Minnesota Rules: Amendments and AdditionsNOTICE:HowtoFollowStateAgencyRulemakingintheStateRegisterTheStateRegisteristheofficialsource,andonlycompletelisting,forallstateagencyrulemakinginitsvariousstages.Stateagenciesare

Regardlessoftheareasidentifiedintheself-assessment,thefieldexperiencemustinclude,butneednotbelimitedto,thefollowing: A. exposuretoallareasofoperationswithintheassistedlivingfacilitytoprovidetheALDIRwithknowledgeofallfunctionsoftheassistedlivingfacility; B. reviewofthefindingsandresultsofregulatoryinspectionsandresponsesoftheassistedlivingfacility; C. observationoftheintegrativeandadministrativeroleofthedirectorthroughattendancewiththedirectoratmeetingswithstaff,families,governingbodies,communitygroups,residentcouncils,andothergroups; D. observationoftherelationshipsbetweentheassistedlivingfacilityandcommunityandotherhealthcareprovidersandorganizationsoperatinginthecontinuumofhealthcare; E. participationinaqualityassuranceandperformanceimprovementproject;and F. completionofamajorproject,study,orresearcheffortdesignedtoimproveoperationsattheassistedlivingfacilityorprovideinformationuponwhichamajordecisionfacingtheassistedlivingfacilityanditsmanagementcanbemade. Subp.5. Completion of self-assessment. Attheendofeachfieldexperienceandaspartofthelicensureprocess,theALDIRandthementormustprovideevidencetotheboardofsuccessfulrecompletionoftheboard-approvedself-assess-mentandremediationofanyareasidentifiedasdeficient. 6400.7040 COURSE PROVIDER REVIEW. Subpart1. Program review and approval. Uponrequestofacourseprovider,theboardshallreviewcoursecontentofferedbythecourseprovider,anduponfindingconformitybetweentheproposedprogramandtherequirementsofthischapter,shallapprovethecourseproviderasofferingcourseswhichmeetallofthecourserequirementsforlicensure. Subp.5. Five-year course provider review. A. Theboardshallreviewthefive-yearprogramreviewpackagesubmittedbythecourseproviderandapproveordenycontinuedboardapprovalfortheprogramasprovidedinsubpart3.Whentheboardfindsitnecessarytodenycontinuedapprovaltoaprogramortospecificcourses,theboardshallprovideinformationtotheprogramdirectoraboutwaysinwhichstudentscurrentlyenrolledintheprogrammayobtainsupplementaryoralternativecoursestocompletetherequirementsforlicensureinviewoftherevocationofapprovalforcoursesofferedbythecourseprovider.Theprogramdirectorshallprovidetheinformationtoallstudentsenrolledinthepreviouslyapprovedprogramorcoursesandshallworkwiththestudentstoprovideasmoothtransitiontoalternativecourseprovidersofferingapprovedcourses. C. Alicenseeactivelypracticingshalldisplaytheboard-issuedlicense,notaphotocopy,inaconspicuousplaceintheassistedlivingfacilitythatthelicenseedirects,thatisvisibletoresidentsandvisitors.

6400.7060 DUPLICATE LICENSES.

Uponreceiptofanotarizedstatementfromalicenseethatthelicensee’slicensehasbeenlost,mutilated,ordestroyed,orthatthelicenseehashadanamechange,theboardshallissueaduplicatelicense.Alicenseemayalsoapplyforadu-plicatelicensetodisplayateachassistedlivingfacilitywherethelicenseeservesastheassistedlivingdirectorunderthischapter.Licenseesobtainingduplicatelicensesaresubjecttotheapplicablefee.

6400.7065 RENEWING LICENSES. Subpart1. Forms; time for renewal. Everyindividualwhoholdsavalidlicenseissuedbytheboardshallannu-allyapplytotheboardonorbeforeOctober1forrenewaloftheindividual’slicenseandshallreportanyinformationpertinenttocontinuedlicensurerequestedbytheboard.Theapplicantshallsubmitevidencesatisfactorytotheboardandsubjecttoauditunderpart6400.7090,subpart3,thatduringtheannualperiodimmediatelyprecedingtherenewalapplicationthelicenseehascompliedwiththerulesoftheboardandcompletedcontinuingeducationrequirementsforlicenserenewal. Subp.2. Fees. Uponmakinganapplicationforlicenserenewal,thelicenseeshallpaytheannualfee.IfsubmittingCEcreditswhichincludeclockhoursforworkshops,seminars,institutes,orhomestudycourseswhichhavenotbeenpreap-provedbytheboard,thelicenseeshallalsopayafeeforreviewofclockhoursbaseduponthetotalnumberofnon-pre-approvedclockhoursbeingsubmittedforCEcredittomeetrenewalrequirements.IftheapplicationforrenewalhasnotbeenreceivedbyOctober31ofeachyear,thelicenseshalllapseandtheholderofalapsedlicenseshallbesubjecttothereinstatementprocedureandlaterenewalfees. AnapplicantforapermittoserveanassistedlivingfacilityasanALDIRmustfurnishsatis-factoryevidencethattheapplicant: A. hasgraduatedfromhighschoolorholdsageneraleducationdevelopment(GED)certificateofequivalentcompetency; B. hasexperienceinthemanagementofanassistedlivingfacilityorrelatedfacilityorprogramorisenrolledwithacourseprogramapprovedbytheboardwithinsixmonthsofdesignation; C. isingoodstandingineachjurisdictionfromwhichtheapplicanthaseverreceivedahealthcarelicense; D. hassuccessfullycompletedacriminalbackgroundcheckunderMinnesotaStatutes,section214.075;and E. hasestablishedamentorrelationship,includingprovidinginformationaboutthemodeandfrequencyofcom-municationbetweenthementorandtheassistedlivingdirectorinresidence. Subp.3. Responsibilities. Theassistedlivingdirectorinresidencemustmeetthelicenseeresponsibilitiessetforthinpart6400.7050. 6400.7085 SHARED DIRECTOR. A. Withapprovaloftheboard,anassistedlivingfacilitymaysharetheservicesofalicensedassistedlivingdirectororapermittedassistedlivingdirectorinresidence.Thedirectorordirectorinresidencemustmaintainanon-sitepresencetoadminister,manage,andsuperviseeachassistedlivingfacilityandmeetthedomainsofpracticeaccordingtotherequirementsofthischapter. B. Within15daysafterassumingtheposition,theshareddirectorordirectorinresidencemustsubmitanappli-cationtoserveasashareddirector,onformsprovidedbytheboard.Allapplicationsforashareddirectorarrangementmustbesignedbyalegalrepresentativeofthefacility,suchastheassistedlivingfacility’sboardchairorowner,orbyacontrollingindividual. C. Theboardshallconsiderthefollowingcriteriatodeterminewhethertoapprovethesharedarrangement: (1) educationandexperienceofthedirectororassistedlivingdirectorinresidence; (2) geographiclocationanddistancebetweenassistedlivingfacilities; (3) whethertheassistedlivingfacilitiessharecommonmanagementorcommonownership; (4) externalorregionaladministrativesupportandclinicalsupport; (5) numberofassistedlivingfacilitiestobeshared; (6) servicesprovidedateachassistedlivingfacility; (7) numberofresidentsateachassistedlivingfacility; (8) licensedstaffingateachassistedlivingfacility; (9) proposeddurationoftheshareddirectorarrangement;

D. Iftheproposedsharedassistedlivingfacilitiesarefiveorfewerinnumber,areallwithina60-mileradiusandhavecommonmanagement,andtheassistedlivingfacilities’licensesandthelicenseorpermitoftheproposeddirectorareingoodstanding,theboardshalladministrativelyapprovethesharedassistedlivingfacilityarrangement. E. TheboardshallreviewallsharedassistedlivingfacilityarrangementsapprovedordeniedadministrativeapprovalunderitemDattheboard’snextregularlyscheduledboardmeetingfollowingtheapprovalordenial.Theboardmustdetermine,accordingtothecriteriainitemC,whethertoratifytheadministrativeapprovalorapprovethesharedarrangementpreviouslydeniedadministrativeapproval. F. Iftheboardapprovestherequesttoserveasashareddirector,thelicenseeorpermitholdermust: (1) establishproceduresanddelegateauthorityforon-siteoperationsinthedirector’sorassistedlivingdirec-torinresidence’sabsence; (2) beavailabletostaffateachassistedlivingfacilitythatthelicenseeorpermitholderdirects; (3) postateachassistedlivingfacilityaboard-issuedlicenseorpermitinaconspicuousplacewithintheassistedlivingfacility; (4) postateachassistedlivingfacilitytheproceduretocontactthepersoninchargeonthepremisesintheabsenceofthedirectororassistedlivingdirectorinresidence;and (5) makecommunicationplansavailabletoresidents,families,andstaffateachassistedlivingfacilitythelicenseeorpermitholderdirects. G. Iftheboarddoesnotapprovetherequesttoserveasashareddirector,theboardshallprovidethedirectorwrittennoticeoftheboard’sdecisionandaremediationplan.

CONTINUING EDUCATION 6400.7090 CONTINUING EDUCATION REQUIREMENTS. Subpart1. Renewal requirements. Atthetimeoflicenserenewal,eachlicenseeshallprovideevidencetotheboardthatthelicenseehascompletedintheprecedingtwoyears30continuingeducationcreditsofcontinuingeducationactivitiesasspecifiedinthispartandMinnesotaStatutes,section144A.20,subdivision4,paragraph(c).LicenseesintheirfirstyearoflicensureshallhavethenumberofCEcreditsrequiredforlicenserenewalproratedforthenumberofmonthstheywerelicensedduringtheprecedingyear.ForpurposesofobtainingandpresentingCEcredits,ayearrunsfromSeptember1toAugust31. Subp.2. Evidence of continuing education requirement completion. Licenseesmustmaintainproofasdescribedinpart6400.7091ofhavingcompletedthenumberofCEcreditsclaimedatthetimeofrenewalandshall,uponrequestoftheboard,makethatproofavailableforaudittoverifycompletionofthenumberandvalidityofcreditsclaimed.Docu-mentationtoprovecompletionofCEcreditsmustbemaintainedbyeachlicenseeforfouryearsfromthelastdayofthelicensureyearinwhichthecreditswereearned.

Subp.4. Acceptable content for continuing education activities. Unlessotherwisespecifiedinpart6400.7091,thecontentofcontinuingeducationactivitiesmustrelatetooneormoreofthefollowing: A. administrationofservicesforpersonsneedinglong-termservicesandsupports; B. currentissuesandtrendsinlong-termservicesandsupportsandassistedlivinglicensure; C. therelationshipoflong-termservicesandsupportstootheraspectsofthehealthcarecontinuum;and D. responsibilities,tasks,knowledge,skills,andabilitiesrequiredtoperformassistedlivingdirectorfunctionsasoutlinedintheNABdomainsofpractice. Subp.5. Credits to maintain another professional license. Continuingeducationrequiredtomaintainanotherpro-fessionallicense,suchasanursinghomeadministratorlicense,nursinglicense,socialworkerlicense,mentalhealthpro-fessionallicense,orrealestatelicense,maybeusedtosatisfytherequirementsofsubpart4whenapprovedbytheboard.TheboardshallapprovecontinuingeducationcreditsunderthissubpartwhenthecontinuingeducationisrelatedtothedomainsofpracticeofassistedlivingasidentifiedintheNABjobanalysisforassistedlivingdirectors. Subp.6. Unacceptable content for continuing education activities. Subjectsforcontinuingeducationthatarenotacceptabletomeetlicenserenewalrequirementsinclude: A. generalpersonaldevelopmentincludingstressmanagement; B. assistedlivingfacilityorcompanyorientation; C. assistedlivingfacilityorcompanypoliciesorproceduralissues; D. organizationalfunctionssuchasbusinessmeetingsandelectionofofficers; E. medicaltreatmentataclinicallevelbeyondthatrequiredforlicensureasanassistedlivingdirector;and F. anyothersubjectunrelatedtocontentspecifiedundersubpart4. Subp.7. Requirements in specified subjects. Theboardshall,whencompelledbyadvancementinscopeofpracticeoremerginglong-termservicesandsupportsissues,andbypublicwrittennoticetoeachlicenseeonorbeforeSeptember1,requirealllicenseestoattendcontinuingeducationprogramsinspecifiedsubjects. 6400.7091 NUMBER OF CE CREDITS FOR ACTIVITIES.

AcceptableactivitiestomeetcontinuingeducationrequirementsforlicenserenewalandthenumberofcontinuingeducationcreditsthatlicenseesmayobtainforeacharedescribedinitemsAtoK.

Alicenseewhopassesacademiccoursesapplicabletothedomainsofpracticetakenatanaccreditedpostsec-ondaryinstitutionshallreceivenineCEcreditsperquartercreditand12CEcreditspersemestercredit.Toverifypassageofacademiccourses,thelicenseemustmaintainacopyofanacademictranscriptshowingthecoursegradeandthedateitwasawarded. F. Alicenseewhowritesanarticleonatopicrelatedtolong-termcareservicesandsupportsthatispublishedinanationalperiodicalshallreceivetwoCEcreditsforanarticleof500to1,000wordsandoneadditionalcreditforeachadditional500wordstoamaximumoftenCEcreditsperyear.Toverifypublication,thelicenseemustmaintainacopyoftheperiodicalcontainingthepublishedarticle. G. BACKGROUNDEachyearaharvestablesurplusissetforwalleyeinLakeMilleLacsbyajointmanagementprocessbetweenthe

stateandtheeightChippewaBandsthataresignatoriestotheTreatyof1837.TheharvestablesurplusisthepoundsoffishthatcanbetakensafelyfromLakeMilleLacswhileensuringsufficientwalleyeremaininthelakeforahealthypopulation.Theharvestablesurplusfor2021,whichisallocatedbetweentheStateofMinnesotaandtheeightChippewaBands,willnotbedetermineduntilJanuary2021.However,theMinnesotaDepartmentofNaturalResources(DNR)isconfidentthattheharvestablesurpluswillbesimilartothe2020harvestablesurplus;therefore,forthewinter2020/2021fishingseason,stateanglersmaytakealimitedharvestabovetheincidentalkillratethatoccursfromcatchandreleasefishing.Thewinter2020/2021fishingseasonwillcommenceDecember1,2020,andextendthroughFebruary28,2021,withtheharvestrestrictionsoutlinedintheorderbelow.ThisdecisionisbasedontheresultsofrecentfisheriessurveysthatindicatetheMilleLacswalleyefisherycanaccommodatealimitedharvestduringtheicefishingseasonandstaywithintheprojectedstateshareofthe2021harvestablesurplus.
