Gazette’s 5 October 2018 edition and became effective same day. A submission to the Joint Standing Committee on Delegated Legislation on the gazetted law was made and included explanatory memorandum, checklists and supporting documentation. The committee will review the process that the shire followed in making the law.
