Title: Instructional Materials Adoption

Consideration of Instructional Materials Adoption

Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees approve adoption of all titles for the 2011 State Adoption which includes recommendations of the 2010-2011 Humble Independent School District Instructional Materials Adoption Committee. Background/Impact Information: In October 2010 the Board of Trustees approved a District Instructional Materials Adoption Committee and the timeline of activities for the instructional materials selection process. The committee members met with their subcommittees to discuss subject area instructional needs. Teacher and administrator teams thoroughly examined instructional materials on the list provided by the State, using a rubric to guide the decision making process. The State lists are categorized as Conforming and Non-Conforming, as determined by the inclusion of all Texas Essential Knowledge and Skills (TEKS) for each content area and grade level. Districts can adopt non-conforming books provided they identify the missing components and develop a plan to address them. This year we are recommending the adoption of one non-conforming instructional materials series. Overall it is the best resource to support instruction and 98% conforming. Since the initial rating by the State, the publisher has revised the contents to ensure that all TEKS are addressed. In the meantime, the district has put in place a supplemental plan to ensure compliance with State requirements. The instructional materials were displayed for citizens' review January 31 - February 4, 2011 at the Administration Building. These dates were published in local newspapers, submitted to schools for publication and posted on the district’s website. There is a maximum cost allocation per text that the state allows per student. The District is responsible for any additional costs if a text is chosen that is priced above the state allocation; however, none of the recommended instructional materials exceeds the state maximum. The District Instructional Materials Committee recommended list is attached. (Attachment 1)

Title: Policy Update 89

Consideration of Texas Association of School Boards (TASB) Policy Update 89

Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees adopt the revisions proposed to local policies included in TASB Update 89. Background/Impact Information: The District subscribes to a service provided by TASB to propose and assist with management of Board policies. This Localized Policy Manual Update 89 includes two types of policies: legal and local policies. There are a number of (LEGAL) policies that are being amended to reflect changes or clarifications to the applicable laws. These changes to (LEGAL) policies do not require Board action since they reflect laws already in effect. There are also (LOCAL) policies in this Update, which do require Board action, and are being brought to the Board at this time for potential action. The local policies are board policies that implement the legal policies based upon the District's specific needs. TASB revisions to local policies in Update #89 align local practice with recent changes in legal policy or provide clarification to existing policy. The (LOCAL) policies in Update #89 are described in detail in the Vantage Points, Explanatory Notes, and other materials found in the attachments. TASB has proposed revisions to local policies CKB, EHDD and FD. TASB has reorganized section E of the manual. Provisions previously at codes EEJA and EEJB have been moved to EHDB and EHDC, respectively, with proposed revisions (see explanatory notes). Title: Revisions to Board Policy DFF (Local)

Consideration of proposed revisions to the Humble ISD Board policy DFF (Local) regarding "Termination of Employment, Reduction in Force" Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees approve the proposed revisions to local Humble ISD Board Policy DFF, which revises and clarifies the process for initiating and implementing a reduction in force. Background/Impact Information: The process for a reduction in force (RIF) is governed by local school district policy at DFF(LOCAL). Districts do not have a legally referenced policy at DFF because there are no statutory provisions governing the RIF process. This means that the local school board determines the process of deciding which positions, and ultimately which employees, will be affected by a RIF. The Superintendent recommends revisions to Humble ISD's current policy, as outlined in the attached redline version of policy DFF. The purpose of these proposed revisions is to provide the Board and the Superintendent more flexibility in initiating and implementing a reduction in force, particularly in the context of selection criterion for identifying employees for reduction. This item is being brought for action at this meeting, which is a departure from the Board’s normal practice of reviewing policies at least one meeting prior to a vote. Although the Superintendent is not recommending that the Board declare a financial exigency at this time, given the uncertain status of the State’s proposed funding to schools, as well as the dynamic nature of this district’s budget development process, the Superintendent recommends preparing the RIF policy for implementation should quick action be warranted. The Superintendent’s recommended revisions include: 1. A new introductory paragraph to explain that, in addition to the formal RIF process outlined in DFF (LOCAL), the Superintendent may pursue the reduction of personnel employed under employment arrangements not covered by the formal RIF process. The

types of employment arrangements not included in the RIF process were formerly listed in a Note on page 1. 2. An expanded definition of “financial exigency” to include “an increase in expenses” as a basis for declaring a financial exigency. 3. Additional text at GENERAL GROUNDS to explain that the Superintendent recommends to the board the declaration of a financial exigency or program change. 4. Additional text at EMPLOYMENT AREAS, item 3, to address career and technical education and to include special education “and related services.” Also added as en employment area are “programs funded by state or federal grants or other dedicated funding.” 5. Several changes at CRITERIA FOR DECISION, including: a. Renaming the “certification” criterion to “qualifications for current or projected assignment.” This criterion will continue to include consideration of certification, endorsement, and highly qualified status related to the current or projected assignment, but has been expanded to also include licensure, bilingual or multilingual capabilities, and/or specialized or advanced content-specific training or skills for district programs related to the current or projected assignment. b. An expanded definition of “performance” to clarify that it includes consideration of the most recent formal appraisal and any other written evaluative information, including disciplinary information, within the last 36 months. c. Addition of an “extra duties” criterion to include consideration of whether an employee is currently performing an extra-duty assignment, such as department chair, band director, athletic coach, or activity sponsor. d. Reordering of the criteria, so that the “seniority” criterion is applied last. e. At CONSIDERATION FOR AVAILABLE POSITIONS, a clarification that an employee who applies for an open position must be offered the position in accordance with the policy provisions up until the final action by the board to end the employee’s contract, not until the date of a hearing requested in accordance with the policy. f. At DISCHARGE, deletion of text specifying that the discharge hearing is before an independent hearing examiner, as this is adequately reflected in another policy (DFD). As determined by the Superintendent, a necessary reduction in personnel may include the reduction of personnel em-ployed pursuant to employment arrangements not covered by this policy. For the termination at any time of at-will employ-ment, see DCD; for the termination of a probationary contract, see DFAA and DFAB; for the termination of a continuing con-tract, see DFCA; and for the termination at the end of the con-tract period of a contract not governed by Chapter 21 of the Education Code, see DCE.

This policy shall apply only when a to reductions in force of con-tractual employees when the reduction in force requires the termi-nation of:

1.A contract governed by Chapter 21 of the Education Code in the following circumstances:

a.1. A probationary contract during the contract periodThe termi-nation of a probationary contract during the contract period;

Definitions used in this policy are as follows:

1. “Financial exigency” shall mean any event or occurrence that creates a need for the District to reduce financial expenditures for personnel including, but not limited tofor example, a de-cline in the District’s financial resources, a decline in enroll-ment, a reduction in cut in funding, a decline in tax revenues, or an unanticipated expense or capital need, or an increase in expenses.

2. “Program change” shall mean any elimination, curtailment, or reorganization of a curriculum offering, program, or school operation, including, for example,. The term shall include, but not be limited to, a change in curriculum objectives, a modifi-cation or reorganization of staffing patterns on a particular campus or District wide, a redirection of financial resources to meet the educational needs of the students, a lack of student response to particular course offerings, legislative revisions to programs, or a reorganization or consolidation of two or more individual schools or school districts.

3. “Discharge” shall mean termination of a contract during the contract period.

4. “Nonrenewal” shall mean the termination of a term contract at the end of the contract period.

A reduction in force may take place when the Superintendent rec-ommends and the Board determines that a financial exigency or a program change requires the discharge or nonrenewal of one or more employees in accordance with this policy. Such aA determi-nation of financial exigency or program change constitutes suffi-cient cause for discharge or a sufficient reason for nonrenewal.

When a reduction in force is to be implemented, the Superinten-dent shall make recommend ations to the Board and the Board shall determine the employment areas to be affected. In determin-ing affected employment areas, the Board may combine or coordi-nate employment areas , as defined below (e.g., the Board may combine “elementary programs” and “compensatory education programs” to identify an employment area of “elementary compen-satory education program”).

Employment areas may include, for examplebut are not limited to:

1. Elementary grades, levels, subjects, departments, or pro-grams.

2. Secondary grades, levels, subjects, departments, or pro-grams.

3. Special programs, such as gifted and talented, bilingual/ESL programs, special education and related services, compensa-tory education, career and technical education, and migrant education. Each special program is a separate employment area.

4. Counseling programs.

5. Library programs.

6. Nursing and other health services programs.

After the Board has determined the employment area(s) to be af-fected, Tthe Superintendent shall recommend to the Board the dis-charge or nonrenewal of employees within the affected employ-ment area(s) because of a reduction in force, based on the following criteria. These criteria are listed in order of importance; the Superintendent shall apply them sequentially to the extent nec-essary to identify the employees who least satisfy the criteria and therefore are subject to the reduction in force. For example, , i.e., if all necessary reductions can be accomplished by applying the certification first criterion, it is not necessary to apply the second performance criterion, and so forth.etc.

1. Qualifications for Current or Projected Assignment: Certifica-tion, or multiple composite certifications, licensure, : Appro-priate certification, endorsement, and/or highly qualified status, bilingual or multilingual capabilities, and/or specialized or advanced content-specific training or skills for current or projected assignment.

2. Performance: Effectiveness, as reflected by appraisal re-cords and other written evaluative information.:

a. The most recent formal appraisal, whether completed by the District or by a previous district; and

b. Any other written evaluative information, including disci-plinary information, from the last 36 months.

If the Superintendent at his or her discretion decides that the documented performance differences between two or more reduc-tion-in-force prospects are too insubstantial to rely upon, he or she may proceed to apply the remaining criterion in the order listed be-low:3 and, thereafter and to the extent needed, criterion 4.

3. Extra Duties: Currently performing an extra-duty assignment such as a department chair, band director, athletic coach, or activity sponsor.

Once the Superintendent has identified the appropriate employees in the affected area(s), those employees may apply for other avail-able positions for which they are qualified. An employee is respon-sible for reviewing posted vacancies, submitting an application, and otherwise complying with District procedure to be considered for a particular vacancy.

Up until final action by the Board to end an employee’s contract, the date of a hearing requested in accordance with this policy, an employee who applies for an open position must be offered an open the position if the employee applies for the position, meets the District’s objective criteria for that the position, and is the most qualified internal applicant. for the position.

After considering the Superintendent’s recommendation, the Board shall determine the employees to be proposed for discharge or nonrenewal, as appropriate. The Superintendent shall provide each employee written notice of the proposed action, including a statement of the reason(s) requiring such action and notice that the employee is entitled to a hearing.

An employee receiving a notice of proposed nonrenewal may re-quest a hearing in accordance with DFBB.

An employee receiving notice of proposed discharge during the period of a contract governed by Chapter 21 of the Education Code may request a hearing before an independent hearing examiner in accordance with DFD.

An employee receiving notice of proposed discharge during the period of an employment contract not governed by Chapter 21 of the Education Code may request a hearing before the Board or its designee in accordance with DCE.

Title: Tax Refunds

Consideration of Petitions for Refunds in Excess of $500

Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees approve the petitions for tax refunds. Background/Impact Information: The Texas Property Tax Code, Section 31.11(c) states “If a taxpayer applies to the tax collector of a taxing unit for a refund of an overpayment or erroneous payment of taxes and the auditor for the unit determines that the payment was erroneous or excessive, the tax collector shall refund the amount of the excessive or erroneous payment from available current tax collections or from funds appropriated by the unit for making refunds. However, the collector may not make the refund unless: (1) in the case of a collector who collects taxes for one taxing unit, the governing body of the taxing unit also determines that the payment was erroneous or excessive and approves the refund if the amount of the refund exceeds:…(B) $500 for a refund to be paid by any other taxing unit;…An application for a refund must be made within three years after the date of the payment or the taxpayer waives the right to the refund.” Detailed information and rationale for each correction or refund has been documented in the attachment. If the Board approves this consideration, Humble ISD will be in compliance with the Texas Property Tax Code. The total effect of the refund(s) will result in a reduction of total collections received of $158,990.59. Overpayments are recorded as a liability on the general ledger upon receipt and, therefore, do not cause a decrease in recorded revenue when refunded.

Title: Waiver of P&I

Consideration of Requests for Waiver of Penalty & Interest on Delinquent Taxes

Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees approve the requests for waiver of penalty & interest on delinquent tax accounts. Background/Impact Information: Section 1.08, Timeliness of Action by Mail and Section 33.011, Waiver of Penalty and Interest, of the Texas Property Tax Code, provide conditions for timely payments and waivers of penalties and interest. The taxpayers listed on the attached schedule have provided satisfactory evidence to meet the requirements of these sections of the Property Tax Code. Documentation is available for review in the Tax Office. If the Board approves the recommendation to grant the waivers of penalty and interest, Humble ISD will be in compliance with the Texas Property Tax Code (as well as consistent with treatment of previous requests of this nature). Title: Budgetary Amendments Consideration of Budgetary Amendments Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees approve the budgetary amendments as described in the accompanying attachment. Background/Impact Information: The Texas Education Code Section 44.006, the Texas Education Agency Resource Guide Sections 2.10.6 and 5.3.4 and Humble ISD Board Policy CE (LOCAL), page 2, require that certain budgetary amendments be approved by the Board of Trustees. Changes to budgetary accounts in the General Fund, National School Breakfast and Lunch Program and Debt Service Fund that affect functional expenditure categories must be approved by the Board of Trustees according to TEA regulations. By approving these amendments, Humble ISD will be in compliance with both state law and local policy regarding approval of budgetary amendments. In the 2009-10 budget, the Board approved a one-time increase request to the Safety budget for an Asbestos Audit and the City of Houston Fire Code Compliance items. The audit and fire compliance have been completed under budget. With the remaining available balance of $44,276, Support Services would like to use these funds to address current needs within their Division for the purchase of (1) van, (2) CMS attenuation walls, (3) custodial floor finishers, (4) surveillance systems, and (5) additional cameras, DVR's and NVR's.

Background/Impact Information: Section 31.10 of the Texas Property Tax Code requires the Tax Collector for a taxing unit to prepare and submit to the governing body a written report accounting for all taxes collected for the unit during the preceding month. In accordance with the Tax Code, the attached Tax Collection Report as of February 28, 2011 has been provided for information. The Cash and Investment Reports, Schedule of Revenues and Expenditures, and Construction in Progress Summary Report as of February 28, 2011 are included in the accompanying attachments in accordance with the Texas Education Code, Section 44.007(d). Title: Employee Benefits Program

Report on Employee Benefits Program

Background/Impact Information: The Humble ISD Employee Benefits Program currently includes Health Care, Short Term and Long Term Disability, Life, and Vision Coverage. With the exception of Life and Vision coverage, all of the above listed benefits are funded and accounted for in the District’s Internal Service Fund. Also included in the Internal Service Fund is Workers’ Compensation Coverage.

Health Care Plan

The District’s Health Care Plan includes medical, dental, and prescription coverage. At the March 10, 2009, board meeting, the Board of Trustees approved the selection of United Healthcare to provide administration of the District’s employee health care and flexible spending programs. As part of that approval, employee premiums for the Traditional Plan remained unchanged while employee premiums for the State Comparable Plan were reduced.

In planning for the 2010-11 year, the Benefits & Risk Management Department reviewed existing and alternative plan designs with the following parameters.

New plan designs:

1) Must not compromise financial stability 2) Must not increase financial risk 3) Must add value in terms of coverage and pricing

Reform, indicated that the District could not offer plan design changes that remained within those parameters.

The trend for increasing health care costs has continued in the current fiscal year and the projected deficit for year end is in excess of $2 million. The contributions made by the District and the employees have not been adequate to meet both the increased cost of claims and administration. The current financial constraints have forced the District to reduce personnel, including personnel responsible for the administration of the Health Care Plan, and to seek even more efficient and cost effective ways of doing business. The implementation of Health Care Reform will require additional personnel and funding. Consequently, the District began looking at the TRS-Active Care Program as an alternative.

In 2001, the 77th Texas Legislature passed legislation that required TRS to develop a uniform statewide health care plan for public educators. TRS-ActiveCare went into effect September 1, 2002, and initially served school districts with less than 1,000 TRS members, charter schools, regional education service centers, and other educational districts. In September 2005, school districts with more than 1,000 employees became eligible to participate. Today, after eight years of existence, the program has grown to over 445,000 employees and dependents. Of the 1,246 districts and other entities eligible to participate in the program, over 88.9 percent or 1,108 now participate. The program has four PPO plan options administered by Blue Cross and Blue Shield of Texas and Medco, along with three HMO options. Employees are able to select TRS-ActiveCare coverage under one of the PPO plans or through an authorized HMO serving certain parts of the state.

Some of the advantages of TRS-ActiveCare to employees include: Flexibility for employees to choose among four PPO options The 2011-12 employee cost for almost every tier and option will be less than the cost of our self-funded plan

Some of the advantages of TRS-Active Care to the District include: Risk is transferred to Blue Cross & Blue Shield and Medco District contribution is no longer an unknown from year to year Removes HISD from the health insurance business Stop loss insurance no longer required Potential transfer from the Internal Service Fund to the General Fund for amounts above the 20% fund balance requirement

Some of the disadvantages of TRS-Active Care to the District include: Election by Board to participate is permanent District no longer has input into annual benefit design and premiums Significant time requirement for communication, training, and implementation

If the Board approved the selection of TRS-ActiveCare to provide medical benefits for eligible employees, the District would have a short Plan Year July 1, 2011 through August 31, 2011 with the current provider, and coverage under the TRS-ActiveCare Program would begin September 1, 2011. Premiums withheld in July payrolls would remain the same and the new premiums with TRS-ActiveCare would be withheld in August. Employees would have a new deductible to meet with the new plan. In order to help offset the cost of meeting a new deductible, the District could elect to contribute $250 per participating employee to a Flexible Spending Account in the new plan year. The 2011-12 premiums for the TRS-ActiveCare Program and the current and projected premiums for the District’s self-funded plan are provided in the attachments along with the summary plan provisions.

Dental

There is no District contribution for Dental coverage and no increase in premiums for the 2011-12 year. The current dental rates are as follows:

Short Term and Long Term Disability

In the 2009-10 fiscal year the Board of Trustees approved Prudential as the new provider for Long Term and Short Term Disability coverage and FMLA administration. The Long Term Disability is funded by the District while the Short Term Disability is funded by employees. No changes are recommended for this program at this time.

Life

In addition to Disability benefits, the District also provides Term Life and AD&D coverage. The coverage is with Minnesota Life and provides a $10,000 term life policy at $0.53 per $1,000 and $0.01 per $1,000 for AD&D. The current cost for providing this coverage is approximately $35,000. All optional life choices are paid by the employees.

Vision

Vision coverage is currently provided by VSP. The rates that are in place are guaranteed to District employees through June 30, 2013, and are as follows:

Enrollment

The enrollment period for selecting benefits for the 2011-12 plan year will be April 18, 2011 through May 20, 2011. During the coming weeks, employees will receive various communications regarding the Humble ISD Benefits Program including literature, e-mail, and Town Hall Meetings.

Fiscal Impact Statement: With the rising costs of health care and the current financial environment, the District can no longer supplement the Medical Plan with General Fund expenditures. Once run out claims for the current plan year are processed and an analysis of the Internal Service Fund is performed, the District recommends transferring any amount in excess of the 20% requirement for Assigned Internal Service Fund Balance to the General Fund.

CHAPTER 1579. TEXAS SCHOOL EMPLOYEES UNIFORM GROUP HEALTH COVERAGE

SUBCHAPTER A. GENERAL PROVISIONS

Sec. 1579.001. SHORT TITLE. This chapter may be cited as the

Texas School Employees Uniform Group Health Coverage Act.

Sec. 1579.002. GENERAL DEFINITIONS. In this chapter:

(1) "Administering firm" means any entity designated by

the trustee to administer any coverages, services, benefits, or

requirements under this chapter and the trustee's rules adopted under

this chapter.

(2) "Trustee" means the Teacher Retirement System of

Texas.

(3) "Charter school" means an open-enrollment charter

school established under Subchapter D, Chapter 12, Education Code.

(4) "Health coverage plan" means any group policy or

contract, hospital service agreement, health maintenance organization

agreement, preferred provider arrangement, or any similar group

arrangement or any combination of those policies, contracts,

agreements, or arrangements that provides for, pays for, or reimburses

expenses for health care services.

(5) "Participating entity" means an entity participating

in the uniform group coverage program established under this chapter.

The term includes:

(A) a school district;

(B) another educational district whose employees are

members of the Teacher Retirement System of Texas;

(C) a regional education service center; and

(D) a charter school that meets the requirements of

Section 1579.154.

(6) "Program" means the uniform group coverage program

established under this chapter.

(7) "Regional education service center" means a regional

education service center established under Chapter 8, Education Code.

Sec. 1579.003. DEFINITION OF EMPLOYEE. In this

chapter, "employee" means a participating member of the Teacher

Retirement System of Texas who is employed by a participating

entity and who is not receiving coverage from a program under Chapter

1551, 1575, or 1601. The term does not include an individual

performing personal services as an independent contractor.

Sec. 1579.004. DEFINITION OF DEPENDENT. In this

chapter, "dependent" means:

(1) a spouse of a full-time employee or part-time employee;

(2) an unmarried child of a full-time or part-time

employee if the child is younger than 25 years of age, including:

(A) an adopted child;

(B) a foster child, stepchild, or other child who is

in a regular parent-child relationship; and

(C) a recognized natural child;

(3) a full-time or part-time employee's recognized natural

child, adopted child, foster child, stepchild, or other child who is

in a regular parent-child relationship and who lives with or has his

or her care provided by the employee or the surviving spouse on a

regular basis, regardless of the child's age, if the child is mentally

retarded or physically incapacitated to an extent that the child is

dependent on the employee or surviving spouse for care or support, as

determined by the board of trustees; and

(4) notwithstanding any other provision of this code, any

other dependent of a full-time or part-time employee specified by

Sec. 1579.005. CONFIDENTIALITY. (a) Section 825.507,

Government Code, applies to records relating to an employee or

dependent under the program and in the custody of the Teacher

Retirement System of Texas or in the custody of an administrator,

carrier, agent, attorney, consultant, or governmental body acting in

cooperation with or on behalf of the system.

(b) The Teacher Retirement System of Texas may disclose

to a health care provider, benefit provider, or claims administrator

information in the records of an individual that the system determines

is necessary to administer the program.

Sec. 1579.006. EXEMPTION FROM PROCESS. (a) The following are

exempt from execution, attachment, garnishment, or any other process:

(1) benefit payments, including optional benefit payments;

(2) contributions of active employees, the state, and a

participating entity, and any other contributions;

(3) any rights, benefits, or payments accruing to any

person under this chapter; and

(4) any money in the Texas school employees uniform group

coverage trust fund.

(b) The items listed in Subsection (a) may not be assigned

except for direct payment to benefit providers as authorized by the

trustee by contract, rule, or otherwise.

Sec. 1579.007. EXEMPTION FROM STATE TAXES AND FEES. A premium

or contribution on a policy, insurance contract, or agreement

authorized by this chapter is not subject to any state tax, regulatory

fee, or surcharge, including a premium or maintenance tax or fee.

Sec. 1579.008. COVERAGE EXEMPT FROM INSURANCE LAW. A coverage

plan provided under this chapter is exempt from any other insurance

law, including common law, that does not expressly apply to the plan

or this chapter.

SUBCHAPTER B. ADMINISTRATION

Sec. 1579.051. ADMINISTRATION OF GROUP PROGRAM. The Teacher

Retirement System of Texas, as trustee, shall implement and

administer the uniform group coverage program described by this

chapter.

Sec. 1579.052. AUTHORITY TO ADOPT RULES; OTHER AUTHORITY.

(a) The trustee may adopt rules relating to the program as considered

necessary by the trustee.

(b) The trustee may adopt rules to administer the program,

including rules relating to adjudication of claims and expelling

participants from the program for cause.

(c) The trustee may contract with independent and experienced

group insurance consultants and actuaries for advice and counsel in

implementing and administering the program.

(d) The trustee may enter into interagency contracts with any

agency of the state, including the Employees Retirement System of

Texas and the department, for the purpose of assistance in

implementing the program.

(e) The trustee shall take the actions it considers necessary

to devise, implement, and administer the program.

Sec. 1579.053. PERSONNEL. The trustee may hire and compensate

employees as necessary to implement the program.

Sec. 1579.054. COMPETITIVE BIDDING REQUIREMENTS; RULES. A

contract to provide group health coverage under this chapter may be

awarded only through competitive bidding under rules adopted by the

trustee.

Sec. 1579.055. CONTRACT AWARD; CONSIDERATIONS. (a) In

awarding a contract to provide group benefits under this chapter, the

trustee is not required to select the lowest bid and may consider also

any relevant criteria, including the bidder's:

(1) ability to service contracts;

(2) past experiences; and

(3) financial stability.

(b) If the trustee awards a contract to a bidder whose bid

deviates from that advertised, the trustee shall record the deviation

and fully justify the reason for the deviation in the minutes of the

next board meeting.

Sec. 1579.057. PHARMACY BENEFIT MANAGER CONTRACTS. (a) In

awarding a contract to provide pharmacy benefit manager services under

this chapter, the trustee is not required to select the lowest bid but

must select a contract that meets the criteria established by this

section.

(b) The contract must state that:

(1) the trustee is entitled to audit the pharmacy benefit

manager to verify costs and discounts associated with drug

claims, pharmacy benefit manager compliance with contract

requirements, and services provided by subcontractors;

(2) the audit must be conducted by an independent auditor

in accordance with established auditing standards; and

(3) to conduct the audit, the trustee and the independent

auditor are entitled access to information related to the services and

the costs associated with the services performed under the contract,

including access to the pharmacy benefit manager's facilities,

records, contracts, medical records, and agreements with

subcontractors.

(c) The contract must define the information that the pharmacy

benefit manager is required to provide to the trustee concerning the

audit of the retail, independent, and mail order pharmacies performing

services under the contract and describe how the results of these

audits must be reported to the trustee, including how often the

results must be reported. The contract must state whether the

pharmacy benefit manager is required to return recovered overpayments

to the trustee.

(d) The contract must state that any audit of a mail order

pharmacy owned by the pharmacy benefit manager must be conducted by an

independent auditor selected by the trustee in accordance with

established auditing standards.

SUBCHAPTER C. COVERAGES

Sec. 1579.101. PLANS OF GROUP COVERAGES. (a) The trustee by

rule shall establish plans of group coverages for employees

participating in the program and their dependents.

(b) The plans must include at least two tiers of group

coverage, with coverage at different levels in each tier, ranging from

the catastrophic care coverage plan to the primary care coverage

plan. Each tier must contain a health coverage plan.

(c) The trustee by rule shall define the requirements of each

coverage plan and tier of coverage.

(d) Comparable coverage plans of each tier of coverage

entities.

Sec. 1579.102. CATASTROPHIC CARE COVERAGE PLAN. The coverage

provided under the catastrophic care coverage plan shall be prescribed

by the trustee by rule and must provide coverage at least as extensive

as the coverage provided under the TRS-Care 1 plan operated under

Chapter 1575.

Sec. 1579.103. PRIMARY CARE COVERAGE PLAN. The coverage

provided under the primary care coverage plan must be comparable in

scope and, to the greatest extent possible, in cost to the coverage

provided under Chapter 1551.

Sec. 1579.104. OPTIONAL COVERAGES. The trustee may not offer

optional coverages, other than optional permanent life insurance,

optional long-term care insurance, and optional disability insurance,

to employees participating in the program. This section does not

affect the right of a participating entity to offer optional coverages

to its employees under terms and conditions established by the

participating entity.

Sec. 1579.105. PREEXISTING CONDITION LIMITATION. During the

initial period of eligibility, coverage provided under the

program may not be made subject to a preexisting condition limitation.

Sec. 1579.106. PRIOR AUTHORIZATION FOR CERTAIN DRUGS. (a) In

this section, "drug formulary" means a list of drugs preferred for use

and eligible for coverage by a health coverage plan.

(b) A health coverage plan provided under this chapter that

uses a drug formulary in providing a prescription drug benefit must

require prior authorization for coverage of the following categories

of prescribed drugs if the specific drug prescribed is not included in

the formulary:

(1) a gastrointestinal drug;

(2) a cholesterol-lowering drug;

(3) an anti-inflammatory drug;

(4) an antihistamine drug; and

(5) an antidepressant drug.

(c) Every six months the trustee shall submit to the

comptroller and the Legislative Budget Board a report regarding any

cost savings achieved in the program through implementation of the

prior authorization requirement of this section. The report must

cover the previous six-month period.

Sec. 1579.107. DISEASE MANAGEMENT SERVICES. (a) In this

section, "disease management services" means services to assist an

individual manage a disease or other chronic health condition, such as

heart disease, diabetes, respiratory illness, end-stage renal disease,

HIV infection, or AIDS, and with respect to which the trustee

identifies populations requiring disease management.

(b) A health coverage plan provided under this chapter must

provide disease management services or coverage for disease management

services in the manner required by the trustee, including:

(1) patient self-management education;

(2) provider education;

(3) evidence-based models and minimum standards of care;

(4) standardized protocols and participation criteria; and

(5) physician-directed or physician-supervised care.

Sec. 1579.108. LIMITATIONS. The trustee may not contract for

or provide a health coverage plan that excludes from participation in

the network a general hospital that:

(1) is located in the geographical service area or areas

of the health coverage plan that includes a county that:

(A) has a population of at least 100,000 and not more

than 175,000; and

(B) is located in the Texas-Louisiana border region,

as that term is defined in Section 2056.002(e), Government Code; and

(2) agrees to provide medical and health care services

under the plan subject to the same terms as other hospital providers

under the plan.

SUBCHAPTER D. PARTICIPATING ENTITIES

Sec. 1579.151. REQUIRED PARTICIPATION OF SCHOOL DISTRICTS WITH

500 OR FEWER EMPLOYEES. (a) Each school district with 500 or fewer

employees and each regional education service center is required to

participate in the program.

(b) Notwithstanding Subsection (a), a school district otherwise

subject to Subsection (a) that, on January 1, 2001, was individually

self-funded for the provision of health coverage to its employees may

elect not to participate in the program.

(c) An educational district described by Section 1579.002(5)(B)

that, on January 1, 2001, had 500 or fewer employees may elect not to

participate in the program.

Sec. 1579.152. PARTICIPATION OF OTHER SCHOOL DISTRICTS.

Effective September 1, 2005, a school district with more than 500

employees may elect to participate in the program. A school district

that elects to participate under this section shall apply for

participation in the manner prescribed by the trustee by rule.

Sec. 1579.153. PARTICIPATION BY CERTAIN RISK POOLS. (a) In

determining the number of employees of a school district for purposes

of Sections 1579.151 and 1579.152, school districts that, on January

1, 2001, were members of a risk pool established under the authority

of Chapter 172, Local Government Code, as provided by Section 22.004,

Education Code, may elect to be treated as a single unit. A school

district shall elect whether to be considered as a member of a risk

pool under this section by notifying the trustee not later than

September 1, 2001.

(b) A risk pool in existence on January 1, 2001, that, as of

that date, provided group health coverage to 500 or fewer school

district employees may elect to participate in the program.

(c) A school district with 500 or fewer employees that is a

member of a risk pool described by Subsection (a) that provides group

health coverage to more than 500 school district employees must elect,

not later than September 1, 2001, whether to be treated as a school

district with 500 or fewer employees or as part of a unit with more

than 500 employees. The school district must notify the trustee of

the election, in the manner prescribed by the trustee, not later than

September 1, 2001.

(d) For purposes of this section, participation in the program

by school districts covered by a risk pool is limited to school

districts covered by the risk pool as of January 1, 2001.

Sec. 1579.154. PARTICIPATION BY CHARTER SCHOOLS; ELIGIBILITY.

(a) A charter school is eligible to participate in the program if the

school agrees:

(1) that all records of the school relating to

participation in the program are open to inspection by the trustee,

the administering firm, the commissioner of education, or a designee

of any of those entities; and

(2) to have the school's accounts relating to

participation in the program annually audited by a certified public

accountant at the school's expense.

(b) A charter school must notify the trustee of the school's

intent to participate in the program in the manner and within the time

required by rules adopted by the trustee.

SUBCHAPTER E. PARTICIPATION BY EMPLOYEE

Sec. 1579.201. DEFINITION. In this subchapter, "full-time

employee" and "part-time employee" have the meanings assigned by rules

adopted by the trustee.

Sec. 1579.202. ELIGIBLE EMPLOYEES. (a) Except as provided by

Section 1579.204, participation in the program is limited to employees

of participating entities who are full-time employees and to part-time

employees who are participating members in the Teacher Retirement

System of Texas.

(b) An employee described by Subsection (a) who applies for

coverage during an open enrollment period prescribed by the trustee is

automatically covered by the catastrophic care coverage plan unless

the employee:

(1) specifically waives coverage under this chapter;

(2) selects a higher tier coverage plan; or

(3) is expelled from the program.

Sec. 1579.203. SELECTION OF COVERAGE. (a) A participating

employee may select coverage in any coverage plan offered by the

trustee.

(b) The employee is not required to continue participation in

the coverage plan initially selected and may select a higher or lower

tier coverage plan than the plan initially selected by the employee in

the manner provided by rules adopted by the trustee.

(c) If the combined contributions received from the state and

the employing participating entity under Subchapter F exceed the cost

of a coverage plan selected by the employee, the employee may use the

excess amount of contributions to obtain coverage under a higher tier

coverage plan or to pay all or part of the cost of coverage for the

employee's dependents.

(d) A married couple, both of whom are eligible for coverage

under the program, may pool the amount of contributions to which the

couple are entitled under the program to obtain coverage for

themselves and dependent coverage.

Sec. 1579.204. CERTAIN PART-TIME EMPLOYEES. A part-time

employee of a participating entity who is not a participating member

in the Teacher Retirement System of Texas is eligible to

participate in the program only if the employee pays all of the

premiums and other costs associated with the health coverage plan

selected by the employee.

Sec. 1579.205. PAYMENT BY PARTICIPATING ENTITY.

Notwithstanding Section 1579.204, a participating entity may pay any

portion of what otherwise would be the employee share of premiums and

other costs associated with the coverage selected by the employee.

SUBCHAPTER F. CONTRIBUTIONS

Sec. 1579.251. STATE ASSISTANCE. (a) The state shall assist

employees of participating school districts and charter schools in the

purchase of group health coverage under this chapter by providing for

each covered employee the amount of $900 each state fiscal year or a

greater amount as provided by the General Appropriations Act. The

state contribution shall be distributed through the school finance

formulas under Chapters 41 and 42, Education Code, and used by school

districts and charter schools as provided by Section 42.260,

Education Code.

(b) The state shall assist employees of participating regional

education service centers and educational districts described by

Section 1579.002(5)(B) in the purchase of group health coverage under

this chapter by providing to the employing service center or

educational district, for each covered employee, the amount of $900

each state fiscal year or a greater amount as provided by the General

Appropriations Act.

Sec. 1579.252. CONTRIBUTION BY PARTICIPATING ENTITIES. A

participating entity shall make contributions for the program as

Sec. 1579.253. CONTRIBUTION BY EMPLOYEE. (a) An employee

covered by the program shall pay that portion of the cost of coverage

contribution under Section 1579.251 and the participating entity

contribution under Section 1579.252.

(b) The employee may pay the employee's contribution under this

(c) Notwithstanding Subsection (a), a participating entity may

pay any portion of what otherwise would be the employee share of

premiums and other costs associated with the coverage selected by the

employee.

Sec. 1579.255. INTEREST ASSESSED ON LATE PAYMENT OF

CONTRIBUTIONS BY PARTICIPATING ENTITIES. (a) A participating entity

that does not remit to the trustee all contributions required by this

subchapter before the seventh day after the last day of the month

shall pay to the Texas school employees uniform group coverage trust

fund:

(1) the contributions; and

(2) interest on the unpaid amounts at the annual rate of

six percent compounded monthly.

(b) On request, the trustee may grant a waiver of the deadline

imposed by this section based on a participating entity's financial or

technological resources.

Sec. 1579.301. FUND; ADMINISTRATION. The Texas school

employees uniform group coverage trust fund is a trust fund with the

comptroller.

Sec. 1579.302. COMPOSITION OF FUND. The fund is composed of:

(1) all contributions made to the fund under this chapter

from employees, participating entities, and the state;

(4) any additional amounts appropriated by the legislature

for contingency reserves, administrative expenses, or other expenses;

and

(5) any other money required or authorized to be paid into

the fund.

SUBCHAPTER C TEXAS SCHOOL EMPLOYEES GROUP HEALTH (TRS-

ACTIVECARE)

RULE §41.45 Required Information from School Districts with More than 1,000 Employees

(a) When a large school district, as defined in subsection (b) of this section, submits its notice of election or within 15 calendar days after receiving notice from TRS staff, the large school district must submit to TRS the information listed in the following paragraphs for each medical and prescription drug plan that the large school district offered to its employees during the designated time period. Large school districts must include this information for the year to date for the plan year in which the large school district submits its notice of election (current year) and for the two complete plan years immediately preceding the current year. The required information is:

(1) Plan type (PPO, POS, HMO, etc.), including the effective date of each plan;

(2) Average number of employees participating in each plan;

(3) Average number of covered lives in each plan;

(4) Description of all medical and prescription drug benefits, including effective dates of any changes in each plan;

(5) Total premium rates by family tier for each insured plan, including effective dates of any changes;

(6) Total COBRA rates by family tier for each self-funded plan, including effective dates of any changes;

(7) Required employee contribution rates by family tier for each plan, including effective dates of any changes;

(8) Funding arrangement (fully insured, self-funded, etc.) for each plan;

(9) Total premiums paid by year for each plan, if insured; and

(10) Total claims paid by year for each plan.

(b) For purposes of this section, a large school district means a school district that had 1001 or more employees at any time during the 2001 school year, as reflected on any report

received by TRS from that school district for a reporting period in that school year.

(c) If a large school district cannot obtain the information required under subsection (a) of this section, the large school district must obtain a letter from the insurer or third-party administrator stating that the insurer or third-party administrator cannot legally provide that information to the large school district. The large school district must submit that letter to TRS in lieu of the requested information in subsection (a) of this section.

(d) TRS will not deny a large school district's request to participate in TRS-ActiveCare based on any information provided to TRS in accordance with the requirements of this section.

(e) TRS may delay a large school district's effective date of participation in TRS-ActiveCare if the school district does not provide the information required by this section within the time frames prescribed in subsection (a) of this section.

(f) TRS may prescribe the form in which large school districts must submit the information required by this section.

Title: Turner Stadium Close-out

Consideration of Close-out and Final Payment to Brae Burn Construction Company Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees approve the final payments of $100,000 and $899,126.45 for Phase 1 and Phase 2, respectively, to Brae Burn Construction Company for a total Guaranteed Maximum Price of $19,982,528.93 for the additions and renovations at Turner Stadium. Background/Impact Information: The 2005 Bond Study Committee reviewed the need for renovations and additions to Turner Stadium and recommended the related construction to the Board. The 2005 and 2008 bond referendum identified and allocated funds for additions and renovations to Turner Stadium. At its March 10, 2009 meeting, the Humble ISD Board of Trustees (Board) approved Brae Burn Construction Company, (Brae Burn) as the Construction Manager at Risk (CM@R) for the project. Based on design development documents approved by the Board at its April 14, 2009 meeting, Brae Burn developed and proposed a Guaranteed Maximum Price (GMP) for the project of $19,983,468. In July 2009, the Board approved the GMP. In November 2010, one deductive change order in the amount of $940.07 was approved resulting in a final GMP of $19,982,528.93. Located in its original location near Humble High School and Ross Sterling Middle School, the renovated Turner Stadium is a premier athletic facility and showcase for the District. In July 2010 representatives of the Architect, HISD Construction Department, and HISD Support Services determined the project was substantially complete. Since that time, all punch list items have been completed to HISD’s and the Architect’s satisfaction. Additionally, all close out documents have been submitted by the contractor, reviewed by the Architect and HISD Construction Department, and audited by HISD’s internal auditor with no material

Title: Woodcreek Middle School Close-out

Consideration of Close-out and Final Payment to Durotech, LP

Superintendent’s Recommendation: The Superintendent recommends that the Board of Trustees approve the final payment of $1,222,165 to Durotech, LP for a total Guaranteed Maximum Price of $24,633,348 for the construction of Woodcreek Middle School. Background/Impact Information: The 2005 Bond Study Committee reviewed the need for Middle School No. 8 and recommended its construction to the Board. The 2005 bond referendum identified and allocated funds for the construction of Middle School No. 8. Middle School No. 8 was eventually named Woodcreek Middle School (WMS) in March 2009. At its February 12, 2008 meeting, the Humble ISD Board of Trustees (Board) approved Durotech, LP, (Durotech) as the Construction Manager at Risk (CM@R) for the project. Based on design development documents approved by the Board at its November 13, 2007 meeting, Durotech developed and proposed a Guaranteed Maximum Price (GMP) for the project of $24,629,086. In October 2008, the Board approved the GMP. In October 2010, one change order in the amount of $4,262 was approved resulting in a final GMP of $24,633,348. WMS is located in the Summerwood area and opened in August 2010. In August 2010 representatives of the Architect, HISD Construction Department, and HISD Support Services determined the project was substantially complete. Since that time, all punch list items have been completed to HISD’s and the Architect’s satisfaction. Additionally, all close out documents have been submitted by the contractor, reviewed by the Architect and HISD Construction Department, and audited by HISD’s internal auditor with no material findings. The warranty period has commenced.
