Request: Swartz Crossing Development requests the vacation of a drainage and utility easement within the Swartz Crossing Commercial Subdivision, Block D, E, F and Common Area 2. The location is further detailed on the petitioner’s petition (attached). The current drainage will be relocated nearby on site to better accommodate the proposed site design. This relocation of drainage will meet all current Greenwood standards. Procedurally, the vacation of an easement is a function of the Common Council. Greenwood’s process requires a recommendation be given by the Plan Commission and the Board of Public Works and Safety to aid in Council’s decision making process. Location: Approximately 600’ south of Stones Crossing Road and Galena Drive intersection. Parcels 41-04-13-021-004.000-040 and 41-04-13-024-001.000-040 are southeast of the intersection of Stones crossing and SR 135. Recommendation: Staff recommends a favorable recommendation of this request.
PETITION TO VACATE PLATTED EASEMENT
WITHIN THE CITY OF GREENWOOD, INDIANA
CrossRoad Engineers, P.C. (“Petitioner”) is hereby filing a petition on behalf of Swartz Crossing
Development, LLC (“Developer”) to vacate platted 20-foot-wide Sanitary Sewer Easements (20’ SSE)
and variable width Drainage and Utility Easements (Var. DUE) and common area with the City of
Greenwood Common Council and states and requests as follows:
1. The real estate in question is described as follows:
Lot 1, Blocks B, C, D, E and F, and Common Areas 1 and 2 in the Replat of Swartz Crossing
Commercial Subdivision, as per the plat thereof recorded May 10, 2019, as Instrument
Number 2019-009111, in Plat Cabinet “E”, page 378 in the office of the Recorder of Johnson
County, Indiana.
Approximate location: Near the southeast quadrant of the intersection of State Road 135 and Stones
Crossing Road (County Road 700 North).
2. The existing sanitary sewer previously located on Lot 1, Blocks B and C and Common Area 1,
which was located within a 20’ SSE dedicated to the Town of Bargersville as recorded in
Instrument Number 2005-031962 and subsequently assigned to the City of Greenwood as
recorded in Instrument Number 2014-014544, was relocated as part of the approved
construction plans for Swartz Crossing Commercial Subdivision. The Developer intends to
vacate said easement for future development of Blocks B and C.
3. On behalf of the Developer, an application has been filed with the Department of Community
Development Services for approval of construction plans and a final plat to replat Blocks D,
E, F and Common Area 2 & DUE in the Replat of Swartz Crossing Commercial Subdivision (as
recorded in Instrument Number 2019-009111). The recently filed construction plans include
new utility layouts and design for the proposed sanitary sewer, storm sewer and detention
pond. It should be noted that none of the previously approved infrastructure associated with
the Replat of Swartz Crossing Commercial Subdivision was installed. All proposed
infrastructure will be installed in platted easements as shown on the documents filed with
Community Development Services. The Developer intends to vacate the easements shown
herein to accommodate proposed and future developments on Blocks D and E and Lot 10 in
the proposed replat.
4. The easements and common area proposed to be vacated are more fully described in legal
descriptions attached here to as Exhibit “A”.
5. The names and addresses of the property owners that abut the proposed easements to be
vacated are as follows:

6. A plat map of the proposed easement to be vacated and the abutting property owners with
addresses is attached hereto as Exhibit “B”.
7. A copy of the original recorded plat of the Replat of Swartz Crossing Commercial Subdivision
showing the proposed easement and common area to be vacated is attached hereto as
Exhibit “C”.
WHEREFORE, the petitioner respectfully requests that the Common Council grant this petition
vacating the subject easements and common area.
