Online Tender through e-Tendering are invited by the Maharashtra Medical Council, 189-A, Anand
Complex, 2nd

and interior work proposed at the office premises above referred, vide on line digitally signed tenders for
the work from the contractor having done similar work individual of Rs. 1 crore and above.
1. The Complete bidding process will be online e-tendering in two bid system. All the notifications and detailed terms and conditions regarding this tender notice hereafter will be published on line on
website mahatenders.gov.in and www.maharashtramedicalcouncil.in
2. Bidding documents must be loaded only on the website mahatenders.gov.in from Date 19.11.2015
at 09.00 am to Date 26.11.2015 up to 01.00 pm.
3. The Payment for e-Tender Form Fees and Earnest Money Deposit (EMD) must be made online (Net
Banking only).

9) Conditions of Notice Inviting Tender
The contactor whose tender is accepted will be required to produce to satisfaction of the Concerned
Authority valid and current license issued in his favour under the provision of the contract labour
(Regulations and abolition) Act 1970 and in case of failure to do so the acceptance of the tender
would be liable to be withdrawn and earnest money forfeited.
10) RATES TO BE FILLED IN BILL OF QUANTITIES
a) The tenderer is requested to fill up rates both in figures and words. In case of any discrepancy found between the figures and words, the rate quoted in words will be treated
as valid.
b) If for the same item appearing in different sections, quoted rates vary, then the lowest quoted rates in such case will be treated as valid and will be applicable.
11) The tenders shall be received online on above mentioned e-Tendering Portal in two envelops system.
12) The Conditional tenders will be rejected.

13) Water & electricity to the extent available after meeting the need / requirement of the employer for the work will be supplied at specification in the premises. The contractor will have to make his own
arrangement for cabling/wiring etc., to the place of work. Any additional requirement for
water/power shall be arranged by contractor at his own cost.
14) Validity period of the offer of the tenderer will be 100 days from the opening of the tender.
15) The lowest tenderer will have to submit the rate analysis of all major items if called for.
16) The contract is neither a fixed lumpsum contract not a piece work contract. It is an item rate
contract to carry out the entire work to be paid for as per actual quantities as per given
specification.
17) No price Escalation is payable under this contract as per Govt. Resolution.
18) The contractor should have an experience of completion of such type / similar type of work, at least one work of value not less than 75% of the cost put to tender or two work of 50% of the cost
put to tender, during the last five years.
19) Bids for joint venture will not be accepted.
20) Bidder should upload scanned attested photocopies of all documents on above mentioned e-Tendering Portal & produce in original on request by MMC at any stage from e-Tender Opening.
21) The amount of security deposit should be paid 50% in the form of fixed deposit receipt of any nationalised /Schedule Bank, which can be encashed at any time and 50% will be deducted from
the bills. The Security deposit (including Earnest Money) paid by the successful tenderer, shall be
held by the Client for period of due execution and fulfilment of the contract and will not bear any
interest.
22) The amount of earnest money shall be forfeited in case after his / her / their tender is accepted the contractor fail/fails to complete the contract documents and pay the amount of Security Deposit
noted against the work within specified time would be intimated in the letter of acceptance.
23) In case the contractors fails to Deposit the necessary initial Security deposit within the specified time, MMC may, at its discretion, grant extension of time on payment of interest at 20% per
annum for such amount of Security Deposit as has not been paid till the whole of the Security
Deposit is paid.
24) Decision of tenders will vest with the competent Authority who reserves the right of rejecting any or all the tenders without assigning any reasons for doing so.
25) The offer of the tenderer shall be binding for a period of 100 days from the date of opening of e-Tender.
26) A statement showing names of partners, Directors, etc. of the firm with complete address of each should be uploaded to the e-Tender and authorize person on behalf of firm should sign tender
using digital signature certificate.

27) The tenders which are not accompanied by necessary information vide item 9 will be rejected without assigning any reasons for doing so.
28) The lowest tenderer shall be required to pay the stamp duty for the execution of the contract agreement with the Maharashtra Medical Council, according to Govt. rules and scale in force.
29) The contractor/s whose tender is accepted will have to enter into a regular contract agreement with the 'Maharashtra Medical Council.
30) No alternations in the form of tender, schedule of quantities, units, specifications and in the shape of special stipulations will be permitted. Tender of the Contractor/s quoting the rates for units other than
specified in the tender will not be considered.
31) The Competent Authority shall be entitled to reject complete tender and forfeit the earnest money paid
by the Contractor/s if they fail to produce the required documents within stipulated period.
32) While submitting tenders the contractors/s shall take into consideration that they will have to pay
income-tax at 2% on gross amount and surcharge at prevailing rates to be paid and the same will be
recovered through R.A. Bills.
33) The tendered rates shall be inclusive of all taxes rates and cesses and shall be inclusive of service tax
and tax leviable in respect of work contract under the provision of the Maharashtra Sales Tax on
Transfer of Property in goods involved in execution of Works Contract (TDS) Maharashtra tax laws
(Act No XVII of 1999) (Levy Amendment & Validation Act 1999), Maharashtra Value Added Tax
(MVAT) etc.
35) While preparing & submitting e-Tender the Contractor/s shall take into consideration that they will
have to pay works contract Tax as per the Maharashtra value Added Tax Act 2002, TDS shall be
deducted at the rate of 5% on gross amount of bill payable to contractor if he is not registered under
VAT, if he is registered under VAT, the TDS to be deducted at 2% from the bill. The rate shall be
subject to Government's directions as those shall be issued from time to time.
36) While submitting e-Tender the tenderer/s shall take into consideration that they will have to pay
Service Tax as per the rates decided by and as and when revised by central Excise Department. The
contractor will have to produce a registration certificate from Central Excise Department.
37) The acceptance of tender will be intimated by email or otherwise by the authority competent to accept
the tender, i.e. the Maharashtra Medical Council to the contractor/s, which shall be deemed to be an
intimation of the tender given by the Authority Competent to accept the tender.
38) MMC reserves the right to verify financial transaction of contractor in his Bank / Financial
Institutions. Contractor should give authority to that effect along with his accounts number & Bank /
Financial Institutions name & address. Any changes / modification may be communicated to MMC
immediately.
39) The scope of work may increase or decrease as per site condition. The work shall be executed under
supervision of Architect or his representative appointed by him.
40) If there is any amendment in the tender the same shall not be published in the news paper but will be
published on MMC website www.maharashtramedicalcouncil.in

41) The cost of tender shall include the cost of all permits and NOCs required for construction purpose, if
required at site. The Contractor shall comply the rules and regulations of the BEST/Reliance/Local
Municipal Ward Office, Fire Brigade, Debris removal Department, etc., and shall pay all charges and
deposits at his own cost. In case Contractor fails to do so, Owner shall pay the same including
penalty if any and debit the same to the Contractor's Bill.
42) The contractor shall remove all rubbish and superfluous material from the site of the works with all
reasonable speed from time to time and at completion at their cost. No additional charges will be paid
on this account.
43) The bidder should visit the site prior to submission of tender and ascertain the local site condition,
working restrictions, obstruction, conditions in tender document regarding necessary approvals, NOC
required for the work from the Local Authorities and shall quote the offer inclusive of all such expenses
likely to be incurred while execution of the work. No claim or compensation for any extra payments
incurred by the bidders towards the approvals, NOC's, permission will be entertained by the MMC,
which shall be noted.
44) The competent authority reserves the right to reject any or all the tender offers, without assigning any
reason thereof.

(i.e. Rs. 5,700/-) tender charges payable
online to the Maharashtra Medical Council.
b) Earnest Money Deposit : Rs. 3,00,000/- payable online to the Maharashtra Medical

3) Initial Security Deposit : In the form of Demand Draft payable at Mumbai, on acceptance of tender, at 5% of the tender amount less EMD

subject to the maximum of 5% of the total bill amount.
10) Minimum Value of Work : Rs. 25,00,000/-( Twenty Five Lakhs Only) per bill.

Instructions to the Tenderers for procedure of submission of tender
Contents of tenders should be prepared & submitted on MMC e-Tendering portal mentioned above in
following manner & must include requisite document„s (scanned copies) as given below :

Note:- Proforma of statements Serial Nos. 2 to 6 are also provided along with main Tender
document. Tenderers are requested to fill online forms of statements & encrypt the
data using valid Digital Signature certificate issued by any of Government of India
approved Certificate Authority in envelope given.
Online Envelope - II Main tender document mentioning the financial offer of the tenderer
Upon preparation of Data in Both the envelopes mentioned above contractor need to
generate HASH value of bid & same has to be signed using Digital Signature
certificate then submit the HASH value on e-Tendering Portal: On prescribed date of
Bid submission Contractor need to upload all the documents uploaded during Bid
Preparation & also re-encrypts and using Digital Signature certificate
Tenders not received in above referred manner will be rejected forthwith.
Procedure for Tender opening
Tender will be opened online by competent authority on prescribed date given in tender schedule. Online
E.M.D. scrutiny will be done first and uploaded documents by contractors will be opened against the tender
requirements mentioned above. If contents are not as per requirements, online financial bid may not be
opened.

INSTRUCTIONS TO BIDDERS & METHODOLOGY OF TENDER SUBMISSION
1. The Bidder shall, prior to submitting his tender for the work, visit and examine the site of work and its surroundings at his own cost and obtain and ascertain all information that may be necessary for
preparing his tender offer and entering into a contract including, interalia, the actual condition of site,
soil samples and foundation conditions, availability of materials, labours, water supply, electricity,
traffic restrictions and obstructions in work if any and it shall be presumed that, Agency has taken
into consideration prevailing site conditions and envisaged factors affecting the cost of work while
quoting the price.
2. A Bidder shall be deemed to have full knowledge of the site, whether he inspects it or not and no extra
charges consequent on any misunderstanding or otherwise shall be allowed.
3. Submission of quoted tender implies that Bidder (bidder) has received tender notice and all other
contract documents and has made himself aware of …..
(I) Scope and specifications of the work to be done.
(II) Local site conditions.
(III) Other factors having any bearing whatsoever on execution of the work.
4. The Bidder shall submit the tender that satisfies each and every condition laid down in the tender
failing which, it is liable to be rejected.
5. The successful Bidder shall be required to produce to the satisfaction of Engineer/Architect a valid
and current license issued in his favour under the provisions of the contract labour Act 1979 before
starting the work, failing in the matter the acceptance of the bid shall be liable to be withdrawn and
also Earnest Money and Initial Security Deposit shall stand forfeited.
6. The other data furnished in the Tender Documents are only by way of general information and the
MMC shall not entertain any claims due to variations from this data or for any expenses incurred by
the Bidder in this connection. The Bidder shall himself obtain all necessary information at his risk and
costs and other circumstances which may affect or influence his tender. No extra charges consequent
on any misunderstanding or otherwise shall be allowed.
7. At any time prior to the deadline of Bid preparation and Hash submission, the MMC may, for any
reason whether at its own initiative or in response to a clarification requested by a prospective Bidder
pursuant to subsequent clause hereof modify the Tender Documents by the issuance of an addendum.
8. The Addendum shall be issued by uploading on e-tender portal for all prospective Bidders who have
received the Tender Documents and shall be binding upon them, irrespective of whether the
prospective Bidders acknowledge receipt of the same or not.
9. In order to afford prospective Bidders reasonable time to take the Addendum into account for the
preparation of their tenders, the MMC may at its discretion extend the deadline for the submission of
tenders.

10. PROCEDURE FOR SUBMISSION OF TENDER:
i) Tender forms can be downloaded from the e-tendering portal of MMC ie. https://mahatenders.gov.in, after entering the details of payment towards Tender fees and
EMD as per the tender Schedule.
ii) The Tender submitted by the tenderer shall be based on the clarification, additional facility offered ( if any ) by the Council, and this tender shall be unconditional. Conditional tenders
will be summarily REJECTED.
iii) All tenders are cautioned that tenders containing any deviation from the contractual terms and conditions, specification or other requirements and conditional tenders will be treated as non
responsive. The contractor should clearly mention in forwarding letter that his offer (in
envelope no. 1& 2 ) does not contain any condition, deviations from terms and conditions
stipulated in the tenders.
iv) Tenderers should have valid Digital Signature Certificate (DSC ) obtained from any Certifying Authorities. In case of requirement of DSC, interested Bidders should go to
http://mahatenders.gov.in and follow the procedure mentioned in the document ; Procedure

10.3 OPENING OF TENDERS
On the date, specified in the Tender Notice, following procedure will be adopted for opening of the
Tender.
(A) ENVELOPE NO. 1 : (Technical Bid)
First of all Envelope No.1 of the tender will be opened to verify its contents as per requirements.
If the various documents contained in this envelope do not meet the requirements of the
Department, a note will be recorded accordingly by the tender opening authority and the said
tenderers Envelope No.2 will not be considered for further action and the same will be recorded.
The decision of the tender opening authority in this regards will be final and binding on the
contractors.
(B) ENVELOPE NO. 2 (Financial Bid) :
This envelope shall be opened after opening of Envelope No. One, only if contents of Envelope
No.1 are found to be acceptable to the Department. The tender cost shall then be read out in the
presence of bidders who remain present at the time of opening of Envelope No. 2.
Tenders should bring and submit, signed and sealed hard copies of the duly filled in tender
documents (in two separate envelopes for technical bid & price bid) at the time of opening of the
online technical bid.

SPECIAL CONDITIONS OF CONTRACT
1. This supplement of special conditions of contract, the instructions to tenderer and the General
conditions of contract as applicable to works contract shall be considered part of the contract
documents. Where the provisions of these special conditions are at variance with the General
conditions of contract these conditions shall prevail.
2. SCOPE OF WORKS : Civil & Interior, Electrical, HVAC & Fire
Fighting work.
3. LOCATION OF WORK : Maharashtra Medical Council, 189-A,
Anand Complex, 1st Floor, Sane Guruji Marg, Arthur
Road Naka, Chinchpokli (W), Mumbai – 400 011.
4. PERIOD OF COMPLETION : 100 days from the Date of Commencement.
5. RETENTION MONEY AND SECURITY DEPOSIT :
10% of the R.A Bill value is to be retained in all Running Bills as a retention money. This is in
addition to the initial security deposit.
6) Within seven days of the receipt of intimation from the Architect of the acceptance of his/their tender,
the successful tenderer shall be bound to implement the contract by signing an agreement in
accordance with the Agreement and conditions of the contract, but the written acceptance by the
Employer and the person tendering, whether such formal contract is or not subsequently entered into.
7) The successful tenderers shall deposit the amount of Rs. 3,00,000/- (Rupees Three Lakhs Only) as the
Earnest Money Deposit. As the security deposit @ 5% of the tender cost including EMD to be paid
when the tender is accepted.
8) No escalation shall be paid for any reason whatsoever. The Client/Architect is not concerned with any
rise or fall in the prices of any materials. The rates quoted shall include all costs, work contract tax,
allowances, excise duties including Service tax all taxes or any other charges including any enhanced
labour rates etc. which may be enacted from time to time by the State or Central Government under no
circumstances shall our clients be held responsible for compensation or loss to the contractor due to
any increase in the cost of labour, materials etc.
9) If the contractor fails to comply to the works by the schedule date of completion or within any
sanctioned extended time he shall have to pay 1/2% of the contract value, per week of delay or part
thereof upto a maximum 5% of contract amount as liquidated damages for such delay beyond the date
that the works remain incomplete subject to the clauses of the attached General conditions of the
contract.
10) The Contractor shall prepare all loose furniture items in his workshop, if required under the
Architect's supervision and shall assemble the same at site as per the instructions of Architects/ MMC.
No separate payment will be made to the Contractor towards the cost of transportation.
11) In order to have early completion of the work, the MMC may distribute the work between two or
more Contractors, and all these Contractors are required to work in coordination with each other. No

Compensation will be given to any contractor for reduction in work for awarding the same to other
Contractors. However, the Contractors are required to quote for all the works given in the tender.
12) Detailed drawings and designs may be inspected in the office of the architects on any working day
during normal working hours.
13) The tenderer must obtain for himself on his own responsibility and his own expenses all the
information which may be necessary for the purpose of filling this tender and for entering into
contract for the execution of the same and must acquaint himself with all local conditions and matters
pertaining thereto.
14) Each page of the tender document is required to be signed by the person/ persons submitting the
tender in token of his/ their having acquainted himself /themselves with the Conditions of the tender,
as laid down. Any tender with any of the documents not so signed will be rejected.
15) The tender form must be filled in English and all entries must be made by hand and written in ink. If
any of the documents is missing or unsigned the tender shall be considered invalid.
16) All erasures and alterations made must be attested with the initials of the tenderer while filling the
tender. Overwriting of figures is not permissible. Failure to comply with either of these conditions will
render the tender void. No advice or any changes in rates after the submitting of the tender, will be
entertained.
17. ROYALTIES ETC. :
All charges, such as sales tax, work contract tax, royalties, octroi and other duties for materials
obtained for the works of fabrication of materials, if any, shall be borne by the contractors also all
tolls, local and other taxes, etc. including Service Tax. Royalties for materials removed shall be
payable by the contractor. All amounts due to this contract (royalties taxes etc.) shall be paid
directly to the Authorities concerned by the contractor, or if not paid will be recoverable from the
money due to the contractor, if so required by the authorities. The contractor will not be entitled to
any refund on this account.
18. TIME IS THE ESSENCE OF THE CONTRACT :
The date of commencement will be 4th day from the date of letter of intent. Time being the essence of
the contract, the various items of work shall be constructed and completed in accordance with the
works. The time shall be recorded from the date of commencement of work. The contractors shall
commence the work immediately within 4 days from the date of work order/letter of intent and shall
proceed with the same with due efficiency or without any delay, except as may expressly be
sanctioned or ordered by the employer or their representatives or Architect.
19. MAINTENANCE :
The contractor shall, maintain for a period of 12 months, (defect liability period) after the date of
completion of works certified by the Architect, the works in such a manner that, at the expiry of the
period of maintenance the same shall be in good and perfect order.
The contractor shall at his own expenses repair, rectify, and make good to the satisfaction of the
Architect/Employer, all defects imperfections, shrinkages or workmanship not in accordance with the
contract or from neglect or failure on the part of the contractor to comply with the provisions of the
contract. No separate charges will be paid by the MMC/Architects for maintenance; the defects
pointed out shall be rectified within three days.
20. COOPERATION WITH THE OTHER CONTRACTORS :

The contractor shall cooperate with the employer and other Contractors if any working at the site in
respect of those works which would be executed simultaneously under separate contract or agencies.
21. WORKING HOURS :
The hours of works for the labour employed by the contractor shall conform to the hours fixed by the
employer (no inconvenience should be caused to the MMC as well as nearby residences /offices.)
Contractor may carry out some of the items of work in his workshop under the supervision of
Architect and to assemble and finish at the site as per the design and drawing. However, no separate
charges will be paid towards transportation.
22. SETTING OF WORKS :
The contractor shall at his own expense provide all necessary pegs, nails strings and such other
materials necessary for setting out & shall at all times provide for skilled & technical assistants who
are capable of carrying out the work in accordance with the drawings and specifications to correct
lines & levels. The contractor shall be responsible for setting out the work and get the same approved
before the work is actually commenced.
23. SECURITY REGULATIONS:
The contractor shall strictly comply with the security regulations in force at site.
24. PAYMENT :
The owner on submission of bills by the contractor shall pay the contractor, normally at scheduled
intervals for the work done on Interim certificates to be issued by the Architects.
To enable the Architects to issue such Certificates the contractor shall submit bill for all works
executed in the previous bills, supported with detailed measurements of relevant items of works
spelling out location and part of structure and all such details for easy verification and the Architect
shall take down measurements and verify the same before issuing recommendations.
The Architect reserves the authority to with hold issue of the certificate and take amendments,
modifications and nullify subsequently any previous certificate issued by him. Payments on Interim
Certificate shall be regarded as payments by charge of advance against final payment only and not as
payment of work actually done and completed.
25. MORE THAN ONE SHIFT WORKING :
It may be noted by the tenderers that the overall completion time shall be totally binding upon the
contractors & to that effect the element of maintaining proportionate progress will be very vigilantly
watched. In that context the employer/Architect would insist on timely completion of some portions
of work under the scope of contract which forms important linkage in relations to subsequent
activities of progress by the other agencies in an expeditious manner to match the overall progress
identified by the employer from time to time. The contractor will have to complete the same as
instructed by employer/Architect. Contractor may carry out some of the items of work in his
workshop under the supervision of Architect and to assemble and finish at the site as per the design
and drawing. However, no separate charges will be paid towards transportation.
26. The Tenderers are also required to make a sample/ produce prototype /mock up of all the different
items of furniture to be made for the above work which they have quoted, without any additional cost
for Architect's and Interior Designer's approval.

27. The method of measuring various items of work shall be generally as described in the relevant items
of work. In case of any doubt the mode of measurements shall be in accordance with the latest Indian
Standard Code of Procedure for method of measurement.
28. The Contractor at the site of his work at the place or places shown to him shall maintain the following
facilities:
a) Printed time schedule displayed properly.
b) All the drawings which will be given to him for execution of the work.
c) The Contractor shall keep all the drawings in proper condition and will not be permitted to
remove the same from site of work for any reasons whatsoever. They shall be available for
inspection at all times by the Architect & his authorised representatives & Employer /
employer's representatives.
d) One 100 ft. & one 50 ft. steel measuring tape with ISI stamped certificate and two ten feet
stock tapes, box of chalk for marking.
e) Measurement books, copies of bills of work due or certified, site instruction Book, Registers
etc.
29. There shall be co-operation between the other contractors working at site and the successful tenderer
to the maximum possible extent in accordance with the advice of the Architect/ Employer.
30. The successful tenderer shall properly safeguard against damage or injury to the public any person,
including any employee of the employer and to any property or thing and shall alone be responsible
for any such damage and injury to any person or persons or thing arising in connection with its
execution of the work. The successful tenderer shall protect and hold harmless the owner against any
or all claims for any such injury or damage.
31. The work in every respect during the progress and till final acceptance by the Owner, including raw
materials delivered at the job site to be incorporated or used in the work by the successful tenderer are
at his own risk. The successful tenderer at his own expense shall immediately replace any loss or
damage to such material or work by the owner or anybody.
32. The Architects shall have the right to direct the contractor to purchase and use materials from any
particular/specified source for the proper execution of the work.
33. The Architect/Interior Designer, the owner or their authorised representatives shall have full
power for inspecting the work at the Contractor's workshop or at any place from which the materials
are obtained at the workshop of the contractor. Acceptance of any material shall in no way relieve the
contractor of his responsibility of best material and workmanship. The tests and or analysis shall be
done in the laboratory approved by the Architect and the Contractor shall permit the Owner and /or
the Architects or their authorised representative to be present during any of the tests and or analysis.
The cost for tests will have to be borne by the contractor.
34. The Contractor shall carry out the work strictly in accordance with the drawings prepared by the
Architects/Structural Engineer and the specifications given in the tender. If the Contractors does not
carry out the work as per the plan prepared by the Architects/Structural Engineers, these mistakes will
be required to be rectified by the Contractor at their cost, whenever, it is pointed out to the Contractor
as per the instructions of the Architects, irrespective of whether further work has been executed or not.

Any discrepancy in the drawings of the Architects/Structural Engineer shall be brought to the notice
by the Contractor before starting the work.
35. CONTRACT PRICE :
i] The rate for carpentry and joinery work shall include for slightly rounded, rises where
required, for all cutting and waste, notching, holes, housing ends, meters, ends and shaped ends,
junctions, beading joints, short lengths etc. for all nails, spikes, pins and bleeds for coating the backs
of frame, backing fillets etc. with two coats of Atlas `A' or other equal and approved wood
preservative and all necessary templates or moulds for circular or shaped work.
ii] Where the description of works states, "Plugging and fixing with nails spikes etc., to brickwork
or concrete work and any racking off and clearing away existing plaster as necessary; the rates for
hardware are to include for supplying all necessary screws to match and for the provision to keep
striking plates etc. as necessary. The rates for fixing hardware are to include for all fittings, cuttings,
sinking, forming mortising, first fixing removing for decorations, finally refixing after execution of
the decoration casing, coiling, adjusting, making good and leaving in perfect working order to the
satisfaction of the Interior Designer.
iii] The rates for steel work etc., are to include for cutting to required lengths, meters slays at
ends, welds and all drilling and counter sinking.
iv] The rates for fitting fabrics etc. are to include for all cutting, fitting and waste for equal
margins and for all "making good".
v] T.W. Beading/moulding: The rate of all furniture items shall include cost of providing and
fixing T.,W. beading/moulding etc as shown in respective drawings, even though not mentioned in the
description of the items.
vi] All exposed wood work shall be provided with melamine polish of approved shade even
though it may not include in the description of individual item.
vii] The rates for provision for furniture are to include for placing in position and protecting from
damage until handed over to the Owner.
viii] The rates for all paint work or polishing are to include for all preparation of surface,
rubbing down before each coat, all brushes and cleaning materials, submitting sample panels of paint
work for decoration is applied to general surfaces, analysis of any paint, if required, cutting into line,
multi calculated work, protecting fittings etc. necessary to leave everything clean and perfect on
completion.
ix] The rates for demolishing, making cut-out etc. in alteration work are to include for all
necessary supporting propping making cut out to floors, walls or soffits, making good and touching up
decorations and finishes all to match existing and make good all work disturbed.
x] The rate for "Upholstered" furniture shall include fixing of upholstery material as described
with all necessary material required for that fixing.
xi] T.W. DRAWERS:
The cost of all the furniture items shall include cost of providing T.W. drawers wherever specified or
shown in detail drawings. The drawers shall be fitted with M.S. sliding channel as per instructions.

The depths of drawers for different table, counters, racks etc. shall vary as per requirement. The cost
of aforesaid items is included in individual items and no separate cost shall be paid for the same.
xii] SLIDING SHUTTERS:
The cost of furniture items such as storage units, tables etc., where sliding shutters are provided,
include the cost of providing sliding channels of approved company to be provided to sliding shutters.
xiii] LOCKING ARRANGEMENT : (BRASS)
The cost of furniture such as tables, storage units, etc., shall include the cost of providing (brass) of
necessary locking arrangement of Godrej door set, Kich/Neki make even though not specified in the
individual item. However, no separate payment will be made for this. All locks shall be of brass and
Godrej make unless otherwise specified by the Architect.
xiv] DOORS:
The cost of the doors of partitions shall include the necessary locking arrangement such as Godrej
door set, Kich/Neki "Mortis" lock or equivalent with Brass black Anodised / oxidized or S.S. handle
concealed door-closer with heavy Railway Type brass black oxidized hinges (with S.S. pin) with brass
black oxidized screws as approved by the Architect.

OTHER CONDITIONS
(To be read in addition to or in further clarification to the condition of contract given in Article of Agreement
attached herewith).
1. Before filling in the tender, the contractor will check all the drawings and Schedule of Quantities and
will get an immediate clarification from the Architect /Interior Designer on item not clearly
understood. In case of any discrepancy the same should be brought to the notice of Architect. No
claims for any loss or compensation will be entertained on this account.
2. All the work shall be carried out as per detailed drawings and specifications by Architect.
3. a) The rates quoted in the Tender shall be for the finished items of work.
They shall include all the charges required for labour, materials sheds for storage of materials,
transportation of materials and equipment, double scaffolding of centering materials, tools and plants,
making out and cleaning of site, during execution of various items of work and to do all things
necessary to provide complete finished items for work consistent with the specifications attached to
this Tender Document. The rates shall be inclusive of octroi duty, excise duty, packing and
forwarding or any other duties or fees levied by any Government, public or local bodies. The rates
shall be firm and shall not be subjected to any change, variations, labour conditions or any other
conditions whatsoever.
b) Water and electricity to the extent available after meeting the need/requirement of the
employer for the work will be supplied at specified location in the premises for which the contractor
has to pay necessary consumption charges. The contractor will have to make his own arrangement
cable/wiring etc. for carrying power to the place of work. Any additional requirement of water and
power has to be arranged by the contractor at his own cost.
5. Adequate Engineering & technical staff should be appointed at site by the contractor. Architect should
be informed of their number and qualifications. Approval of Architect should be taken prior to
appointing such technical staff on site.
6. The contractor shall not be entitled to any compensation for any loss suffered by him on account of
delays in commencing the works or executing the works, whatever the cause for such delays may be,
including delays in procuring Government controlled or other materials.
7. Acceptance of the Tender shall be governed by the Conditions of contract stipulated hereinafter.
Acceptance of any or lowest tender and rejection of any tender is entirely, to the discretion of
Clients/Architect without assigning any reasons to the tenderers.
8. The Contractor shall keep the Tender submitted by him open for acceptance for a minimum period of
100 days from the date of its submission. The rate quoted by the successful tenderer shall be firm and
variation in rate of any one or all the items on any account shall not be allowed during the entire
duration of any contract.
9. During the execution of work, Contractor must check the work with his drawings. The contractor shall
be responsible for all the errors in this connection and shall have to rectify all the defects at his own
cost, failing which Architect/Engineer reserves the right to get the same rectified at the risk and cost
of the contractor.

10. No claim for extra items or deviation from specifications shall be entertained unless the same is
pointed out and accepted as such before the work of extra items or deviation is taken in hand.
The Architect, however, will be the Arbitrator in such matters in every respect and his decision will be
final & binding on both the Owner & the Contractor.
If any dispute, difference, or question shall at any time arise between the parties as to the construction
of this Agreement or concerning anything herein contained or arising out of this agreement or as to the
rights, liabilities and duties of the said parties hereunder, or as to the execution of the said works,
except in respect of matters for which it is provided "herein that the decision of the Employer is final
and binding, the same shall be referred to the arbitrations and final decision of an arbitrator to be
agreed upon and appointed by both the parties or in case of disagreement as to the appointment of
single arbitrator, to the appointment of two arbitrators shall, before taking upon themselves the burden
of reference, appoint an umpire.
12. Any legal dispute between the Owner and the successful tenderer shall be settled as per the Articles of
Agreement attached herewith.
13. The Contractor shall comply with all bye-laws & regulations of local and other statutory authorities
having jurisdiction over the works and shall be responsible for the payment of all the fees and other
charges for giving and receiving all necessary notices, drawing and test certificates.
23. Phased programme (Bar charts) for execution of the various items of work shall be submitted by the
contractor within a week of receiving the work order and this phased programme shall duly be
adhered to while working.
24. After receiving the Letter of Intent, the Contractor is required to bring the samples of all the required
material as mentioned in the tender and get the same approved by the Architect. In case if any
material is not available he should bring it to the notice of the Architect immediately. Similarly the
Contractor is required to prepare mock-up of designs for showing various alternatives/designs as
mentioned in the tender. The various items for which the mock-up designs are being made by the
Contractor such as false ceiling, paneling, acoustical treatment, floor pattern, dado patterns, hand rails,
railing, compound pavement, aluminum windows. ACP treatments etc. However, the Contractor will
not be paid extra charges for making the mock-up design. The approved design/selected from the
mock-up design will be kept at site till the entire work is completed by the Contractor.
25. The Contractor shall be responsible for the stability of the construction including all temporary
structures, formwork, centering, shoring, propping other temporary support/structures etc., during the
construction phase, particularly the stability of scaffolding, centering, formwork incomplete RCC
work, half-finished walls etc. He shall indemnify the owner, Architect, Structural Engineer, Site
Supervisor and other technical staff at site against any further third party claim, liability that may arise
during the execution of work till the possession is handed over to the Owner by giving separate
Indemnity Bond, if required.
26. INSURANCE :
The Contractor shall indemnify the Owner against all claims which may be made against the Owner
by any member of the public, or third party in respect of anything which may arise in consequence
thereof and shall at his own expense arrange to effect and maintain up to one month after the virtual
completion of the Contract with an office approved by the Owner & the contractor and deposit such
policy or policies with the Owner from time to time during the currency of this contract.

The Contractor shall also indemnify the Owner against all claims which may be made upon the Owner
under the Workman's Compensation Act or any other statute in force during the currency of this
contract or any common law in respect of any employee of contractor or any sub-contractor, and shall
at his own expenses effect and maintain upto one month after the virtual completion of the Contract,
with an effect approved by the owner a policy or policies of insurance in the joint names of the Owner
& the contractor as aforesaid. The Contractor shall be responsible for anything, which may be
excluded from the Insurance Policies above referred to, and also for all other damages to any property
arising out of and incidental to the negligence or defective carrying out of this contract. The policy
should be for full amount of contract value. The premium will be paid by the contractor and should be
the contractors all risk policy.
He shall also indemnify the owner/architect in respect of any costs, charges or expenses arising out of
any claim or proceeding and also in respect of any award of compensation or damage arising there
from. The owner shall be at liberty and is hereby empowered to deduct the amount of any damages,
compensation costs, charges & expenses arising or occurring from or in respect of any such claims for
damages from any sum or sums due/ to become due to the Contractor.
The Contractor shall deposit the policies and receipt for the premium with the owner within 15 days
from the date of receipt of work order, unless otherwise instructed by the owner. In default of the
Contractor insuring as provided above, the owner on his behalf may so insure and may deduct the said
premium from the money due or which may become due to the Contractor.
27. FIRE INSURANCE :
Unless otherwise instructed by the owner, the Contractor shall on signing the Contract, insure the
above works & keep them insured upto one month after the virtual completion of the contract against
loss or damage by fire and/or earthquake by taking out a Policy of Insurance from the office approved
by the Owner in the Joint names of the Owner and the Contractor for full value of Contract plus 3% to
cover the Consultant's fees. Such policy shall cover the property of the Owner only and the
Consultant's fees in connection with his services generally in the reinstatement, and shall not cover
any property of Contractor or any sub-contractor or employees.
The Contractor shall deposit the policies and receipt for the premium with the owner within 15 days
from the date of receipt of work order, unless otherwise instructed by the owner. In default of the
Contractor insuring as provided above, the owner on his behalf may so insure and may deduct the said
premium from the money due or which may become due to the Contractor.
The contractor shall as soon as the claim under the Policy is settled or the work reinstalled by the
Insurance officer, should they elect to do so, proceed with all due diligence with completion of the
works and in the same manner as though the fire had not occurred and all respects under the same
conditions of the contract. The Owner and the Contractor may mutually agree upon the Contractor in
case of building or reinstatement after the fire shall be entitled to such extension of time for the
completion as.
28. PROGRAMME OF WORK :
The Contractor shall furnish within two weeks of instructions to commence decoration operations &
manufacture of furniture and in agreement with the Interior Designers a "Programme & Progress
Chart" of the whole of the works. Two copies of the Programme & progress chart shall be furnished
on the site and kept up to-date by the Contractor.
This chart shall be modified as necessary Interior Designer shall be informed about any circumstances
rising effecting its validity.

29. WORKMEN AT SITE :
The Contractor's work people shall not be allowed to live on the site at any time throughout the
contract nor to trespass beyond the limits of the site. His work people will hold the Contractor
responsible for any acts of trespass.
30. DIMENSIONS :
Figured dimensions are to be taken in preference to scaled dimensions in all cases. Before
commencing any work the Contractor shall verify all measurements. If any discrepancies are found
they shall immediately be brought to the notice of the Architect.
31. DISCREPANCIES :
All items shown on the drawings or specifications are taken to be included in both. Any discrepancies
that occur either in the drawings or the specifications shall immediately be brought to the attention of
the Architects.
32. PHOTOGRAPHS :
The Contractor shall throughout the period of the contract take all practicable steps to ensure that no
photographs of the site or of the works or any part thereof or anything therein are taken except with
the permission in writing of the Interior Designer and no such photographs are published or otherwise
circulated without such permission.
33. CUTTING AND MAKING GOOD :
Where it is found necessary to cut & make good the interiors with finished work in order to execute
this Contract, the Contractor will be required to do all necessary work at his own expenses.
Only "approved" hangers and bolts or other metal fixing devices shall be used to secure frames, panels
and other units in position. Wooden plugs will not be permitted. Holes shall be formed with electric
drills wherever possible. Structural members shall not be cut or drilled without prior consent of the
Project Engineer/Architect.
34. MAINTENANCE AND GUARANTEE :
The whole of the work to be performed under this Contract shall be completed to the satisfaction of
the Interior Designer/Employer.
The Contractor shall without additional charge to the Owner renew or replace any works which prove
to be of faulty workmanship or materials and fully maintain the whole installations for a period of
12 months after the commencement of a Defect Liability period of the Main Contract & a sum of 5 %
of the Contract amount shall be retained by the Owner for this period, the same may be released
against Bank guarantee of equivalent amount from a Nationalized Bank other than Maharashtra
Medical Council (MMC) or its subsidiaries for the period of thirteen months.
35. NOMINATED SUB-CONTRACTOR AND SUPPLIERS :
The Contractor is to, ensure all nominated Sub-Contractor's and supplier's general attendance in a
trades and every facility to move about the works in the legitimate pursuit of their respective and
particular work, and is to allow for free use of such plant, scaffolding, ladders etc. as they may require
to clear away rubbish for the use of Welfare and sanitary conveniences and other usual conveniences

of the site. He has to obtain full particulars about their requirements with regard to chases, recesses
and other details and execute them and is to supply them with all necessary dimensions and other
information so that their work may be correctly executed and subsequent alterations obviated.
Should the Contractor fail to do so, and chases, recesses etc. are afterwards found to be necessary, he
will be required to make them" at his own cost". The Contractor shall not be required to maintain any
such scaffolding or staging longer than is necessary for his own use, or to erect any special scaffolding
or staging longer than is necessary for his own use, or to erect any special scaffolding or staging for
the use of others.
36. PREVENTION OF SOIL DUMPING :
The Contractor shall take all reasonable steps to prevent spill, rubbish, debris, surplus materials etc.
arising from the works being dumped on an area other than a recognized or approved dumping area
and the Contractor will be held responsible for and shall indemnify the Owner against any claim or
loss arising there from.
37. LEAVE PERFECT :
The Contractor shall remove all rubbish and superfluous material from the site of the works with all
reasonable speed from time to time and at completion. On no account shall the owner's receptacles be
used for this purpose.
38. LOCAL PERMISSIONS:
a) The cost of tender shall include the cost of obtaining permissions from various local
authorities required for carrying out the interior renovation work in the tender amount & no separate
payment shall be paid to him on this account.
b) WATER & ELECTRICAL CHARGES: The cost of tender shall include the cost of water &
Electricity charges required for construction purpose. They should make their own arrangements for
water and electricity. No separate meter will be provided. Contractor shall pay necessary consumption
charges.
c) NOC CHARGES: The cost of tender shall include the cost of all permits and NOCs required
for construction purpose, if required at site. The Contractor shall comply the rules and regulations of
the BEST/Reliance/Local Municipal Ward Office, Fire Brigade, Debris removal Department, etc., and
shall pay all charges and deposits at his own cost. In case Contractor fails to do so, Owner shall
pay the same including penalty if any and debit the same to the Contractor's Bill.
39. CONTRACT PRICE :
i] The rate for carpentry and joinery work shall include for slightly rounded, rises where
required, for all cutting and waste, notching, holes, housing ends, meters, ends and shaped
ends, junctions, beading joints, short lengths etc. for all nails, spikes, pins and bleeds for
coating the backs of frame, backing fillets etc. with two coats of Atlas `A' or other equal and
approved wood preservative and all necessary templates or moulds for circular or shaped
work.

ii] Where the description of works states, "Plugging and fixing with nails spikes etc., to
brickwork or concrete work and any racking off and clearing away existing plaster as
necessary; the rates for hardware are to include for supplying all necessary screws to match
and for the provision to keep striking plates etc. as necessary. The rates for fixing hardware
are to include for all fittings, cuttings, sinking, forming mortising, first fixing removing for
decorations, finally refixing after execution of the decoration casing, coiling, adjusting,
making good and leaving in perfect working order to the satisfaction of the Interior Designer.
iii] The rates for steel work etc., are to include for cutting to required lengths, meters slays at
ends, welds and all drilling and counter sinking.
iv] The rates for fitting fabrics etc. are to include for all cutting, fitting and waste for equal
margins and for all "making good".
v] T.W. Beading/molding: The rate of all furniture items shall include cost of providing and
fixing T.,W. beading/molding etc as shown in respective drawings, even though not
mentioned in the description of the items.
vi] All exposed ward work shall be provided with melanin polish of approved shade even though
it may not include in the description of individual item.
vii] The rates for provision for furniture are to include for placing in position and protecting from
damage until handed over to the Owner.
viii] The rates for all paint work or polishing are to include for all preparation of surface, rubbing
down before each coat, all brushes and cleaning materials, submitting sample panels of paint
work for decoration is applied to general surfaces, analysis of any paint, if required, cutting
into line, multi calculated work, protecting fittings etc. necessary to leave everything clean
and perfect on completion.
ix] The rates for demolishing, making cut-out etc. in alteration work are to include for all
necessary supporting making cut out to floors, walls or soffits, making good and touching up
decorations and finishes all to match existing and make good all work disturbed.
x] The rate for "Upholstered" furniture shall include fixing of upholstery material as described
with all necessary material required for that fixing.

Maharashtra Medical Council.
ITEM RATE TENDER AND CONTRACT FOR WORKS.
GENERAL RULES AND DIRECTIONS FOR THE GUIDANCE OF CONTRACTORS
1. All work proposed to be executed by the contractor shall be notified in a form of invitation to tender
pasted on a board hung up in the office of MMC and signed by Registrar. This form will state the work to
be carried out as well as the date for submitting and opening tenders and the time allowed for carrying out
the work; also the amount of earnest money to be deposited with the tender and amount of security
deposit to be deposited by successful tenderer and the percentage, if any, to be deducted from bills. It will
also state whether a refund of quarry fees, royalties, octroi dues, and ground rents will be granted. Copies
of the specifications, designs and drawings and estimated rates, schedule rates and any other documents
required in connection with the work shall be signed by the Engineer/Architect for the purpose of
identification shall also be open for inspection by contractors at the office of the Engineer/Architect
during office hours. Where the works are proposed to be executed according to the specifications
recommended by the contractor and approved by a competent authority on behalf of the Maharashtra
Medical Council such specification with designs and drawings shall form part of accepted tenders.
2. In the event of the tender being submitted by a firm, it must be signed separately by each partner thereof or in the event of the absence of any partner, it shall be signed on his behalf by a person holding a power
of attorney authorising him to do so.
2 (A) i) The contractor shall pay online along with the tender Rs. 5,000/- Plus Service Tax at 14% (i.e.
Rs. 5,700/-) towards tender charges and Rs. 3,00,000/- towards earnest money. The said amount of
earnest money shall not carry any interest. The tender charges are non-refundable.
ii) In the event of his tender being accepted, subject to the provisions of sub- clause below, the said
amount of earnest money shall be appropriated towards the amount of Security Deposit payable by
him under the conditions of General Conditions of Contract.
iii) If, after submitting, the tender, the contractor withdraws his offer or modifies the same or if after
the acceptance of his tender the contractor fails or neglects to furnish the balance of Security Deposit,
without prejudice to any other rights and powers of the Maharashtra Medical Council hereunder
shall be entitled to forfeit the full amount of the earnest money deposited by him.
iv) In the event of his tender not being accepted, the amount of earnest money deposited by the
contractor shall, unless if prior thereto is forfeited under the provisions of sub clause (iii) above, be
refunded to him on his producing receipt thereof.

3. Receipts for payments made on account of any work, when executed by a firm, shall also be signed by
all the partners except where the contractors are described in their tender as a firm in which case the
receipts shall be signed in the name of the firm by one of the partners or by some other person having
authority to give effectual receipts for the firm.
4. Any person who submits a tender shall fill up a usual printed form stating at what percentage above or
below the rates specified in Schedule B (memorandum showing items of work to be carried out) he is
willing to undertake the work; only one rate of such percentage on all estimated rates/schedule rates
shall be named. Tenders which propose any alteration in the works specified in the said form of
invitation to tender, or in the time allowed for carrying out the work, or which contain any other
conditions will be liable to rejection.
5. The Registrar or his duly authorized Assistant shall open tenders in the presence of Contractors who
have submitted tenders or their representatives who may be present at the time and he will enter the
amounts of the several tenders in a comparative statement in a suitable form. In the event of a tender
being accepted, the contractor shall for the purpose of identification, sign copies of the specifications
and other documents mentioned herein. In the event of a tender being rejected, the Registrar, MMC
shall authorize the to refund the amount of the earnest money deposited by the contractor on his
making a request, and his giving back the receipt for the return original the money.
6. The officer competent to dispose off the tenders shall have the right of rejecting all or any of the
tenders.
7. No receipt for any payment alleged to have been made by a contractor in regard to any matter relating
to this tender or the contract shall be valid and binding on Maharashtra Medical Council unless there
is documentary proof thereof.
8. All work shall be measured by standard measure and according to the acceptable rules and customs.
10. Under no circumstances shall any contractor be entitled to claim enhanced rates for any items in this
contract.
11. Every contractor shall, produce along with his tender a solvency certificate from the Collector of the
District within which he resides or a banker's certificate of his financial stability. If he fails to produce
such a certificate his tender will not be considered.
12. All corrections and additions should be initialed by tenderer.
13. The measurements of work will be taken according to the usual method in use and no proposals to
adopt alternative method will be accepted. The Engineer/Architect's decision as to what is the usual
method in use will be final & binding on the contractor.
14. The tendering contractor shall furnish a declaration along with the tender showing all works for which
he has already entered into contract and the value of the work that remains to be executed in each case
on the date of submitting the tender.
15. Every tenderer shall submit along with tender information regarding the income tax circle, or ward or
the district in which he is assessed to income-tax, the reference to the number of the assessment and
assessment year.

16. Price escalation is not payable under this contract which please be noted.
17. The tender offer will be binding on the tenders for a period of 100 (hundred) days from the date fixed
for opening of tenders and thereafter until it is withdrawn by notice in writing duly addressed to the
Authority receiving the tender.
