requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.
AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.
Whenrulesarefirstdrafted,stateagenciespublishthemasProposedRules,alongwithanoticeofhearing,oranoticeofintenttoadoptruleswithoutahearinginthecaseofnoncontroversialrules.Thisnoticeasksforcommentontherulesasproposed.Proposedemergencyrules,andwithdrawnproposedrules,arealsopublishedintheStateRegister.Afterproposedruleshavegonethroughthecommentperiod,andhavebeenrewrittenintotheirfinalform,theyagainappearintheStateRegisterasAdoptedRules.Thesefinaladoptedrulesarenotprintedintheirentirety,butonlythechangesmadesincetheirpublicationasProposedRules.Toseethefullrule,asadoptedandineffect,apersonsimplyneedstwoissuesoftheStateRegister,theissuetheruleappearedinasproposed,andlaterasadopted.

Exempt RulesExemptrulesareexcludedfromthenormalrulemakingprocedures(Minnesota Statutes§§14.386and
14.388).Theyaremostoftenoftwokinds.OnekindisspecificallyexemptedbytheLegislaturefromrulemakingprocedures,butapprovedforformbytheRevisorofStatutes,reviewedforlegalitybytheOfficeofAdministrativeHearings,andthenpublishedintheStateRegister.Theseexemptrulesareeffectivefortwoyearsonly.
ThesecondkindofexemptruleisoneadoptedwhereanagencyforgoodcausefindsthattherulemakingprovisionsofMinnesota Statutes,Chapter14areunnecessary,impracticable,orcontrarytothepublicinterest.Thisexemptioncanbeusedonlywheretherules:

Today,theHennepinCountyDistrictCourtheardclosingargumentsinthetrialofformerpoliceofficerDerekChauvin.TheanticipatedverdictintheChauvintrialandthefatalpoliceshootingofDaunteWrighthaveraisedthepotentialoffurthercivilunrestintheseven-countymetropolitanareaofAnoka,Carver,Dakota,Hennepin,Ramsey,Scott,andWashingtoncounties.SinceApril11,2021,whenDaunteWrightdiedafterbeingshotbyapoliceofficer,manyMinnesotanshaveexpressedtheirfrustrationsinapeacefulandconstructivemanner.However,someindividualshaveengagedinunlawfulanddangerousactivity,includinglootinganddamagingpublicandprivateproperty.Theseactivitiesthreatenthesafetyoflawfuldemonstrators,peopleinthesurroundingcommunities,andfirstresponders.Assuch,localandstateresourceshavebeenreallocatedtoassistintheunrestinBrooklynCenterandnearbycommunities.ThisreallocationhasdrawnresourcesawayfromthecitiesofMinneapolisandSaintPaul,andnearbycommunities,wherethereisathreatofcivilunrest.
OperationSafetyNet,ajointplanningandresponseeffortbetweentheStateofMinnesotaandmanylocaljurisdictionstocoordinateandsendresources,continuestooperate.OnFebruary5,2021,inExecutiveOrder21-06,IactivatedtheMinnesotaNationalGuardtosupportpublicsafetyandsecurity,andtorespondtopotentialcivilunrestduringandaftertheChauvintrial.Asaresult,theNationalGuardiscurrentlyonstateactivedutyandauthorizedtorespondtocivilunrest.TheNationalGuardcansupplementlocallawenforcementeffortstokeepthepeace,ensurepublicsafety,andallowforpeacefuldemonstrations.
Localandstateresourceshavebeenfullydeployed,buttheyareinadequatetoaddressthethreat.RecenteventsinBrooklynCenterhaveexhaustedMinnesota’slocalandstateresourcesandarelikelytohamperourabilitytoprovidepublicsafetyandprotectcriticalinfrastructureandkeyresourcesintheseven-countymetroareainthecomingweek.Forthesereasons,theChiefsofPoliceinthecitiesofMinneapolisandSaintPaulandtheSheriffsofDakota,Hennepin,andRamseycountieshaveallrequestedthattheStateseekassistancefromotherstatespursuanttotheEmergencyManagementAssistanceCompact(“EMAC”).ThispeacetimeemergencydeclarationallowstheStatetoreceiveEMACassistancefromotherstates.
