2 1 (c) FIVE YEAR LIBRARY PLAN

It was agreed that the 5 year Library Plan would be presented to An Chomhairle at a Special Meeting of Whole Council in Committee. It was further agreed that a date for this Special Meeting would be discussed at the next meeting of the Party Whips.

2. MINUTES

An Chomhairle considered minutes of Ordinary Meeting of An Chomhairle held on 24th October, 2005. Comhairleoir D. Wallace raised the issue of accuracy of minutes in relation to item 17.5. Comhairleoir D. Wallace proposed and Comhairleoir S. Martin seconded that the minutes be amended to reinstate the original wording of the motion at item 17.5.

An tArdmhéara declared the vote carried. An Chomhairle agreed to amend the motion at item17.5 of the Minutes of the Ordinary Meeting of An Chomhairle held on 24th October, 2005 to read as follows:-

‘That Cork City Council put in place a co-ordinated strategy involving key departments to work closely with local communities and other state agencies, to address the social and economic inequalities that still exist on the Northside of Cork City and in particular in the North West Ward with a view to the social and capital gain of the area.’

3 3. QUESTION TIME

3.1 RECYCLING MATERIAL – GREENSTAR DEPOT

In response to question submitted by Comhairleoir J. Kelleher, a written reply was circulated which stated that Cork City Council collects dry recyclables from householders and transports same to a licenced facility operated by Greenstar. The materials are sorted into the relevant material streams such as paper, cardboard, plastic and metals. Each stream is baled and transported to facilities for final processing at locations in Ireland and the UK. All materials are dealt with on site in accordance with EPA requirements.

Mixed paper and cardboard is converted into packing material and can be reprocessed up to eight times. Plastics are converted into a pellet form which is further converted into lumber material for use in manufacture of plastic decking, parking cones, tables, waste bins etc. Aluminium metal is recycled repeatedly without losing its quality (e.g. aluminium cans etc) Steel cans can also be recycled similar to aluminium. As stated above the end products are manufactured in locations in Ireland and UK.

3.2 DEVELOP RECREATION AND AMENITY PARK – KEMPTON PARK/

MEELICK PARK, BALLYVOLANE

In response to question submitted by Comhairleoir C. Clancy, a written reply was circulated which stated that following consultation with local residents,a final draft plan has been agreed to further develop the park fronting Meelick Park/Kempton Park incorporating playground, walkways, seating etc. It is expected to commence the Part 8 Planning Process within the next few days, with work scheduled for commencement in the Spring.

3.3 RECYCLING MATERIALS COLLECTED BY CORK CITY COUNCIL

In response to question submitted by Comhairleoir M. Ahern, a written reply was circulated which stated that the materials collected for recycling are sorted at the licenced Greenstar facility in Glanmire. The materials are sorted in the relevant streams and are ultimately converted into usable product in Ireland and the UK. Greenstar were appointed following a procurement procedure by public advertisement and are paid on a per tonne basis in accordance with the accepted tender.

Cork City Council does not receive payment for these materials from the selected tenderer.

Approximately 4,600 tonnes were processed in Year 1 of the project and payment was made in accordance with the approved tender at a rate of €70 per tonne + VAT and at a rate of €180.00 per tonne + VAT for residual waste. Residual Waste in this context amounts to approximately 5% of total waste throughput.

4 3.4 CONCRETE BOLLARDS ON KILMORE ROAD

In response to question submitted by Comhairleoir T. Fitzgerald, a written reply was circulated which stated that Plans are at an advanced stage to construct a low plinth wall with decorative railings on top along the green area fronting Kilmore Road, similar to perimeter railings around Gerry O Sullivan Park. Work is scheduled to commence in January.

3.5 LEISUREWORLD

In response to question submitted by Comhairleoir C. O’ Leary, a written reply was circulated which stated that The Board of Leisureworld comprises representatives of Cork City Council, City of Cork VEC, the County Council, swimming interests etc with all members being appointed in a voluntary capacity i.e they do not receive remuneration for being Board members. Any queries in relation to the Board of the company should be directed to Leisureworld, as the Council does not interfere in how the company arranges its affairs. Leisureworld does pay water charges to the Council.

3.6 WORK IN POPHAMS FIELD

In response to question submitted by Comhairleoir D. McCarthy, a written reply was circulated which stated that erection of perimiter railing has been completed at Pophams Field. A contractor is on site installing a playground at present, but has been delayed in recent weeks because of bad weather. A multi user play area and perimeter paths will also be constructed shortly. It is expected all works will be completed by early January and the new park open to the public at that stage.

3.7 GREEN ROUTE FROM THE AIRPORT TO CORK CITY CENTRE

In response to question submitted by Comhairleoir S. Martin, a written reply was circulated which stated that the full programme of work for the Airport Green Route includes: • Installation of bus priority measures by the use of bus lanes, bus gate and bus

priority at traffic signals • New traffic signals at various junctions • Upgrading of bus stops and bus shelters • Installation of pedestrian crossing facilities • Improvement of road surfacing • Upgrading of footpaths • Installation of cycle facilities including cycle tracks and advance stop lines • Improvement of public lighting.

The contract is almost complete and the ‘snagging’ stage is about to begin. The tender price for the contract was €2.3 million and is fully funded by the Department of Transport.

5 3.8 PARK AND RIDE FOR THE NORTH SIDE

In response to question submitted by Comhairleoir A. Spillane, a written reply was circulated which stated that a preliminary design for a Park & Ride facility is currently being carried out at Tinker’s Cross. A previous preliminary/feasibility design was previously carried out at Banduff, just east of Mayfield Cross.

Cork County Council/Iarnrod Eireann have also engaged a firm of consulting engineers to investigate the feasibility of a Park & Ride facility at the train station at Dunkettle. Further feasibility studies for Park & Ride sites at Kilbarry and Blarney as per CASP recommendations will be carried out in due course.

3.9 RESIDENTS PARKING PERMIT

In response to question submitted by Comhairleoir T. O’ Driscoll, a written reply was circulated which stated that Each applicant for a residents parking permit must complete the application form and submit the following documentation:

1) A copy of the Vehicle Licensing Certificate / Log Book for the vehicle – the

vehicle must be registered to the address for which the parking permit is being sought.

2) Two recent domestic Utility Bill or Financial Documents in the name for the

address for which the permit is being sought (i.e. electricity, gas, landline telephone, Credit Card Bill, Bank Account Statement, Credit Union Statements).

3) A copy of car insurance certificate – the address on the insurance certificate

must be the same as the address for which the permit is being sought.

4) A copy of the driving licence.

If a person lives in rented accommodation they must also supply the following in addition to the above:

5) A copy of the Rent Book/Rental Agreement and a copy of the confirmation

letter from the Private Residential Tenancies Board (PRTB) acknowledging the registration of the tenancy with the PRTB.

If the applicant is not on the register to vote from the address for which the parking permit is being sought the declaration on the reverse side of the form must be fully completed, signed & stamped in the presence of a Peace Commissioner /Commissioner for Oaths or Practising Solicitor in Cork City/County.

6 3.10 OUTSTANDING WATER BILLS

In response to question submitted by Comhairleoir M. Barry, a written reply was circulated which stated that

(a) The City Council provides water services to approximately 4,200 non-

domestic customers. Of these approximately 60% have paid while 1,800 accounts are in arrears. The total outstanding at present is approximately €5.5.m

(b) We do not have any sub-classification of the non-domestic accounts so cannot

say how much is due by the voluntary/community sector but it would only be a small percentage of the total.

(c) The largest outstanding amount is €153,380.93.

The five largest outstanding accounts amount to €730,000 The ten largest outstanding accounts amount to €1,072,000

(d) To date 129 customers have been visited regarding disconnection but it has not

proved necessary to proceed with any disconnection as customers have paid or entered into appropriate agreements to pay. A small number of these customers have raised queries which are being resolved. Up to 30th September 2005 we had received €2.9m in respect of Water. Since 1st October, we have received a further €2.3m While this is very encouraging, we are continuing our policy of enforcement to ensure that we secure our income and this will involve disconnection of supply if necessary.

3.11 PARKING FINES ISSUED IN GRENVILLE PLACE, HENRY STREET

In response to question submitted by Comhairleoir M. O’ Connell, a written reply was circulated which stated that

1. Parking fines issued in Grenville Place, Henry Street on 25/10/05: 9. 2. Parking fines issued so far this year:

Grenville Place 346 Henry Street 780.

3. Corbett Tyres No.9 Henry Street does not have special parking permits. 4. The Traffic Division did not give permission to Corbett Tyres to cordon off

4/5 parking places with large tractor tyres. This matter will be investigated. 5. The traffic wardens were not instructed not to issue parking fines to cars

illegally parked outside Corbett Tyres. Parking enforcement in the area is carried out in similar fashion to all other parts of the City.

7 3.12 HIGH COURT DECISION ON TENANT PURCHASE

In response to question submitted by Comhairleoir C. Lynch, it was agreed to defer question to the next meeting of An Chomhairle to be held on 28th November, 2005.

3.13 TEMPORARY PARK AND RIDE FACILITIES FOR THE CHRISTMAS

PERIOD

In response to question submitted by Comhairleoir J. Buttimer, a written reply was circulated which stated that (i) In addition to the normal Monday – Saturday service, the Black Ash Park &

Ride facility will be opened on the three Sundays proceeding Christmas to facilitate increased shopper demand.

A temporary Park & Ride facility is also to be provided at the County Hall car park on the Carrigrohane Road on Saturdays and Sundays during December, and for the first weekend in January. Use will be made of the County Council staff multi-storey car park which is available at weekends. A bus shuttle service will drop and pick up customers on the Grande Parade.

(ii) Cork City Council has a range of initiatives to support the Christmas and New

Year shopping period.

In addition to the infrastructural refurbishments of the City Centre which resulted in the St. Patrick’s Street being awarded Best Shopping Street in the country two years running, the City Council has funded 80% of the provision of new Christmas lights on St. Patrick’s Street which will be further enhanced this year.

Adding to the festive season in the City Centre, a range of events for the Closing of the European Capital of Culture year is being organised in conjunction with Cork 2005 including the switching on of the lights on the 27th November, Journey’s of Light on the 11th December and a fireworks display on the 31st December.

In relation to parking facilities, the City Council’s multi-storey car park at Paul Street and Kyrl’s Quay will have increased opening hours including Sunday opening for the Christmas period. The Black Ash Park & Ride facility will be opened on the three Sundays preceding Christmas to facilitate increased shopper demand. Based on current usage spare capacity of approximately 300 spaces exists during the week at the Park and Ride.

8It is proposed to advertise the traffic management and parking facilities (including private sector car parks which also open on Sundays) widely in newspapers in the Cork and Munster region. Additionally, the investment of the City Council in Green Bus Routes will facilitate access to the City Centre.

Finally, it is proposed to introduce the pedestrianisation of Oliver Plunkett Street, Maylor Street and adjoining streets with effect from the 21st November 2005 which will further enhance the City Centre as a shopping attraction.

4. SUSPENSION OF STANDING ORDERS

Comhairleoir C. O’ Leary called for a suspension of Standing Orders to discuss Anti-Social Behaviour in Cork City. On the proposal of Comhairleoir T. Shannon, seconded by Comharleoir P. Gosch, An Chomhairle unanimously agreed to hold a Special Meeting of An Chomhairle on Monday, 21st November, 2005 at 7p.m. to discuss the issue of Anti-Social Behaviour.

5. SKATEBOARDING

An Chomhairle considered the report of the City Manager on Skateboarding dated 10th November, 2005. Comhairleoir C. Burke proposed and Comhairleoir M. O’ Connell seconded that further consideration be deferred for a period of two weeks to enable consultation to take place. A vote was called for where there appeared as follows: FOR: Comhairleoirí C. An tArdmhéara declared the vote defeated.

An Chomhairle approved the report of the City Manager dated 10th November, 2005. The report of the City Manager stated that there is a need to provide skateboarding facilities in the city to cater for young people who engage in this sport. In the absence of suitable facilities skateboarding is occurring on the city streets and squares and in the environs of public buildings. Complaints have been received from members of the public and from traders with regard to problems which arise from skateboarding in inappropriate places. Complaints have also been received about damage being caused to stonework on steps at the Washington Street Courthouse and at other public buildings.

Members have requested that bye-laws be introduced to deal with the problems being caused by skateboarders using the public streets. This is feasible but, I have advised

9earlier that before bye-lays are introduced that purpose built facilities for skateboarders should be in place. An earlier proposal to provide skateboarding facilities at Kennedy Park on Victoria Road was not favoured by the City Council. It is now proposed to provide skateboarding facilities on amenity zoned land at the Mardyke on land owned by the Council. A map of this site will be forwarded under separate cover. This land is already used as a public amenity and has the correct zoning. It is not far from the city and only a short distance from the Washington Street Courthouse where skateboarding is occurring at present. It is on the city bus route and is open and overlooked by the public. The new riverside walkway from North Mall through the old Distillery to the Mardyke leads directly to the site. It is also convenient to Fitzgerald’s Park.

Money is available to fund the project and it is proposed to proceed immediately with the provision of this much needed facility. While the project is under construction, bye-laws will be prepared to deal with the inappropriate use of skateboarding in the city centre. The bye-laws will come before the Council for formal adoption and it is recommended that the implementation date should coincide with the completion of the new skateboarding facilities at the Mardyke.

6. CONTINUATION OF MEETING

An Chomhairle agreed to continue the meeting beyond 8p.m. and agreed unanimously that the meeting would finish at 9p.m.

7. MONITORING GROUP OF R.A.P.I.D.

An Chomhairle agreed to defer the nomination of the two members to fill the vacancy on the Monitoring Group of R.A.P.I.D. following the resignations of Comhairleoir J. Kelleher and Comhairleoir J. O’ Brien to the next meeting of An Chomhairle to be held on 28th November, 2005.

8. CORK CITY ENTERPRISE BOARD

On the proposal of Comhairleoir D. Wallace, seconded by Comhairleoir T. Shannon, it was agreed to nominate Comhairleoir D. Counihan to Cork City Enterprise Board to fill the vacancy arising from the resignation of Comhairleoir G. O’ Flynn.

9. MOTIONS REFERRED FROM MEETING OF AN CHOMHAIRLE HELD ON

26TH SEPTEMBER, 2005

An Chomhairle approved the following motions which were deferred from the meeting of An Chomhairle held on the 10th October, 2005:-

10 9.1 ACKNOWLEDGE SPONSORS/CONTRIBUTORS TO CORK 2005 An Chomhairle approved the following motion:-

‘That Cork City Council would devise an appropriate means of acknowledging the generous contribution of a number of sponsors/contributors who through their support enabled our City to Celebrate its designation as European Capital of Culture 2005 with energy and style.’

It was also agreed to refer this motion to the Recreation, Amenity & Culture Functional Committee for further discussion and for this committee to report back to An Chomhairle with a recommendation on the best means of acknowledgement.

9.2 20 MOORE STREET - HERITAGE OF OUR COUNTRY An Chomhairle approved the following motion:-

‘That Cork City Council urges the Government to acquire, develop, and maintain no. 20, Moore St. as a valued and essential part of the Heritage of our Country.’

(Proposer: Cllr. M. Quill 05/304) 10. MOTIONS REFERRED FROM MEETING OF AN CHOMHAIRLE HELD ON

24TH OCTOBER, 2005 10.1 RE-DESIGNED PLAZA IN BLACKPOOL VILLAGE

An Chomhairle agreed to refer the following motion to the Party Whips for discussion: ‘That the re-designed Plaza in Blackpool Village be named after the noted stone carver Seamus Murphy. He designed the nearby church of the Annunciation. The Church also contains many of his stone carvings. He also carried out his work in the area with his workshop on the Watercourse Rd.’

It was also agreed that the Party Whips would make a recommendation on the naming of Public Places and report back to An Chomhairle in two months for further discussion.

Members approved the report of the Director of Services dated 12th October, 2005 on the following motion which was referred to the Committee by An Chomhairle. An Chomhairle further approved the recommendation of the Recreation, Amenity & Culture Functional Committee that Leisureworld be asked to make one price for access to the swimming pool/slide. “That Cork City Council would abolish the 70 cent charge for the use of the children’s slide at the Churchfield Leisure Complex Swimming Pool.”

Barry 05/324) The report of the Director of Services stated that the slide requires constant supervision whilst in use with a staff member on duty at the top and bottom of the slide at all times and that this incurred extra costs over and above the normal operation of the swimming pool was also considered.

The report of the Director of Services stated that the site was not suitable for further pitch development and that the nearby Na Piarsaigh Club have plans to develop a full All Weather Pitch shortly. The report also stated that the Parochial Hall opposite the Sam Allen Centre has a full size indoor hall suitable for basketball and that the nearby Scoil Mhic Suibhne Community Hall in Knocknaheeny was also capable of

11.6 OUTDOOR CHESS AS AN AMENITY

‘That Cork City Council Recreation, Amenity and Culture Directorate would include

Outdoor Chess as an amenity in the development of “Pophams Field”.

‘Following the recent High Court decision (Wednesday 2 November 2005), regarding the right of residents to make tenant purchases from Dun Laoghaire & Rathdown County Council at 1996 property price values, Cork City Council will:

1. Examine to see if Cork City Council is now open to a similar High Court challenge following the precedent set by this case.

2. Examine to see if there are tenants of Cork City Council, including those living in flats, who made applications to Cork City Council, before and during this period, still waiting to buy their homes, with a view to getting legal advice as to what is each party’s situation resulting from this judgement.

3. And that in the event of a comparable situation in Cork City Council being in place which lead to that of this High Court ruling, Council will immediately take whatever necessary steps to speedily resolve the matter.’
