There’s no law againstPhotography!...Right?Well... It’s easier to say that one is free to take apicture except within a few legal circumstances.Objects/People in a Public spaceObjects/people in a public space or visible from apublic highway where there is no reasonableexpectation of privacy is ‘fair game’. This includesuniformed police.Do not cause an obstruction (i.e. Prevent the publicfrom using the highway)Do not do anything which would come underHarassment laws.Model releases must be sought where recognisableimages of people are to be used commerciallymost agencies will ask to see these.Under 18s cannot give consent, a parent orguardian must provide this.Photography of CourtProceedingsis always prohibited, and an additional penalty isissued if photos are published. This includes areasbeyond the actual courtroom, defined as thePrecincts of the Court.

Private PropertyThe law permits picture taking by default, exceptwhere notified otherwise via signs etc. Takingphoto’s where prohibited effectively makes you aTrespasser. Exactly as if you had entered theproperty without permission.

Landowners DO have the right toDemand a person cease taking photo’s.Demand they leave the property, using ReasonableForce.

They have NO right toConfiscate / damage equipment or delete pictures.Threaten or use violence.Demand you present identification or take anydetailsThe above applies to Security guards, employees orother individuals acting as agents of the owner.

The PoliceWe live in interesting times...Terrorism Act 2000There are 2 sections of this act which are currentand of concern to photographers both allow a ‘Stopand Search’Section 43 – Covering suspicion of TerroristactivitiesSection 58A – Communication of information aboutthe armed forces for the purpose committing orassisting another in a terrorist act.Section 44 – This notorious article of law now nolonger exists, it allowed a ‘Stop and Search’ searchwithout the need for suspicion.Under sections 43 / 58A, Where an officer hasReasonable Suspicion that a person may beinvolved in terrorist activities, An officer can searcha person and anything they are carrying,This includes:Viewing digital images contained within phones, cameras or other imaging equipment.Seize and retain any item discovered during the

search which the officer reasonably suspectscontains evidence of illegal activity. An officer can NOTDestroy or delete images, damage equipment ordata contained on such devices without a courtorder. It is not against the law to photograph frontlineuniformed police officers in public, and the act ofphotographing Police alone is not grounds for asearchNational SecurityThere are additional restrictions placed onphotography of / around military installations. The Official Secrets Act makes it illegal tophotograph a Prohibited Place where it might beuseful to an enemy. The previously mentioned Section 58A of theTerrorism Act can also apply to buildings, vehiclesand personnel at such locations. Both of the above restrictions apply even if thephotograph is taken from a public highway.WildlifeSome animals, birds and plants are protected by theWildlife & Countryside act 1981.Taking Photographs in of itself is not prohibited, BUT‘Disturbing’ the animal or habitat, nests etc. can

carry hefty fines.Licenses to photograph protected species areissued and controlled by Scottish and EnglishNational Heritage and the Welsh CountrysideCouncil.ReferencesMetropolitan Police PhotographyAdvicewww.met.police.uk/about/photography.htm‘Not a Crime’ online campaignwww.notacrime.comLinda Macpherson ’s Guide toyour rightswww.sirimo.co.uk/2009/05/14/ukphotographersrightsv2/Protected species listsAnimalshttp://www.naturenet.net/law/sched5.htmlBirdshttp://www.naturenet.net/law/sched1.htmlModel Release Formshttp://www.professionalphotographer.co.uk/Magazine/Downloads/ModelReleaseForm
