Consideration of the approval of the Interlocal Physical Therapy and Music Therapy Contracts between Harris County Department of Education and Humble I.S.D.

ADMINISTRATION RECOMMENDATION

The Superintendent recommends that the Board of Trustees approve the contract with Harris County Department of Education in the amount of $78,660 to provide Physical Therapy and Music Therapy Services.

B. Action: CYS Contract

Consideration of Approval of the Agreement between Harris County and Humble ISD

ADMINISTRATION RECOMMENDATION

The Superintendent recommends that the Board of Trustees approve the Agreement (Attachment 1) with Harris County for two (2) Community Youth Services, Youth Services Specialists for the 2007-2008 school year.

Consideration of adoption of Texas Association of School Boards (TASB) Policy Update #80 ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board review updated (LEGAL) policies and act on (LOCAL) policies as recommended in TASB Update #80.

B. Action: Calendar 2007-2008 Revision

Consideration of Revision to 2007-2008 School Calendar

ADMINISTRATION RECOMMENDATION

The Superintendent recommends that the Board of Trustees approve a revision to the 2007-2008 School Calendar that reschedules the April 28, 2008, Professional Growth Day/Student Holiday to April 21, 2008.

C. Action: Addendum to the Highpoint MOU

Consideration of the First Addendum to the “Memorandum of Understanding” (MOU) from the Harris County Department of Education.

ADMINISTRATION RECOMMENDATION

The Superintendent recommends that the Board of Trustees approve the First Addendum to the Interlocal Contract between Humble ISD and Harris County Department of Education proposed in Attachment 1.

Consideration of the revised “Memorandum of Understanding” (MOU) from the Harris County Juvenile Board.

ADMINISTRATION RECOMMENDATION

The Superintendent recommends that the Board of Trustees approve the new agreement included in the “Official Memorandum of Understanding” as presented by the Harris County Juvenile Board.

E Action: Patrol Officer

Consideration for Approval of an Interlocal Agreement with The City of Humble Police Department ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approves the Interlocal Agreement between the City of Humble Police Department and Humble Independent School District.

A. Action: Waiver of P & I

Consideration of Requests for Waiver of Penalty & Interest on Delinquent Taxes ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the requests for waiver of penalty & interest on delinquent tax accounts as described in the background information section.

B. Action: Tax Refund > $500

Consideration of Petitions for Refunds in Excess of $500 ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the petitions for refunds as described in the attachment.

C. Action: Budgetary Amendments

Consideration of Budgetary Amendments ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the budgetary amendments as described in the accompanying attachments.

D. Action: Delinquent Taxes

Consideration of Petition for Removal by Statute of Limitation on Collection of Delinquent Taxes ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the removal of unpaid tax accounts for real property of 20 years or more and for personal property of 10 years of more from the delinquent tax roll.

E. Action: Group Health Re-Insurance

Authorization to renew insurance coverage for the Humble ISD Self-Funded Medical Plans.

ADMINISTRATION RECOMMENDATION

The Superintendent recommends the Board accept the proposal for Group Health Re-Insurance from Symetra, effective September 1, 2007.

F. Action: Employee Long-Term Disability Insurance

Authorization to renew the employee long-term disability coverage, effective, September 1, 2007.

ADMINISTRATION RECOMMENDATION

The Superintendent recommends that the Board renew the long term disability insurance with Standard Life for one year effective September 1, 2007.

G. Action: Resale Properties

Consideration of Resolution for Resale of Properties ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the attached resolution (Attachment 1) for resale of properties currently owned by Humble ISD as listed in Attachment 2 at public auction with the minimum sales price listed.

The Humble Board of Trustees held the regular meeting on July 10, 2007 at 5:30 p.m. in the Board Room, 20200 Eastway Village Drive, Humble, Texas. The Board thanked all of the patrons who had come forward and provided information regarding the water polo club. COMMENTS BY THE SUPERINTENDENT

Dr. Sconzo also thanked the patrons of the district for bringing this information to the Board and was glad to hear the parents have a meeting scheduled next week with the campus principal.

Dr. Sconzo stated that the district will soon be working with external auditors. These experts will be reviewing all administrative activity learning how we as a district can be more efficient in our daily work. ACTION ITEMS FROM CLOSED SESSION

The motion was seconded by Dr. Longnion. The motion passed unanimously.

A motion was made by Dr. Longnion to approve the minutes for the regular board meeting on June 12, 2007. The motion was seconded by Mr. Cunningham. Consideration of Requests for Waiver of Penalty & Interest on Delinquent Taxes The Superintendent recommends that the Board of Trustees approve the requests for waiver of penalty & interest on delinquent tax accounts as presented by administration. Approved by consent.

C. Student Insurance

Approval of Student Accident/Athletic & Catastrophic insurance program with Brazos Valley Insurance Group for a two-year program.

The Superintendent recommends that the Board of Trustees approve the two-year renewal of the voluntary student accident, athletic and catastrophic accident insurance programs from Brazos Valley Insurance Agency for a multiple year contract beginning August, 2007 through August, 2009. Approved by consent.

D. General and Professional Liability

Authorization to renew the inter-local agreement with TASB for General and Professional Liability coverage, effective August 1, 2007.

The Superintendent recommends that the Board of Trustees approve the renewal of the inter-local agreement with TASB for the General and Professional Liability Insurance coverage, effective August 1, 2007 for one year. Approved by consent.

4. SUPPORT SERVICES REPORTS, CONSIDERATIONS AND PURCHASES

A. 2007 Demographic Study Update

Consideration of approval of contract for a demographic study update, including revised long-range enrollment projections for Humble ISD

The Superintendent recommends that the Board of Trustees approve the award of a contract to update the 2005-06 demographic study and long-range enrollment projection to Population and Survey Analysts. Approved by consent.

B. AHS Additions Proposal

Consideration of Proposal Award for Atascocita High School Additions

The Superintendent recommends that the Board of Trustees approve the proposal award for construction of Atascocita High School Additions to Prime Contractors in the base proposal amount of $8,400,000 and also approve Alternate Nos. 1 and 3 in the amount of $580,000. The total recommended award amount including the base proposal and recommended alternates is $8,980,000. Approved by consent.

C. KPHS Additional Funding

Consideration of additional funding for construction of Kingwood Park High School

A motion was made by Mrs. Fields to accept the Superintendent’s recommendation that the Board of Trustees approve additional funding for construction of Kingwood Park High School. The total recommended additional funding amount is $200,000. Of this amount, approximately $155,000 will be used to fund pending change proposals and the remainder will be added to owner contingency (any unspent owner contingency funds will be released and transferred to program contingency at the end of the project). The motion was seconded by Dr. Longnion. The motion passed with the vote six (6) for and one (1) opposed. Mr. Martin opposed.

Following Board discussion, a motion was made by Mr. Lapeze recommending that the Board of Trustees approve a change in the preface to the Board Operating Procedures. The motion was seconded by Mr. Cunningham. The motion was approved unanimously.

The Board discussed, established and accepted a Board Agenda Planning Calendar. Mr. Eggers asked that the Board Calendar Committee to periodically review the Board Agenda Planning Calendar for planning purposes.

Mr. Eggers distributed to the Trustees, the list of Board Committees. Each Trustee had previously been contacted asking them if they feel a committee needed to be added or deleted and of their interest in serving on the committees. Consideration of Dance Team Uniforms for Kingwood High School A motion was made by Mr. Martin to accept the Superintendent’s recommendation that the Board of Trustees approve the purchase of dance team uniforms from Leapin’ Leotards for Kingwood High School. The motion was seconded by Dr. Longnion. Following discussion, the motion passed unanimously.

Consideration of the approval of the Interlocal Physical Therapy and Music Therapy Contracts between Harris County Department of Education and Humble I.S.D. ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the contract with Harris County Department of Education in the amount of $78,660 to provide Physical Therapy and Music Therapy Services. DISTRICT PRIORITY AREA Achieve Academic Excellence BACKGROUND This contract will provide physical therapy and music therapy for students as determined by the ARD committees. Currently the district has unfilled positions due to unavailability of licensed personnel. To ensure continuity of services to students, the District must contract outside with Harris County Department of Education. IMPACT OF THIS ACTION Approving this contract ensures that students will receive services provided by qualified personnel. Not approving the contract will result in students not receiving services, thereby not making progress on goals and objectives as outlined in the IEP. Compensatory time would be required at a later time, most likely at a higher cost. BUDGET INFORMATION This cost of $78,660 will be funded through general operating funds and IDEA Formula B Special Education funds. STAFFING IMPLICATIONS None MONITORING AND REPORTING TIMELINE Identified services will be determined annually based on ARD committee decisions

CYS Contract

Consideration of Approval of the Agreement between Harris County and Humble ISD ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the Agreement (Attachment 1) with Harris County for two (2) Community Youth Services, Youth Services Specialists for the 2007-2008 school year. DISTRICT PRIORITY AREA ADDRESSED Achieve Academic Excellence BACKGROUND Harris County, acting by and through the Harris County Children’s Protective Services Board, operates a Community Youth Services (CYS) Program. This program provides specialized services to children and families within the District that are not currently available to the District through its present staff of employees. IMPACT OF THIS ACTION The Community Youth Services (CYS) Program is an integral part of support services, including crisis intervention, offered to Humble ISD students and their families. The impact of approving this recommendation provides continuing support services to students who are experiencing barriers to learning. The impact of not approving this contract diminishes the support system available to students in need. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) The District’s commitment to this contract in the amount of $60,762.00 will be paid from District and At-Risk funds. MONITORING AND REPORTING TIMELINE This contract will be due for renewal before the beginning of each school year.

Report to the Board of 2007 District and Campus Accountability Ratings AUTHORITY FOR THIS ACTION Policy EKB (Legal) Overall student performance data shall be made available to the public, with appropriate interpretations, at regularly scheduled meetings of the Board, after receipt from TEA. DISTRICT PRIORITY AREA ADDRESSED Achieve academic excellence. INFORMATION The Texas Education Agency released the 2007 Accountability Ratings for public school districts and campuses on August 1. Each year at this time, a full report on the District and Campus Accountability Ratings for Humble ISD are made at the Board meeting and a written report is published on the District’s web site. The attachments provide full information about District and Campus Accountability Ratings for 2007, as well as a ratings history. Highlights of the 2007 Ratings\ In 2007, the Humble Independent School District achieved Academically Acceptable status, with: TAKS passing rates for all students and all student groups meeting the standard for Recognized (75%, but less than 90%) or Exemplary (90% or more) in Reading/English Language Arts, Writing, and Social Studies. TAKS passing rates for all students and for white students were in the Recognized range for Mathematics and Science. SDAA II percent met ARD expectations of 82 percent for all students. Compared to the 2006 TAKS results at the 2007 student passing standards, the 2007 statewide performance on the TAKS improved for all students and all student groups in each subject area tested except Science, which showed small (e.g., 3 points for all students) losses..

The public has a right to know the quality of the schools their children attend and their tax dollars support. Consideration of adoption of Texas Association of School Boards (TASB) Policy Update #80 ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board review updated (LEGAL) policies and act on (LOCAL) policies as recommended in TASB Update #80. DISTRICT PRIORITY AREA ADDRESSED None addressed BACKGROUND The district subscribes to a service provided by TASB to propose and assist with management of Board policies. This Localized Policy Manual Update #80 previously distributed to the Board includes two types of policies. There are a number of (LEGAL) policies which are being amended to reflect changes in legal citations or deleted because the legal provisions have expired. These changes to (LEGAL) policies do not require Board action since they reflect laws already in effect. There are also (LOCAL) policies in this Update which do require Board action, and are being brought to the Board at this time for adoption. The (LOCAL) policies in Update #80 are described in detail in the Explanatory Notes and Vantage Points (previously provided). IMPACT OF THIS ACTION Adopting the LOCAL policies in Update #80 will bring Humble ISD policies into compliance with current state laws and policies. Calendar 2007-2008 Revision

Consideration of Revision to 2007-2008 School Calendar ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve a revision to the 2007-2008 School Calendar that reschedules the April 28, 2008, Professional Growth Day/Student Holiday to April 21, 2008. DISTRICT PRIORITY AREA ADDRESSED Planning for our Future BACKGROUND In July, the Texas Education Agency announced revised dates for TAKS testing for the 2007-2008 school year. The agency was required to change the testing schedule in response to the passage of Senate Bill 1031 during the 80th legislative session, which directs that spring TAKS testing occur later in the school year. Under the new testing schedule, Humble ISD students in grades 3-12 will be involved in TAKS testing April 29-May 2, 2008. The students are scheduled to have a Student Holiday on April 28, 2008. Addendum to the Highpoint MOU

Consideration of the First Addendum to the “Memorandum of Understanding” (MOU) from the Harris County Department of Education. ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the First Addendum to the Interlocal Contract between Humble ISD and Harris County Department of Education proposed in Attachment 1. DISTRICT PRIORITY AREA ADDRESSED Board policy BBE (local) states that “The Board has final authority to determine and interpret the policies that govern schools”. Senate Bill 1 and Senate Bill 133 established the Juvenile Justice Alternative Education Program and requirements for student attendance. BACKGROUND In June the Board approved the “Memorandum of Understanding” between Humble ISD and the Harris County Department of Education (Highpoint) at time sixteen (16) discretionary slots were approved. Each year additional discretionary slots are purchased at the Harris County Juvenile Justice Alternative Education Program which gives Humble ISD an alternate placement for students. In the past, the cost of the JJAEP discretionary slot was $59 per day with additional funding provided under the Chapter 41. This year the additional funding will not be provided under Chapter 41 and Humble ISD will incur the extra expense. Discretionary slots at JJAEP will be $90 per day for Humble ISD. Due to the significant change in cost to the district, it is recommended that we purchase additional discretionary slots at Highpoint and allocate JJAEP only for mandatory placements. The attached addendum updates the memorandum reacting to recent legislation and identified needs as well as adding an additional 9 discretionary slots. Humble ISD will purchase a total of 25 slots. IMPACT OF THIS ACTION The adoption of the Highpoint MOU at the June 12, 2007 board meeting approved the purchase of sixteen (16) discretionary slots at a total cost of $126,400.00 for the 2007-2008 school year. This addendum is to request the purchase of nine (9) additional discretionary slots from Highpoint at a cost of $71,100. The total cost for Highpoint would be $197,500 for twenty five (25) slots.

ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the new agreement included in the “Official Memorandum of Understanding” as presented by the Harris County Juvenile Board. In the past the district has purchased discretionary slots at JJAEP as well as discretionary seats at Highpoint. Last year the discretionary slots at JJAEP were $59 per day with additional funding provided under the Chapter 41. This year the additional funding will not be provided under Chapter 41 and Humble ISD would incur the additional expense. Due to the significant change in cost to the district, it is recommended that we do not purchase discretionary slots at JJAEP and use this facility for mandatory students only. IMPACT OF THIS ACTION The district will continue to place mandatory students at JJAEP. All discretionary placements will be sent to the Highpoint Alternative School. This change will save the district $99,000. Adoption of this memorandum assists the district in finding cost-effective options for the education of expelled students. Patrol Officer Consideration for Approval of an Interlocal Agreement with The City of Humble Police Department ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approves the Interlocal Agreement between the City of Humble Police Department and Humble Independent School District. DISTRICT PRIORITY AREA ADDRESSES Policy CH (Legal) and the Texas Interlocal Cooperation Act, Chapter 791, Texas Government Code. BACKGROUND The City of Humble police officer patrolling at Humble High School campus will be in addition to the District’s security officer. The Agreement shall be for the 2007-08 school year beginning August 27, 2007 through June 3, 2008. IMPACT OF THIS ACTION The safety and security of Humble ISD students is of the utmost importance to the administration of the District and parents of the students attending Humble High School. The officer patrolling this campus is a visual deterrent to anyone contemplating behavior that could lead to injury to District students and/or staff members. If approval is given, the District’s police teams presence can be further enhanced by showing city law enforcement agencies working together to ensure safety and security remains on the forefront of priorities. INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY OF HUMBLE

AND HUMBLE INDEPENDNT SCHOOL DISTRICT

THE STATE OF TEXAS § § COUNTY OF HARRIS §

THIS AGREEMENT is made and entered into pursuant to the Interlocal

Cooperation Act, Chapter 791 of the Texas Government Code, by and between the City

of Humble (the “City”), acting by and through its City Council and City Manager, and

Humble Independent School District (the “District”), acting by and through its Board of

Trustees and its General Superintendent.

PREMISES

WHEREAS, the District operates the Humble High School Campus on Wilson

Road within the corporate limits of the City;

WHEREAS, the District is authorized to employ and commission peace officers

to provide security on its campuses;

WHEREAS, the District, to augment the Districts own peace officers to provide

security on its Humble High School Campus, desires to enter into an interlocal agreement

whereby the City would assign one or more of its officers to patrol this campus during the

hours that school is in session;

WHEREAS, the City is willing to assign one or more of its officers to patrol the

District’s Humble High School Campus in exchange for the District’s agreement to

reimburse the City a fixed amount, which is calculated to be approximately 70% of the

salary and expenses of one full-time officer.

NOW, THEREFORE, the City and the District agree as follows:

AGREEMENT

Article 1

Scope of Services

The City shall, during the term of this Agreement, assign one or more if its police

officers to patrol the District’s Humble High School Campus during the time that classes

are in session at this Campus, exclusive of summer school. The assigned officer shall

devote (or, if multiple officers are assigned, a cumulative total of) eight (8) hours per day,

for each day that classes are in session, exclusive of summer school, to patrolling and

providing police security to the Humble High School Campus and performing related

duties. These related duties shall include, without limitation, preparing for each day’s

patrol activities, conducting District-related investigations, transporting and processing

persons arrested while providing patrol services to the District, and attendance at court in

connection with cases arising out of the arrests made or citations issued while providing

patrol services to the District.

Article II

Payments by District

The District agrees to pay the City the fixed sum of $41,261.00 as reimbursement

for the cost of the services provided under this Agreement. The District shall pay this

sum in four equal installments of $10,315.25. The first installment of $10,315.25 shall be

due and owing on the seventh (7th) business day after the date that this Agreement is

executed and approved by the Board of Trustees for the Humble Independent School

District (the “Board”). Subsequent installments shall be due and owing as follows:

(a) Second installment due December 14, 2007;

(b) Third installment due March 14, 2008; and

(c) Final installment due June 13, 2008.

Article III

Supervision and Control of Police Officers

The City and the District agree that the officer or officers assigned to patrol the

District’s Humble High School Campus shall remain under the control and supervision of

the City’s police department and shall not be subject to the control or supervision of the

District or any of it’s employees. The duties of the officer or officers assigned to patrol

the District’s Humble High School Campus shall be those duties established and

recognized under laws of the state of Texas, in addition to those duties outlined in Article

I of this Agreement. The City shall require any officers assigned to the Humble High

School Campus under this Agreement to attend at least one course offered by the Texas

School Safety Center (TxSSC) for “school resource officers” upon the District’s request.

The District shall be responsible for payment for any course fees to the TxSSC.

Article IV

Limitation of Remedies

The sole obligation of the City to the District is to assign one or more officers to

patrol the District’s Humble High School Campus. Should the City fail, for any reason,

to carry out its obligations under this Agreement the sole remedy of the District shall be

to receive a refund proportionate to the period of time in which the City failed to assign

an officer to the District’s Humble High School Campus. The District understands that

the City can not guarantee or insure the safety of the District’s students, faculty or

property and that by entering into this Agreement it does not undertake to do so. The

District further understands that the City retains the discretion to determine the level and

type of police services that it will provide to the community, including the District, and to

assign its police officers as it deems appropriate.

Civil Liability

The City, as the authority with exclusive control and supervision of the assigned

officer(s), shall be responsible for all civil liabilities and related costs and expenses that

arise from the actions or omissions of any officer(s) assigned to the Campus under this

Agreement. However, nothing in this Agreement is intended to waive the City’s or the

District’s governmental immunities provided under the laws of the state of Texas.

Term

This Agreement shall be for a fiscal term beginning August 27, 2007 through June

3, 2008.

Termination

Either party may terminate this Agreement upon thirty (30) days written notice if

either party determines that the continuance of this Agreement is not in its best interest.

Notices to the City must be sent to the City Manager or his designee. Notices to the

District must be sent to the Superintendent or his designee.

Waiver of P&I Consideration of Requests for Waiver of Penalty & Interest on Delinquent Taxes ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the requests for waiver of penalty & interest on delinquent tax accounts as described in the background information section. DISTRICT PRIORITY AREA ADDRESSED Maximize Our Financial Resources BACKGROUND Texas Property Tax Code, Section 1.08 Timeliness of Action by Mail. When a property owner is required by this title to make a payment or to file or deliver a report, application, statement, or other document or paper before a specified date, his action is timely if: (2) it bears a post office cancellation mark of a date earlier than the specified date and within the specified period or the property owner furnishes satisfactory proof that it was deposited in the mail before the specified date and within the specified period. Texas Property Tax Code, Section 33.011(a) Waiver of Penalties and Interest states that the governing body of a taxing unit shall waive penalties and may provide for the waiver of interest on a delinquent tax if an act or omission of an office, employee, or agent of the taxing unit or the appraisal district in which the taxing unit participates caused or resulted in the taxpayer’s failure to pay the tax before the delinquency and if the tax is paid with 21 days after the taxpayer knows or should know of the delinquency. The taxpayers have provided satisfactory proof to the District. Information related to the requests for waiver of penalty and interest has been documented in the attachment. Detailed information related to each request is on file in the Tax Office. IMPACT OF THIS ACTION If the Board approves this consideration, Humble ISD will be in compliance with the Texas Property Tax Code. Real property accounts are delinquent on the tax roll for several reasons such as: the property is in an undesirable location in the district, there is possible environmental pollution, or the research of deeds at the County Court House shows the deeds are so “clouded” that delinquent tax litigation is impossible. Personal property also has several reasons for delinquency. Examples of personal property are business inventory, mobile homes, and vehicles registered in a business name. These accounts remain delinquent on the roll when a business files bankruptcy or when a business closes down. Vehicles registered in a business name are on the delinquent roll when people close a business, move, or sell the vehicles. Frequently, the tax collector cannot locate the property owner to begin litigation. Mobile homes are sold and moved frequently. IMPACT OF THIS ACTION If the Board approves this consideration, Humble ISD will be in compliance with the Texas Property Tax Code. If the Board does not approve this consideration, the District will not be in compliance. BUDGET INFORMATION At fiscal year end, all unpaid delinquent taxes are recorded in the financial statements as receivables. At June 30, 2007, the total amount of delinquent taxes receivable was $9,157,410.41 (see attachment). Removal of the 1986 real property accounts will be in the tax amount of $68,806.61 (this includes one account prior to 1986 in which litigation has ended). The removal of the 1996 personal property accounts will be removed in the tax amount of $56,732.95. The total amount to be removed is $125,539.56.

Group Health Re-Insurance Authorization to renew insurance coverage for the Humble ISD Self-Funded Medical Plans. ADMINISTRATION RECOMMENDATION The Superintendent recommends the Board accept the proposal for Group Health Re-Insurance from Symetra, effective September 1, 2007. DISTRICT PRIORITY AREA ADDRESSED Maximize financial resources. BACKGROUND Re-insurance coverage is carried on the district’s self-funded medical plans to protect the plan and the district from liability due to adverse claim experience. Several companies were provided claims information from the Humble ISD Medical Plan. A renewal quote from Symetra (current carrier) and a quote from Standard Security were received at specific deductible levels of $175,000 (current level), $200,000 and $225,000. Seven other companies were also requested to bid. AIG does not quote public entities. Best Re/Standard Life, HCC Life, Zurich, and Cairnstone/Transamerica declined to quote due to claims history or ongoing claims. No response was received from Excess Re/American Fidelity and ING. The attached exhibit provides a comparison of current coverage and the proposals for next year. The re-insurance market continues to provide few carriers and combined with the number of catastrophic claims experienced by our health plans in the last few years and the potential catastrophic claims being experienced currently, it is not unreasonable to see an increase in this coverage. With the increase in employees as the district grows, we have an increase in the possibility of catastrophic illnesses. Along with this, there is a chance for chronic conditions that would require long-term medical treatment. With re-insurance, the aggregate coverage protects the overall fund balance of the plan, and the specific coverage protects the plan from a large claim on any one individual. Our current retention level or specific deductible is $175,000. Due to the number of large claims for this year, it is not recommended that this be changed for the coming year. For this reason, Proposal #1 (renewal from Symetra) is recommended.

Employee Long Term Disability Insurance

Authorization to renew the employee long-term disability coverage, effective, September 1, 2007. ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board renew the long term disability insurance with Standard Life for one year effective September 1, 2007. DISTRICT PRIORITY AREA ADDRESSED Maximize financial resources BACKGROUND The district’s benefit program currently provides long-term disability for all TRS-eligible full-time employees with a 210-day waiting period. This is in addition to the district’s self-funded short-term disability plan. Currently, the Long-Term Disability program provides a maximum of $9,000 of income per month. Due to the volume of claims Humble ISD had in the past, it is recommended that the income paid will be 60% of the salary. The renewal of this policy is at $0.15 per $100 payroll until expiration of the policy in August 31, 2008. IMPACT OF THIS ACTION Maintaining this coverage will assist in keeping the district’s overall benefit program comparable to other school districts in our area. BUDGET INFORMATION Funds for long term disability insurance are contained in the budget. Consideration of Resolution for Resale of Properties

ADMINISTRATION RECOMMENDATION

The Superintendent recommends that the Board of Trustees approve the attached resolution (Attachment 1) for resale of properties currently owned by Humble ISD as listed in Attachment 2 at public auction with the minimum sales price listed.

BACKGROUND

Texas Property Tax Code, Sec. 34.05, Resale by Taxing Unit, states that property that is “bid off” to a taxing unit due to insufficient bids may be offered at any time for resale. “The taxing unit purchasing the property by resolution of its governing body may request the sheriff or a constable to resell the property at a public sale.”

When real property that has been ordered sold pursuant to foreclosure of a tax lien is offered at the initial tax sale, the minimum bid is calculated as the total amount due under judgment (including all taxes, penalties, and interest) plus any other amount awarded by judgment, court costs, and the costs of the sale or the adjudged market value of the property, whichever is less. If no one offers the minimum bid for the property, it is “bid or struck off” to the taxing unit that ordered the sale (the purchasingtaxing unit) to hold in trust for itself and the other taxing jurisdictions.

Pursuant to Section 34.05 of the Texas Property Tax Code, the property may be offered at a public sale for any amount. The resolution for resale may recommend a minimum bid. In accordance with Section 34.06 of the Texas Property Tax Code, the purchasing taxing unit retains an amount to reimburse reasonable costs (defined in Section 34.21) incurred by the unit. The purchasing taxing unit then pays all costs of the suit and sale of property in accordance with Section 34.02. After all costs are paid, any remaining balance of proceeds is paid to each taxing unit participating in the sale on a pro-rata basis.

The District works closely with Perdue, Brandon, Fielder, Collins & Mott, L.L.P., to determine which properties to foreclose on; taking only those properties we believe can be promptly resold. The attached listing represents all properties that have been bid off to the District since 2005. Although the District may receive less than the full amount owed, the resale procedure allows the property to be taken off the delinquent tax roll.

IMPACT OF THIS ACTION

Approval of this action will authorize the county constable to resell the properties at public auction.

If approved, the process for resale will begin with a publication notice that must be published for three weeks before the sale. On the 14th day of August, 2007, at a regularly scheduled meeting of the Board of

Trustees of Humble Independent School District (District) a motion was duly made and

seconded that the District resell the property described on Exhibit "A" attached hereto

which was acquired through tax foreclosure proceedings, and that the District request that

Glen Cheek, Constable of Precinct 5, Harris County, Texas conduct such sale in

accordance with Section 34.05(a)(c)(d), Property Tax Code, and that such sale be held at

the earliest available date in accordance with the laws of the State of Texas; and further,

that the District notify the Constable that it would not object to a minimum sale price of

such property in the sum of $1,000.00.

Discussion amongst the Trustees was then conducted, and upon completion of the

same the presiding officer of the Board called for a vote on the motion, and the same was

passed by majority. Now therefore:

accordance with Section 34.05(a)(c)(d), Property Tax Code, the property described on

DISTRICT PRIORITY AREA ADDRESSED Maximize Financial Resources BACKGROUND All school campuses require kitchen equipment to be maintained in an acceptable working manner in order for District Child Nutrition Services employees to prepare meals for District students. Repairs of this equipment are done by District personnel, which require ordering new parts and/or accessories as needed. Because some parts can only be purchased through original equipment manufacturers or select manufacturer’s distributors, it is necessary to negotiate discounts off of list prices per product line. Consideration of Generator Maintenance Services ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the purchase of Generator Maintenance Services from Generators of Houston and Waukesha-Pearce. DISTRICT PRIORITY AREA ADDRESSED Maximize Financial Resources BACKGROUND In order to ensure that District generators operate at the highest capacity, preventive maintenance inspections are performed twice a year. In addition, as generator problems surface it is necessary to establish set service call rates for labor, parts, and materials required for repairs. Generators of Houston has offered the District the best overall value for semi-annual inspections, while Waukesha-Pearce offered the best overall value for as-needed maintenance repairs as it relates to labor, parts, and materials. Request for Proposals (RFP) were sent to nine (9) vendors and three (3) bids and one (1) no-bid was received. IMPACT OF THIS ACTION The process of utilizing the selected vendors will accommodate routine maintenance on a semi-annual basis on all District generators. It also provides hourly charges and a discount structure for parts and materials should a unit become inoperable. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) Expenditures associated with these services during the twelve month period are anticipated to be approximately $30,000. This includes $9,482 for semi-annual maintenance inspections and labor, parts, and materials as needed when units become inoperable. Utensil Packs

Consideration of Imprinted Utensil Packs ADMINISTRATION RECOMMENDATION The Superintendent recommends that the Board of Trustees approve the purchase of imprinted utensil packs from Wallace Packaging. DISTRICT PRIORITY AREA ADDRESSED Maximize Financial Resources BACKGROUND Disposable utensil packs are used at meal service every day at each campus. The use of disposable utensil packs reduces costs by eliminating the need for metal silverware which is often inadvertently thrown in the trash. In addition, misuse of metal utensil may cause injury to students. Utensil packs are imprinted with the Child Nutrition Logo. IMPACT OF THIS ACTION Approval of this proposal will provide students with sanitary eating utensils and allow the district to establish firm pricing for the fiscal year. Request for Proposals (RFP) were sent to eleven (11) vendors and three (3) bids were received. BUDGET INFORMATION The expenditure for this purchase will be disbursed from CNS operating funds budgeted for this purpose in the amount of $27,000. MONITORING AND REPORTING TIMELINE Vendor performance, product quality, availability and price are monitored by Child Nutrition staff. Design Development for MS#8 Discussion of Design Development Documents for Middle School No. 8 in Summerwood ADMINISTRATION RECOMMENDATION Report on the design of Middle School No. 8 to be located in the Summerwood area west of West Lake Houston Parkway and north of Beltway 8. DISTRICT PRIORITY AREA ADDRESSED Plan for Our Future BACKGROUND At its meeting on July 11, 2006, the Board authorized Joiner Partnership, Inc. to provide architectural services to program and develop the design for Middle School No. 8. The design development documents, which are being presented for approval, are a result of the collaboration of the design professionals and the Middle School No. 8 Steering Committee comprised of District administrators and staff members. In particular, significant input was received from teachers and staff members at Timberwood Middle School and, in particular, from Carol Atwood, Principal at Timberwood Middle. The basic floor plan for this design has been used successfully in Willis ISD. As a result of a site visit to the Willis ISD middle school by several Humble ISD staff members and the architect, several modifications have been made to incorporate Humble ISD construction and design standards. The scope of this project includes the following:

• New middle school of 175,120 square feet to accommodate up to 1,050 students

• Sports fields and playfields on 18 acres • Parking lots and driveways • Constructed adjacent to a 34,059 square foot YMCA facility with some

shared facilities and spaces The schedule for the project is as follows:

• Construction documents complete in March 2008 • Award contract to general contractor in May 2008 • Construction phase from June 2008 through June 2010 • Open new middle school in August 2010

Design Development for MS#8 jeopardize the District’s ability to substantially complete this project on schedule. If, however, the design development documents are approved and accepted at the September Board meeting, Joiner Partnership will proceed with the preparation of Construction Documents. If all proceeds according to schedule, the project can be completed in August 2010. BUDGET INFORMATION (INCLUDING ANY STAFFING IMPLICATIONS) Funding for this project will come from an additional bond sale in Phase 5 of the 2005 Bond Program. The total project cost is estimated at $28 million. The budgeted construction cost for this project is approximately $25 million. The school will be staffed according to Humble ISD staffing guidelines. MONITORING AND REPORTING TIMELINE Members of the Humble ISD Construction Department, along with the architect, will monitor the progress to ensure that the work will be performed in compliance with the specifications. A construction contract will be presented at a future Board meeting for consideration. Periodic reports will be provided to the Board and administration. In addition, the District is currently making use of its web site to keep the community informed about the progress of all bond projects.
