In this regard, it is noted that the major works in this contract being Earthwork, Paver block laying and concrete pavement. Weight age is notably equal for all the above works. The contract

also includes notable extent of building construction works. However, while defining similar completed works, the Employer has referred to only Concrete pavement works, does seem to be random, unilateral and illogical. Hence, it is requested that definition for similar works may please be stretched/modified to include experience in all types of civil works, which would also helpful in ensuring fair and large

participation of firms in the bidding process thereby increasing the chances of best price for the Employer.

Possession of the Site 21.1 The Employer shall give possession of all parts of the Site to the Contractor free from encumbrances. If possession of a part is not given by the date stated in the Contract Data the Employer is deemed to have delayed the start of the relevant

activities and this will be Compensation Event.

We understand that the entire site is handed over to us in one go. This will prevent Idling of resources and also enables us to match the schedule. Please confirm.

The employer shall handover the entire work front to the contractor for commencement of work, however if any delay for handing over the work front partially/ fully, employer will give necessary extension of time for completion of contract. Accordingly, in case any delay for handing over the land

beyond the control of employer, the contract shall be terminated and no compensation whatsoever will be paid by KPL.

We have carried out several concrete road works and asphalt road works and Major Bridges in highways department. Bridge work involves major concreting at elevated levels which is tougher job than the ordinary concrete pavement work at ground level.

Hence we kindly request you to consider the similar work criteria as per your tender condition clause No. 4.3; as; “Similar Completed Work” means having experience in field “Construction of Concrete road work / Container yard work / Major Bridges” works in Port Sector / Central or State Government / Central or State PSUs / SPV Company of PPP Project mode or Concrete pavement works in Airport.

20. Use of M-Sand for all Concrete works, Masonry & Plastering works: As you may be aware that there is a sever scarcity of River Sand in Tamil Nadu and due to which construction activities has been hit across the State. Chennai, Kanchipuram, and Thiruvallur districts are the worst hit.

On 30 th November 2017, The Madurai Bench of the Madras High Court advised import of sand from Malaysia and directed the State government to stop sand quarrying within six months. Hence, please arrange to confirm that the M-Sand will be permitted for all Concrete, Masonry and Plastering works.

21. Also, usage of river sand is envisaged in types of work in the bid document. As you are aware that the availability of good quality river sand is scarce in the state of Tamil Nadu in general; moreover, the situation is worse at this juncture in the wake of direction issued by Honorable High Court, Madurai Bench to

close all the sand quarries in the State.

Hence, we request for usage of manufactured sand (M-sand or stone crushed sand) duly meeting all the specification requirements as the Govt. of Tamil Nadu has strongly advocated usage of M-sand in all types of construction activities. Please note many construction works concerning Govt. of Tamil Nadu, NHAI are being progressed with only M-sand.

Hence, we request you to amend the condition of reimbursement of GST to the Contractor by KPL on production of remittance only on the 25th day of subsequent month provided ITC will be reflected in KPL’s GST Portal accordingly. Please note that the Contractor can pay the GST only on receipt reimbursement of the same from the KPL, which can be reflected in the KPL’s GST

portal in the subsequent month.

Since, this being the Original works as per GST, GST will be paid along with the bill amount provided contractor issued the GST tax invoice.

ii) Also, it is requested to specify the extent of GST to be considered in the price bid.

The price bid would be evaluated along with the BoQ amount with GST as stated in the price bid.

i) Please Clarify the % GST. The bidder has to assess and

consider the applicable GST rate.

29. Work at Night hours:

Considering the nature of work, KPL to allow for 24 hours working.

Allowed for 24 hours working subject to the following conditions: When any work is performed at night or where day light is shut off or obscured, the contractor shall, at his cost provide appropriate lighting facilities to continue execution and permit inspection. During such periods the access to the place of work shall also be clearly illuminated. All wiring for electric lights and power shall be installed and maintained, securely fastened in a place at the points and shall be kept away as far as possible from telephone and signal wires. All wiring shall be subject to approval by the Engineer.
