When licensed contractors work outside of their specific classification or scope of work, they sub- ject their license to possible criminal charges from PELS and disciplinary action from CSLB. Illegal acts of unlicensed engineering and land surveying by licensed CSLB contractors or unli- censed individuals are governed by B&P Code 8792(a), which is a misdemeanor. Civil penalties for these violations could run into the thousands of dollars and could be included in an action to revoke a license. Licensed Contractors Not Allowed to PerformLand Surveying and Civil Engineering Work

License required from Board for Professional Engineers, Land Surveyors and Geologists

SACRAMENTO, CA - The Contractors State Li-cense Board (CSLB) is reminding licensees that their CSLB-issued license does not allow them to perform land surveying and civil engineer-ing work. Performing this type of work without a license issued by the Board for Professional En-gineers, Land Surveyors and Geologists (PELSG) could put your CSLB license at risk.

Land surveyor and civil engineer requirements are detailed in California Business and Profes-sions (B&P) Code, Chapter 15, Articles 1-8, Sec-tions 8700-8805.

This October, youth from the Santa Barbara area interested in learn-ing about careers in green building will be invited to hear from suc-cessful green building practitioners working in the following area:

Design• General construction and trades• Associated businesses (e.g. material suppliers, manufacturers, • real estate and lenders)Specialty contractors (e.g. solar installers, landscapers, energy • and home performance auditors)

Would you be interested in serving on a panel sharing your experi-ence and hope with our motivated youth? Youth who attend will also have an opportunity to apply for one-hour visits to participating businesses.

This Youth Green Building Careers Symposia is a collaboration be-tween Built Green and the Santa Barbara Contractors Association (SBCA), Santa Barbara County Education Office--Partners in Educa-tion, Tradart Foundation, and the Workforce Investment Board (WIB). The Symposia was generally funded by the SBCA and a grant from the California Coalition for Construction in the Classroom (CCCC), as well as financial support from WIB.

FIRE SAFETY - IN CASE OF FIRE

You are responsible for fire prevention at work for your safety and that of your co-workers. The best way to prevent workplace fires is to be aware of and on the lookout for potential fire hazards. Report hazardous situations to the supervisor. Know the location of fire extinguishers and other emergency equipment that is available to you. During an actual emergency, protect yourself. Do not get involved if it is not safe.

If you ever discover a fire, keep your cool but think fast and act with caution. Size it up fast; knowing when to attempt extinguishing the fire yourself and when to call for help is essential.

In case of fire, follow your company’s fire response procedures. The important thing is to know what to do and do it fast. The exact order to do the things depends on the established company procedures.

Sound the alarm and evacuate the area. Call the emergency numbers you’ve been given, and give the details about the fire (location, how it started etc.). Never hesitate to call the fire department, even if the fire seems minor and you manage to put it out before firefighters arrive. The quicker the alarm is sounded, the sooner firefighters can attempt to get it under control. Have someone meet the firefighters to tell where the fire is. They can lose valuable minutes if they have to find it themselves.

You are responsible for preventing fires, but not to put out major fires. Fight the fire only if you can do it safely with proper extinguishing materials. In general, never battle the blaze unless the firefighters request your help.

Warn anyone in the area so they can get to safety. This is especially important with indoor fires. Most people die from smoke, poisonous gases and panic (usually the result of not knowing what to do). If there is an escape plan, adapt it to the emergency.

Most fires start small, but they can rage out of control in a few minutes. It is important to know where the fire extinguishers are located and how to operate them properly. Distinguish before you extinguish. Choose the correct extinguisher for the type of fire (paper/wood, grease/gas/flammable liquids, electrical). If you are not trained or authorized to use an extinguisher, don’t try. The time you waste in figuring out how to operate an extinguisher could mean the difference between minor damage and a major disaster.

Review your company’s fire safety procedures often so you’ll now what to do. Act with caution. Sound the alarm. Warn others in the area. Evacuate and stay back unless you’re asked to help. In case of fire, being informed and prepared can keep you and your co-workers safe from injury.

EN CASO DE INCENDIO

Usted es personalmente responsable de evitar incendios en el trabajo para su propia seguridad y la de sus compañeros de trabajo. La mejor manera de evitar incendios es mantenerse alerta contra los posibles peligros de incendio.

Esté consciente de los peligros potenciales de incendio en el sitio de trabajo. Reporte situaciones peligrosas a su supervisor. Conozca la ubicación de los extinguidores de fuego y otros equipos de emergencia que se encuentren disponibles. Durante una emergencia, protéjase. Si no es seguro involucrarse, no lo haga.

You don’t have to get a tattoo when you want a contractor’s license in California, but you do get ‘inked’. That’s often where the trouble starts. An out-of-state builder doesn’t think he needs a license but his lawyer does. Our last contractor inquiry gets a full 100% answer for his ‘ten per-cent’ question…

Q: I want to apply for a contractor’s license; how-ever, I was convicted of a felony about 8 years ago. I’ve heard that someone with a criminal re-cord will likely not be given a license. What do they look at?

A: According to a recent report released by the CSLB, the Criminal Background Unit has received more than 242,000 transmittals from the Depart-ment of Justice since the CSLB’s fingerprinting program began in January 2005. Of the appli-cants fingerprinted, they have received “hits” on over 41,000 applicants or about 17%. The Board has denied just over 1,000 applications and is-sued nearly 1,100 probationary licenses.

The CSLB considers a number of factors when evaluating someone’s criminal background. Among other things, they’ll look at when the crime was committed; is someone a repeat of-fender; what crime was committed and how recent was the offense. In your case, with only one incident in your background, I would say you have a very good chance of ultimately being

issued a license.

Q: My attorney told me I need a contractor’s li-cense. I have an upcoming project in California where I need to sign a contract, however I don’t plan to self-perform the work. In my home state, no license is required unless you actually handle the construction. Could you confirm whether in fact a license will be necessary? I don’t want to go through the hassle if I don’t need to.

A: One of the primary reasons your attorney told you to get a license is because it’s not worth the potential financial consequences if your con-struction project runs into problems. The key is whether you have a signed contract with the owner to handle the construction. Whether you decide to self-perform all or none of the work has little bearing on whether a contractor’s li-cense is required.

Acquiring a license may look like a “hassle” in the short run but failure to do so could cost you dearly down the road. For instance, a dispute may develop where you need to go to court. Without a license your case could be tossed out so any money you hoped to collect will be out the window. Further, if it’s determined a license was required to work in CA and you don’t have one, the other side in this theoretical dispute could ask the court to order the return of all monies you’ve already been paid. Welcome to

CA Code Section 7031.

Q: I have what I hope to be a pretty cut and dry question...We are General contractors who do a lot of business with subs. Legally how much can a subcontractor ask for work they “plan” to do? My understanding is that no one can charge for work that had not been completed. Does the 10% down payment rule apply in this case?

A: As it relates to home improvement contracts, B&P Code Section 7159.5(a) is pretty ‘dry’. In response to your first question, yes, subsection (5) clearly states that except for the down pay-ment a contractor may “neither request nor ac-cept payment that exceeds the value of the work performed or material delivered”. Your second question is clearly addressed in Subsection (3): “…the down payment may not exceed $1000 or 10% of the contract amount, whichever is less.” As the General contractor, the down payment would relate to your contract with the home owner, regardless of whether you self-perform or hire subs to do the work.
