In exercising this responsibility, the property management 21 division shall: 22 23 ( 1) Assign an identification number to each item of personal property that is a 24 capitalized asset; 25 26 (2) Maintain original vehicle and equipment titles except titles to vehicles and 27 equipment purchased or maintained through the equipment rental and revolving fund, 28 which shall be maintained by the fleet management division of the department of 29 facilities and fleet; 30 31 (3) Conduct inventory audits and maintain inventory records for county property; 32 33 (4) Consolidate personal property into lots when doing so provides an advantage with 34 respect to its management or disposition; 35 36 (5) Determine the fair market value of surplus property by appraisal, market study, or 3 7 other means appropriate to the type of property and determine whether, based on such 38 fair market value and disposition costs, the surplus property is worthless; 39 40 (6) Maintain all original deeds, easements, reservations of mineral rights and other 41 documents evidencing title to real property except those documents relating to property 42 held for county road purposes, which shall be maintained by the department of public 43 works; 44 45 (7) Maintain all original lease and license agreements except: Ordinance No. 19- AMENDING sec 4.46.115 077

(a) Agreements relating to property within the boundaries of the Snohomish 2 county airport, which shall be maintained by the Snohomish county airport 3 manager; 4 (b) License agreements approved under sec 2.32.150, which shall be 5 maintained by the department of parks and recreation; and 6 (c) Residential leases of real property within the custodianship of the department 7 of parks and recreation, which shall be maintained by the department of parks 8 and recreation. 9

1 O (8) Act as the designee of the county treasurer under RCW 36.34.080 as now enacted 11 or hereafter amended; 12 13 (9) Recommend removing the tax title status of property by paying the outstanding 14 taxes as provided in RCW 36.35.150(1) if the property may have use for a public 15 purpose; 16 17 ( 10) Advertise the disposition of surplus property as provided in SCC 4.46.250 or as 18 otherwise required by applicable law; 19 20 (11) Upon request from the public, provide verification or status of county ownership or 21 placement in county inventory for county real and personal property; 22 23 ( 12) Initiate requests to utilities to start or stop service delivery to county real property; 24 25 ( 13) Execute form trespass enforcement requests to local law enforcement agencies 26 having jurisdiction where county real property is located; 27 28 (14) Execute all documents for which the property management division is granted 29 signature authority; 30 31 (15) Conduct or approve the conduct of the disposition of all surplus county property 32 except disposition of property approved and conducted by the purchasing manager or 33 fleet manager pursuant to sec 4.46.201; 34 35 (16) Execute on behalf of Snohomish County documents that are administrative in 36 nature for the management of county-owned property which do not obligate the county 37 monetarily or for which sufficient appropriations already exist and which do not 38 otherwise give rise to new or additional liabilities, including but not limited to applications 39 and forms required for development of county-owned property, owner association 40 documents related to county-owned property, forms required for acknowledgment of 41 and responsibilities associated with county-owned property ownership; and 42 43 .{1Il Execute all documents necessary to complete transactions for which the property 44 officer has approval authority. 45

PURPOSE: Snohomish County Council approval of the Ordinance amending SCC 4.46.115 and to authorize the Snohomish County Executive to sign said ordinance.

Snohomish County code 4.46.115 defines the administrative responsibilities for the Property Management division of the department of Facilities and Fleet.

In the course of performing the duties of the Property Management division there are circumstances where signature authority is required associated with the management of county-owned property which do not obligate the county monetarily or for which sufficient appropriations already exist and which do not otherwise give rise to new or additional liabilities.

County signature is required to process these documents and are administrative in nature and considered part of the duties in the management of county-owned property. Examples include but are not limited to applications and forms required for development of county-owned property (i.e. Critical Area Site Plans, Joint Aquatic Resources Permit Application) and documents associated with homeowners association of which the county is a property owner (i.e. Amendment to Declaration of Covenants, Conditions and Restrictions) and property owner information update forms (i.e. Elevator Information Update forms).

The proposed ordinance is to amend Snohomish County code 4.46.115 for the purposes of streamlining processess and to reduce staff time to obtain the county's signature for documents administrative in nature relating to property management functions. This proposed ordinance will delegate signature authority to the Property Officer within the Division of Property Management, Department of Facilities and Fleet.

Consideration: The Executive’s Office requests Council consider approving proposed Ordinance 19-077, which would approve and authorize a change to SCC 4.46.115 related to the Property Management Division’s Administrative Responsibilities.

Background Currently, when a signature is needed in order to manage county-owned property, the request comes before Council, requesting signature authority for each specific instance. Some of those circumstances do not obligate the county monetarily and/or do not give rise to new or additional liabilities. Examples of documents that are administrative in nature and currently require Council authority to sign are: Critical Area Site Plans; Joint Aquatic Resources Permit Application; Amendment to Declaration of Covenants; Conditions and Restrictions and Elevator Information Update Forms. The Department of Facilities and Fleet, Property Management Division is requesting an update to SCC 4.46.115, delegating signature authority to the Property Officer related to documents that are administrative in nature, do not obligate the county monetarily or for which sufficient appropriations already exist and do not give rise to new or additional liabilities.
