1. INTRODUCTION
1.1. PROJECT OBJECTIVES:
The Rural Energy Project No. 2 (RE2) aims at facilitating the Vietnamese
Government to launch poverty elimination campaign in rural areas by providing key
infrastructures such as power and access to public services to improve life, production and
business performance.
The RE2- Additional Financing (Phase 4) Subproject shall continue supporting the
Vietnamese Government to:
- Develop a rural electrification strategy, specially focusing on power supply to
mountainous and remote areas.
- Rehabilitate, upgrade and expand the rural power system to satisfy power supply
demand for the future socio-economic development.
- Improve power supply reliability, reduce loss on power, and improve performance
for production and business activities.
- Re-unify the rural power grid system to improve reliability and power quality to be
provided, including reduction of power loss due to technical or non-technical failure. The
sub-projects are conducted in 40 communes (wards and towns) under 06 districts (cities) of
Ha Nam Province.
2. PROJECT DESCRIPTION
2.1. BRIEF DESCRIPTION ON NATURAL AND SOCIAL CONDITIONS OF HA
NAM PROVINCE

1 Geological position Ha Nam is situated in the geological coordinates
of above 20 Northern latitude and between 105 – 110
Eastern longitude, in the Southeast of Hong River
Delta, covered by the Northern key economic
development area. Being over 50km far from Hanoi
capital, Ha Nam is the capital’s Southern gateway. Its
North borders with Hanoi, the East borders with
Hung Yen and Thai Binh, the South borders with
Nam Dinh and Ninh Binh, the West borders with
Nam Dinh and Hoa Binh.
Ha Nam is the home of 06 district-level
administrative units including Phu Ly city, Binh Luc
district, Duy Tien district, Kim Bang district, Ly
Nhan district and Thanh Liem district; 119
administrative units at commune, ward and town
level. Phu Ly city is the political, economic and
cultural center of the Province.

Nam is characterized by diversified terrain with delta,
half-plain half-mountain and hollow area. The
mountainous terrain accounts for 25.7% of province’s
area, while delta makes up 74.3% of area.
3 Climate Ha Nam owns the monsoon, hot and wet tropical
climate. The average temperature is 23 – 240C.
Average number of sunlight hours is from 1,300 to
1,500 hours. The annual average rainfall is 1,900mm.
The annual average humidity is 85%. Climate has
temperature mode-based differentiation with two
opposite seasons, namely summer and winter and two
relatively transit seasons namely spring and autumn.
Summer lasts from May to September, while winter
lasts from the mid of October to the mid of March,
spring often lasts from the mid of March to the end of
April and autumn often lasts from October of the mid
of November. In the two main seasons in a year,
wind's prevail directions are: South, Southwest and
Southeast in Summer, North, East and Northeast in
Winter

- Handicraft villages such as: Silk, drum, woven

6 Rural hygiene - Wastewater self treated by households (penetrated in
garden land).
- Solid waste: In the towns, solid waste collection
system is equipped in the towns. While in rural area,
farmers usually burn or bury in their garden campus.
- Local people are allowed to construct and use septic
toilet.
- Generally, rural hygiene is relatively good.
7 Traffic infrastructure - Through inter-district and inter-communal road
system.
8 National power grid Up to now, 100% districts in the Province successfully
access to the national power grid. However, power
quality in many areas is low; wirelines are not updated,
resulting in overload in many areas.

2.3. PRE-CONSTRUCTION AND WHILE-CONSTRUCTION ACTIVITIES IN
ACCORDANCE WITH IMPLEMENTATION PROCEDURES
- Site clearance method
Site clearance covers mainly cutting trees off and clearing structures situated in pylon
foundations, trees with height of over 4m and buildings available in the route.
- Buildings in the route not affected should not be cleared.
- Trees at pylon foundation positions are mainly crops (rice, maize, potato, and
cassava). Communal People’s Committees and district People’s Committees in the project
area agree to implement compensation and site clearance as stipulated to ensure power
construction and erection. If it is fallen in the harvest season of farmers, it is required to
calculate to compensate trees on land for farmers in accordance with the average
productivity.
Trees with height of over 4m available in the route may be cut down before wiring.
- Compensation is undertaken by Ha Nam Power Company. Therefore, Ha Nam PPC
should complete the land recovery procedures and grand land for construction so that site can
be handed over to builders.
- Camp construction:
In order to ensure the storage of materials, plants and equipment and houses for
workers, the temporary works to be built include:
+ Indoor storage for cement, equipment, electrical materials and accessories: 30m2 x
17 communes = 510m2.
+ Outdoor storage with fence to protect transformers, medium voltage conductors,
construction tools, beam, bracket and backstays: 40m2 x 58 communes = 2,320m
2.
+ Temporary buildings for workers during construction: 20m2 x 58 communes
=1,160m2.
+ Indoor warehouse and temporary buildings are made from bamboo frame with
fiberboard, its roofs are covered with fiberboard and roofing felt.
Transporting materials and equipment to the site
Different types of equipment and materials such as: Conductors and insulators are
bought in Hanoi and transported by trucks to the route center of each project component (site
storage).
Goods are transported from Hanoi to the site storage as follows:
+ Protection switchgear, insulators and cables with small packing, scattered goods
shall be transported to the site by trucks and manually unloaded.
+ Conductors with bulk quantity shall be transported to the site by the less than 5 ton
trucks and 5 ton cranes.
+ Centrifugal concrete pylon bought in Hanoi, Ha Nam or Ninh Binh shall be
transported to the site by KMAT 7.5 ton truck, each shipment delivers 6 pylon sections,
loaded by 5 ton cranes. Pylons are piled at the ending route and scattered transported to the
site by combining the manual and mechanical method.
+ Other materials such as beam, backstay, accessories, etc from Hanoi shall be
transported to the site by the 5 ton trucks and manually unloaded.

+ Cement bought in districts is transported by the 5 ton trucks and manually
unloaded.
+ Sand and stone bought at the project’s district, 10km distance, shall be transported
by the 5 ton dump trucks and manually unloaded.

2.5. EXPECTED MEASURES TO TRANSPORT MATERIALS AND EQUIPMENT
TO THE SITE
- Cement and various types of electrical materials and equipments are scattered
transported by trucks and workers to the indoor warehouses at the site along the route with
weighted average transportation distance of 100m.

- The centrifugal concrete pylons are transited by trucks and workers (the average
distance is equal to the distance of transporting cement).
- Sand and stone are transported by light trucks and workers with the same average
distance to the distance of transporting pylon).
- Others materials are transported from indoor warehouse by light trucks and workers
with the same average distance to the distance of transporting cement).
2.6. EXPECTED IMPLEMENTATION PERIOD

The expected construction period is 03 months; the maximum expected numbers of

3. LEGAL FRAMEWORK ON THE PROJECT’S ENVIRONMENT IMPACT
ASSESSMENT
3.1 LAWS AND REGULATIONS OF VIETNAM
The Vietnamese Government promulgates some laws and regulations on
environmental protection. Such documents include:
- Legislation of the Socialist Republic of Vietnam (April 1992) specifies that the
State-own enterprises, governmental agencies, cooperatives and national defense bodies must

be responsible for fulfilling policies on environmental protection to ensure the proper use of
natural resources and environmental protection.
- Law on Environmental Protection approved by the National Assembly on 29th
November 2005 and valid since 1st July 2006, superseding Law on Environmental Protection
in 1993 which prescribes responsibilities of the central, locality, individuals and
organizations in environment degrading prevention and protection and implements specific
environmental protection functions.
- Law on Forest Protection (1992) specifies on managing, protecting, developing and
exploiting forest and preventing cutting trees downs and deforestation.
- Law on Protection of People's Health (11th
July 1989): Rights and obligations of
residents in health protection, guiding principles on health protection, sanitation education in
people; conduct the standby measures; rehabilitate and clean living environment; ensure
labor sanitation standards, food and foodstuff hygiene.
- Decree No. 80/2006/ND-CP dated 9th

4. ENVIRONMENTAL IMPACT ASSESSMENT
4.1. TYPES OF IMPACTS
Environmental Impact Assessment focuses on main environmental issues in each
highest priority Solution of the Project. Potential impacts of preparation, construction and
operation phases are evaluated under four levels as follows:
i. NO IMPACT Potential impacts of project activities are evaluated as negligible if
such activities are naturally eliminated in terms of time and space from environmental
sections.
ii. SIGNIFICANT IMPACTS An impact is considered to be significant if the project
activities may affect environmental sections. Significant impacts may be “positive” or
“negative”. Following criteria is applied to determined a significant impact:
a) Spatial scale of the impact (at Site, in locality, area, or nationwide/global
scale);
b) Time interval of impact (short-term, medium- term or long-term);
c) Change level of environmental sections caused by project activities (small,
medium and significant);
d) Significance for local persons;
e) Compliance with the national, provincial or district laws, standards and
regulations on environment;
f) Compliance with Vietnam’s international commitments. Such commitments
include Ramsar Convention on Wetlands of International Importance,
especially living environment of water-bird species (RAMSAR), Convention
concerning the Protection of the World Cultural and Natural Heritage
(Convention on World’s Heritage) and Convention on International Trade in
Endangered Species (CITES);
g) Compliance with WB’s guidelines, policies and regulations.
iii. NEGLIGIBLE IMPACTS If an impact appears but it is disqualified with a
significant impact, it shall be regarded as NEGLIGIBLE impact. Negligible impacts
may be “positive” or “negative”.
iv. MINIMIZED IMPACT The potential impacts of a project activity on environmental
sectors are considered to be minimized if the recommended mitigation measures and
methods for significant adverse impacts successfully prevent or reduce the impacts to
the acceptable level.

4.2. DETERMINATION OF THE PROJECT’S POTENTIAL IMPACTS
The Project shall pay an essential role in electrification and poverty elimination
program in 40 communes, wards and town in 06 project districts and cities. The Project also
facilitates the industrialization and modernization policy promulgated by the Government and
offers best opportunities for general socio-economic development to poor areas.
When distribution wirelines are constructed, local persons tend to move to live near
such wirelines. Local People’s Committee shall prepare a specific plan to support the
regional development. Such plans include: road, residential areas, industrial and agricultural
development, etc. Such district/commune or province shall divert the development as
sketched in these plans.
In addition to noticeable positive impacts, variety of adverse impacts may be posted
on environment and local socio-economics. By using the Checklist of Environmental Test
Data and Background Environment List as guided in the Guidelines, the environmental
protection measures are applied for the Rural Energy Project No. II. Quick impact assessment
of the Project is described in Table 4.2

General impacts due to land occupation of MV and LV wirelines and transformer stations
are regarded as negligible one. Agricultural, forestry and public land area (unoccupied land area
along the inter-village and inter-communal roads) which is temporarily occupied is 18,780 m2
(4.6%). While the permanently occupied agricultural, forestry and public land area is 3,208m2
(0.43%).
Environmental impact due to route corridor clearance shall be minimized through
compensation plan and recovery measures as specified in the Report on Compensation and
Resettlement.
Land occupied by the Project (including medium voltage wirelines and transformer
station) does not affect great and important works (such as buildings and outlets) or auxiliary
works (such as cattle sheds, fence walls, garden and playground).
Trees which are higher than 4 shall be cut down; this impact is short term and negligible.
ROW shall be planted with trees for general vegetation with height of less than 4m.
The Project’s Compensation and Resettlement Plan also specifies that contractors must
return plane of temporarily occupied agricultural land lots to its origin status which can cultivate
for the land owners. The wirelines passing the agricultural land lots would cause no impact on
lower cultivation.

4.2.3: Impacts on biological resources
The Project's impact on vegetation covers temporary and permanent impacts. No part of
power grid trespasses the well developed forest, poor forest, secondary forest or scattered forest.
MV wireline mainly passes paddy field along with inter-village and inter-communal roads.
Main impacts on ecology may be briefed as follows:
Impacts on ecological environment are negligible. The Project is designed to adhere along
inter-communal, inter-village and inter-district road axis. Wireline construction lays no
impacts on biological resource

Data given in the above table helps us to imagine about volume of surplus soil when
casting column foundation. Considering about project scale, numbers of project communes,
number of pylons to be built are 2172 pylons (both MV and LV wirelines) and 92 transformer
stations, it is found that project’s impacts on soil erosion, causing impurity in surface water
and dust are harmful to environment; such impacts are insignificant. Because with MV
wirelines, average interval among pylons is about 100m, at each position and volume of
excavated soil to concrete pile foundation is approximately 2-2.5m3; for LV wireline, average
interval among pylons is about 35- 40m and volume of excavated soil to concrete pile
foundation is approximately 0.8 - 1.0m3. Terrain to be constructed in project communes is
completely delta.

MV and LV wirelines mainly go along the inter-communal road and trespass paddy
fields. For positions in the fields, crop soil layer is aggrandized at site, the remaining is used
to embank foundation protection cover. Regarding positions within the unoccupied corridor of
inter-village and inter-communal roads, the surplus soil must be transported to the place as
directed by the CPC. Such impacts may be minimized if mitigation measures are strictly
adhered.

5. COMMUNITY CONSULTATION AND INFORMATION DISCLOSURE
During preparing the Project (2011), following works were conducted:
Activity 1: Understand and discuss with the local authority about wiring position
Activity 2: Make a survey and statistics about impacts
Activity 3: Organize meetings with affected households
After finishing survey, the Consultant must notify the local persons and affected
communes about the project’s activities. Public notice form should be applied. Such notices
must be provided to the local persons with following contents, especially in the project
communes:
- General information about Project title, the Project Owner, project scale, names of
project districts and communes;
- Possible impacts on environment due to project’s activities;
- Applied mitigation measures to minimize impacts on environment;
- Project implementation plan
- Place to receive the community’s feedback on project-related environmental issues
This activity was launched from June to July 2011 in all project districts and
communes. Following representatives of organizations were invited and involved in the
community consultation meeting, concretely:
Affected households;
Fatherland Front Committee
Women Association;
Youth union;
Youth union;
Farmer association
People’s Committee;
Other concerned agencies and mass organizations.
Feedback received from the community consultation meetings was briefed as follows:
- Rural power grid quality in this area is very poor, not eligible to satisfy power
consumption of local persons, hence, they were very happy if the project was
launched. Local persons would completely support the Project Owner and construction
Contractors to fulfill the Project;
- The Project may cause some environmental impacts such as noise and dust but its
scale and level were negligible and acceptable;
- Local persons were available to cooperate with the Project Owner and construction
Contractors to manage the Project's environmental issues;
- The construction Contractors must commit to clear and return the plane for
temporarily employed land lots for Project performance;
- Recommended mitigation measures for noise and dust should be strictly adhered
during construction and transportation of raw materials.

Details of feedback received from the consultation are described in Appendix 3.
Activity 4: Continue receiving feedback from affected households.
Activity 5: Announce results and determine responsibility in EMP
The Project is only issued with the investment license after a proper adjustment on
design, position of wirelines, capacity and technology applied in the project is made in
accordance with requirements on immigration and environmental protection. In order to settle
requirements of WB’s OP 4.01, the Consultant and NPC must:
Provide copies of Report on Environmental Impact Assessment, preliminary
emigration plan and Executive Summary in Vietnamese to Communal People’s
Committees to Provincial People’s Committees in the project area.
Advertise on project in some series of main newspapers issued by the locality in 2
months. Notify in public about community opinion collection regarding the project’s
main activities, preliminary emigration plan, Report on Environmental Impact
Assessment in working hours in 2 months at following locations: 1) Provincial
People’s Committees; and 2) Communal People’s Committees.
Copies of EMP report in English and Vietnamese shall be submitted to Vietnam
Development Information Center at 63 Ly Thai To, Hanoi for access.
EMP in English shall be submitted to the World Bank to serve for WB’s publication.

6. ENVIRONMENTAL MANAGEMENT PLAN
6.1 THE PROJECT’S SOCIAL IMPACT MANAGEMENT:
Information and communication program:
Basic information includes:
a) Population survey and statistics include:
- Name and number of people in a household.
- Number, types and area of damaged houses
- Number, types and area of damaged residential land lot
- Number, types and area of affected agricultural land
- Number and types of affected crops and trees
- Affected business including architectural structures, land and other assets.
- Affected profitable assets: percent of total affected assets
- Quantity and classification of other fixed assets affected by each sub-project, and
- Temporary damages for profitable assets
b) Certain socio-economic survey of DPs: Age, gender, nation, qualification, occupation,
income source and total income of whole household.
c) Public news release at the Site regarding (a) bidding package, (b) contractor, (c) detailed
construction plan and (d) hotline to solve claims on social and environmental issues.
Public news release during project preparation through community consultancy meeting
and mass media.
Claim and compensation mechanism
Claims and questions relating to any aspects of RP, including determination of unit
price and quantity of lost assets shall be solved in accordance with following steps:
Step 1: If any person claims about any issue of the resettlement and life recovery
program, he may present directly or submit a written claim to authority persons of the
commune. The CPC shall settle such questions within 15 working days since the claim
is received.
Step 2: If claimer is not satisfied with decisions in Step 1, his claim may be submitted to
district People’s Committee or CRC within 15 working days since the date of receiving
the decision in step 1. The DPC or CRC shall make decision within 15 working days
since the date of receiving the claim.
Step 3: If the claimer is still dissatisfied with decision of the district authority, he may
lodge the appeal to the PPC or the district CRC within 15 working days since the date
of receiving decision of DPC or district CRC. Within 15 working days, PPC or PCRC
shall decide such claim.
Step 4: If he is still dissatisfied with decision released by the provincial authority, he may
file the appeal to the district court within 15 working days since the date of receiving
decision made by PPC or PCRC.
DPs are completely exempted from administrative and legal fees and charges.
Monitoring and evaluation system
Power companies and concerned PMUs work closely with corresponding DPCs/CPCs
at the management units and independent supervision unit to launch regular
monitoring of Compensation and Resettlement Plan Performance. Findings shall be
recorded in the quarterly report to submit EVN, power companies and concerned
provincial power companies.

Internal inspection and monitoring include:
- Verifying that basic information about DPs, evaluating lost or damaged assets,
compensations, benefits of resettlement and life recovery are conducted in accordance
with the regulations of the corresponding Policy Framework and RP.
- Monitoring that RP is conducted as designed and approved.
- Determining that financial resources to implement RP are provided to PMUs in due
date with full quantity to fufill the objectives; Such resources are properly used by
PMUs as prescribed in RP.
- Archiving all claims and questions and ensuring that such claims are solved as
scheduled.
Independent supervision: Independent units or independent consultancy units employed
by PCs under EVN shall conduct regular monitoring and external evaluation in addition
to RP performance. Independent organizations may be schools, research institutions,
NGOs or independent consultancy companies with professional staffs and Terms of
Reference (TOR) accepted by World Bank.
In order to verify information provided to internal control and supervision report of
corresponding power companies, employed external supervisors shall visit sample,
approximately 20% of affected households in the concerned province in 6 months since
RP is conducted to:
- Determine whether procedures on involvement of DPs, compensation work,
Rights of recovering new life are conducted in accordance with policy
framework or not; and
- Evaluating whether objectives of policy framework on improving or at least ensuring
living standards and income of DPs are satisfied or not.
- Collecting quality criteria of socio-economic impacts on DPs when the Project is
conducted.
- Recommending amendments during RP performance in case it is possible to put
forward principles and objectives of policy framework.
