SANGGUNIANG PANLUNGSOD SESSION HALL ON TUESDAY, AUGUST 11, 2015.

WHEREAS, the Sangguniang Panlungsod of the City of General Santos enacted Ordinance No. 06, series of 2015, otherwise known as "An Ordinance Prescribing the Comprehensive Guidelines in the Prohibition of Smoking in the City of General Santos and providing penalties for violations thereof;

WHEREAS, Item H, Section 4 of the said Ordinance provides: "Selling and smoking of cigarette and other tobacco products inside or within 10 meters from the perimeter of the school campus are absolutely prohibited;"

WHEREAS, there is a need to amend the same Section of the said Ordinance so as to change the distance of prohibiting the selling and smoking of cigarette from 10 meters to 100 meters from the perimeter of the school in order to be consistent with Section 10 of RA 9211, which provides that "The sale or distribution of tobacco products is prohibited within One Hundred (100) meters from any point of the perimeter of a school, public playground or other facility frequented particularly by minors;"

ORDINANCE NO. 21 Series of 2015

AN ORDINANCE AMENDING ITEM H, SECTION 4 OF CITY ORDINANCE NO. 06, SERIES OF 2015, OTHERWISE KNOWN AS AN ORDINANCE PRESCRIBING THE COMPREHENSIVE GUIDELINES IN THE PROHIBITION OF SMOKING IN THE CITY OF GENERAL SANTOS AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF, SO AS TO INCREASE THE DISTANCE OF PROHIBITING THE SELLING AND SMOKING OF CIGARETTE FROM THE PERIMETER OF THE SCHOOL CAMPUS FROM 10 METERS TO 100 METERS

Be it enacted by the Sangguniang Panlungsod, City of General Santos that:

Section 1. Item H, Section 4 of City Ordinance No. 06, series of 2015 is hereby amended so as to increase the distance of prohibiting the selling and smoking of cigarette from the perimeter of the school campus from 10 meters to 100 meters, thus, the same shall now read as follows:

H. Selling and smoking of cigarette and other tobacco products inside or within 100 meters from the perimeter of the school campus are absolutely prohibited.

Section 2. Section 18 of Ordinance No. 06, series of 2015 is also amended such that the same shall now read:

Applicability Clause. —The provision of RA 8749 Clean Air Act and RA 9211 or an Act Regulating the Packaging, Use, Sale, Distribution, and Advertisements of Tobacco Products and for other purposes and Joint-Memorandum Circular No. 2010-01 of the Department of Health (DOH) and Civil Service Commission (CSC) insofar as Applicable, shall be considered Suppletory to this Ordinance.

Section 3. Repealing Clause.- All ordinances, resolutions, memoranda, orders and similar issuances, or part or parts thereof, which are inconsistent with any of the provisions of this Ordinance are hereby repealed or modified accordingly.

Section 4. Effectivity Clause.- This Ordinance shall take effect immediately upon approval.

Enacted by the 17th Sangguniang Panlungsod, City of General Santos, on its 102nd Regular Session held on August 11, 2015.
