Assembly Bill 878 requires workers’ compen- sation insurers to report to CSLB if a licensee’s policy is cancelled as the result of a premium au- dit or investigation, or a misrepresentation that results in harm to the insurer without reimburse- ment being made. This legislation also states that disregard and violation of workers’ compen- sation insurance laws are cause for discipline by the CSLB Registrar. Other laws passed this year may also impact contractors and their business operations. Laws with effective dates other than January 1, 2012 are noted in bold italics. New Year Means New Laws for LicenseesLicensure for LLCs among laws effective January 1, 2012

SACRAMENTO, CA – Limited Liability Companies are now able to apply for contractor licenses in California, in compliance with Senate Bill 392 which was signed into law in 2010. LLC officers interested in obtaining a contractor license must fill out a form specific to LLCs to initiate the pro-cess. That form is now available on the CSLB website. This is one of the new laws that go into effect this weekend.

Starting January 1, 2012, Assembly Bill 397 re-quires a contractor who certifies that he/she has no employees and is exempt from carrying a workers’ compensation policy to submit a new certification, or proof of workers’ compensation insurance coverage or self-insurance, each time the license is up for renewal. C-39 Roofing con-tractors must still purchase workers’ compensa-tion insurance coverage even if they certify they have no employees, as required by Business and Professions Code section 7125.

Assembly Bill 878 requires workers’ compen-sation insurers to report to CSLB if a licensee’s policy is cancelled as the result of a premium au-dit or investigation, or a misrepresentation that results in harm to the insurer without reimburse-ment being made. ERGONOMIC BREAKS, REST PERIODS, AND STRETCHES

Ergonomic injury risk factors include forceful movements, repetitive motions, awkward postures, and lack of rest. Rest periods give the body time to recover from work; breaktime exercises and stretches strengthen the body. Workers should think of themselves as Industrial Athletes; athletes wouldn’t participate in a sport without proper rest and warm-up, so use the same preparation on the job.

Maintaining overall health reduces your risk of injury. Get a good night’s sleep to rest your body and maintain alertness. Eat healthy foods and drink fluids to boost energy and stay hydrated. Aerobic exercise and weight training increase strength and vitality. Stretching, yoga, and pilates improve flexibility and build core body strength.

Pay attention to signs of discomfort and fatigue on the job; these are warning signs from your body. As muscles tire during a work task, slouching can lead to poor posture, sloppy, uncontrolled movements, and injuries. Rest breaks mean recovery for the body. During a job task, take micro-breaks lasting 10-15 seconds every ten minutes. Take mini-breaks lasting 3-5 minutes every thirty to sixty minutes. These short breaks give the body a rest, reduce discomfort, and improve your performance.

Alternate your work activities and postures throughout the day. Rotating tasks may seem inefficient, but the rest and use of different muscle groups increases energy and maintains productivity. For example, if you are a landscaper, don’t trim all of the shrubs, sweep up the trimmings, and then leaf-blow the whole area; work in sections and trim, sweep, and leaf-blow in alternating tasks. If you work at a single workstation and job task all day, move into different postures while you work: first standing, then standing with one foot resting on a stool, then sitting.

Stretches help you warm-up before work and relax during breaks; they increase flexibility and boost blood flow and oxygen to muscles. Perform stretches slowly and gently; avoid extreme postures and stop stretching if you feel pain or discomfort. Physical and Occupational Therapists are the most qualified individuals to generate a specific stretching and warm-up program.

Overall fitness and flexibility, adequate sleep, task rotation, and rest breaks can help limit the overall risk of injury.

Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.

Assembly Bill 1424 requires CSLB to state •on its applications that the law allows the Board of Equalization and Franchise Tax Board to share information with CSLB and that a license may be suspended for failure to pay state taxes.

Mechanic’s LiensSenate Bill 190 makes technical changes •to the mechanic’s lien overhaul legislation passed last year (SB 189) that is to take ef-fect on July 1, 2012.

Senate Bill 424 enables a design profession-•al lien to be converted to a mechanic’s lien if the design professional lien expires and remains partially or fully unpaid.

Assembly Bill 456 clarifies that the proof •of service affidavit that must accompany a mechanic’s lien filing to validate the lien must show the name of the property owner and the title or capacity in which the person or entity was served the claim of lien.

The law does not apply to certain contracts such as those governing residential homes, public buildings, work-ers’ compensation agreements, and some insurance agreements.

Certification and TrainingSenate Bill 56 changes some requirements •for construction trade apprenticeship pro-grams and the Division of Apprenticeship Standards responsibilities for oversight of such programs.

Assembly Bill 1346 requires those seeking •electrical certification from the Division of Apprenticeship Standards to include an employment history report from the Social Security Administration when submitting an application for certification and exami-nation.

Energy EfficiencySenate Bill 454 authorizes the California •Energy Commission to assess civil or ad-ministrative penalties for violating energy efficiency standards. It also prohibits pub-lic utility rebates or incentives unless the recipient certifies that the improvement or installation was completed by a licensed contractor and that required permits and inspections were obtained.

Environment and SafetyAssembly Bill 341 requires businesses that •generate more than four cubic yards of com-mercial, solid waste per week to arrange for recycling services by July 1, 2012.

Senate Bill 341 requires that construction •vehicles with a gross vehicle weight rating of 14,000 pounds or more be equipped an automatic backup alarm audible from 200 feet under normal conditions.

Small ClaimsSenate Bill 221 raises small claims court ju-•risdiction from $7,500 to $10,000.

CSLB Licensing and Board Operations Assembly Bill 1091 requires that CSLB be •notified within 90 days of a Responsible Managing Officer’s (RMO) or Employee’s (RME) disassociation from the license. The bill also enables a 90-day extension in lim-ited circumstances to replace the qualifier for the license.

Senate Bill 543 continues CSLB’s operation •as a board until January 1, 2016.

Senate Bill 944 makes technical changes •and updates to Contractor License Law.
