Minnesota Rules: Amendments and AdditionsNOTICE: How to Follow State Agency Rulemaking in the State RegisterThe State Register is the official source, and only complete listing, for all state agency rulemaking in its various stages. State agencies are required to

publish notice of their rulemaking action in the State Register. Published every Monday, the State Register makes it easy to follow and participate in the important rulemaking process. Approximately 80 state agencies have the authority to issue rules. Each agency is assigned specific Minnesota Rule chapter numbers. Every odd-numbered year the Minnesota Rules are published. Supplements are published to update this set of rules. Generally speaking, pro-posed and adopted exempt rules do not appear in this set because of their short-term nature, but are published in the State Register.

An agency must first solicit Comments on Planned Rules or Comments on Planned Rule Amendments from the public on the subject matter of a possible rulemaking proposal under active consideration within the agency (Minnesota Statutes §§ 14.101). It does this by publishing a notice in the State Register at least 60 days before publication of a notice to adopt or a notice of hearing, or within 60 days of the effective date of any new statutory grant of required rulemaking.

When rules are first drafted, state agencies publish them as Proposed Rules, along with a notice of hearing, or a notice of intent to adopt rules without a hearing in the case of noncontroversial rules. This notice asks for comment on the rules as proposed. Proposed emergency rules, and withdrawn proposed rules, are also published in the State Register. After proposed rules have gone through the comment period, and have been rewritten into their final form, they again appear in the State Register as Adopted Rules. These final adopted rules are not printed in their entirety, but only the changes made since their publication as Proposed Rules. To see the full rule, as adopted and in effect, a person simply needs two issues of the State Register, the issue the rule ap-peared in as proposed, and later as adopted.

The State Register features partial and cumulative listings of rules in this section on the following schedule: issues #1-13 inclusive; issues #14-25 inclusive (issue #26 cumulative for issues #1-26); issues #27-38 inclusive (issue #39, cumulative for issues #1-39); issues #40-52 inclusive, with final index (#1-52, or 53 in some years). An annual subject matter index for rules was separately printed usually in August, but starting with Volume 19 now appears in the final issue of each volume. Adopted RulesA rule becomes effective after the requirements of Minnesota Statutes §§ 14.05-14.28 have been met and five working

days after the rule is published in the State Register, unless a later date is required by statutes or specified in the rule. If an adopted rule is identical to its proposed form as previously published, a notice of adoption and a citation to its previ-ous State Register publication will be printed. If an adopted rule differs from its proposed form, language which has been deleted will be printed with strikeouts and new language will be underlined. The rule's previous State Register publication will be cited.

5219.0500 INDEPENDENT MEDICAL EXAMINATION FEES.[For text of subps 1 to 3, see M.R.]

Subp. 4. Adjustments. On October 1, 1994, and on October 1 of each succeeding year, the fees in this part must be adjusted by the percentage determined under Minnesota Statutes, section 176.645, in the same manner as the conversion factor of the relative value fee schedule is adjusted under Minnesota Statutes, section 176.136. This provision does not apply to expenses under subpart 3, item E, subitem (1). The fees shall be adjusted as follows:

Rural Hospital Capital Improvement Grant Program. Eligible hospitals are non-federal, not-for-profit, general acute care hospitals with 50 or fewer beds that are located in a rural area or in a community with a population of less than 15,000 and are outside the seven-county metropolitan area. Grant funds are for updating, remodeling or replacing aging hospital facilities and equipment necessary to maintain the operations of the hospital. Approximately $1.6 million is available. Applicants may apply for grants of up to $125,000.

The State Court Administrator’s Office (SCAO), of the Minnesota Judicial Branch (MJB), is using a competitive selection process to select the vendor responsible for delivering, implementing, and supporting the most appropriate telephony solution for Interactive Voice Response (IVR), Interactive Web Response (IWR), and Automated Call Distribution (ACD) for the Minnesota Court Payment Center (CPC), eFile Support Center and Self-Represented Litigant (SRL) Statewide Self Help Center.

This is a second solicitation to consider both on premise and off premise solutions and security and technology stack require-ments have been included. This project was intended to assist the following statewide operations in the State Court Administra-tor’s Office: Court Payment Center, eFile Support Center and Self-Help Center with improved and enhanced service delivery and ensure compliance regarding financial, legal, and audit controls. This project provides an opportunity to improve the technology that supports each of the aforementioned operations and simultaneously creates a seamless, efficient, stable, scalable, and da-ta-driven solution that serves customer inquiries quickly. Minnesota Department of Transportation (Mn/DOT) Notice of Disposition for a Portion of Rail Bank Property in Melrose

The State of Minnesota, acting through its commissioner of transportation, has ownership of the rail bank corridor, and is pro-posing a sale of a 50-foot strip of rail bank property to the City of Melrose, Stearns County. The total corridor width is currently 150 feet. This notice is published pursuant to Minnesota Statute 222.63, subd. 3, and Minnesota rules 8830.5820 and 8830.5840

The 50-foot strip, proposed for sale to the City, retains a 100 foot corridor for the railbank. The 50-foot strip of land is adjacent to the existing City of Melrose’s electrical substation on the rail bank corridor. The sale is 0.07 miles long and contains approximately 21,000 square feet. This rail bank line located in Melrose had its tracks removed and was acquired initially from the Burlington Northern Railroad in 1994.

The City requested the State to sell a strip of rail bank for economic development in the City. The State plans no conditions on the sale to the City. The sale would be for appraised value.

After sale of the rail bank strip to the City, the City plans to combine the rail bank parcel and electrical substation parcel, which would then create a larger parcel for the City’s use.

The State is reviewing the need for the sale and soliciting comments to the proposed sale of a portion of the rail bank.
