Durham HistoryEducation

In 1887, Trinity College moved from Randolph County to Durham� Washington Duke and Julian Carr donated money and

land to facilitate the move� Following a $40 million donation by Washington Duke’s son, James Buchanan Duke, Trinity College was renamed Duke University in 1924�

In 1910, Dr� James E� Shepard founded  North Carolina Central University, the nation’s first publicly supported liberal arts college for African-Americans�

African-American Enterprise

After the Civil War, the African American economy progressed through a combination of vocational training, jobs, land ownership, business ownership, and community leadership� In 1898, John Merrick founded North Carolina Mutual Life Insurance Company, which today is the largest and

oldest African American owned life insurance company in the nation� With its founding in 1907, M&F Bank became one of the nation’s strongest African American owned and managed bank� So many other businesses joined these two in Durham’s Parrish Street neighborhood that the area became famous across the country as “Black Wall Street�”

Civil Rights

The Durham Committee on the Affairs of Black People, organized in 1935 by C�C� Spaulding and Dr� James E� Shepard, has been cited nationally for its role in the sit-in movements of the 1950’s-60’s� The committee also has used its voting strength to pursue social and economic rights for African-

Americans and other ethnic groups�

In the late 1950’s, Reverend Douglas Moore, minister of Durham’s Asbury Temple Methodist Church, along with other religious and community leaders, pioneered sit-ins throughout North Carolina to protest discrimination at lunch counters that served only whites� A sit-in at a Woolworth’s counter in Greensboro, NC, captured the nation’s attention� Within days, Dr� Martin Luther King Jr� met Reverend Moore in Durham, where Dr� King coined his famous rallying cry “Fill up the jails,” during a speech at White Rock Baptist Church�

Advocating non-violent confrontation with segregation laws for the first time, Dr� King said, “Let us not fear going to jail� If the officials threaten to arrest us for standing up for our rights, we must answer by saying that we are willing and prepared to fill up the jails of the South�”

History

When the North Carolina General Assembly enacted House Bill 18 on March 1, 1939, it paved the way for a new generation of African-American lawyers� The bill, authorizing a law school at North Carolina College for Negroes, was passed 25 years after Shaw

University, in Raleigh, N�C�, closed its law school in 1914, a move that left no in-state option for blacks to receive a formal education in law�

Following the Great Depression, the legislation was, in theory, a way to create a separate-but-equal option for blacks who wanted to become lawyers, without integrating the law school at the University of North Carolina at Chapel Hill�

House Bill 18 authorized the Board of Trustees to establish the North Carolina College for Negroes Law School and announced it would open in the fall of 1939� Due to the amount of time the college had to prepare and advertise the law school, only one student registered, resulting in the administration delaying the opening to the following year�

Law School Dean Maurice T� Van Hecke, who was also dean of the University of North Carolina at Chapel Hill (UNC-CH) law school, solicited advice and opinions about the school’s curriculum from black attorneys and others� In December 1939, Durham Attorney C� Jerry Gates thanked Van Hecke for providing him a copy of the law school’s bulletin� He also wrote:

I am profoundly of the opinion that the legal education of the Negro in the South has been grossly neglected… The lawyer, in America, comes within the class of the accepted leaders of his people, and if the Negro is to keep pace with his fellow white citizens, he must develop within his ranks strong, competent and outstanding lawyers�

Gates’ letter went on to express his disappointment that the Law School had no blacks on the faculty� Having even a part-time black on the faculty, he argued, “would have gone a long way in disabusing the average Negro’s mind of the popular notion that the Negro can’t serve in such capacity and to a great extent that he is prohibited from practicing law in the south as the white lawyer does�”

“I am aware of the fact that a conscientious effort was made to secure some qualified Negro to act in this capacity,” he continued� “However, I can’t help but regret that such an effort was not successful�”

Also in December 1939, Winston-Salem Attorney W� Avery Jones wrote Van Hecke that the curriculum outlined in the bulletin “meets with my approval in every way�” “There is one suggestion that I should like to make relative to the colored law school,” he continued�

In view of the fact that there are so few law offices into which the graduates may enter and gain practical experience after graduation and admission to the Bar, it is very necessary that these students be given as much practical training in the law school as possible� It is one thing to know the principles of law involved and what ought to be done; but, an entirely different thing to know how to do it� I, therefore, suggest that the students be given practical training in drawing all kinds of papers so that they will be somewhat self reliant when they enter the field�

FOR THE NATIONAL HBCU PRE-LAW SUMMITFOR PRE-LAW REGISTRANTS, ADVISORS, PARENTS, SUPPORTERS, LAW STUDENTS,

LAW GRADUATES, ATTORNEYS AND OTHER PARTICIPANTS

Please carefully read the following terms and conditions related to your participation in The National HBCU Pre-Law Summit which will sometimes be referred to from here forward as “NHPLS�”

By registering for the NHPLS, you (the “Attendee”) signify your acceptance of and obligation to these terms and conditions� If you have objections to the following Terms, Conditions and Disclaimers, you should not register for or attend the NHPLS�

1. DISABILITIES/REASONABLE ACCOMMODATIONS: If you are in need of accommodations due to a disability and/or medical condition please contact Ms� Deidre Kelly at dkelly17@nccu�edu at least two weeks prior to the event�

2. SPECIAL DIETARY REQUESTS: Please let us know if you have any special dietary requests at least two weeks prior to the event by sending an e-mail to info@hbcuprelawsummit�org�

3. AUDIO/VISUAL RULES AND RELEASE: By participating in the National HBCU Pre-Law Summit (NHPLS), the Attendee understands that portions of the conference and law fair may be recorded in video and audio and/or captured in still and/or digital photographs by the NHPLS staff or independent contractors that we hire�

The Attendee agrees that the National HBCU Pre-Law Summit and its assigns have the right and permission to use such recordings and photographs should they include the Attendee’s name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Attendee�

The Attendee understands and agrees that all recordings from the National HBCU Pre-Law Summit are the exclusive rights of the National HBCU Pre-Law Summit, and Attendee does not ask for or expect compensation for the use of recordings or photographs in which Attendee appears or speaks� The National HBCU Pre-Law Summit owns all rights of any audio, video, and/or photograph captured during the National HBCU Pre-Law Summit�

4. ATTENDEE CONDUCT: The National HBCU Pre-Law Summit (NHPLS) requires all Attendees to be respectful and professional to our staff, volunteers, contractors, location hosts, speakers, panelists, presenters, and other attendees and their guests or families throughout the duration of the NHPLS, even during non-scheduled downtime and breaks�

The NHPLS reserves the right to ask any Attendee and/or their guests to leave the law fair exhibition rooms, conference rooms, and other areas where the event is being conducted immediately should they be deemed rude, uncooperative, unprofessional, intoxicated, or in possession of alcohol or any illegal substance�

In such case, the Attendee’s registration fee, if one was paid, for the NHPLS will NOT be reimbursed under any circumstances and they will not receive any future products, services, or correspondence from the NHPLS�

5. LIABILITY WAIVER: While we take every possible measure to ensure Attendee safety at the National HBCU Pre-Law Summit (NHPLS), we cannot control everything� For this reason, the Attendee is legally responsible for their own safety and behavior and agrees to, and is held legally liable to, the following statements:

I, the willing Attendee of the NHPLS, hereby accept all risk to my health and of my injury or death that may result from participating in the NHPLS and I hereby release the NHPLS, Persistence of Vision LLC, National Pre-Law Diversity Initiatives, Inc� North Carolina Central University, North Carolina Central University School of Law, and their officers, employees, interns, contractors, sponsors, partners and representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illnesses or injury to my person, including my death, that may result from or occur during my participation at the NHPLS, whether caused by negligence of the NHPLS, its governing board, officers, employees, or representatives, or otherwise�

I further agree to indemnify and hold harmless the NHPLS and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the NHPLS� Under no circumstances will the NHPLS or their assigns be held liable for my injury or death or any loss or damage of my personal belongings resulting from my participation in the NHPLS�

Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the NHPLS, I consent to such treatment� I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment� I will notify the NHPLS verbally and in writing if I am at any time injured prior to, during, or after the NHPLS in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed� However, I understand that the NHPLS is not legally obligated to act on that information in any way or to provide any medical service whatsoever to me� I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the NHPLS that I will notify the NHPLS and that the NHPLS retains the right to ask that I not participate in portions or the entirety of the NHPLS�
