Date: November 6, 2019

Background:

Education codes 44256(b), 44258.2, and 44263 expand the authorization for holders of Multiple Subject and Single Subject credentials, referred to as Board Authorizations. Board Authorizations are assignment options provided to employing districts and counties. School districts may expand subject authorizations only to teachers who hold a full credential (i.e., non-emergency, waiver, provisional internship, short term staff permit or intern).

To teach in a subject area other than designated by the credential, a teacher must complete 12 semester units in the additional subject to be authorized for middle school. Teachers must complete 18 semester units in the additional subject to be authorized for high school.

Recommendations:

HOSPITALITY AND TOURISM YEAR 2 Approve the new regular status CTE capstone course outline for Avalon High School, Hospitality and Tourism Year 2. The new course outline reflects the Linked Learning guiding principles and the LBUSD Strategic Plan’s goals and objectives. In this course, students become familiar with strategies to build business and brand equity, asses marketing niches, and understand customer needs. The basic textbook recommended to support the implementation of this course is:

Hospitality Service, Reynold, Johnny S. and Chase, Dorothy, Goodheart-Wilcox.

This textbook meets the social compliance criteria for instructional materials established by the State of California. The course is proposed for high school graduation elective credit and is a required course in a technical sequence. In addition, this course will be submitted to UC for ‘g’ approval. 2. HEAD START AND EARLY HEAD START SERVICE AREA EXTENSION REQUEST Approve the request to expand the LBUSD recruitment and service area to include 90712, 90713 and 90704 for both Head Start and Early Head Start services. This would align the Head Start LBUSD service area with the District boundaries. The request will allow service of families who reside in those zip codes so that there is a more seamless transition between early care and education and elementary school. If granted, this request will allow the agency to explore the possibility of opening new centers and/or program services. There is no funding associated with this request or additional enrollment opportunities. The Head Start Policy Council approved the area extension request on 10/16/19. 3. REQUEST FOR LOCALLY DESIGNED OPTION- EARLY HEAD START CLASS RATIO

AND SIZE WAIVER Approve the submission of the request to the Office of Head Start for a locally designed option for class sizes in Early Head Start Classes; 1:3 (9 max group size) for child care partner sites. The smaller teacher-student ratios are ideal for very young children who are not yet mobile, have many needs for care, and are on a demand schedule. The Head Start Policy Council approved the request on 10/16/19.

One element of the settlement, now found in Education Code section 35186(d), provides that quarterly reports summarizing complaints by subject area be reported to the Governing Board and the County Superintendent of Schools. BUSINESS AND NON-­INSTRUCTIONAL OPERATIONS 3510 Green School Operations The Governing Board believes everyone has a responsibility to be a steward of the environment and desires to integrate environmental accountability into all district programs and operations. The Superintendent or designee shall develop strategies to promote district use of "green" school principles and practices in order to conserve natural resources, reduce the impact of district operations on the environment, and protect the health of students, staff, and the community. In developing such strategies and assessing the environmental conditions in district facilities and operations, the Superintendent or designee shall involve staff at all levels and with varying job responsibilities, including administrators, certificated staff, classified staff, students and community stakeholders. As appropriate, the Superintendent or designee may also consult with health professionals;; representatives of local governmental agencies, utilities, solid waste and recycling companies, and community organizations;; and/or others with expertise. COMMUNITY RELATIONS 1312.3 Uniform Complaint Procedures (UCP) This document contains rules and instructions about the filing, investigation and resolution of a Uniform Complaint Procedures (UCP) complaint regarding an alleged violation by Long Beach Unified School District of federal or state laws or regulations governing educational programs, including non-­compliance with laws relating to pupil fees and our Local Control and Accountability Plan (LCAP). This document presents information about how the District processes UCP complaints concerning particular programs or activities that are subject to the UCP. A UCP complaint is a written and signed statement by a complainant alleging a violation of federal or state laws or regulations, which may include an allegation of unlawful discrimination, harassment, intimidation, bullying or charging pupil fees for participation in an educational activity or non-­compliance with the requirements of our LCAP. A complainant is any individual, including a person's duly authorized representative or an interested third party, public agency, or organization who files a written complaint alleging violation of federal or state laws or regulations, including allegations of unlawful discrimination, harassment, intimidation, bullying and non-­compliance with laws relating to pupil fees or non-­compliance with the requirements of our LCAP. If the complainant is unable to put the complaint in writing, due to a disability or illiteracy, we shall assist the complainant in the filing of the complaint. The responsibilities of the District Long Beach Unified School District shall have the primary responsibility to ensure compliance with applicable state and federal laws and regulations. The District shall investigate and seek to resolve, in accordance with our UCP process, any complaints alleging failure to comply with applicable state and federal laws and regulations including, but not limited to, allegations of discrimination, harassment, intimidation, or bullying or noncompliance with laws relating to all programs and activities implemented by the District that are subject to the UCP. 1. Allegations of child abuse shall be referred to County Department of Social Services (DSS), Protective Services Division or appropriate law enforcement agency.

2. Health and safety complaints regarding a Child Development Program shall be referred to Department of Social Services for licensed facilities, and to the appropriate Child Development regional administrator for licensing-­exempt facilities.

3. Employment discrimination, harassment, intimidation or bullying complaints shall be sent to the State Department of Fair Employment and Housing (DFEH).

Pupil Fees A pupil fee is a fee, deposit, or other charge imposed on pupils, or a pupil's parents or guardians, in violation of state codes and constitutional provisions which require educational activities to be provided free of charge to all pupils without regard to their families' ability or willingness to pay fees or request special waivers. Educational activities are those offered by a school, school district, charter school, or county office of education that constitute a fundamental part of education, including, but not limited to, curricular and extracurricular activities. A pupil fee includes, but is not limited to, all of the following:

1. A fee charged to a pupil as a condition for registering for school or classes, or as a condition for participation in a class or an extracurricular activity, regardless of whether the class or activity is elective or compulsory, or is for credit.

2. A security deposit, or other payment, that a pupil is required to make to obtain a lock, locker, book, class apparatus, musical instrument, clothes, or other materials or equipment.

3. A purchase that a pupil is required to make to obtain materials, supplies, equipment, or clothes associated with an educational activity.

Local Control Accountability Plan (LCAP) The LCAP is an important component of the Local Control Funding Formula (LCFF), the revised school finance system that overhauled how California funds its K-­12 schools. Under the LCFF we are required to prepare an LCAP, which describes how we intend to meet annual goals for our pupils, with specific activities to address state and local priorities identified pursuant to California Education Code (EC) § 52060(d).

BP 1312.3 The UCP Annual Notice The District ensures annual dissemination of a written notice of complaint procedures to all students, employees, parents or guardians of its students, school and district advisory committee members, appropriate private school officials or representatives, and other interested parties that includes information regarding allegations about discrimination, harassment, intimidation, or bullying. The Long Beach Unified School District UCP Annual Notice shall also include information regarding the requirements of EC §§ 49010 through 49013 relating to pupil fees and information regarding the requirements of EC § 52075 relating to the LCAP. The UCP Annual Notice shall be in English and in the primary language, pursuant to section 48985 of the Education Code, or mode of communication of the recipient of the notice. Filing UCP Complaints When Filing Pupil Fees UCP Complaints A pupil fees complaint may be filed with the principal of a school or our superintendent or his or her designee. A pupil fees complaint and/or an LCAP complaint may be filed anonymously if the complaint provides evidence or information leading to evidence to support an allegation of noncompliance. A pupil fees complaint shall be filed no later than one year from the date the alleged violation occurred. When Filing State Preschool Health and Safety Issues UCP Complaints UCP complaints regarding state preschool health and safety issues pursuant to HSC section 1596.7925 shall include the following statements:

• File with the preschool program administrator or his or her designee.

• A state preschool health and safety issues complaint pursuant to HSC section 1596.7925 about problems beyond the authority of the preschool program administrator shall be forwarded in a timely manner, but not to exceed 10 working days to the appropriate local educational agency official for resolution.

• A state preschool health and safety issues complaint pursuant to HSC section 1596.7925 may be filed anonymously. A complainant who identifies himself or herself is entitled to a response if he or she indicates that a response is requested. A complaint form shall include a space to mark to indicate whether a response is requested. If Section 48985 of the Education Code is otherwise applicable, the response, if requested, and report shall be written in English and the primary language in which the complaint was filed.

• A complaint form for a state preschool health and safety issue pursuant to HSC section 1596.7925 shall specify the location for filing a complaint. A complainant may add as much text to explain the complaint as he or she wishes.

BP 1312.3 The Long Beach Unified School District will investigate all allegations of unlawful discrimination, harassment, intimidation or bullying against any protected group as identified in EC §§ 200 and 220 and Government Code (GC) § section 11135, including any actual or perceived characteristics as set forth in Penal Code (PC) § 422.55 or on the basis or a person’s association with a person or group with one or more of these actual or perceived characteristics in any program or activity we conduct, which is funded directly by, or that receives or benefits from any state financial assistance. BP 1312.3 The District ensures an attempt shall be made in good faith to engage in reasonable efforts to identify and fully reimburse all pupils, parents and guardians who paid a pupil fee within one year prior to the filing of the complaint. We shall report summarized data on the nature and resolution of all state preschool health and safety issues complaints on a quarterly basis to the county superintendent of schools and our board. The summaries shall be publicly reported on a quarterly basis at a regularly scheduled meeting of our board. The report shall include the number of complaints by general subject area with the number of resolved and unresolved complaints. The District is aware that all complaints and responses are public records. BP 1312.3 A complainant may appeal our Decision of a UCP complaint to the State Superintendent of Public Instruction (SSPI) or their Designee at the CDE regarding all specified federal and state educational programs subject to the UCP. To appeal all UCP complaint Decisions except State Preschool Health and Safety Issues the complainant must file a written appeal within 15 days of receiving the Decision to the SSPI. To appeal a UCP complaint Decision regarding State Preschool Health and Safety Issues the complainant must file a written appeal within 30 days of receiving the Decision to the SSPI. This appeal to the CDE must fully explain the basis for the appeal, stating how the facts of our Decision are incorrect and/or the law is misapplied. In addition the appeal shall be sent to CDE with: (1) a copy of the original locally filed complaint;; and (2) a copy of the Decision of this original locally filed complaint. The 2019-­2020 district reclassification criteria have been updated to align to the September 2019 guidance from the California Department of Education regarding changes to the summative English Language Proficiency Assessments for California (ELPAC) threshold scores and the policy decision to standardize the ELPAC criterion to inform English learner student reclassification decisions. This revised policy is supported by revised Administrative Regulation 6174 and Exhibit A which provide sites further guidance necessary to support implementation. INSTRUCTION BP 6174 Education for English Learners The Board of Education intends to provide English learners with challenging curriculum and instruction that develop full proficiency in English as rapidly and effectively as possible while facilitating student achievement in the district’s regular course of study. English learners shall be provided differentiated English language development instruction which is targeted to their English proficiency level. Such instruction shall be based on sound instructional theory, be aligned with state content standards, emphasize inquiry-­based learning and critical thinking skills, and be integrated across all subject areas. (cf. 6141 -­ Curriculum Development and Evaluation) (cf. 6161.1 -­ Selection and Evaluation of Instructional Materials) (cf. 6161.11 -­ Supplementary Instructional Materials) (cf. 6171 -­ Title I Programs) No middle or high school student who is an English learner shall be denied enrollment in any of the following: (Education Code 60811.8)

1. Courses in the core curriculum areas of reading/language arts, mathematics, science, and history-­social science, courses required to meet state and local high school graduation requirements, or courses required for middle school grade promotion. However, an English learner may be denied participation in any such course if the student has been enrolled in a school in the United States for less than 12 months or is enrolled in a program designed to develop the basic English skills of newly arrived immigrant students, and the course of study provided to the student is designed to remedy academic deficits incurred during participation and to enable the student to attain parity of participation in the standard instructional program within a reasonable length of time after the student enters the school system.

2. A full course load of courses specified in item #1 above.

3. Other courses that meet the "a-­g" course requirements for college admission or

are advanced courses such as honors or Advanced Placement courses, on the sole basis of the student's classification as an English learner.

BP 6174 The Superintendent or designee shall encourage parent/guardian and community involvement in the development and evaluation of programs for English learners. The Superintendent or designee may also provide an English development literacy training program for parents/guardians and community members so that they may better support students' English language development. (cf. 0420 – School Plans/Site Councils) (cf. 6020 – Parent Involvement) English learners shall be provided English language development instruction targeted to their English proficiency level and aligned with state content standards and curriculum framework. The district’s program shall be based on sound instructional theory, use standards-­aligned instructional materials, assist students in accessing the full educational program. (cf. 4112.22 -­ Staff Teaching English Language Learners) The district shall provide effective professional development to teachers (including teachers in classroom settings that are not the settings of language instructional programs), administrators, and other school personnel to improve the instruction and assessment of English learners and enhance staff’s ability to understand and use curricula, assessment, and instructional strategies for English learners. Such professional development shall be of sufficient intensity and duration to produce a positive and lasting impact on teachers’ performance in the classroom (20 UDC 6825) Staff development shall also address the sociocultural needs of English learners and provide opportunities for teachers to engage in supportive, collaborative learning communities. To support students’ English language development, the Superintendent or designee may provide an adult literacy training program that leads to English fluency for parents/guardians and community members. Identification and Assessment The Superintendent or designee shall maintain procedures which provide for the early and accurate identification of English learners and an assessment of their proficiency using the state's English Language Proficiency Assessments for California (ELPAC). To oversee test administration, the Superintendent or designee shall annually designate a district ELPAC coordinator and a site coordinator for each test site in accordance with 5 CCR 11518.40-­11518.45. and needs in the areas of listening, speaking, reading, and writing in English.

BP 6174 Once identified as an English learner, a student shall be annually assessed for language proficiency until he/she is reclassified based on criteria specified in this policy and in the accompanying administrative regulation. In addition, English learners’ academic achievement in English language arts, mathematics, science, and any additional subject required by law shall be assessed using the California Assessment of Student Performance and Progress. As necessary, the test shall be administered with testing variations in accordance with 5 CCR 854. 1-­845.3. 853.5 and 853.7. English learners who are in their first 12 months of attending a school in the United States shall be exempted from taking the English language arts assessment to the extent allowed by federal law. (Education Code 60603, 60640;; 5 CCR 854. 1-­845.3 853.5, 853.7) Formative assessments may be utilized to analyze student performance and appropriately adapt teaching methodologies and instructions. Language Acquisition Programs The district shall offer research-­based language acquisition programs that are designed to ensure English acquisition as rapidly and as effectively as possible and that provide instruction to students on the state-­adopted academic content standards, including the English language development standards. (Education Code 306;; 5 CCR 11300) At a minimum, the district shall offer a structured English immersion program which includes designated and integrated English language development. In the structured English immersion program, nearly all of the classroom instruction shall be provided in English, but with the curriculum and presentation designed for students who are learning English. (Education Code 305-­306;; 5 CCR 11309) For the purpose of determining the amount of instruction to be conducted in English in the structured English immersion program, "nearly all" means that all classroom instruction shall be conducted in English except for clarification, explanation, and support as needed. In addition, language acquisition programs offered by the district may include, but are not limited to, the following: (Education Code 305-­306)

1. A dual-­language immersion program that provides integrated language learning and academic instruction for native speakers of English and native speakers of another language, with the goals of high academic achievement, first and second language proficiency, and cross-­cultural understanding;;

2. A transitional or developmental program for English learners that provides

literacy and academic instruction in English and a student's native language and that enables an English learner to achieve English proficiency and academic mastery of subject matter content and higher order thinking skills, including critical thinking, in order to meet state academic content standards.

The district's language acquisition programs for grades K-­3 shall comply with class size requirements specified in Education Code 42238.02. (Education Code 310)

BP 6174 In establishing the district's language acquisition programs, the Superintendent or designee shall consult with parents/guardians and the community during the LCAP development process. He/she shall also consult with administrators, teachers, and other personnel with appropriate authorizations and experience in establishing a language acquisition program. (Education Code 305) Language acquisition programs are educational programs that are designed to ensure English acquisition as rapidly and as effectively as possible and that provide instruction to students on the state-­adopted academic content standards, including the English language development standards. The language acquisition programs provided to students shall be informed by research and shall lead to grade-­level proficiency and academic achievement in both English and another language. (Education Code 306) The district shall offer English learners a structured English immersion program to ensure that English learners have access to the core academic content standards, including the English language development standards, and become proficient in English. (Education Code 310) At the beginning of each school year or upon a student's enrollment, parents/guardians shall be provided information on the types of language acquisition programs available to students enrolled in the district, including, but not limited to, a description of each program, the process to be followed in making a program selection, identification of any language to be taught in addition to English when the program includes instruction in another language, and the process to request establishment of a language acquisition program. BP 6174 Reclassification When an English learner is determined pursuant to state and district reclassification criteria as delineated in accompanying Exhibit A administrative regulation to have acquired a reasonable level of English proficiency pursuant to Education Code 313 and 52164.6, or upon request by the student's parent/guardian, the student shall be transferred from a language acquisition program into an English language mainstream classroom. Program Evaluation To evaluate the effectiveness of the district’s educational program effectiveness for English learners, the Superintendent or designee shall report to the Board, at least annually, regarding progress towards proficiency in English, the number and percentage of English learners who have been reclassified as fluent English proficient, the number and percentage of English learners who are or are at risk of being classified as long-­term English learners, the achievement of English learners on standards-­based tests in core curricular areas, for any language acquisition program that includes instruction in a language other than English, student achievement in the non-­English language in accordance with 5 CCR 11309, progress towards any other goals for English learners identified in the district’s LCAP, and a comparison of current data from at least the previous year. The Superintendent or designee also shall annually report these findings to the Board and shall provide the Board with regular annual reports from any district or school-­wide English learner advisory committees.
