Minister for Law and Justice (Mr. Zahid Hamid): The informationwas not available in this Division, therefore, all the High Courts were requested toprovide the requisite information.

(a) The High Court of Sindh has informed that being Appellate Courtdoes not decide category wise case like murder, kidnapping and terrorism whichare categorized in trial courts only while that Court decides matters in appealsagainst the judgments of trial courts.

31. *Ms. Shakila Luqman:

Will the Minister for Defence Production be pleased to state the stepsbeing taken by the present Government to enhance the Defenceproduction in the country?

Minister for Defence Production (Rana Tanveer Hussain):1. MoDP,

as a result of its vigorous marketing, participation in defence exhibitions, inductingnew technologies and promoting indigenous production / development of localdefence industry through various development projects for Armed Forces is makingconcerted efforts to enhance defence production. These efforts, aimed at importsubstitution, have resulted in saving of huge foreign exchange.

2. Major steps being taken to enhance Defence Production in the countryare as under:—

(i) A consolidated programme for Balancing, Modernization,Replacement and Expansion (BMRE) is being implemented toincrease the production capacity of POF and also improve the qualityof defence products.

(ii) Induction of latest CNC machines in POFs and HIT and limited useof Robotics for enhancement of existing capacity is being undertaken.

Besides 20 new products and 23 new R&D (Research &Development) projects have been started by POFs.

(iii) JF-17 MRO facilities, design and development of Avionics Systemsand Life Cycle Support of JF-17 Aircraft and overhaul facility ofJ-69-7-25 A engine of T-35 Aircraft have been established. Thesefacilities are a step towards self-reliance and would save huge foreignexchange.

(iv) NRTC is undertaking production of latest state of the artcommunication equipments and security solutions to include a widerange of security jammers for defence forces for local use as well asfor export purpose. Moreover, negotiations are underway for JVswith international reputed firms.

(v) Construction of 4 x Chinese Submarines, construction of PN FleetTanker, Missile Crafts and Maritime Petrol Vessels (MPVs) ofMaritime Security Agency (MSA) at Karachi Shipyard & EngineeringWorks (KS&EW) under Transfer of Technology arrangements ismanifestation of indigenization policy. Besides, KS &EW isundertaking indigenous construction of Pusher Tugs and Barges.

(vi) Construction of F 22P Frigate (PNS ASLAT), Fast Attack Craft(Missile) No. 2 &3, 32 Tons & 12 Tons Bollard Pull Tugs are therecent examples of success. The forthcoming mega project ofconstruction of 4 x new generation AIP submarines for PN withtechnical collaboration of China under transfer of technology willcommence soon. This project will completely revamp KS & EW fortimes to come.

(vii) Presently, construction of mega project of 17000 Tons Fleet Tankerand Fast Attack Craft (Missile) No. 3 is being completed. Launchingof both these vessels were held in August and September 2016respectively and heading towards completion. Other projects include1 x 600 Tons and 1 x 1500 Tons OPVs for Pakistan MaritimeSecurity Agency. 22 x Bridge Erection Boats for Pakistan Army arealso under construction and 1st batch of 7 boats have been deliveredduring 2015.

32. *Ms. Shahida Akhtar Ali:

Will the Minister for Science and Technology be pleased to state:

(a) whether it is a fact that it is the right of citizens to provide thempotable water;

(b) if the answer to part (a) above is in the affirmative, whether any

project is being planned by the present Government for theprovision of clean water to citizens in the country;

(c) whether it is also a fact that the Government has established

laboratories and launched/extended projects at Federal levelfor the provision of such water; and

(d) whether it is further a fact that the benefits have been accrued

from the experienced employees working in projects of PSDWalongwith the future of said public importance projects?

Minister for Science and Technology (Rana Tanveer Hussain): (a)

Yes, it is a fact that provision of safe drinking water is amongst the fundamentalrights guaranteed by the Constitution of Pakistan. Provision of access to safedrinking water to every person in Pakistan is amongst the goals reflected in theVision 2025 as well as our global commitments such as Sustainable DevelopmentGoals (SDGs).

(b) After 18th amendment to the constitution of Pakistan, provision ofsafe drinking water is the responsibility of provincial governments. However, MoSThas written letters to all provincial Heads and suggested certain measures forprovision of access to safe drinking water based on PCRWR research results.

(c) Yes, it is a fact. Federal Government has established 18 newlaboratories and upgraded 6 existing water quality laboratories throughout thecountry under the project “Provision of Safe Drinking Water for All” (Annex-1).

(d) Yes. It is a fact that benefits have been accrued from experience ofthe employees of the project “PSDW” who had been working for about 10 years.The project was initiated in 2006 and completed in December, 2015.

34. *Mr. Muhammad Jamal Ud Din:

Will the Minister for Science and Technology be pleased to state theyear-wise total number of persons of the Federally Administered TribalAreas appointed in the Ministry during the last five years till date?

Minister for Science and Technology (Rana Tanveer Hussain): No

person from FATA has been employed during the last five years as no vacant postfilled during this period fell in FATA quota. However, one post of Assistant(BS-15), to be vacated on retirement of the present incumbent on 05-01-2017,will be filled by a person holding the domicile of FATA as per 4% quota reservedfor FATA.

It is worth mentioning here that at present the following three officers/officials working in the Ministry belong to FATA:—

(i) Mr. Khan Muhammad Wazir, Assistant Scientific Adviser (BS-18)

(ii) Mr. Muhammad Tayyab, Stenotypist (BS-14)

(iii) Mr. Muhammad Anwar Khan, Staff Car Driver (BS-4).

35. *Mr. Jamshed Ahmad Dasti:

Will the Minister for Communications be pleased to state:

(a) whether the Government has taken notice of deterioratedcondition of 57 KM single track of N-70 from Tayyip ErdoganHospital, Muzaffargarh to D.G. Khan; if so, the details thereof;and

(b) the steps are being taken by the Government to improve/bring

up to the standard of said section at par with the standardizesection of the country alongwith the dualisation thereof?

Minister for Communications: (a) National Highway Authority (NHA)is fully cognizant of deteriorated condition and the volume of traffic on this sectionof National Highway N-70 between from Muzaffargarh Bypass (near TayyipErodogan Hospital) to D.G. Khan.

In addition to routine maintenance of the road NHA has planned dualizationof Muzaffargarh - D.G. Khan Section of National Highway N-70 and bids wereinvited on Build-Operate-Transfer (BoT) basis. A Concession Agreement has beenfinalized, which is under consideration of NHA Executive Board for approval.

(b) This road section is planned to be dualized with construction of newbridge on river Indus at Ghazi Ghat. International Safety standards shall bemaintained on the section.

36. *Sheikh Salahuddin:

Will the Minister for Law and Justice be pleased to state the stepsbeing taken by the National Accountability Bureau to controlcorruption from the Government departments?

Minister for Law and Justice (Mr. Zahid Hamid): NAB is striving

hard to eradicate corruption through its three pronged strategy of Awareness,Prevention and Enforcement. Under Awareness regime, NAB has takenconcrete steps to create awareness against corruption, through following activities:

TV Talk Shows Radio Programmes Walks Lectures Seminars Workshops Advertisements in leading English / Urdu newspapers. Newsletters Essay Writing Competitions Declamation Contests Poster / Painting Competitions Character Building of future generation through establishment of

character Building Societies (CBS) at schools, colleges anduniversitities level, across the country.

Publication of procedure for lodging a complaint in NAB on the BillBoard.

Installation of permanent bill boards carrying anti corruption slogansat prominent points.

Printing NAB’s message on Utility Bills

Dissemination of anti-corruption messages through mobile phonemessaging in addition to electronic media.

Holding of seminars in a year for different segments of societies, withactive participation of NGOs and UN offices to ensure greater visibilityand effectiveness:

In commemoration of anti Corruption day (9th December), holdingof different activities i.e. TV Talk Shows, seminars, walks,declamation contests, display of posters / Banners and publicationof Special Supplements in the newspapers.

Pro active approach:

NAB has been engaging different Governmental and Non-GovernmentalOrganizations in fight against corruption. In this context following steps have beentaken:

a. Signing Memorandum of Understanding (MoU) with Higher EdcationCommission (HEC) for creating awareness amongst students ofvarious Universities.

b. Collaboration with Pakistan Cricket Board (PCV) — PakistanCricket Team advertisement for “Say No to Corruption”.

c. Collaboration with Pakistan Hockey Federation — Hockey Teamto raise slogan “Say No to Corruption”.

d. Collaboration with Pakistan Television (PTV) for airing the song“Say No to Corruption”.

e. Collaboration with PTA, PIA, SNGPL, IESCO and Banks to displayand print NAB slogan “Say No to Corruption” from their platform.

f. Signing of MoU with UNODC (in the piple line) for joint effort againstcorruption.

g. Generic and sector specific awareness campaigns in print media,focusing on warning public against:

(1) Possible financial scams

(2) Fake housing societies

(3) Unrecognised education institutions etc.

h. Interaction with civil society organizations (Aimed at changingsocietal attitude towards corruption from acceptance toabhorrence)

i. Anti-Corruption Themes in the National Education Curriculum forclasses 1-12

j. Efforts are being made to join hand with Motorways Police to takefollowing initiatives:

(1) Display of advertisement board at various points with“Say No to Corruption” at Motorway (M1, M2, M3).

(2) Distribution of pamphlets, hand bills and stickers etc. havinganti-corruption messages to vehicles plying on Motorway.

(3) Joint seminar on “Say No to Corruption” with MotorwayPolice.

(4) Joint newspaper advertisements for awareness of general publicregarding ill effects of corruption.

(5) Any new creative ideas which would strengthen the anti-corruption campaign as proposed by your good office.

Under Prevention Regime NAB has established prevention committeesu/s 33-C, NAO to review rules and regulations of Federal as well as ProvincialDeptts., so as to suggest doable recommendations in coordination with Deptts.concerned.

Further, NAB has taken many steps to control corruption throughcomprehensive approach and to create effective platform for prudent andaccountable management of public resources. The three pronged strategy of NABconsisted upon Awareness, Prevention and Enforcement can be counted the

major steps for eradication of corruption from society. The steps taken under thesaid three pronged strategy are annexed as supplementary material. .

Apart from these, NAB has taken the strategic, measures during last twoyears and initiated tangible actions to bring about the revival and rejuvenation ofNational Accountability Bureau by enhancing both the quality and quantity ofmanpower. The salient features of strategic measures are:

a. In order to ensure effective enforcement of NAO the operationalmethodology and standard operating systems have been revised /upgraded as approved during the 19th DG’s Conference inSeptember 2014 which are helpful in effective and transparentdisposal of cases to curtail the abuse of authority in an arbitrarymanner.

b. The concept of combined investigation team (CIT) has beenintroduced for utilization of collective wisdom and experience ofsenior investigators and law officers to improve quality of inquiry /investigation and the time limit have been fixed for the completion ofcomplaint verfication, inquiries, investigation and filing of referenceas

37. *Ms. Khalida Mansoor:

Will the Minister for Parliamentary Affairs be pleased to state thenew steps being taken by the Government to make next electionsfree and transparent?

Minister for Parliamentary Affairs (Sheikh Aftab Ahmad):

Steps taken by the Election Commission of Pakistan for next GeneralElections

In order to ensure that the election is conducted honesty, justly, fairly andaccordance with law, Election Commission is taking following steps:

i. Electoral Reforms

Parliamentary Committee on Electoral Reforms was established inAugust, 2014 under the Chairmanship of Senator Ishad Dar. It furtherconstituted Sub-committee under the Chairmanship of Mr. ZahidHamid, Minister of Law and Justice. This Sub-Committee afterconducting 68 meetings has finalized the draft Election Act 2016 forfurther submission / deliberation in the main Parliamentary Committeeon Electoral Reforms. Soon the package will be placed before theParliament for necessary enactment.

ii. Setting up of Independent Monitoring Wing

Monitoring Wing has been established in the ECP to oversee pre-poll, post poll activities and point out illegal practices, including hugespending on Electoral exercises in violation of Law. In this regard,ECP has demanded 141 new posts and necessary budget from theGovernment of Pakistan to set up the Wing on permanent basis.Apart from that already monitoring officers are assigned duties tocheck the Electoral process (Bye-elections) and point outirregularities, if any.

iii. Interaction with Political Parties and Civil Society organizations

Meetings are held with political parties and Civil society organizationsfor consultation on important matters such as preparation andfinalization of existing Code of Conduct to get their feedback/suggestions for making improvement in election process. SomeNGOs are also in touch with ECP.

iv. Re-activation of District Voters Education Committees

124 District Voters’ Education Committees are activated and areregularly accessing and motivating masses to register themselves asvoters.

v. Establishment of Federal Election Academy

In order to horne the skills of officers of ECP Federal ElectionAcademy has been established at Postal staff college G-8/4,Islamabad. Courses on regular basis “Interpersonal Skills andCapacity Development Training Programme” are being conducted.Apart from that polling staff will be trained for which lists from variousdepartments have been procured (four Provinces) for selection ofwell-reputed Polling Personnel.

vi. Purchase of Electronic Machines and Bio-Metric Machines

It was long standing demand of the political parties and public thatElectronic voting machines and Bio-metric Machines may be used inElections as per practice in a few countries of the world. Tenders of400 Electronic Voting Machines and 300 Bio-metric Machines arebeing evaluated in this regard.

vii. Establishment of Warehouses for Storage of Election Material

In order to safeguard Election material four model warehouses onein each province will be established. Thereafter around 30 morewarehouses would be set up across the country.

viii. GIS Mapping of polling stations

Verification of 75,000 Polling Stations and uploading its Coordinateson Web is in process and would be completed by June-2017.Theabove exercise has been started to survey new polling station andpresent condition of existing polling stations.

ix. Gender Directorate

Mandate

(a) Encourage inclusion of female staff at ECP

(b) Develop strategies and implementation plans for reducing thegender disparity.

(c) Conduct research to identify barriers for women andmarginalized sections of society from participation in electoralprocess.

(d) Develop a mechanism to electoral process inclusive as perGoal# 8 of Strategic Plan.

x. Giving the Right of vote to the Overseas Pakistanis

During past few years some political parties had made lot of hue andcry that overseas Pakistanis may be given right of franchise. Thepros and cons of the matter are deliberated in various meetings ofParliamentary Committees established for the said purpose. NADRAhas been asked to come up with a solution to facilitate them how tocast their vote (procedure). Hopefully, some solution will come tofore, so that more than eight million overseas Pakistanis cast theirvote.

xi. Updatation of Electoral Rolls

Electoral Rolls have been up dated as of December-2016 and wouldbe again revised/updated by December-2017. Total registered votersas of 5th December, 2016 is 97,016,232, which are expected toreach to 100,000,000 by December-2017.

38. *Ms. Saman Sultana Jaffri:

Will the Minister for Law and Justice be pleased to state:

(a) the steps being taken by the Government to codify various laws;and

(b) the details of those laws which have been codified during the

last three years?

Minister for Law and Justice (Mr. Zahid Hamid): (a) A dedicatedteam of IT professionals and Legal experts has been appointed in the Laws of

Pakistan Cell of the Ministry to codify, compile, proof-read and upload the updatedand authenticated Laws of Pakistan on a dedicated website of the Ministry(www.pakistancode.gov.pk).

Minister for Petroleum and Natural Resources (Mr. Shahid KhaqanAbbasi): (a) In SSGCL’s Franchise areas (i.e. Sindh and Balochistan) all newdomestic gas connection applications are being processed after completion offormalities on “first come first serve” basis. Lead time for processing suchapplications in SSGC is Forty Five (45) days and there is no priority criteria.

However, there are 2.21 million normal applications for domestic gasconnection pending in SNGPL’s franchise area (i.e. Punjab, Khyber Pkahtunkhwa,AJK and the capital territory of Islamabad)

(b) SNGPL strictly follow turn/merit policy and process request on firstcome first serve basis. Annual quota for provision of gas connections is set byOGRA.

In order to facilitate applicants, SNGPL has requested OGRA to increaseconnections quota to 0.5 Million. The process for provision of gas connection isbeing expedited by deputing additional resources in terms of manpower & material.Due to expeditious processing of domestic applications waiting period has beenreduced from 48 months to 30-36 months at present.

(b) Pak Steel is not paying its current / arrears gas bill despite SSGCserious recovery efforts at the highest forum of Pak Steel management, Ministriesand other relevant forums.

appointed by the National Highway Authority through the localDistrict Police Officer?

Minister for Communications: (a) An agreement was made by NationalHighway Authority (NHA) with KPK Police Shangla for provision of 247 securitypersosnsnel for security of Chinese construction team working on Thakot-RaikotKKH (N-35) project w.e.f. 01-7-2015 to 30-6-2016 at the total cost ofRs. 93.270 million. Later the said agreement was extended from 01-7-2016 to30-6-2017 at the same cost of Rs. 93.217 million. However, on completion ofthe project and departure of Chinese team from Pakistan, the said agreementwill be terminated from 31-12-2016 and as per relevant agreement clause, onemonth prior notice was also given to the concerned police office.

Due payment of Rs. 46.635 million for (06) months agreement period hasbeen made to Inspector General (IG) KPK Police through, the Budget OfficerProvincial Police Office Peshawar.

(b) The security arrangement for Chinese construction team was requiredto be made by Pakistan Government through NHA. For this purpose all securitypersonnel/ employees were appointed/provided by the KPK police under anagreement as stated above.

(b) There exist 08 numbers CNG station exists on the above 4" dialinepipe (Malakand Road to Gujjar Garhi).

(c) Oil and Gas Regulatory Authority (OGRA) had granted thepermission for setting up of the above CNG stations at 4" dia linepipe laid fromMalakand Road to Gujjar Garhi during subsequent fiscal years. The detail is givenat Annex-A.

Will the Minister for Communications be pleased to state themechanism being adopted to stop corruption at Toll Plazas establishedon Motorways and Highways functioning under the control of theMinistry at present?

Minister for Communications: There is zero percent corruption in awardof toll plazas established on Motorways and National Highways, Operations &Management of Toll Plazas are awarded in line with provisions of PPRA Rules2004 and NHA Code-2005 on yearly basis, through open competitive bidding.

(i) Advertisement in daily newspapers and at NHA and PPRA websites.

(ii) As per defined PQ criteria, evaluation of applicants/bidders.

(iii) Bid opening, in front of all qualified bidders.

(iv) Contracts awarded to highest bidders in case of manual toll plazasand contract awarded to lowest bidders in case of computerized(ETTM based) toll plazas.

Further, the procurement process and revenue thus collected under-goesauditing by the Office of DG (Audit Works) and commercial auditors (PrivateChartered Accountants firm) in order to ensure transparency. It is worth mentionthat there is no major audit Para observation on entire procurement process.

The constant growth in revenue @ average rate of 15% on yearly basis istestimony of the transparency and credibility of the system.

59. *Ms. Tahira Aurangzeb:

Will the Minister for Science and Technology be pleased to state:

(a) the fine prescribed for preparing injurious to health andsubstandard products and items in the country; and

(b) whether there is any proposal under consideration of the

Pakistan Standards and Quality Control Authority to make anincrease in said fine upto 10 million rupees?

Minister for Science and Technology (Rana Tanveer Hussain): (a)Pakistan Standards and Quality Control Authority (PSQCA) working underadministrative control of Ministry of Science and Technology (MoST) has themandate to formulate Standards and monitor the quality of products falling underthe Compulsory Certification Mark Scheme.

The PSQCA Act 1996 in its present form prescribes the applicable penalty/fine in its various clauses, which are as under:

20. Penalty for improper use of Authority marks, etc.—

(1) Any person who contravenes the provisions of sections 10, 11 or12, shall be punishable with imprisonment of either description for aterm which may extend to one (1) year, or with fine whichshall not be less than thirty thousand rupees, or with both.

(2) A court convicting a person under this section may direct that anyproperty in respect of which the contravention was made shall beforfeited to the Federal Government.

21. Penalty for contravention of section 13. —

If any person contravenes the provisions of any notification issued undersection 13 or of any licence or certificate issued there-under, he shall withoutprejudice to confiscation of property or penalty to which he may be liable underthe provision of the Customs Act, 1969 (IV of 1969), as applied by sub-section(2) of the said section 13, be punishable with imprisonment of either descriptionfor a term which may extend to one year, or with fine which shall not beless than fifty thousand rupees, or with both.

22. Penalty for other contraventions.—

Whoever contravenes any of the provisions of this Act or any rule madeor notification issued there-under, including a notification issued “ under Section-14, prohibiting, manufacture, storage or sale of an article not conforming to thePakistan Standard shall, if no other penalty is elsewhere provided under this Act,be punishable with imprisonment of either description for term which may extendto one year, or with fine which shall not be less than fifty thousand rupees,or with both.

(b) In order to make the enforcement mechanism more effective, PSQCAas per recommendations of Senate Standing Committee on Law and Justice, hasproposed following amendments in its Act with regard to increase in the penalties/punishments:

In section 20 sub-section (1), the following shall be substituted

(1) Any person who contravenes the provisions of sections 10, 11 or12, shall be punishable with rigorous imprisonment for a term whichshall not be less than three years and may extend to five years,or with fine which shall not be less than five hundred thousandrupees and may extend to one million rupees or with both.

In section 21 the following shall be substituted:—

22. Penalty for other contraventions:

(b) the name of employee/officer to whom charge of the said posthas been given alongwith the terms and conditions andqualification thereof; and

(c) whether there is any proposal under consideration to fill thesaid post; if so, the time by which the said post will be filled; ifnot, the reasons thereof?

Minister for Communications: (a) the post of Assistant Manager,Express Post (Delivery) is vacant w.e.f. 01-04-2015 due to retirement ofMr. Khalid Farooq Bajwa, the incumbent official who was holding the charge ofsaid post.

(b) a stop gap arrangement is in place. The charge of post was held byMr. Aziz Ullah, a Clerk (BS-09) w.e.f. 01-04-2015 to 19-08-2016 whosequalification is B.A. The charge of said post was assigned to Mr. MuhammadNawaz, Deputy Chief Postmaster, Delivery (BS-14) w.e.f. 20-8-2016 upto24-11-2016 on dual charge basis but due to his transfer, the charge of the posthas since been given to Mr. Aziz Ullah, Clerk (BS-09 on current charge basis.

(c) under the prescribed recruitment method, the post of BS-14 is filledup 100% by promotion. D.P.C. was convened to fill up the post but no officialwas recommended for promotion due to lacking in eligibility criteria. The post willbe filled up in due course of time, for which process is underway.

66. Mr. Muhammad Muzammil Qureshi:(Deferred during 34th Session)

Will the Minister for Defence be pleased to state:

(a) whether it is a fact that the Heavy Mechanical Complex (HMC),Taxila is not paying salaries and pensionery benefits to theirserving and retired employees respectively for the lastseveral months; if so, the reasons thereof; and

(b) the steps being taken by the Government to pay the said dues to

the employees of HMC at the earliest?

Minister for Defence (Khawaja Muhammad Asif): (a) HeavyMechanical Complex (HMC) has been transferred to Strategic Plans Division(SPD) Pakistan Atomic Energy Commission (PAEC). The payment of salaries toits employees is upto date and no salary is outstanding so far. HMC retired pensionersare getting their monthly pensions regularly. The gratuity dues of some retiredemployees are pending.

(b) Government of Pakistan has also approved a sum of Rs.500 Millionfor HMC wherein HMC has received first tranche of Rs.253 Million and thesecond tranche of Rs. 247 Million will soon be released by Ministry of Finance.With this monetary assistance all dues will be cleared.

(c) HMC is in the process of securing business and expects to improveits balance sheet.

6. Mr. Muhammad Muzammil Qureshi:

(a) the names of Government employees who opted plea bargainwith the National Accountability Bureau so far alongwith theposts, departments, nature of alleged misappropriations andamount thereof; and
