A provisional seniority list of Upper Division Clerks appointed to the vacancies in the Commercial Taxes Department for the period from 01-07-06 to 31-08-08 was published and circulated among the U D Clerks of the department, inviting objections vide Order read as 2nd paper above. There are altogether 338 vacancies arisen in the department in the U D Clerk cadre during the period. The objections pointed out by the individuals comprise of omissions, claims of seniority of permanent test exemption under Rule 13B of KS&SSR, 1958, claims of seniority of temporary test exemption under Rule 13 A(1) a and (2) of KS & SSR , 1958, corrections in the dates of eligibility, names, date of birth, native place etc. Each representation has been examined in detail with reference to the test-qualified details furnished by the respective controlling officers. The following individuals filed objections that they have not been included in the provisional list though they are qualified.

As per the test-qualified details furnished from the controlling

offices, it was found that their claims are genuine and have been included in the list. Among them, Sri K Sudeep is eligible for temporary test exemption under Rule 13 A (1) a and (2) of KS &SSR, 1958.

The names of the following individuals have also been included in

the final list as they are found to be eligible for inclusion in the list. 1 M Antony 2 V C Mathew 3 P K Vinodkumar 4 A M Mathew Due to the inclusion of the above 14 individuals in the final list,

those individuals with lower-most rankings in the provisional list starting from Sl No 327 to 338 have been excluded. They are:

Smt Rosamma Antony (Sl No 128 in the provisional list) is excluded from the list as it is found that her date of filing of willingness for conversion is on 25-11-08.

The name of Sri N C Sunilkumar (Sl No 10 in the provisional list) is

also excluded from the final list, as he has not joined duty in the cadre of U D Clerk. Sri Sunilkumar was promoted as Upper Division Clerk by mistake as per Order No A3-100/07/CT (3) dated 16-10-07 of the Joint Commissioner-I, while he applied for Leave Without Allowance with effect from 01-10-07.

Certain individuals pointed out the objection of non-inclusion of their names in the provisional list. All of them have passed the departmental test conducted in June/ July 2008 and the result of which was published by the PSC on 20-10-08. The date of publication of the result of departmental test is the criterion of eligibility rather than date of test conducted as far as the seniority is concerned. The last vacancy arose in the list is on 04-08-08. Hence they are not eligible for inclusion in the seniority list. They shall be included in the list for the next period in the right positions. They are:

in the list even though they are eligible for inclusion in the list with reference to their promotion order dated 21-02-09. Some of the individuals in the same promotion order have been included in the provisional list. The reason that they have not found a place in the list is nothing but their turn with respect to the seniority in the LDC cadre has not reached at all. They also shall be placed in the list for the next period. They are:

Rule 13 A(1) a & ( 2 ) of KS &SSR, 1958 for re-assigning seniority

position just above his junior in the LDC list. On examining the matter, it is seen that his immediate junior in the LDC cadre was promoted to the cadre of U D Clerk as per Order dated 21-07-06 and was given placement in the seniority list of U D Clerks in a vacancy that arose on 28-06-05. As Sri Radhakrishnan has not passed the required departmental tests within 3 years from 21-07-06, he is not eligible for seniority just above his immediate junior in the LDC cadre as per Rule 13 A (1) a and (2) of KS &SSR. He also made two more doubts about the list:

(a) The dates in almost every month of the year are shown as the eligibility date in the column No 6 of the provisional list against the individuals. He contented that it is not correct, as the result of the departmental tests do not publish on every month.

(b) Also he doubted that whether the probation of all the candidates included in the list have been declared in the cadre of LD Clerk.

In the preparation of seniority list, the date of publication of result

of the departmental tests by the PSC or the date of declaration of probation in the cadre of LD Clerk whichever is latter, is the date of eligibility of an individual for promotion. But in the case of a typist for conversion as U D Clerk, the date of completion of 10 years’ service in the typist cadre or the date of filing of willingness for category change whichever is latter, is the date of eligibility in addition to the two conditions prescribed in the clerical cadre.

Smt Sangeetha Susan Varghese has represented to correct her name, which was wrongly entered as Sangeetha Susan in the provisional list. She also pointed out that the period of LWA sanctioned to her has been curtailed. Necessary corrections have been made in the list. Due to the incorrect test qualified details furnished from sub offices, certain individuals filed their objection to restore their due seniority with reference to their eligibility. On examination, it is found that their claims are genuine and are eligible for seniority on a prior date. They are:

In the case of Sri A R Mohanakrishnan, though he passed the departmental test with effect from 18-10-04, his probation was declared with effect from 16-01-06. Hence he is eligible for seniority with effect from that date. Smt P N Pushpa represented that her date of eligibility is on 24-02-06 instead of 12-10-06 as she filed her willingness for conversion on that date. But it does not change her seniority position in the final list. Smt C M Sumathy represented that her date of eligibility is on 22-10-06.But it is seen that her date of eligibility is on 25-10-06 as she filed her willingness for conversion on that date. Hence her request is rejected. Smt K R Valsamma, represented that she has not been included in the provisional list and Smt Anice Thomas, her junior in the U D Typist seniority list was included in the list. On examination, it is found that Smt Valsamma is not eligible on 19-07-08, ie, the date on which the vacancy assigned to Smt Anice Thomas. As Smt Valsamma filed her willingness for category change on 22-07-08, she has been assigned seniority in a vacancy that arose after 22-07-08 in accordance with her rank in the UDT seniority list.

The following persons included in the provisional list have claimed seniority in the same order as that in the LDC seniority list or the very same placement given to them in their promotion orders. 1 M R Sheela 2 M G Ullaskumar 3 K Aravindakshan 4 S Sunilkumar 5 V Anil

Among them, Sri M G Ullaskumar, Sri K Aravindakshan, Sri S Sunilkumar, Sri V Anil, Sri K Devamukundan and Smt P E Saji are U D Clerks converted from the cadre of U D Typist. The promotion orders issued from time to time are purely provisional. But preparation of seniority list is strictly based on the dates of eligibility with reference to the dates of occurrence of vacancy and seniority in the LDC/UDT cadre. The ratio fixed for L D Clerks and U D Typist/CA for promotion/conversion as UDC is 5:1. As per this quota, the placement of a Typist/CA candidate in between two clerks does not repeat just same as in the promotion orders. The objections have no merits and hence rejected. Certain typist-converted U D Clerks have objected to the placement given to Smt M Remadevi (Sl No 86 in the provisional list). On examination, it is found that though Smt Remadevi is very senior to them, she filed her willingness for category change only on 14-12-07. Her seniority has been re-assigned accordingly.

Smt M Ushakumari has filed objection against the seniority given to Smt I Jeejakumari and Smt A Sameeda. Though they have been given conversion on a later date than Smt Ushakumari, they are seniors to Ushakumari in the UDT seniority list. Hence her objection is rejected.

Sri T V Muhammed Suhail objected that certain individuals who

are juniors to him in the LDC seniority list have been placed in the provisional list ahead of him. It is simply because these juniors passed the departmental tests on a prior date than Sri Muhammed Suhail, when actual occurrence of vacancy is considered. His objection has no merits and hence rejected.

Many individuals have pointed out that certain persons promoted on later dates than them are placed above them in the provisional list. The reason is that either they have been promoted after attaining the age of 50 years under Rule 13 B of KS & SSR or they acquired the test qualification prior to them when actual occurrence of vacancy is considered, in accordance with their seniority in the LDC/UDT cadre.

Smt A A Mary Sherly and Sri M R Rajeev who were given conversion as per Order dated 06-03-08 also objected to the placement given to a group of individuals starting from Sl nos 4 to 283, above them. All of them have been given promotion/conversion along with them or after them.

The promotion orders issued from time to time are purely provisional. But in the case of preparation of seniority list, it is strictly based on the dates of eligibility with reference to the dates of occurrence of vacancy and seniority in the LDC/UDT cadre. The ratio fixed for L D Clerks and U D Typist/CA for promotion/conversion as U D Clerk is 5:1. The objections have no merits and hence rejected.

Certain individuals have filed objection against the seniority assigned to Sri Jojo Varghese. Their request has been examined in detail. Sri Jojo Varghese joined the dept on 01-09-90 and entered LWA from 13-02-91 to 13-02-96. He re-joined duty on 14-02-96 and his probation was declared with effect from 24-02-98. He was given seniority in the cadre of LD Typist only after the date of his rejoining duty after LWA. He was promoted to the cadre of UD Typist with effect from 11-03-00.He filed willingness for conversion on 08-06-05. Thus he is eligible for seniority to a vacancy arose on or after 13-02-06.This does not change the seniority position of Jojo Varghese in the final list.

The following candidates objected that they are eligible for seniority with effect from the date of conducting the examination by the PSC instead of the date of publication of result under Rule 28(bbb) of KS & SSR. They have also mentioned the Circular memorandum No 7850/Rules-1/88/P&ARD dated 30-08-89 of P&AR Department. 1 Suharabeebi

Rule 28 (bbb) of KS &SSR, 1958 is intended for promotion not

involving change of duties against vacancies remaining unfilled for want of test qualified hands. The placement in the seniority list is strictly based on the dates of eligibility on a particular date of occurrence of vacancy with respect to their turn in the LDC/UDT seniority list. Further, the above circular is just a clarification of the Rule 28 (bbb), conferring the benefit of passing the departmental test on the day following the last day of the whole examination when there are two options for test and both are equivalent. Hence their requests have no merits and are rejected.

Sri T K Thulaseedharan Nair represented that his seniority was

affected by the placement of Smt R V Leena, the one and only CA candidate in the list. He also claimed that CAs have separate ratio for conversion. He also objected the placement of Sri B Sivaprasad ahead of him. Though he was given conversion prior to Sri Sivaprasad, he is junior to Sivaprasad in the UDT seniority list. Hence his objection is rejected.

Smt P E Saji has represented that in the previous seniority list, there were no eligible U D Typists to be converted as U D Clerk in the ratio 5:1. Her request is that whether any priority will be given to the current seniority list to fulfill the ratio.

As per G O (MS) No 301/68/PD dated 26-09-68 of Public (Services

D) Department, Upper Division Typists/ Stenographers who have the prescribed qualifications and have put in 10 years of service will be eligible for appointment as U D Clerks/Assistant Grade I in every 6th vacancy arising in the concerned department. If eligible candidates are not available at the time of occurrence of vacancy, the vacancies will be filled up by the promotion of L D Clerk/Assistant Grade-II.

In the light of the above Government Order, the contention of

Smt P E Saji has no merits and is rejected. Necessary corrections in names, dates of birth, native place etc have been made as required by certain individuals. In the circumstances, the following orders are issued.

The Seniority list of Upper Division Clerks appointed to the vacancies in the Commercial Taxes Department for the period from 01-07-06 to 31-12-08 is finalized as above. The promotions of U D Clerks shown in the seniority list are regularized with effect from the date of occurrence of vacancies shown against their names. The list has been strictly adhered to the provisions contained in Rule 27 of the Kerala State & Subordinate Service Rules, 1958 and the G O read 3rd paper above.
