Policy cover

The schedule shows the type of insurancecover that applies. Unless an endorsementshows that certain sections of the policy do notapply to your insurance, then:

• if the cover is comprehensive, all the sectionsand the general exceptions and conditionsprinted in this booklet apply;

• if the cover is third party, fire and theft,sections 1, 2, 3 and the general exceptionsand conditions printed in this booklet apply,but cover for accidental or malicious damagein section 1 does not apply;

• if you have paid an extra premium to addwindscreen cover to a third party, fire andtheft policy, section 6 also applies.

Please remember that wording in the scheduleor in endorsementsmay change the terms ofthe insurance cover shown in this booklet.

Definitions

Throughout this booklet, certain words andphrases are printed in bold type. These wordsand phrases have the meanings set out below.

We, us, our Covea Insurance plc.

You, your The person, company or firm named as theinsured in the schedule.

Schedule The schedule forms part of the policy andcontains details of you and your vehicle andparticular features of the insurance. We willsend you a replacement schedule each timeyour vehicle or other features of the insuranceare changed.

Certificate of insurance The certificate of insurance proves that youhave motor insurance needed by law. Thecertificate forms part of the policy and showsthe people allowed to drive your vehicle andthe purposes for which your vehicle can beused.

Civil partner The person who you have entered into a legalcivil partnership with as defined in the CivilPartnership Act 2004 (a civil partnership is aformal arrangement that gives same-sexpartners the same legal status as a marriedcouple).

Proposal The information you gave in your applicationfor this insurance. This includes informationgiven in writing (or spoken) by you or bysomeone on your behalf.

Period of insurance The length of time the insurance cover is inforce as shown in the schedule.

Insured driver A person shown on the certificate ofinsurance as a person allowed to drive yourvehicle and who is not excluded from drivingunder the conditions and exceptions of thepolicy or in an endorsement to the policy.

Your vehicle The insured vehicle shown on the certificate ofinsurance including any standard tool kit themanufacturer has supplied with it, andaccessories permanently fitted to it. However,this does not apply to accessories shown under‘What is not covered’ in policy section 1.

Territorial limits Great Britain, Northern Ireland, the ChannelIslands and the Isle of Man includingtransporting your vehicle by sea between theirports.

Your husband or wife The person you are legally married to (not yourpartner).

Definitionscontinued

ExcessThe first part of a claim which youmust pay.More than one excess can apply to your policyas shown in your schedule. Youmust pay allexcesses that apply as the first part of anyclaim.

EndorsementWording which changes the terms of the policyor features of the insurance cover.Endorsements form part of the policy. Theendorsement wording is printed in theschedule or in a separate document we sendto you.

Insured valueThe value of your vehicle that you told uswhen you arranged this insurance. The value isshown in the schedule.

Market valueThe cost of replacing your vehicle with one ofthe same make, model, specification, year,mileage and condition. In assessing themarket value of your vehicle, wemay refer toinsurance industry recognised guides of vehiclevalues as well as searching for available vehiclesbeing offered for sale to the general public.

Road Traffic ActsThe laws which include details of the minimummotor insurance cover needed in the territoriallimits.

Policy section 1Loss of or damage to your vehicle

What is coveredWe will insure you against loss of or damage toyour vehicle caused by:

• accident or malicious damage (if the policycover is shown as comprehensive in theschedule);

• fire (if the policy cover is shown ascomprehensive or third party, fire and theftin the schedule); or

• theft or attempted theft (if the policy coveris shown as comprehensive or third party, fireand theft in the schedule).

If your vehicle is damaged so that it cannot bedriven safely and the damage is covered by thispolicy, we will pay the reasonable cost ofmoving your vehicle to the nearest repairer orto the nearest place where it can be storedsafely. If the repairer is within the territoriallimits, we will also pay the reasonable cost ofreturning your vehicle to your address after ithas been repaired.

Settling claimsWe will choose whether to repair or replaceyour vehicle or any parts, or to pay you a cashamount to settle your claim. If we choose torepair your vehicle, wemay decide to usesuitable parts which are not supplied by theoriginal manufacturer. If a repair improves thecondition of your vehicle, wemay ask you topay part of the repair cost.

We will pay up to the market value of yourvehicle (as it is at the time of the loss ordamage), but we will not pay more than theinsured value.

If we choose to pay you a cash amount tosettle your claim and you are still paying foryour vehicle under a finance agreement, wewill first pay the finance company and then payany amount that is left over to you.

If comprehensive cover is shown on yourschedule, we will pay the cost, but only up to£500, to replace or repair audio equipment andsatellite navigation systems permanently fittedto your vehicle. If the equipment was suppliedand fitted as standard when your vehicle wasfirst registered, we will pay up to £1,000. If youhave third party, fire and theft cover, we willpay the cost, but only up to £150, to replace orrepair audio equipment permanently fitted toyour vehicle.

We will provide a small courtesy van for thetime your vehicle is being repaired by ourapproved repairer. Once we have decided thatyour vehicle can be economically repaired (isworth repairing) our approved repairer willprovide a courtesy van for the time it takesthem to do the repairs. If we provide a courtesyvan, we will extend the cover provided by thispolicy so that you are also insured to drive thecourtesy van under the same terms andconditions. The courtesy van will not necessarilybe the same make or model as your vehicleand will depend on whether one is available.

Youmust only use the courtesy van in theUnited Kingdom under the approved repairer’sterms of use. We will not provide a courtesy vanif your vehicle is a total loss (a write off).

If you are registered for VAT purposes, you willhave to pay the VAT on the cost of any repairsand replacement goods. You can claim backthe VAT in your tax return up to the limitsallowed by law.

If your vehicle is a total loss and it has acherished registration number plate, we willgive you 30 days from the date we tell you it isa total loss to transfer the cherished registrationnumber onto a DVLA Retention Certificate inyour name. If you do not tell us that you wantto keep the cherished registration numberplate, we will dispose of it with the vehicle.

New vehicle replacementIf your vehicle is less than 6 months old fromthe date of first registration, and it is:

• stolen and not recovered; or

• damaged so that the cost of repair is morethan 60% of the maker's current list price fora new vehicle of the same make, model andspecification;

we will replace your vehicle with a new one ofthe same make, model and specification.

New vehicle replacement does not apply if:

• your vehicle is more than six months oldfrom the date of first registration at the timeof the loss or damage;

• you did not buy your vehicle from new;

• the repairs cost less than 60% of themanufacturer’s current list price; or

• a new replacement vehicle of the samemake, model and specification is notavailable in the United Kingdom.

We will only replace your vehicle if a newvehicle of the same make, model andspecification is available straight away in theUnited Kingdom. If a new vehicle of the samemake, model and specification is not availablestraight away in the United Kingdom, we willsettle your claim as shown in ‘Settling claims’.

If you are still paying for your vehicle under afinance agreement, we will need the financecompany’s permission to settle the claim in thisway.

What is not coveredWe will not pay for the following.

• Loss of use of your vehicle and any resultingcosts or expenses, loss of value including lossof value because of damage whether youhave it repaired or not, wear and tear, damageto tyres caused by punctures, cuts or bursts,or damage caused by any mechanical,electrical, electronic chip or computersoftware breaking or failing to work properly.

• Loss or damage if your vehicle is taken ordriven without your permission by youremployee or by a member of your family orby a person living in your home or by a

person in a close personal relationship withyou such as your girlfriend or boyfriend,unless there is evidence that they are beingprosecuted for taking your vehicle.

• Loss or damage if your vehicle is taken ordriven by a person who got your permissionby pretending to be a buyer for your vehicleor by offering to sell it for you.

• Loss or damage caused by theft or attemptedtheft while nobody is in your vehicle, unlessall the doors, windows and other openingsare closed and locked, the vehicle’s keys andany other door or ignition unlocking devicessuch as electronic fobs or cards are removed,and the vehicle’s electronic or mechanicalsecurity devices are set.

• Loss of or damage to communicationsystems, phones, radar detectors, televisions,DVD players, portable navigation equipmentor similar equipment.

• If comprehensive cover is shown on yourschedule, any amount over £500 to replaceor repair audio equipment and satellitenavigation systems permanently fitted toyour vehicle, unless the equipment wassupplied and fitted as standard by thevehicle’s manufacturer when your vehiclewas first registered. We will pay up to £1,000if this is the case. If third party, fire and theftis shown on your schedule, any amount over£150 to replace or repair audio equipment.

• Loss or damage as a result of a deliberate actby anybody insured under this policy.

• Any extra costs resulting from parts orreplacements for your vehicle not beingeasily available in the United Kingdom.

• Loss of or damage to any trailer, caravan orvehicle (or to any property in the trailer,caravan or vehicle) being towed by yourvehicle or being towed by a vehicle you aredriving.

• Loss or damage to your vehicle caused bythe wrong type or grade of fuel being used.

• Damage caused by frost, unless you havefollowed the manufacturer’s instructions toavoid liquid freezing in your vehicle.

• Loss or damage caused by theft, attemptedtheft or malicious damage if you have notgiven us a crime reference number.

• Loss of or damage to your vehicle beingseized or destroyed by, or on behalf of, anygovernment or public authority.

• Loss or damage while you, anyone insuredunder your policy, or anyone you givepermission to, carries out repairs orimprovements to your vehicle if that personis not qualified within the motor trade to doso.

• Loss or damage caused by overloading yourvehicle or loading your vehicle in a way it isnot designed for.

• Loss or damage resulting from using yourvehicle, or the machinery attached to it, as atool of trade.

• Loss or damage to your vehicle if yourvehicle does not have a valid MOT certificateat the time of the incident. This includesmalicious damage and loss or damagecaused by accident or fire, theft or attemptedtheft.

• Any amount over £150 relating to signwriting, advertisements, logos or specialisedartwork, when repairs are undertaken.

• Any storage charges unless you tell us aboutthem and we agree to pay for them.

• The amount of any excess applying toclaims under this section of the policy.

Please also read the general exceptions andgeneral conditions of the policy.

What is coveredWe will cover your legal liability for the deathof or bodily injury to any person and damageto property caused by:

• you using or driving your vehicle;

• an insured driver driving your vehicle withyour permission;

• any person using (but not driving) yourvehicle for social, domestic and pleasurepurposes with your permission;

• any passenger travelling in your vehicle, orgetting into or out of your vehicle, with yourpermission;

• you or an insured driver driving a vehicleloaned to you under an agreement betweenus and one of our approved repairers whileyour vehicle is being repaired as a directresult of damage covered by this policy.

We will also cover the legal liability of thefollowing people for causing death, bodilyinjury or accidental damage.

• The legal personal representatives of anyperson who has died and who was coveredby this section of the policy.

• Your employer while an insured driver isdriving your vehicle on the business of youremployer with your permission. This coveronly applies if the certificate of insuranceshows that the business use is allowed. Thecover does not apply if your vehicle isowned by or hired, rented or leased to youremployer.

• Your husband, wife or civil partner while aninsured driver is driving your vehicle on thebusiness of your husband, wife or civilpartner with your permission. This coveronly applies if the certificate of insuranceshows that the business use is allowed andthat your husband, wife, or civil partner isan insured driver.

• Your husband’s, wife's or civil partner’semployer while any insured driver is drivingyour vehicle on the business of yourhusband’s, wife’s or civil partner’semployer with your permission. This coveronly applies if the certificate of insuranceshows that the business use is allowed andthat your husband, wife or civil partner isan insured driver. The cover does not applyif your vehicle is owned by or hired, rentedor leased to your husband’s, wife’s or civilpartner’s employer.

We will also pay:

• legal costs and expenses which we havepreviously agreed and which arise from anycoroner’s inquest, fatal accident inquiry orpolice prosecution in connection with anaccident covered by this policy; and

• the cost of emergency treatment to injuredpeople if the Road Traffic Acts say that thepayment must be made; and

• liability to other people when your vehicle isbeing used for towing any single trailer orcaravan or broken-down vehicle while it is

• Any amount over £1,000,000 for pollution orcontamination as a result of any claim, orseries of claims caused by one event.

• Any amount over £2,000,000 for damage toother people's property (including anyrelated indirect loss or damage) and anyamount over £1,000,000 for related legalcosts and expenses as a result of any claim,or series of claims caused by one event.

• Any legal costs or other amounts that youpay or agree to pay, or that any person,company or firm claiming cover under thispolicy section pays or agrees to pay, withoutfirst getting our agreement.

• Any liability for loss, damage, death or injurythat happens anywhere other than on a roadand involves anyone, other than the insureddriver or a passenger in your vehicle,bringing property to your vehicle for loadingor taking property away from your vehicleafter unloading.

• Any liability for death or injury to anemployee which arises out of or in the courseof their employment by you or by anotherperson, company or firm covered by thissection of the policy. However, we will givethe minimum cover needed under the RoadTraffic Acts.

Please also read the general exceptions andgeneral conditions of the policy.

• Loss of or damage to any vehicle or propertythat belongs to, or is in the care of, anyperson, company or firm claiming under thispolicy section.

• Loss of or damage to any property beingtowed by, carried on, loaded on, or unloadedfrom your vehicle.

• Loss of or damage to any trailer, caravan orvehicle (or to any property in the trailer,caravan or vehicle) being towed by yourvehicle.

• Loss or damage or liability which is theresponsibility of the person driving orsteering any vehicle being towed by yourvehicle.

• Loss or damage as a result of a deliberate actby anybody insured under this policy.

• Any liability which is covered under anotherinsurance policy.

• Any liability for pollution or contaminationunless it is caused by a sudden event whichwas not deliberate and not expected tohappen.

Policy section 3Foreign travel

Compulsory insurance cover outsidethe territorial limitsYour policy provides the minimum cover youneed by law for civil liability to other peoplewhile your vehicle is used in:

1. any country which is a member of theEuropean Union;

or

2. any other country which the EuropeanCommission is satisfied has madearrangements to meet the requirements ofArticle (8) of EC Directive 2009/103/ECrelating to civil liabilities arising from the useof motor vehicles. These countries arenamed on your certificate of insurance.

If the minimum insurance needed by law inGreat Britain is higher than the minimumneeded in the country where your vehicle isbeing used, we will provide the minimumneeded in Great Britain. You do not need a‘green card’ to take your vehicle to thecountries described above if you take yourcertificate of insurance with you.

If your certificate of insurance allows you todrive any other private motor car, the insurancefor you to drive any other private motor cardoes not apply while you are outside theterritorial limits.

Full policy cover outside theterritorial limitsYour policy automatically provides the covershown on your schedule for up to 35 days inany one period of insurance while you areusing your vehicle in the countries referred toat 1 and 2 on the left, as long as:

• your vehicle is taxed and registered in theUnited Kingdom;

• your vehicle is normally kept in the UnitedKingdom; and

• you keep a permanent home in the UnitedKingdom.

Your policy provides cover while your vehicle isbeing transported by rail or a recognised searoute (including while it is being loaded andunloaded) between any countries in which thispolicy provides cover, as long as:

• you are travelling with your vehicle;

• the total time taken to transport yourvehicle is not more than 65 hours (includingany stopovers during the journey); and

• the purpose of transporting your vehicle isnot to permanently export it.

If the total length of all your visits outside theterritorial limits during the period ofinsurance is more than 35 days, we cannotprovide further cover. We do not offerinsurance if you visit countries that are notdescribed at 1 and 2 on the left above.

We will pay customs duty if your vehicle isdamaged and the damage is covered by thispolicy and your vehicle cannot be returned tothe United Kingdom.

Policy section 4Personal accident benefits

What is coveredWe will pay £5,000 if you or your husband,wife or civil partner are accidentally killed orsuffer an injury described below while travellingin, or getting into or out of, your vehicle or anyprivate motor car.

Injury

• Total and permanent loss of sight in one orboth eyes.

• Total and permanent loss of use of one orboth hands or one or both feet.

What is not coveredWe will not pay the benefit if the injury or death:

• is the result of suicide or attempted suicide;

• happens when the person killed or injured isunder the influence of alcohol or drugs;

• happens as a result of someone not wearinga seat belt when they have to by law; or

• happens more than three months after thedate of the accident or is not a direct resultof the accident.

We will not pay the benefit if you are acompany or firm.

We will not pay more than £5,000 in any oneperiod of insurance, and we will not pay morethan £5,000 for a single accident, even if theperson killed or injured in the accident is insuredunder more than one motor policy with us.

Policy section 5Personal belongings

What is coveredWe will pay up to the personal belongings limitshown in the schedule for loss of or damage topersonal property in your vehicle caused by amotor accident, fire, theft or attempted theft. Ifa personal belongings limit is not shown in theschedule, we will pay up to £100.

What is not coveredWe will not pay for the following.

• Loss of or damage to money, jewellery,phones, cameras and their accessories,stamps, tickets or documents.

• Loss of or damage to tools, goods or samplescarried in connection with any business.

• Theft of personal belongings, unless they arehidden in a glovebox or luggagecompartment and your vehicle is lockedwhen it is unattended.

• Theft of personal belongings unless all doors,windows and other openings on yourvehicle are locked, and it is broken into byforce.

• Loss or damage due to wear and tear or lossin value.

• Loss of or damage to property that iscovered under any other policy.

• The amount of any excess applying toclaims under this section of the policy.

Policy section 6Windscreens and windows

What is coveredWe will pay up to the amount of thewindscreen limit shown in the schedule foraccidental or malicious damage to thewindscreen or windows of your vehicleincluding repairing scratches to the bodyworkcaused by the windscreen or windows beingbroken by accidental and malicious damage. Ifa windscreen limit is not shown in theschedule, we will pay up to the market valueof your vehicle, but we will not pay more thanthe insured value.

If you do not use our chosen windscreen andwindow repairer, the most we will pay underthis section is £100 after deducting anyexcesses which youmust pay. If you claimunder this policy section, your no-claimdiscount will not be affected.

What is not coveredWe will not pay for the following.

• Damage to any part of a glass or plasticsunroof or roof panel.

• Damage as a result of a deliberate act byanybody insured by this policy.

• Loss of use of your vehicle.

• Any extra costs resulting from parts for yourvehicle not being easily available in theUnited Kingdom.

• Extra costs for work to be carried out outsidenormal hours, unless the windscreen isshattered, or the damage affects the driver’svision or the security of your vehicle.

• The amount of any excess applying toclaims under this section of the policy.

Policy section 7Replacement locks

What is coveredIf the keys or lock transmitter of your vehicleare lost or stolen, we will pay for the cost ofreplacing:

1. the affected locks;

2. the lock transmitter and central lockingsystem;

3. the affected parts of the alarm orimmobiliser (or both);

as long as you can prove to our satisfactionthat the person who has your keys ortransmitter knows where your vehicle is. Noexcess is payable under this section but themaximum amount we will pay is £200.

What is not coveredWe will not pay this benefit if:

• your keys are left in or on your vehicle atthe time of the loss;

• you do not report the loss to the policewithin 24 hours of discovering it.

What is coveredWe will pay up to £100 in medicalexpenses for each injured person if youor anyone in your vehicle is injured asa result of an accident involving theinsured vehicle.

Policy section 9Onward travel/overnight accommodation

What is coveredIf your vehicle is not roadworthy afteran accident and you cannot completeyour journey, we will pay for overnightaccommodation or travel expenses ofup to £50 per person for you and yourpassengers (up to £250 in total).

Compulsory excessIf your vehicle or any part of it (includingaccessories or spare parts) is lost or damagedas a result of accidental damage, fire, theft,attempted theft or malicious damage, you willbe responsible for the first part of the cost asshown in your schedule regardless of whetheror not the accident was your fault.

Voluntary excessIf your vehicle or any of its accessories orspare parts are lost or damaged as a result ofaccidental damage, fire, theft, attempted theftor malicious damage, youmust pay thevoluntary excess as well as the compulsoryexcess and any other excesses that applies toyour policy as shown in your schedule.

Windscreen excessIf your windscreen or the windows of yourvehicle are damaged as a result of accidentaldamage or malicious damage, you will beresponsible for the first part of the cost asshown in your schedule.

More than one excess can apply to your policyas shown in your schedule and youmust payall excesses that apply as the first part of anyclaim. Other excesses that may also apply aredescribed below.

No-claim discount protection excessIf you have taken the option to protect yourno-claim discount at your policy start date orrenewal, if youmake a claim, you will have topay an extra excess as shown in yourschedule.

Young driver excessIf youmake a valid claim under this policyinvolving a driver who is under the age of 25 atthe time of the claim, youmust pay an extraexcess, as well as any other excesses shown inyour schedule.

Inexperienced driver excessIf youmake a valid claim under this policyinvolving a driver who has a provisional licenceor a person who has held a licence for less than12 months at the time of the claim, youmustpay an extra excess as well as any otherexcesses as shown in your schedule.

This policy will not provide cover or benefitsunder the following circumstances.

1. We will not pay for any loss, damage orliability which arises while the vehicle coveredby the certificate of insurance is being:

• used for a purpose which is not allowed bythe current certificate of insurance;

• driven by, or is in the charge of, a personwho has your permission to drive andwho is not an insured driver;

• driven by a person who does not hold adriving licence, unless the person has heldand is not disqualified from holding orgetting a licence;

• driven by a person who is not keeping tothe conditions of the driving licence theyhold or are entitled to hold;

• used to take part in a crime;

• used in a place used for aircraft taking off,landing, parking or moving includingairport service roads that the generalpublic are not allowed to use;

• used in a race, speed trial, rally, track dayor similar motor sporting event; or

• used in an unsafe or unroadworthycondition.

2. We will not pay for any legal liability whicharises under a contract or agreement unlessthe person, company or firm claiming coverunder this policy would have had that liabilityif the contract or agreement had not existed.

3. We will not pay for any loss, damage orliability which is the direct or indirect resultof the following.

• War, revolution or any similar event.

• Actual or threatened terrorism or anysimilar event, or action to control, preventor stop any terrorist event.

(Terrorism is any illegal action involvingviolence, force or danger to people orproperty that appears to be intended to:

– cause fear among the people of acountry or state;

– disrupt any part of the economy of agovernment, country or state; or

– affect the policy or conduct of agovernment.)

• Earthquake, riot or civil disturbanceoutside Great Britain, the Isle of Man orthe Channel Islands.

• Ionising radiation or radioactivecontamination from any nuclear fuel orfrom nuclear waste.

• The radioactive, poisonous, explosive orother dangerous properties of any explosivenuclear equipment or any part of it.

• Pressure waves caused by aircraft or otherflying objects travelling at or above thespeed of sound.

• The commercial transportation of bulkhazardous materials such as:

– liquefied petroleum or gasoline;

– chemicals or gases in liquid,compressed or gaseous forms; and

– high explosives such as nitro glycerine,dynamite or any other similar explosive.

• Anything harmful contained in any goodsor property being towed by, carried on,supplied from, loaded on, or unloadedfrom your vehicle.

• Any harmful or incorrect medicaltreatment or help given at or from yourvehicle.

However, we will provide the cover neededunder the Road Traffic Acts for the eventsshown above.

4. We will not pay for any loss, damage orliability for which legal proceedings havebeen brought or judgement given in a courtoutside the United Kingdom, unless theproceedings or judgement are in a foreigncountry because your vehicle was beingused in that country and we had agreed toprovide insurance in that country.

General conditions

1. Your dutyWe will only provide the insurance cover set outin this policy if:

• you and any person, company or firmclaiming cover under the policy keep to theconditions of the policy;

and

• the proposal does not contain any fact ordeclaration which is not true, and you havetold us about any circumstances likely toaffect our decision to accept yourapplication for insurance cover.

2. Changes in circumstancesYoumust tell us, as soon as possible, about anychange in circumstances likely to affect ourdecision to continue the insurance.

Examples of these changes are:

• any changes to your vehicle, includingengine modifications and changes such asfitting alloy wheels, spoilers or skirts;

• any problem to do with the health of anyperson who will drive your vehicle;

• a motoring accident, insurance claim,motoring conviction or fixed penalty offenceinvolving any person who will drive yourvehicle;

• changes in the ownership or use of yourvehicle or in the job of any person who willdrive your vehicle;

• changes to your address or the addresswhere your vehicle is usually kept; and

• changes in the number of vehicles owned orregularly driven by you or by members ofyour family who live with you.

If a person whose details you have not alreadygiven us is likely to drive your vehicle, youmust give us their full details.

Please note that if you or wemake anychanges to your policy before the renewaldate, youmay have to pay an administrationcharge or an extra premium (or both). Pleasespeak to your insurance broker or other personacting on our behalf, if you want to make achange to your policy before renewal. They willbe able to confirm any charges.

3. Other insuranceIf any other insurance policies cover the sameloss, damage or liability as this policy, we willonly pay our share of the amount of the loss,damage or liability.

4. Taking care of the vehicle andany trailer or caravan towed bythe vehicle You and any other person, company or firminsured by the policy must take all reasonablesteps to prevent loss of or damage to anyvehicle insured by the policy and to keep thevehicle and any trailer or caravan towed by thevehicle in a safe and roadworthy condition.

Wemay examine the vehicle, trailer or caravanat any time.

5. Our right of recoveryIf we have to settle a claim under the law ofany country and we would not have paid thatclaim under the terms of the policy, we can getback from you the amount of any payment wehave to make.

6. No-claim discountYour no-claim discount will follow the scale ofdiscounts which applies when you renew yourpolicy. If somebody makes a claim, youmaylose all or part of your no-claim discount. If no-claim discount protection is shown in theschedule, you will only lose the no-claimdiscount if there are more than two claims in afive-year period. If somebody makes a claim,wemay also apply a higher premium or anexcess when you renew your policy.

7. Claim procedureAfter any loss, damage or accident, you andany person, company or firm insured by thepolicy must:

• report the incident to us as soon as possibleby phoning our Green Light Claims Helplineas soon as possible and in any case within48 hours on 0330 024 2240;

• give us all the information and help that weask for;

• send us every letter, claim, writ or summonsimmediately without answering it; and

• tell us immediately if there is to be aprosecution, inquest or other courtproceedings.

8. Defending or settling a claimYou and any person, company or firm insuredby the policy must not admit liability for any lossor damage, or make any offer to pay any claim.

We are entitled to decide exactly how to carryout any legal proceedings or settle any claimand to:

• take over and defend or settle any claim inthe name of any person, company or firminsured by the policy; and

• take legal action in your name, or in thename of any person, company or firminsured by the policy, to get back anypayment wemake.

9. FraudWe will not pay for any loss, damage or liabilityif you or any person, company or firm insuredby the policy makes a claim that is dishonest orexaggerated, or makes a false statement orprovides false documents to support a claim.

10. Car sharingThis policy does not insure anyone to use yourvehicle for hire or reward. However, ifpassengers in your vehiclemake a paymenttowards the cost of a journey, we will not classthis as use for hire or reward if:

• your vehicle is not designed or adapted tocarry more than seven people including thedriver;

• the passengers are not being carried in thecourse of a business of carrying passengers;and

• the total of the payments made by all thepassengers does not include a profit.

11. Service and repairThis policy will continue to provide insurancecover for you under policy section 2 while yourvehicle is with motor traders or their employeesbeing serviced or repaired. (We will ignore anyrestriction in use on your certificate ofinsurance which excludes use for motor-tradepurposes under these circumstances.) However,the insurance cover for other people,companies or firms referred to in section 2 willnot apply.

Other sections of the policy which apply for thetype of cover shown in the schedule will alsocontinue to apply if your vehicle is beingdriven by an insured driver or is not beingdriven at the time of the incident.

12. Paying your premiumIf you have not paid the full premium for thewhole period of insurance and youmake aclaim under this policy, wemay deduct theamount of premium you still owe from theamount we pay to settle the claim.

13. Cancelling your policyIf you do not want to accept the policy andyou return the certificate of insurance to

your insurance broker within 14 days ofreceiving your policy documents, we will refundthe premium for the exact number of days lefton the policy, less an administration charge of£10 plus Insurance Premium Tax at the ratethat applies at the time, unless you have madea claim in which case we will not refund anypremiums. We will also do this if you want tocancel the policy within 14 days after therenewal date.

Youmay cancel the policy at any other time byreturning the certificate of insurance to yourinsurance broker.

If you cancel your policy after 14 days andsomeone has claimed in the current period ofinsurance, we will not refund any part of thepremium. If you have chosen to pay yourannual premium by instalments youmustcontinue to pay yourmonthly direct debit.

If nobody has claimed in the current period ofinsurance, we will refund the premium for theexact number of days left on the policy less anadministration charge of £32 plus InsurancePremium Tax at the rate that applies at thetime.

We, or your broker or other person acting forus, may cancel the policy, if we have a goodreason for doing so. Some examples ofsituations where we would have a good reasonfor cancelling your policy include you notpaying a premium when it is due, not providingdocuments we ask for (such as proof of

no-claims discount or security) or providing uswith incorrect information, and failing to putthis right when we ask you to by sending youseven days’ written notice to your last knownaddress. Youmust then surrender (return) thecertificate of insurance back to us and we willrefund the premium for the exact number ofdays left on the policy. We will only pay youthe refund after we receive the certificate ofinsurance.

If we cancel the policy, or your broker or otherperson acting for us cancels the policy, becauseyou have not paid the premium (or the part ofthe premium which is due to be paid) on orbefore the date it is due, we will refund thepremium for the exact number of days left onthe policy, less an administration charge of £32plus Insurance Premium Tax at the rate thatapplies at the time. If someone has claimed inthe current period of insurance, we will notrefund any part of the premium.

If we decide your vehicle is a total loss we willtell you and give you 30 days from the date wepay your claim to replace your vehicle. If youdo not tell us that you have replaced yourvehicle within this time, we will assume thatyou no longer need your policy and so willcancel it. As you will have made a claim underthe policy, we will not refund any premiumsyou have paid.

If we cancel your policy on the grounds offraud, cancellation may be immediate and we

may keep any premium you have paid. Wemay also inform the police of the circumstances.

14. Automatically renewing yourpolicyWemay automatically renew your policy onthe renewal date. If we do this, we will write toyou before the renewal date with details of therenewal terms. If you pay your premium bydirect debit, we will continue to take paymentsfrom your bank account for the renewalpremium. If you do not want to renew, youmust tell your insurance broker or us and returnthe renewal certificate of insurance (if youhave received one) before the renewal date.We will then refund any payment we havetaken for the renewal premium. If you do notwant to renew, but you only tell your broker orus, or return the certificate of insurance, afterthe renewal date, we will work out the refund asthough you had cancelled the policy as shownin general condition 13.
