Instruct your receptionist and/or security personnel on which management staff should be notified of a visit. Inspectors will wait on site about one hour for management contact. Inspectors have the right to walk around the building (accompanied), interview employees in private, and document hazards with photos and measurements. Are You Ready for Cal OSHA Inspections?Cal/OSHA inspectors make unannounced vis-its to ensure California workplaces are safe and healthy. If your business has a documented uncontrolled hazard and, as a result, receives a Cal/OSHA citation, the resulting penalties, legal issues, and lowered employee morale and pub-licity can have serious financial and business impacts. Managers, supervisors, and employees need to know what to expect during a Cal/OSHA inspection and how to respond appropriately.

Cal/OSHA conducts site inspections in cases of imminent danger or industrial accidents. A fatal injury to one or more employees; a serious injury or illness; a serious exposure; or the inpatient hospitalization, regardless of duration, of three (3) or more employees (a catastrophe) will trig-ger an accident investigation and must be re-ported to Cal/OSHA within 8 hours. Inspectors also focus on high-hazard work sites and indus-tries with loss rates at or above Bureau of Labor Statistics averages.

Inspectors will also visit worksites as a response to employee complaints posing an imminent danger. At times, employee complaints may be considered low risk. NEW RULES FOR PREVENTING HEAT ILLNESSES

Cal OSHA adopted a heat illness prevention regulation to prevent heat-related illnesses and deaths. It includes training, temperature monitoring, rest periods, and access to shade, all important factors you need to know to prevent heat-related illnesses.

Your employer must evaluate your outdoor working location for air temperature, humidity, and radiant heat from the sun to see if there is a risk for heat illnesses. Your employer must also evaluate your workload, the protective clothing you are required to wear, and the personal protective gear you use to see how they add to the risk.

To evaluate the working conditions that you will face on the job, your employer may check the Heat Index, a combination of temperature and humidity. When the heat index is at 80 or above when working in the open and at 90 or above when working in the shade, you are at an elevated risk of a heat illness and should take steps to control these risks.

Drinking water is important to reduce the risk of heat illness. While doing heavy work in high heat conditions, the human body loses up to two gallons of water per day. You need to consume about three - four cups of water every hour starting at the beginning of your work shift and throughout the day. Your employer is required to make two gallons of water per employee available for an eight hour shift. Not all of the water needs to be available at once, but the water supply should allow at least one quart per employee at all times.

Rest breaks allow your body to recover from work in the heat. A rest break in the shade for at least five minutes can reduce your heat stress and prevent heat illness. Use rest breaks to recover from hard work in the sun before any heat illness symptoms appear. Your employer must allow you to take a rest break when you request it.

You will need shade for your rest breaks. Your employer is required to provide you with a shaded rest area that has good air movement. You can use buildings, canopies, lean-tos, or even trees as rest areas. Don’t use car or other vehicle interiors for shade unless they are air conditioned or kept cool in some other way. Your rest area should have enough room to allow you to rest and sit comfortably. Your shaded rest area should not be hazardous, so do not rest underneath tractors or in confined spaces.

Get training on the risk factors, signs, and symptoms of heat-related illnesses, and the first aid measures required to treat them. Learn how to prevent heat illnesses by drinking water and slowly building up heat tolerance.

Know how to call emergency medical services to your worksite and give them accurate directions to avoid a delay in life-saving service. When you and your coworkers cannot communicate directly with emergency services, your employer must identify someone who can communicate with emergency services.

It’s better to beat the heat than treat the heat illness. Take rest breaks in a shaded area before your symptoms appear and drink plenty of water while working in the heat.

Cal OSHA ha adoptado un reglamento para la prevención de enfermedades o muertes relacionadas con la insolación. Incluye capacitación, control de la temperatura, períodos de descanso y acceso a sombra, todos factores importantes que usted necesita conocer para la prevención de enfermedades relacionadas con el calor.

Employees should never enter the space until all the safety precautions are in place and they have been authorized to enter. Emergency procedures must be in place and ready before any employee enters a confined space.

Why Are Confined Spaces Deadly?Confined spaces are deceiving and often appear to be harmless. Danger signs (such as dead animals, rusting walls, odors) are often not apparent and the space may have been entered before withoutincident. Never assume that conditions have not changed and that the space is safe for entry at all times.

How Can Work Be Done Safely In Confined Spaces?When possible, avoid entering these spaces by using devices or equipment that allows work to be done from the outside. If they must be entered, Cal/OSHA has regulations for working safely in confined spaces. Please refer to the specific standard for your industry and operations. For general industries such as manufacturing facilities, T8CCR 5157, “Permit-Required Confined Spaces”requirements apply. For employers and employees in Construction, Agriculture, Marine Terminals, Grain Handling, Telecommunications, Natural Gas and Electric Utilities, and Shipyard Operations, the regulations in T8CCR 5158, “Other Confined Space Operations” and other regulations apply.

In general, confined space regulations require all employers to have:

A written confined space plan, including recognizing and marking all confined spaces on site;Procedures to test and monitor the air inside confined spaces before and during all employee entries;Procedures to prevent unauthorized entries and to have an attendant outside the space at all times;Effective controls of all existing atmospheric or safety hazards inside the confined space;Employee and supervisor training on safe work procedures, hazard controls, and rescue procedures; andEffective rescue procedures which are immediately available on site.

It’s a short question with a long important answer that will impact licensed contractors throughout the State of California. While every Capitol Con-nection is a ‘must read’ for contractors, this is in-formation you absolutely don’t want to miss…

Q: I regularly read your column in my local Build-ers Exchange’s Construction Weekly and I appre-ciate your insight. My attorney informed me that, as of July 1st, there would be new preliminary notice forms and requirements for both private and public works. Are you aware of this?

A: Your attorney is correct. Effective July 1 of this year, there will be some significant changes to the 20-day notice requirement and for that matter the requirements for home improvement contracts and “mechanic’s lien” laws. A review of the 2012 License Law and Reference Book in-cludes two sets of laws: one, which is operative until July 1, 2012, and the second that becomes effective on the same day.

Presently, the “preliminary 20-day notice (private work)” is addressed in Civil Code Section 3097, which will be repealed on July 1, 2012. Not being able to locate the new code sections in the same

License Law and Reference Book, we turned to a trusted former CSLB employee, Michael Brown, who worked on this type of state legislation. In its place the State added an entirely new group of code sections (civil code 8200-8216) that deal with the new preliminary notice. Included be-low are a few EXCERPTS from these new Sec-tions. For the entire wording, we have put a link on our web site (www.cutredtape.com).

As with any lien or notice issue, it is critically important that you meet all the deadlines and procedures prescribed by law. Because of the large volume of information AND STRICT RE-QUIREMENTS, we highly recommend consulting a construction attorney with a background in mechanic lien laws.

CA Civil Code 8200. (a) Except as otherwise pro-vided by statute, before recording a lien claim, giving a stop payment notice, or asserting a claim against a payment bond, a claimant shall give preliminary notice to the following per-sons: (1) The owner or reputed owner; (2) The direct contractor or reputed direct contractor to which the claimant provides work, either directly or through one or more subcontractors; (3) The construction lender or reputed construction

lender, if any.

(b) The notice shall comply with the require-ments of Chapter 2 (commencing with Section 8100) of Title 1. (c) Compliance with this section is a necessary prerequisite to the validity of a lien claim or stop payment notice under this title…

CA Civil Code 8204: (a) A preliminary notice shall be given not later than 20-days after the claimant has first furnished work on the work of improve-ment. If work has been provided by a claimant that did not give a preliminary notice that claim-ant shall not be precluded from giving a prelimi-nary notice at any time thereafter. The claimant shall, however, be entitled to record a lien, give a stop payment notice, and assert a claim against a payment bond only for work performed within 20 days prior to the service of the preliminary notice, and at any time thereafter….

and safety, worksite, or personnel matters. Keep notes, photos, and records during the visit. If the inspector takes measurements or readings, conduct the same measurements and readings simultaneously.

After the walkthrough, the inspector should conduct a closing conference to provide inspec-tion results, next steps, and timelines. Inspec-tors may request protocols, work procedures, or other documents. Deadlines for submittal range between 24 hours and 14 days. The Injury and Ill-ness Prevention Program (IIPP) may be required immediately, since it is required to be readily accessible to employees. Conduct follow-up in-vestigations, corrective actions, and gather re-quested documents and provide them to the in-spector by the stated deadline. Missed deadlines can result in further site inspections or citations.

Cal/OSHA inspections are unannounced. Start planning now so you can present a competent, organized, and compliant response to a Cal/OSHA inspection. Designate and train staff to respond to Cal/OSHA inspectors. Maintain your safety programs and employee training proce-dures at appropriate levels. Keep safety records

organized and on site and ensure key staff know how to access them.

Project Description: The Project (Phase 1, located from approximately STA 24+85 to STA 28+81) generally consists of providing construction stormwater pollution control; traffic control; construction of 800 linear feet of 6’ x 18’ RCB 12”-30” diameter storm drain relocations in Amtrak Station parking lot; shoring of construction backcut; construction of manholes and junction structures; 12” diameter storm drain relocation at upstream side of Montecito Street; water facilities protection and relocation; miscellaneous concrete curb and gutter, AC and PCC pavement removal and replacement; irrigation system removal and replacement. The Contractor is required to coordinate with Caltrans, UPRR, The City of Santa Barbara and various utility agencies for permitting and relocations. The WORK occurs within and adjacent to Santa Barbara Amtrak Station, paved urban streets within the City of Santa Barbara and within State right-of-way (US 101). Dodge Green Sheet Value Code H.

The WORK occurs in the City of Santa Barbara, County of Santa Barbara, within Public Road Right of Way and Flood Control easements.

[Pleasenote that the Contract Drawings include Phases 1 and 2 but the bidding project only consists of Phase 1]. Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
