Minnesota Rules: Amendments and AdditionsNOTICE:HowtoFollowStateAgencyRulemakingintheStateRegisterTheStateRegisteristheofficialsource,andonlycompletelisting,forallstateagencyrulemakinginitsvariousstages.Stateagenciesare

requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.

AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.

Rules to be Adopted After a Hearing.Afterreceivingcommentsanddecidingtoholdapublichearingontherule,anagencydraftsitsrule.Itthenpublishesitsruleswithanoticeofhearing.Allpersonswishingtomakeastatementmustregisteratthehearing.Anyonewhowishestosubmitwrittencommentsmaydosoatthehearing,orwithinfiveworkingdaysofthecloseofthehearing.Administrativelawjudgesmay,duringthehearing,extendtheperiodforreceivingcommentsupto20calendardays.Forfivebusinessdaysafterthesubmissionperiodtheagencyandinterestedpersonsmayrespondtoanynewinformationsubmittedduringthewrittensubmissionperiodandtherecordthenisclosed.Theadministrativelawjudgepreparesareportwithin30days,statingfindingsoffact,conclusionsandrecommendations.Afterreceivingthereport,theagencydecideswhethertoadopt,withdrawormodifytheproposedrulebasedonconsiderationofthecommentsmadeduringtherulehearingprocedureandthereportoftheadministrativelawjudge.Theagencymustwaitfivedaysafterreceivingthereportbeforetakinganyaction.

Rules to be Adopted Without a Hearing. Pursuant to Minnesota Statutes§14.22,anagencymayproposetoadopt,amend,suspendorrepealruleswithoutfirstholdingapublichearing.AnagencymustfirstsolicitComments on Planned Rules or Comments on Planned Rule Amendmentsfromthepublic.Theagencythenpublishesanoticeofintenttoadoptruleswithoutapublichearing,togetherwiththeproposedrules,intheState Register. If,duringthe30-daycommentperiod,25ormorepersonssubmittotheagencyawrittenrequestforahearingoftheproposedrules,theagencymustproceedundertheprovisionsof§§14.1414.20,whichstatethatifanagencydecidestoholdapublichearing,itmustpublishanoticeofintentintheState Register.

Introduction.TheMinnesotaBoardofExecutivesforLongTermServicesandSupports(“Board”)intendstoadoptruleswithoutapublichearingfollowingtheproceduresintherulesoftheOfficeofAdministrativeHearings,Minnesota Rules,parts1400.2300to1400.2310,andtheAdministrativeProcedureAct,Minnesota Statutes,sections14.22to14.28.

If,however,25ormorepersonssubmitawrittenrequestforahearingontherulesby4:30p.m.onDecember30,2020theBoardwillholdapublichearingviaWebex,onFebruary23,2021.AnAdministrativeLawJudgewillconductthehearingstartingat9:30a.m.onFebruary23,2021.

TheBoardlicensesandregulatesnursinghomeadministratorsintheStateofMinnesota.OnMay22,2019,GovernorWalzsignedintolawMinnesotaHouseFile90(“H.F.90”),whichultimatelybecameMinn.Stat.§144A.20,subdivisions1and4andwhichrequirestheBoardtolicenseandregulatethepracticeofassistedlivingdirectorsinMinnesota.TheBoardisamendingitsrulestoprovideaframeworkforlicensingandregulatingthepracticeofassistedlivingdirectorsinMinnesota.Theproposedrulechangesfallintothefollowingthreecategories:(1)technicalamendmentstoexistingdefinitionandscoperules;(2)newrulesmodeledentirelyonexistingLNHArules;and(3)newrulesdeviatingfromexistingLNHArules.

Statutory Authority.MinnesotaStatutessection144A.20,.21,.23,.24,and214.06authorizetheBoardtoadoptrulesnecessarytoadministerandenforcesections144A.04through144A.28.MinnesotaStatutessection214.12,subdivision1,authorizesallhealth-licensingboardstopromulgatebyrulecontinuingeducationrequirements.Moreover,asnotedabove,MinnesotaStatutessection144A.20,subdivisions1and4,passedduringthe2019legislativesession,authorizedtheBoardtolicenseandregulateLALDs.

Withdrawal of Requests.If25ormorepersonssubmitavalidwrittenrequestforahearing,theBoardwillholdapublichearingunlessasufficientnumberofpersonswithdrawtheirrequestsinwriting.Ifenoughrequestsforhearingarewithdrawntoreducethenumberbelow25,theBoardmustgivewrittennoticeofthistoallpersonswhorequestedahearing,explaintheactionstheBoardtooktoaffectthewithdrawal,andaskforwrittencommentsonthisaction.Ifapublichearingisrequired,theBoardwillfollowtheproceduresinMinnesota Statutes,sections14.131to14.20.

Modifications.TheBoardmightmodifytheproposedrules,eitherasaresultofpubliccommentorasaresultoftherulehearingprocess.ItmustsupportmodificationsbydataandviewssubmittedtotheBoardorpresentedatthehearing.TheadoptedrulesmaynotbesubstantiallydifferentthantheseproposedrulesunlesstheBoardfollowstheprocedureunder Minnesota Rules,part1400.2110.Iftheproposedrulesaffectyouinanyway,theBoardencouragesyoutoparticipateintherulemakingprocess.

Cancellation of Hearing.TheBoardwillcancelthehearingscheduledforFebruary23,2021,iftheBoarddoesnotreceiverequestsforahearingfrom25ormorepersons.Ifyourequestedapublichearing,theBoardwillnotifyyoubeforethescheduledhearingwhetherthehearingwillbeheld.Youmayalsocalltheagencycontactpersonafterthecommentperiodendstofindoutwhetherthehearingwillbeheld.

Proposed Rules (1) ensurethattheALDIRcomplieswiththedomainsofpracticeandNABadministratorintrainingmanual; (2) ensurethattheALDIRhasexperiencewithprofessionalpracticeanalysis;and (3) notsuperviseanALDIRwhoisarelatedindividualorwhoresidesintheimmediatehouseholdofthementor. Subp.3. Duration. Beforebeginningthefieldexperience,theALDIRmustcompleteaself-assessmentprescribedbytheboardthatidentifiestopicswhereeducation,experience,andtrainingareneeded.TheALDIRmustsharetheresultsoftheself-assessmentwiththementorandallowthementortoprovideinputintotheself-assessment.Thementormustdeterminethedurationofthefieldexperience,with480hoursrecommendedbutaminimumof320hoursrequiredandamaximumof1,000hoursallowed,andthefocusofthefieldexperiencebasedonthetopicsidentifiedintheself-assessment. Subp.4. Contents and topics for field experience. Regardlessoftheareasidentifiedintheself-assessment,thefieldexperiencemustinclude,butneednotbelimitedto,thefollowing: A. exposuretoallareasofoperationswithintheassistedlivingfacilitytoprovidetheALDIRwithknowledgeofallfunctionsoftheassistedlivingfacility; B. reviewofthefindingsandresultsofregulatoryinspectionsandresponsesoftheassistedlivingfacility; C. observationoftheintegrativeandadministrativeroleofthedirectorthroughattendancewiththedirectoratmeetingswithstaff,families,governingbodies,communitygroups,residentcouncils,andothergroups; D. observationoftherelationshipsbetweentheassistedlivingfacilityandcommunityandotherhealthcareprovidersandorganizationsoperatinginthecontinuumofhealthcare; E. participationinaqualityassuranceandperformanceimprovementproject;and F. completionofamajorproject,study,orresearcheffortdesignedtoimproveoperationsattheassistedlivingfacilityorprovideinformationuponwhichamajordecisionfacingtheassistedlivingfacilityanditsmanagementcanbemade. Subp.5. Completion of self-assessment. Attheendofeachfieldexperienceandaspartofthelicensureprocess,theALDIRandthementormustprovideevidencetotheboardofsuccessfulrecompletionoftheboard-approvedself-assess-mentandremediationofanyareasidentifiedasdeficient. 6400.7040 COURSE PROVIDER REVIEW. Subpart1. Program review and approval. Uponrequestofacourseprovider,theboardshallreviewcoursecontentofferedbythecourseprovider,anduponfindingconformitybetweentheproposedprogramandtherequirementsofthischapter,shallapprovethecourseproviderasofferingcourseswhichmeetallofthecourserequirementsforlicensure. Subp.2. Requesting course review. Whensubmittingaprogramofstudyofferedbyacourseprovidertomeetthecourserequirements,thecourseprovidershallprovidethefollowinginformationinanapplicationfortheboard’sreview: A. designationofaprogramdirectortocoordinatethecourseprovider’sprogramorcourseofferingswiththeboard.Iftheprogramdirectorbelievesthatcoursesfromstudentstransferringintothecourseprovider’sprogramorcoursesfromstudentsenrolledintheprogramwhocannotarrangeclassschedulestopermittimelycompletionoftheboard-approvedcoursesareequivalentincontenttothoseacceptedbytheboardtofulfillthecourserequirementsinparts6400.7015and6400.7020,theprogramdirectormustsubmitthestudents’equivalentcoursestotheboard.Theboardmustdeterminethatthecoursesareequivalentincontenttofulfillthecourserequirementsinparts6400.7015and


Proposed Rules6400.7020; B. evidenceoftheestablishmentanduseofanadvisorygroupofassistedlivingdirectorsandothersinthelong-termcareindustry,includingthenamesandexperienceofgroupmembersandthefrequencyofmeetings,toreviewcourserequirementsandpracticumactivities; C. apublishedmarketingdescriptionofthecourseofstudyofferedorrecommendedbytheproviderforthoseinterestedinlicensureasanassistedlivingdirectorinMinnesota.Nothinginthischapterrestrictscourseprovidersfromdesigningorimplementingcurricula,orestablishingrequirementsforcourses,majors,orotherdesignationsofferedbytheinstitution,morecomprehensivethanrequiredunderthischapterforlicensure; D. atopic-by-topicreviewofhoweachcourseofferedbythecourseprovidermeetstherequirementsinparts6400.7015and6400.7020; E. anoutlineofeachcourseofferedbythecourseprovidertofulfilloneormoreofthelicensurecourserequire-ments,listingtextsandmaterialsusedinthecourse;and F. identificationofoneormorecourseprovidersto: (1) coordinatedirectorintrainingfieldexperiencesforstudents;and (2) provideinstructiontoanydirectorbecomingamentorforthefirsttimeregardingobjectivesforthedirectorintrainingorevidenceofuseofNAB’smentortrainingmodules. Subp.3. Review and approval process. Uponreceiptofanapplicationpackageforapprovalofacourseprovider’sprogramtomeetboardcourserequirements,theboardshallacknowledgereceiptoftherequestandidentifyanymissingrequirementstotheprogramdirector.Uponreceiptofallrequiredinformation,theboardshallreviewallmaterialspre-sentedandmayrequestanappearancebyoneormorerepresentativesoftheprogramatameetingtoreviewallmaterialforconformancetorequirements.Boardmembersshallbasetheirdecisiontoapproveorrejectthecourseprovider’sprogramonwhetherornottheapplicationmaterialspresentedprovideassurancethatstudentscompletingthepro-gramwillcoverthecoursetopicsoutlinedinparts6400.7015and6400.7020withsufficientdepthtoenabletheboardtoinferstudentattainmentoftheknowledge,skills,andabilitiestobeginworkasanassistedlivingdirector.Iftheapplica-tionpackageanddiscussionwithprogramofficialsfailtoshowcompliancewithparts6400.7015and6400.7020ortoprovidesufficientevidencetosatisfytheboardmembersthattheycaninferbeginning-levelcompetencyamongstudentscompletingtheproposedcourse,theboardshallnotifytheprogramdirectorinwritingofthedeficienciesthecourseprovidermustremedy.Oncealldeficienciesaresatisfactorilyremedied,theboardshallgrantapprovaltothecourseproviderinwritingandincludereferencetothecourseprovider’sofferingsinitscorrespondencewithstudentsinterestedinlearningwherecoursesapprovedbytheboardtomeetlicensurerequirementsareavailable.Ifthedeficienciesarenotcorrected,theboardshalldenyapprovalforthecourseprovider’sprogrambywrittennoticetotheprogramdirector. Subp.4. Annual review. AnnuallyonorbeforeSeptember1,theprogramdirectorofacourseproviderwithanapprovedprogramorcoursesshallfilewiththeboardonformsprescribedbytheboardforthatpurposeareportindicat-ing: A. anychangesinanyoftheinformationpresentedtosatisfytherequirementsoutlinedinthispartsincetheinitialapplicationorsincetheupdatedreportoftheprecedingyear;and B. totheextentavailable,ascheduleofwhenthroughouttheyeartheapprovedcourseswillbeofferedbythecourseproviderorthelinktotheelectroniccoursewebsite. Subp.5. Five-year course provider review. A. Everyfifthyearfollowingtheboard’sinitialapprovalofacourseprovider’sprogramorcourses,theprogramdirectorshallprovideacompletereviewofthecourseprovider’sprogrambysubmittingtotheboardbySeptember1of


Proposed Rulesthefifthyearareviewapplicationpackageinthesameformatandincorporatingthesameinformationasrequiredinsubpart2foranewprogramapprovalapplication.Whennochangehasoccurredsincetheinitialapplication,theprogramdirectormaysubmitacopyoftheinitiallysubmittedinformationwithanupdateddateandattestationthattheinformationiscurrent. B. Theboardshallreviewthefive-yearprogramreviewpackagesubmittedbythecourseproviderandapproveordenycontinuedboardapprovalfortheprogramasprovidedinsubpart3.Whentheboardfindsitnecessarytodenycontinuedapprovaltoaprogramortospecificcourses,theboardshallprovideinformationtotheprogramdirectoraboutwaysinwhichstudentscurrentlyenrolledintheprogrammayobtainsupplementaryoralternativecoursestocompletetherequirementsforlicensureinviewoftherevocationofapprovalforcoursesofferedbythecourseprovider.Theprogramdirectorshallprovidetheinformationtoallstudentsenrolledinthepreviouslyapprovedprogramorcoursesandshallworkwiththestudentstoprovideasmoothtransitiontoalternativecourseprovidersofferingapprovedcourses. C. Inadditiontothefive-yearprogramreview,iftheboardreceivesinformationthatthesuccessratesfallbelowthenationalaverageforcandidatesfromtheprogramwho,duringtheannualreviewperiod,wroteforthefirsttimethenationalexaminationforassistedlivingdirectorsdevelopedbyNAB,theboardmusttakeoneoftheactionsdescribedinsubitems(1)to(3): (1) ifsuccessratesarebelowthenationalaverageforoneperiod,theboardshallrequiretheprogramdirectortoidentifyfactorsthatpotentiallyaffectthelowsuccessrateofthelicensureexamination.Thedirectorshallsubmitaplanofcorrectiveactionbyaspecifieddate.Theplanofactionmustbeonaboard-suppliedformandincludethesigna-tureoftheprogramdirectorandanothercourseproviderrepresentative.Ifduringthefollowingyearthesuccessrateisabovethenationalaverage,noactionbytheboardisrequired; (2) ifthesuccessratesarebelowthenationalaveragefortwoconsecutiveperiods,theboardshallnotifytheprogramdirectorofasurveytoidentifyadditionalfactorsaffectingthelowsuccessrateandreviewprogressontheplanforcorrectiveactionsubmittedthepreviousyear.Thesurveymustincludethedirector,presenters,students,andacoursepresenterrepresentative.Theprogramdirectorshallsubmitarevisedplanofcorrectiveactionbyaspecifieddate.Theplanofcorrectiveactionmustbeonaboard-suppliedformandincludethesignaturesoftheprogramdirectorandcourseproviderrepresentative.Ifduringthefollowingyearthesuccessrateisabovethenationalaverage,noactionisrequiredbytheboard;or (3) ifsuccessratesarebelowthenormalaverageforthreeconsecutiveperiods,theboardshallrequiretheprogramdirectorandanothercourseproviderrepresentativetomeetwithacommitteeofboardmembersandboardstaffforasurveyforcompliancewithallapplicablerulesandfortheimplementationoftheplanforcorrectiveactionsubmit-tedthepreviousyear.Uponcompletionofthesurvey,theboardshalltakeactionaccordingtosubpart3.

LICENSES AND PERMITS 6400.7045 ENDORSEMENT. Subpart1. License; assisted living director. Theboardshallissueanassistedlivingdirectorlicensetoanindividualwhohasbeenissuedandcurrentlyholdsalicenseasanassistedlivingdirectorinanotherjurisdictionif: A. theotherjurisdictionmaintainsrequirementsforassistedlivingdirectorlicensurethatareequivalenttothoserequiredunderpart6400.7005ortheapplicantiscurrentlylicensedasanassistedlivingdirectorandprovidestheboardevidenceofhavingsuccessfullycompletedaprofessionalprograminassistedlivingadministrationendorsedbyNABorapprovedbytheboard; B. theapplicanthassuccessfullycompletedacoursecoveringthecourserequirementsinpart6400.7020; C. theapplicanthaspassedtheMinnesotastateexaminationwithintheimmediatepasttwoyears; D. theapplicantisingoodstandingasanassistedlivingdirectorineachjurisdictionfromwhichtheapplicanthaseverreceivedanassistedlivingdirectorlicense;and

TheboardshallissueanassistedlivingdirectorlicensetoanindividualwhohasbeenissuedandcurrentlyholdsalicenseasanursinghomeadministratorinMinnesotaoranotherjurisdictioniftheindividual: A. providestheboardevidenceofhavingsuccessfullycompletedaprofessionalprograminassistedlivingadmin-istrationendorsedbyNABorapprovedbytheboard; B. hassuccessfullycompletedacoursecoveringtheMinnesotacourserequirementsinpart6400.7020,unlesstheapplicantgraduatedfromaneducationalinstitutionapprovedbytheboard; C. haspassedtheMinnesotastateexaminationwithintheimmediatepasttwoyears; D. isingoodstandingasanursinghomeadministratorineachjurisdictionfromwhichtheapplicanthaseverreceivedanursinghomeadministratorlicense;and E. hasappliedforlicensureunderpart6400.7010andpaidtheapplicablefees. 6400.7050 LICENSEE RESPONSIBILITIES.

Eachlicenseeshall:

A. complywiththelawsofMinnesotaandtherulesoftheboardandotherMinnesotastateagenciesregardinglicensureasanassistedlivingdirectorandoperationofanassistedlivingfacilityinMinnesota; B. providenoticetotheboardwithinfiveworkingdaysofanychangeine-mailaddress,mailingaddress,ortele-phonenumberpursuanttoMinnesotaStatutes,section13.41,subdivision2,paragraph(b); C. providenoticetotheboardwithinfiveworkingdaysofanychangeinemploymentasanassistedlivingdirec-torforanassistedlivingfacility; D. notifytheboardwithinfiveworkingdaysofanyformaldisciplinaryactionorchargeagainstanylicensethelicenseeholdsasanassistedlivingdirector,healthservicesexecutive,orotherhealthcareprofessionalinMinnesotaoranyotherjurisdiction; E. cooperatewiththeboardbyprovidingdata,reports,orinformationrequestedbytheboardthatisrelevanttotheboard’slicensureanddisciplinaryauthorityandcomplyingwithrequeststoattendconferences,meetings,orhearingsscheduledbytheboardconcerninglicenserenewalorcomplaintinvestigationsanddiscipline; F. provide,whenrequested,adefineddelegationofauthority,inthecaseofdirectorabsences,ateachassistedlivingfacilitywherethelicensedassistedlivingdirectorservesasdirector;and G. beresponsibleforthegeneraladministrationandmanagementoftheassistedlivingfacilityandoverseetheday-to-dayoperationoftheassistedlivingfacility.Thisincludesresponsibilityfor: (1) ensuringthatservicesandsupportareprovidedtoresidentsinamannerthatprotectstheirhealth,safety,andwell-beingandisconsistentwithresidents’rights,includingtherighttochoosetorefuseservices; (2) maintainingcompliancewithapplicablelawsandregulations; (3) developingandimplementingallpolicies,procedures,andservicesrequiredinMinnesotaStatutes,chapter144G;


Proposed Rules (4) ensuringstaffandvolunteerscomplywithresidents’rights; (5) maintainingbuildingsandgrounds; (6) recruiting,hiring,training,andsupervisingstaff;and (7) ensuringthedevelopment,implementation,andmonitoringofanindividualized,person-centeredplanofcareforeachresident,regardlessoftheinternalorcontractedservicemodel. 6400.7055 DISPLAYING LICENSES.

Alicenseeactivelypracticingshalldisplaytheboard-issuedlicense,notaphotocopy,inaconspicuousplaceintheassistedlivingfacilitythatthelicenseedirects,thatisvisibletoresidentsandvisitors.

6400.7060 DUPLICATE LICENSES.

Uponreceiptofanotarizedstatementfromalicenseethatthelicensee’slicensehasbeenlost,mutilated,ordestroyed,orthatthelicenseehashadanamechange,theboardshallissueaduplicatelicense.Alicenseemayalsoapplyforadu-plicatelicensetodisplayateachassistedlivingfacilitywherethelicenseeservesastheassistedlivingdirectorunderthischapter.Licenseesobtainingduplicatelicensesaresubjecttotheapplicablefee.

6400.7065 RENEWING LICENSES. Subpart1. Forms; time for renewal. Everyindividualwhoholdsavalidlicenseissuedbytheboardshallannu-allyapplytotheboardonorbeforeOctober1forrenewaloftheindividual’slicenseandshallreportanyinformationpertinenttocontinuedlicensurerequestedbytheboard.Theapplicantshallsubmitevidencesatisfactorytotheboardandsubjecttoauditunderpart6400.7090,subpart3,thatduringtheannualperiodimmediatelyprecedingtherenewalapplicationthelicenseehascompliedwiththerulesoftheboardandcompletedcontinuingeducationrequirementsforlicenserenewal. Subp.2. Fees. Uponmakinganapplicationforlicenserenewal,thelicenseeshallpaytheannualfee.IfsubmittingCEcreditswhichincludeclockhoursforworkshops,seminars,institutes,orhomestudycourseswhichhavenotbeenpreap-provedbytheboard,thelicenseeshallalsopayafeeforreviewofclockhoursbaseduponthetotalnumberofnon-pre-approvedclockhoursbeingsubmittedforCEcredittomeetrenewalrequirements.IftheapplicationforrenewalhasnotbeenreceivedbyOctober31ofeachyear,thelicenseshalllapseandtheholderofalapsedlicenseshallbesubjecttothereinstatementprocedureandlaterenewalfees. Subp.3. Exemption from renewal. PursuanttoMinnesotaStatutes,section326.56,alicenseewhoisinactiveser-vice,asdefinedinMinnesotaStatutes,section190.05,forthearmedforcesoftheUnitedStatesorisemployedoutsideoftheUnitedStatesinemploymentthatisessentialtotheprosecutionofanywarorthenationaldefense,accordingtoMinnesotaStatutes,section326.56,andwhoselicensewasineffectatthetimeofentryintothearmedforcesorengage-mentinemploymentoutsidetheUnitedStates,isnotobligatedtorenewlicensure.Theboardmustbenotifiedinwritingbythelicenseeregardingthequalificationsforthisexemption.Theexemptionceasessixmonthsafterdischargefromactiveserviceorterminationoftheaforementionedemployment.Alicenserenewalnoticeshallbesenttothelicenseeatthetimethatalicenserenewalnoticewouldnormallybesenttothelicensee.Thelicenseemayberequestedtoreconfirmexemptstatus.Ifthelicenseenolongerqualifiesfortheexemption,therequirementsforlicenserenewalmustbemet. 6400.7070 LICENSE REINSTATEMENT.

AnassistedlivingdirectorpreviouslylicensedinthisstatewhoselicensehaslapsedmayapplyunderitemsAtoCforreinstatementofalicensewithinfiveyearsofthedatetheindividualwaslastlicensed.Ifanindividual’slicensehasbeenrevokedoriftheindividualhasnotbeenlicensedforfiveyearsormore,thelicensecannotbereinstatedbuttheformerlicenseemayapplyforrelicensureundertherequirementsinpart6400.7010.

Uponrequestandpaymentofafeeunderthischapterbythelicensee,theboardshallissueacertifiedstatementofthelicensee’slicensurestatusandexaminationscorestoanotherjurisdiction.

6400.7080 ASSISTED LIVING DIRECTOR IN RESIDENCE PERMITS. Subpart1. Board to issue permits. WhenthecontrollingindividualsofanassistedlivingfacilitydesignateanAL-DIRunderthispart,thedesigneemustsecureapermitwithin30daysofthedesignation.Tosecureapermit,theALDIR


Proposed Rulesmustdesignateonthepermitapplicationthepersonwhowillserveasamentorduringthedirectorinresidencefieldex-perience.Theboardshallissueapermittoserveanassistedlivingfacilityasanassistedlivingdirectorinresidenceforuptooneyear.ApermittoserveasanALDIRisnotrenewablebeyondtheoneyearforwhichitwasissued. Subp.2. Qualifications. AnapplicantforapermittoserveanassistedlivingfacilityasanALDIRmustfurnishsatis-factoryevidencethattheapplicant: A. hasgraduatedfromhighschoolorholdsageneraleducationdevelopment(GED)certificateofequivalentcompetency; B. hasexperienceinthemanagementofanassistedlivingfacilityorrelatedfacilityorprogramorisenrolledwithacourseprogramapprovedbytheboardwithinsixmonthsofdesignation; C. isingoodstandingineachjurisdictionfromwhichtheapplicanthaseverreceivedahealthcarelicense; D. hassuccessfullycompletedacriminalbackgroundcheckunderMinnesotaStatutes,section214.075;and E. hasestablishedamentorrelationship,includingprovidinginformationaboutthemodeandfrequencyofcom-municationbetweenthementorandtheassistedlivingdirectorinresidence. Subp.3. Responsibilities. Theassistedlivingdirectorinresidencemustmeetthelicenseeresponsibilitiessetforthinpart6400.7050. 6400.7085 SHARED DIRECTOR. A. Withapprovaloftheboard,anassistedlivingfacilitymaysharetheservicesofalicensedassistedlivingdirectororapermittedassistedlivingdirectorinresidence.Thedirectorordirectorinresidencemustmaintainanon-sitepresencetoadminister,manage,andsuperviseeachassistedlivingfacilityandmeetthedomainsofpracticeaccordingtotherequirementsofthischapter. B. Within15daysafterassumingtheposition,theshareddirectorordirectorinresidencemustsubmitanappli-cationtoserveasashareddirector,onformsprovidedbytheboard.Allapplicationsforashareddirectorarrangementmustbesignedbyalegalrepresentativeofthefacility,suchastheassistedlivingfacility’sboardchairorowner,orbyacontrollingindividual. C. Theboardshallconsiderthefollowingcriteriatodeterminewhethertoapprovethesharedarrangement: (1) educationandexperienceofthedirectororassistedlivingdirectorinresidence; (2) geographiclocationanddistancebetweenassistedlivingfacilities; (3) whethertheassistedlivingfacilitiessharecommonmanagementorcommonownership; (4) externalorregionaladministrativesupportandclinicalsupport; (5) numberofassistedlivingfacilitiestobeshared; (6) servicesprovidedateachassistedlivingfacility; (7) numberofresidentsateachassistedlivingfacility; (8) licensedstaffingateachassistedlivingfacility; (9) proposeddurationoftheshareddirectorarrangement;

Iftheproposedsharedassistedlivingfacilitiesarefiveorfewerinnumber,areallwithina60-mileradiusandhavecommonmanagement,andtheassistedlivingfacilities’licensesandthelicenseorpermitoftheproposeddirectorareingoodstanding,theboardshalladministrativelyapprovethesharedassistedlivingfacilityarrangement. E. TheboardshallreviewallsharedassistedlivingfacilityarrangementsapprovedordeniedadministrativeapprovalunderitemDattheboard’snextregularlyscheduledboardmeetingfollowingtheapprovalordenial.Theboardmustdetermine,accordingtothecriteriainitemC,whethertoratifytheadministrativeapprovalorapprovethesharedarrangementpreviouslydeniedadministrativeapproval. CONTINUING EDUCATION 6400.7090 CONTINUING EDUCATION REQUIREMENTS. Subpart1. Renewal requirements. Atthetimeoflicenserenewal,eachlicenseeshallprovideevidencetotheboardthatthelicenseehascompletedintheprecedingtwoyears30continuingeducationcreditsofcontinuingeducationactivitiesasspecifiedinthispartandMinnesotaStatutes,section144A.20,subdivision4,paragraph(c).LicenseesintheirfirstyearoflicensureshallhavethenumberofCEcreditsrequiredforlicenserenewalproratedforthenumberofmonthstheywerelicensedduringtheprecedingyear.ForpurposesofobtainingandpresentingCEcredits,ayearrunsfromSeptember1toAugust31. Subp.2. Evidence of continuing education requirement completion. Continuingeducationrequiredtomaintainanotherpro-fessionallicense,suchasanursinghomeadministratorlicense,nursinglicense,socialworkerlicense,mentalhealthpro-fessionallicense,orrealestatelicense,maybeusedtosatisfytherequirementsofsubpart4whenapprovedbytheboard.TheboardshallapprovecontinuingeducationcreditsunderthissubpartwhenthecontinuingeducationisrelatedtothedomainsofpracticeofassistedlivingasidentifiedintheNABjobanalysisforassistedlivingdirectors. Brown’s Creek Watershed DistrictRequest for Qualifications for Engineering Consulting Services for Calendar Years 2021-2023

1. IntroductionTheBrown’sCreekWatershedDistrict(BCWD)isthegovernmentalunitwithprimaryresponsibilityforprotecting

thewaterresourcesoftheBrown’sCreekWatershed.TheDistrictwasestablishedin1997undertheMinnesotaWatershedDistrictAct.

TheDistrictcoversapproximately18,000acresthatdrainintoBrown’sCreek,whichthenenterstheSt.CroixRiver.ThewatershedincludesBrown’sCreek;aDNRdesignatedtroutstreamandseveralsmalltributaries.Thewatershedincludestwelvemajorlakesandnumerouswetlands.TheDistrictincludesportionsoftheCitiesofOakParkHeights,Grant,Hugo,LakeElmo,andStillwateralongwithMayandStillwaterTownships.

2. SolicitationMinnesotaStatutes,Section103B.227,Subdivision5,requireBCWDtosolicitproposalseverytwoyearstoprovide

4. Qualification Statement Content Firmsarerequestedtoincludeintheirqualificationstatement,thefollowinginformationintheorderlisted:

a. Abriefsummaryofthefirmsqualifications.b. Nameandphonenumberofthepersondesignatedtoanswerquestionsaboutthequalification

statement.c. AspecificlistoftheindividualswhowouldbeassignedtoworkandmanageBCWDprojects,their

proposedresponsibilities,technicalbackground,yearsofexperience,andtheirpreviousexperienceinservicingwatersheds.

d. Hourlyfeeschedulesbylaborcategoryandanestimatedmonthlyblendedretainerfeebasedupon66hoursoftypicalservices.

e. Submittalsmaynotexceed10pagesinlength.Submittalsthatexceed10pagesinlengthmaynotbeconsidered.

5. Selection ProcessBecausetheBCWDischargedwithmanagingaDNRDesignatedTroutStreamandmanyotheruniqueresources,

selectionwillemphasizecriteriathatindicateafirm’sexperienceandknowledgeofintegratedresourcemanagementapproachestowatershedmanagement.

QualificationstatementswillbeevaluatedbytheBoardofManagersandrankedbasedonthefollowingcriteria:

1. Experiencewithwatershedmanagementorganizationswithinthemetropolitanarea.2. Experiencewithinnovativeandalternativewatershedmanagementapproachesthatintegratewaterresources

engineeringwithnaturalresourcemanagement.3. Engineeringdesignandtimelyconstructionmanagementandinspection.4. Locallybasedfirmwiththeabilitytorespondtoemergencysituationsinthewatershedorsituationsthatwould

requireimmediateattention.5. Abilitytoworkwiththepublic,regulatoryagencies(includingDNR)andotherstakeholdersandtheabilityto

communicateeffectivelywiththeBCWDBoardofManagers,WatershedDistrictAttorneyandSWCDstaff.6. Permitting,planreviewandenvironmentalassessmentexperience.7. Interdisciplinarygroupofwaterresourcesprofessionalsthatcanprovidefullrangeofservicestothewatershed

(i.e.,surfacewater,groundwater,naturalresources,waterquality,engineering,etc.)8. TheBCWDBoardofManagersanticipatesmakingadecision,within30days,baseduponthesubmittals.

However,attheirdiscretion,theymaychoosetoconductinterviewsafterreviewingtheproposals.
