5.05 CEO Report01 Preliminary Valuation Results - Graham Schmidt of Cheiron will attend the
Financial Meeting on July 22nd to present the preliminary valuation results anddiscuss economic assumptions. He will present the results of the demographicexperience study at the August 17th Financial Meeting,
02 SEIU Local 1021 Strike - CEO St. Urbain reported that SEIU called a strikebeginning July 5, 2016. SJCERA staff represented by SEIU reported to work asscheduled. Thus far, the only impact to SJCERA due to the strike is the pick-up ofoutgoing U.S. mail, and the pick-up and delivery of Interoffice mail. During thestrike, SJCERA management will continue to hand-deliver SJCERA’s outgoingmail to the mailroom at the County Administration Building.
03 Room Block for August Manager Roundtable - The room block at Wine andRoses for Wednesday evening is available until July 22, 2016.

01 06/24/2016 RPESJC Regarding Post ‘82 Retireesa RPESJC President Robert Palmer, along with RPESJC Board Members
Michael Smith and Richard Callistro, presented suggested solutions forfunding the Post 1982 Supplemental Benefit for the Board’s consideration toavoid disruption in Post ‘82 settlement payments to the retirees.
After discussion, the Chair directed staff to include an item on the nextagenda so the Board can address obtaining outside Fiduciary Counsel toassist the Board in reviewing RPESJC’s proposals.

7.0 COMMENTS7.01 Comments From the Board of Retirement
01 Chair McCray welcomed Chanda Bassett to the Board.02 Ms. Praus stated that the NCPERS article that discussed the effects that pension
changes have on society is valuable.03 Upon reconvening in open session following adjournment of closed session, Ms.
Garman said that she never thought Annette would be leaving before she is, andis sorry she will be. She added that Annette is held in high esteem and arespected part of the retirement community. She wished her well. Mr. Weydertsaid that Annette has guided the Board to the position they are in today with greatstrides. She has always exemplified the highest levels of professionalism,diligence, and has done an outstanding job. He wants her to know they appreciateall she has done, although it may not always have been communicated at thelevel he desired, it does not change his feelings or thoughts of the good job shehas done. Mr. Restuccia echoed Mr. Weydert’s comment and thinks Annette isbrilliant at what she does. To highlight how valuable she is, he gave an examplefrom a prior SACRS conference when a panel was discussing PEPRA provisions,a panelist called out to Annette who was in the audience to confirm the panel’sdescription of a specific provision was accurate. Ms. Praus said Annette has seenthe Board through very difficult times, and they made it through it with Annette atthe helm. She thanked Annette, said that she made a difference in the fund, andshe appreciates all that she has done. Mr. Khan echoed all of the Board’scomments in regards to Annette. He added that he respects and appreciates herprofessionalism, dedication and loyalty. Chair McCray stated that Annette has apresence much larger than SJCERA, and although she will be missed, she will beappreciated wherever she goes.
CEO St. Urbain thanked the Board for their kind remarks. She stated that shewould not be successful without a great team behind her. She has an amazingstaff who works diligently together to serve the best interest of SJCERA’smembers and beneficiaries. She thanked the Board for the opportunity to workwith them as they move forward, while providing assistance and input whenrequested during the planning of SJCERA’s next phase.

The Chair convened a Closed Session at 10:02 a.m. The Chair adjourned the ClosedSession and reconvened the Open Session at 11:26 a.m. Counsel reported that inClosed Session the Board took the following actions on personnel matters:01 Senior Office Assistant
Nonservice-Connected Disability
The Board unanimously granted the applicant a Nonservice-ConnectedDisability Retirement.

02 Correctional OfficerService and Nonservice-Connected Disability
The Board unanimously accepted the findings and recommendation of theAdministrative Law Judge and denied the application for a Service andNonservice-Connected Disability Retirement.
8.02 PUBLIC EMPLOYEE DISCIPLINE/DISMISSAL/RELEASE01 Annette St. Urbain has indicated today her intention to submit her resignation no
later than December 31, 2016. The Board has elected to accept that resignationwith great gratitude for her service to date, and through that date. The Board hasadditionally voted unanimously to initiate the recruitment process for herreplacement. Annette will assist in that regard and that process will beginimmediately upon receipt of a written letter of resignation reflecting her intention toresign no later than December 31, 2016.

10.0 ELECTION OF OFFICERS10.01 Chair McCray said it has been a pleasure to act as Chair for the past year, although
the last few months has made it hard personally and professionally. Mr. Restucciathanked Mr. McCray for his service as Chair and added that he has done a great job.Ms. Garman said that she appreciated Mr. McCray’s leadership as Chair and addedthat he brings a wealth of knowledge and background for SJCERA. Mr. Weydertacknowledged Mr. McCray’s exemplary reputation in the SACRS communitystatewide and said he brings added value to the Board. He also mentioned that Mr.McCray’s dedication and commitment to the Board over the past year was amazing.
The Chair called for nominations for each officer of the Board of Retirement for 2016-2017.01 Motion by Weydert, second by Garman, nominating Michael Restuccia as
Chairperson carried unanimously.02 Motion by Weydert, second by Restuccia, nominating Cindy Garman as Vice
Chairperson carried unanimously.03 Motion by Khan, second by Restuccia, nominating Raymond McCray as
Secretary carried unanimously.11.0 ADJOURNMENT

Agenda Item 5.02 August 12, 2016 SUBJECT: Executive Search Firm Recommendation SUBMITTED FOR: ___ CONSENT l_X_l ACTION ___ INFORMATION RECOMMENDATION Ad Hoc Transition Committee recommends the Board of Retirement retain Alliance Resource Consulting, an executive search firm, to conduct a nationwide search on behalf of the Board for the position of Chief Executive Officer of SJCERA. PURPOSE To facilitate and support the Board’s executive management transition and Chief Executive Officer succession. DISCUSSION Staff has obtained information, representative client lists, and fee schedules from three executive search firms with experience in recruiting public sector executives. The Board of Retirement has used both CPS HR Consulting and EFL Associates in the past to recruit candidates for SJCERA’s executive positions. Although the Board has no past direct experience with Alliance Resource Consulting, in recent years this executive search firm has “cornered the market” on recruiting executives for public retirement plans in California. Alliance has a strong reputation, professional and experienced recruitment consultants, a well-defined process, a broad candidate database, and an understanding of the current market environment for public pension executives (compensation levels, recruitment incentives, organizational attributes that help attract top talent, etc.) The following table compares the fees and number of searches conducted by each firm for public pension plans in California (based on the marketing materials the firms submitted): Alliance EFL Assoc. 1–OURUNDERSTANDINGIt is our understanding that the San Joaquin County Employees’ Retirement Association (SJCERA) wishes to engage an executive search firm to assist in the Chief Executive Officer recruitment.
The SJCERA Board of Retirement oversees the Chief Executive Officer and staff in the performance of their duties in accordance with the 1937 Act, County Employees’ Retirement Law, SJCERA’s by-laws and policies set by the Board.

3–RECRUITMENTMETHODOLOGY&APPROACHAlliance Resource Consulting believes that we are an extension of your organization. As such, we work within your expectations and guidelines. Our objective is to find the best qualified candidates. While notices in professional journals may be helpful, many of the best candidates must be sought out and their interest encouraged. If you desire to retain us for a full and thorough recruitment process, we will do the following for your recruitment:
3.1 Strategy DevelopmentWe will interview members of the Search Committee and other client contacts to obtain a detailed understanding of the position, key goals and challenges, and organizational culture. We will also discuss expectations regarding desirable training, experience and personal characteristics of candidates. In addition, should you request it, we will conduct/facilitate community outreach meetings and focus group discussions.
We also have experience creating and managing community surveys, should the organization want input from its constituents. We will also gather/review relevant information about the organization, such as budgets, organization and/or department goals, organization charts, etc.
Once our findings have been summarized, we will submit a Recruitment Profile with the desired qualifications and characteristics to you for approval. The Recruitment Profile that will be sent to potential candidates will include information about the organization, the job and the criteria established by you.
3.2 Active RecruitmentOnce you have approved the Recruitment Profile, we will actively seek out individuals who meet your expectations. To achieve the best response, we will take a three-prong approach to attracting candidates:
1. Direct Contact – We will mail invitations and recruitment profiles to targeted individuals in comparable organizations at the appropriate level. These invitations will be followed up with direct phone calls to potential candidates to gauge interest.
2. Internal “Job Alert” – Over the past eleven years, we have developed an active database of over 20,000 candidates who are active in various public sector positions. We will send a new “job alert” to all our registered users in the Alliance Resource Consulting candidate application program. Prospective candidates will be contacted via e-mail with a link to the PDF version of the Recruitment Profile.
3. Advertisements – We will place job advertisements in the appropriate professional journals and on-line sites.
As a matter of corporate policy, we do not discriminate against any applicant for employment on the basis of race, religion, creed, age, color, marital status, sex, sexual preference, disabilities, medical condition, veteran status or national origin. A substantial percentage of the placements made by our firm have been minority or female candidates.
Frequent communication with our clients is a hallmark of our firm. While consultants will provide regular updates on the progress of your search, you will also be able to access up-to-date ‘real time’ information regarding your search from our secure website.
3.3 Candidate EvaluationWe will review, acknowledge and evaluate all resumes received. Candidate evaluation will begin with an analysis based upon criteria contained in the Recruitment Profile, information contained in the resumes submitted to us, and our knowledge of the people and organizations for which they work.

The next phase in candidate evaluation will focus on gaining additional information from the qualified group of candidates through written supplemental information questionnaires and other resources. Telephone interviews will be conducted with the most promising candidates to gain a better understanding of their backgrounds, qualifications and interest in the position.
3.4 Progress Report MeetingAfter the resume deadline, we will submit to you a progress report of the leading candidates. This report will include summary resumes, supplemental information, and the original resumes of those candidates we believe to be best qualified for the position. Supplemental information on a candidate typically includes: the size of the organization for which the person works, reporting relationships, budget responsibility, the number of people supervised, related experience and reasons for interest in the position. Any other specific information will be dictated by the criteria set forth in the Recruitment Profile.
The purpose of our progress report is two-fold. It allows you an opportunity to review the candidates and choose those who you would like to invite to be interviewed for the position. It also allows us to receive feedback on the caliber of the candidates recruited. In addition, at this point we will have conducted preliminary background checks on each of the presented candidates. Of course, we are flexible and may consider other individuals as final candidates who are subsequently identified and were not included in the progress report.
3.5 Preliminary InterviewsWe will interview (either in person or via video-conference) those candidates identified by you to be the leading candidates. We will conduct a preliminary interview with questions that focus on the selection criteria. Additionally, we will verify degrees and certifications and continue to gather information about the candidate’s professional backgrounds.
3.6 Client Interviews & Interview BooksWe will assist you in scheduling final candidates for interview with your organization, and will send the candidates packets of information which we obtain from you should you request it (e.g., information about the organization and the geographic area, budgets, etc.).
We will prepare final interview books for the selection panel. These books will include interviewing/selection tips, suggested interview questions, and rating forms for your use. Candidates will not be ranked, for we believe it will then be a matter of chemistry between you and the candidates.
We will also be on-site for the interview day(s). We will brief the interview panel at the start of the interviews and will facilitate the process throughout the day. After the last candidate interview, we will assist you in “debriefing” the interview panel members.
As part of our process in evaluating candidates, we make telephone reference checks. In conducting these references, it is our practice to speak directly with individuals who are, or have been, in a position to evaluate the candidate’s performance on the job. To gain a well-rounded impression of the candidates, we speak with current and prior supervisors, peers and subordinates. These references and our evaluations provide you with a frank, objective appraisal of the candidates. Once we finalize references on the top one or two candidates and conduct credit/criminal/civil litigation/motor vehicle record checks through an outside service, we will provide you with a detailed candidate evaluation report.

3.7 Special AssistanceOur efforts do not conclude with presentation of the final report. We are committed to you until a successful placement is made. Services that are routinely provided include:
• Arranging the schedule of interviews and the associated logistics for final candidates.• Advising on starting salary, fringe benefits, relocation trends and employment packages.• Acting as a liaison between client and candidate in discussing offers and counter offers.• Conducting a final round of reference checking with current employers (if not previously done for reasons of
confidentiality).• Notifying those candidates who were not recommended for interview of the decision. Following up with the client
and the selected candidate once he/she has joined the organization to ensure a smooth transition.
4–OURCLIENT’SROLEThe client has a very important role in the recruitment process. While we may identify and recommend qualified candidates, it is the client who must make the decision about which candidate to hire.
In order to insure that the best candidates are available from which to choose, our clients should be willing to do the following:
• Clearly inform us about matters relevant to the search that you wish to keep confidential (e.g., salary, personnel issues, and other privileged information).

6–ALLIANCEADVANTAGES6.1 TechnologyAlliance Resource Consulting is the only firm to utilize a custom-built “online” client/candidate management system. This custom system allows candidates to input their resumes and cover letters on our website. (For candidates who wish to email or mail us a hard copy of their resume, we will input the information for them.) Alliance Resource Consulting is always searching for new ways technology can help us save our client’s money. One way we do this is by using Skype to interview out of town candidates. Our innovative ways have set us apart from our more traditional competitors.
6.2 Stakeholder OutreachOur firm has used several methods, including stakeholder meetings, community forums and surveys, for stakeholder outreach in a number of previous recruitments. For example, for the previous City of San José City Manager recruitment, our consultants facilitated 13 community outreach meetings where citizens were invited to attend and express their opinions about what they were looking for in city manager candidates. For the City of Alexandria’s City Manager recruitment, we also met with special interest groups such as business leaders, Chamber of Commerce members and historic preservation groups.
During the recruitment of the City Administrator for the City of Huntington Beach (CA), the consultants met with each councilperson, each department head, conducted an open citizen forum and a forum for a group of stakeholders comprised of two citizens recommended by each councilperson. For the City Manager recruitment conducted for the City of Moreno Valley (CA), the consultants conducted a community panel as well. Our previous experience in stakeholder outreach makes our firm very qualified to conduct the meetings with the Mayor’s Office and City Council Members as well as facilitate multiple stakeholder outreach forums throughout the City that your request for proposal outlined.
Lastly, our firm has significant experience in creating community surveys should you wish to provide this option to your community. We have utilized surveys for many of our recruitments and can prepared them in different languages, if required. The surveys can be accessed on-line, or at our office and our client’s office.
6.3 Diversity OutreachStriving for diversity in our recruitments is a hallmark of our firm. We use a variety of sources for outreach to various minority communities to ensure the desired diversity of our candidate pool. In addition to our personal contacts in various minority communities, we advertise our positions in publications that target minorities in government and further publicize the position through minority organizations such as Blacks in Government and the International Hispanic Network. To ensure a diverse pool, we also create a recruiting list of qualified candidates from communities that have a comparable level of diversity as our client’s community.
We have created lists for comparable diversity during recruitments for the City Manager for the City of Compton (CA), the City of Tigard (OR), the Assistant City Manager/Chief Operating Officer for the City of Ventura (CA), and the Assistant City Manager for the City of Irvine, CA. The final pool for the City of Irvine included three women among the six finalists. We also collect Equal Employment Opportunity (EEO) information on our candidate pool. This information is accessible to our clients in real time on our company website.
6.4 Weekly Client UpdatesOur consultants provide our client contacts written recruitment updates on a weekly basis. These updates include work done that was completed during the week and what we expect to work on the following week.

7–RECRUITMENTCOSTSWe propose a fixed fee of $34,000 for the work outlined above, which includes up to three on-site meetings: one to develop the Recruitment Profile, one to present our Progress Report, and one to attend the first round of candidate interviews. If additional on-site meetings are required, a budget increase of $1,500 per meeting will be added to the professional fee. Please note that this amount does not include reimbursement of candidates who travel to be interviewed by you. Unless you notify us to the contrary, we will assume that you will handle these reimbursements directly.
Our fee will be split among four equal invoices. All invoices are due and payable upon receipt. We do NOT base our fees on a percentage of the position’s salary.
Our billing schedule on a retained fee (and based not on an hourly rate) is as follows:
1st Billing Due after Start Meeting First Phase $8,500
2nd Billing Due upon our submittal of a draft recruitment profile Second Phase $8,500
3rd Billing Due after we meet and submit our Progress Report to you Third Phase $8,500
4thBilling Due after the client conducts interviews with finalists Fourth Phase $8,500
Please note that this is a standard billing schedule and can be modified as requested.
You may discontinue this assignment at any time by written notification. In the unlikely event that this occurs, you will be billed for all expenses incurred to the date of the cancellation, and for professional fees based upon the time elapsed from the commencement of the assignment to the date of cancellation. If a cancellation occurs within the first 30 days of the assignment, following either verbal or written authorization to proceed, one-third of the professional fee will be due. If a cancellation occurs thereafter, the fee beyond the first one-third will be prorated based upon the number of calendar days which have elapsed. If a cancellation occurs after 90 days, all professional fees will be due in full.
GuaranteeWe are committed to working with you until a placement is made. However, if the selected candidate (recommended by us for hire, and excluding internal candidates) should be terminated within one year from the date of hire, we will re-do the search for no additional professional fee. Naturally, we would expect to be reimbursed for any expenses that might be incurred.
In the event that the Client hires, within one year of completion of this recruitment project, any candidates identified during the Progress Report as a result of Consultant’s recruitment project for any position other than the Chief Executive Officer, the Client agrees to pay Consultant a fee (based upon 50 percent of the recruitment’s professional fee) for each additional candidate hired.

Ms. Krebs is highly adept at working with executive management teams, Board members, and community/special interest group and has managed several high profile recruitments for Alliance.
Ms. Krebs graduated from Baker University with Bachelor of Art degrees in both Communications and Spanish. She is also a graduate of CORO’s Orange County Leadership program. Ms. Krebs is fluent in Spanish and proficient in French and Italian.

CEO SUBMITTED FOR: ___ CONSENT l_X_l ACTION ___ INFORMATION RECOMMENDATION The Ad Hoc Transition Committee recommends the Board of Retirement approve the personal services contract between the Board of Retirement and Robert R. Palmer to serve on a part-time, limited term basis as Interim Asst. CEO of SJCERA. PURPOSE To review the organizational structure and facilitate and support the Board’s executive management transition and Chief Executive Officer succession. DISCUSSION Robert Palmer served as SJCERA’s Retirement Administrator (the position now termed CEO) from 1991 until his retirement in August 2007. As discussed at the Board’s Financial Meeting held July 22, 2016, the CEO recommended, and the Board expressed interest in, retaining Mr. Palmer to serve as Interim Asst. CEO for SJCERA. As a retiree of SJCERA, Mr. Palmer’s post-retirement employment would be limited to not more than 720 hours in a fiscal year. This personal services contract shall be effective upon joint signature and shall terminate on January 12, 2017. Compensation shall be $100.00 per hour and the services to be performed include:
• Organizational Structure, • Clarify Reporting Relationships, • Daily Operations of Administrative Staff, • Staff Evaluation Process, • Succession Planning, and • Recruitment for CEO
Another issue specific to Mr. Palmer is raised in section 4 of the attached personal services contract. Mr. Palmer currently serves as President of the Retired Public Employees of San Joaquin County (RPESJC), which presents a conflict of interest with respect to a specific matter currently before the Board. To remove any perception of conflict of interest or inappropriateness, he has agreed to step away from RPESJC during the term of this agreement.

The Bipartisan Policy Center, apublic policy think tank thatattempts to find common
ground on issues that often divideDemocrats and Republicans, has putits stake in the ground on retirementsecurity with a plan that would shiftmore authority to the federalgovernment.
In “Securing Our Financial Future:Report of the Commission onRetirement Security and PersonalSavings,” the Center advocatescreating a new retirement arrangementto help workers save efficiently andconsistently. The June 9 report isgrounded in the principles thatAmericans don’t save enough, are atincreasingly high risk of outlivingsavings, lack basic knowledge ofhome equity and personal finance, andface an uncertain future with SocialSecurity.
“Taken together, the recommendationscontained in this report aim to establisha better savings culture and renew thepromise of an adequate retirement —across the income spectrum — forcurrent and future generations ofAmericans,” the Center said.
The centerpiece of the proposals is theRetirement Security Plan. Focused onsmall employers, this plan wouldeliminate hurdles to creating multiple

employer plans, foster the creation ofautomatic-enrollment plans for allemployees by creating a safe-harboralternative to nondiscriminationtesting, and expand tax incentives. Theplan would also transfer theadministrative and fiduciaryresponsibilities of running a plan to athird party that would be certifiedthrough the oversight of the TreasuryDepartment and Labor Department.
There is much to agree with in theproposals. For example, the Centerunderscored the impact of the pushaway from defined-benefit to defined-contribution plans. “Workers havefound themselves part of a greatexperiment — one that has givenindividuals and families far morecontrol and responsibility forfinancing their retirement, andsimultaneously exposed them togreater risk.” This approach is notworking for many Americans, thecommission noted. “People need theassistance of a well-designed systemas they accumulate, invest, and spenddown their retirement savings. Publicpolicy has a critical role to play infacilitating savings and a secureretirement.”
However, the Center unnecessarilytakes aim at state regulation,advocating for “establishing anationwide minimum-coverage
standard to pre-empt the patchworkof state-by-state regulation that isalready developing.” NCPERSopposes this approach because it fliesin the face of a long-running traditionof keep pension policy at the statelevel. Congress has not succeeded infinding a comprehensive approach toretirement security strategy that isrespectful of the important rolepublic pensions have played fordecades. The states, meanwhile, havefound common ground. Seven statesare already implementing lawscreating a state-initiated retirementplans for private-sector employees –an approach developed by NCPERSthat fuses the best features of publicpensions with more techniques morecommonly deployed in the privatesector.

Update on Puerto Rico Legislation
On June 9, by a vote of 297-127, theU.S. House approved H.R. 5278,which would create a seven-personoversight board to restructure andmanage Puerto Rico’s escalating debt.Majorities in both parties supportedthe measure. The legislation does notcontain federal reporting requirementson state and local pension plans(commonly known as PEPTA) or theannuity accumulation retirement plan.Both measures are strongly opposedby NCPERS and the public pensioncommunity.
The Senate must now decide how toprocess the House-passed bill andwhether to allow any amendments toit. Senate leadership said previouslythat, if the House passed the measureby a significant bipartisan majority,then it was likely to simply take an up-or-down vote on the House-passedbill. Senate action is expected to takeplace before the end of June.
The serious financial situation inPuerto Rico has been used asjustification to impose reportingrequirements on all state and localgovernmental plans in the 50 states.According to recently completedaudits, Puerto Rico’s largestretirement plan, the Employees’Retirement System, will be insolventsometime in fiscal year 2018, if itstays on its current path. The systemhas only 0.27 percent of fundsnecessary to cover the $30.2 billion itowes current and future retirees. Theargument has been made that, as goesPuerto Rico’s public pensions, so goesthe public pensions in the 50 states.
This link was initially made inlegislation introduced in December2015. At that time, Senate FinanceCommittee Chairman Orrin Hatch (R-UT) introduced S. 2381, his version oflegislation to assist Puerto Rico. Itincluded both the Public EmployeePension Transparency Act (PEPTA)

and the annuity accumulationretirement plan.
PEPTA would require that, if thefunding status of a plan is notcalculated using fair market value orthe specific interest rates defined inthe legislation, the funding status mustbe recalculated using those interestrates (U.S. Treasury bond yieldcurve). The result of the recalculationwill be that even well-funded pensionplans will appear to be poorly funded.This recalculation does not reflect theactual rates of return of the plans ortheir diverse investments. It will serveonly to create negative headlines thatwill be used by opponents of definedbenefit plans.
The annuity accumulation plan, whilecompletely optional for state and localplan sponsors, is clearly beingpositioned as an alternative and

ultimate replacement for definedbenefit pension plans. As areplacement plan, it has manydeficiencies. First, for firefighters andother public safety employees, thereare no survivor or disability benefits.These benefits are essential for publicsafety employees and their families.Second, employee contributions to theannuity plans are prohibited; onlyemployers may contribute. This runscounter to the vast majority of fundingstreams for public plans where bothemployees and employers contributeto the plans. Finally, the plan sponsormay choose to lower or not make anycontribution to the plan in any givenyear, provided it is done uniformly.
This creates great uncertainty onwhether the benefit will beconsistently funded year-to-year.
We are pleased that the House did notinclude PEPTA or the annuityaccumulation retirement plan in thelegislation it recently approved. Thebill does contain a provision dealingexclusively with public pension plansin Puerto Rico. If the oversight boarddetermines, in its sole discretion, that apension system of the territorialgovernment is materially underfunded,the oversight board shall conduct ananalysis prepared by an independentactuary of such pension system toassist the oversight board in evaluatingthe fiscal and economic impact of thepension cash flows. NCPERS believes
that this Puerto Rico-specific pensionprovision is entirely appropriate.
Please rest assured that NCPERS willcontinue to be vigilant in its oppositionto PEPTA and the annuityaccumulation plan, particularly as taxand retirement legislation is consideredby Congress in the future. As always,we will keep you apprised of any keydevelopments on these issues. !

Participating alongside me on thewebcast will be Bailey Childers,executive director of the NationalPublic Pension Coalition, andAnthony Roda, of the law firmWilliams & Jensen. Bailey andTony are simply two of the bestthinkers about the current state ofpublic pensions, and I know youwill find their remarks helpful. Themost important thing about thiswebcast is that NCPERS memberswill have the opportunity to askquestions and offer theirperspective. We look forward toyour lively participation.
We have a lot to be proud of thisyear. We staved off significantthreats to public pensions in
Oklahoma, Indiana, and Missouri.And we racked up affirmativevictories in Wisconsin, Kentucky,Alabama, and Louisiana. NewJersey and Maryland became the6th and 7th states respectively tocreate state retirement savingsarrangements for private-sectoremployees. This list, of course, isfar from comprehensive. You willneed to tune in to hear more abouthow the guardians of publicpensions are fighting the good fightat the state level. With most statelegislatures now in recess, we willalso look ahead to where the actionwill be in 2017.
On the federal level, we will hearabout the latest developments in theDepartment of Labor’simplementation of its ERISA safeharbor regulation, which PresidentObama ordered to clear the path forstates to offer retirement savingsarrangements for private-sectorworkers. The proposed regulationwas unveiled last November andthe period for public commentsended in January. A final regulationis expected before the fiscal yearends on September 30. We will hearabout how the Puerto Ricoassistance bill was neutralized to
eliminate anti-pension measures,and we will get an update on otherfederal initiatives and legaldevelopments in the federal courts.
Of course, it’s impossible to lookinto the second half of 2016 withoutmentioning Election Day.Presidential election years tend tobe divisive, as this year’s contestdramatically illustrates. It’s easyduring election season for domesticissues to be crowded out by turmoilelsewhere in the world. We willneed to remain consistent, clear, andsteady advocates for publicpensions throughout this electionseason to ensure that our voices willbe heard over the noise that anyelection generates.
NCPERS is justifiably proud tohave a highly informed andmotivated membership base thattakes threats to the defined benefitplan model very seriously. Ourmembers are our most effectiveadvocates for the protection andpreservation of the pension rights ofhundreds of thousands of public-sector workers and retirees.
