pursuant to Subsections (b) and (c) may be transferred to the Texas Mobility

Fund upon certification by the Texas Transportation Commission to the

comptroller that a payment is due under an obligation pursuant to Article 3,

Section 49-k of the Texas Constitution. Funds in the Texas Mobility Fund debt

service account are not appropriated in the state fiscal year ending August 31,

2004."

OVERCHARGING. (a) A person is subject to a civil penalty of $1,000 if the

person continues to collect tax on an exempt item or to overcharge tax on a

taxable item after receiving two written notices from the comptroller in relation to

those actions. The person is subject to the civil penalty regardless of whether the

person remits the collected tax to the comptroller.

(b)iiEach violation of Subsection (a) is subject to a separate civil penalty.

(b)iiThis section takes effect September 1, 2003, and applies to a violation

REPRESENTATIVE HOCHBERG: Mr. Pitts, you are the author of HB 3459 andyou are also on the conference committee on HB 1, and you were also the chairof the Education Subcommittee of the Appropriations Committee. You probablyhave a good idea what all this stuff does or doesn ’t do?REPRESENTATIVE PITTS: Well, I depend on you for a lot of that.

HOCHBERG: Well, thank you, Mr. Pitts. Let me just make clear that in Section68 where you ’re adjusting the guarantee deal, you did not intend for that to haveany effect on any other sections of code, any effect on any other parts of Chapter42––those continue to function in the manner that they would function?

PITTS: That is correct. We have no intention to make any other changes inChapter 42. It was just a method––a compromised method on how to get moremoney to our schools.

HOCHBERG: And this is a method of flowing money to the school districts andgiving them that entitlement to that money for this period of time?

PITTS: That is correct.

IN CERTAIN MUNICIPALITIES. (a) In any municipality with a population of

1.18 million or more, the governing board of a private, nonprofit medical

corporation that provides security services for an institution of higher education

or a private postsecondary educational institution and other entities located within

the same medical complex, or that provides security services for a branch of that

medical corporation [complex], may employ and commission security personnel

to enforce the law of this state within the jurisdiction designated by Subsection

(c) [at the medical complex and its branches].


(b)iiAn officer commissioned under this section may make arrests and hasall the powers, privileges, and immunities of a peace officer while [on theproperty under the control and jurisdiction of the medical corporation or whileotherwise] performing the officer ’s [his] assigned duties within the jurisdictiondesignated by Subsection (c). An officer assigned to duty and commissioned shalltake and file the oath required of peace officers and shall execute and file a goodand sufficient bond in the sum of $1,000, payable to the governor, with two ormore good and sufficient sureties, conditioned that the officer [he] will fairly,impartially, and faithfully perform the duties required of the officer [him] by law.The bond may be sued on from time to time in the name of the person injureduntil the whole amount is recovered.

(c)iiThe jurisdiction of an officer commissioned under this section is limitedto:

(1)iiproperty owned, leased, managed, or controlled by the medicalcorporation; and

(2)iia street or alley that abuts the property or an easement in or aright-of-way over or through the property.

(d)iiAn officer commissioned by a medical corporation under this section isnot entitled to compensation or benefits provided by this state or a politicalsubdivision of this state.

(e)iiThe state or a political subdivision of this state is not liable for an act oromission of an officer commissioned under this section during the performanceof the officer ’s assigned duties.

(f)iiA medical corporation may not commission a person under this sectionunless the person obtains a peace officer license issued by the Commission onLaw Enforcement Officer Standards and Education. The medical corporationshall pay to the Commission on Law Enforcement Officer Standards andEducation on behalf of an employee any fees that are necessary to obtain arequired license.

(g)iiA person ’s commission and any authority to act as an officer under thissection are automatically revoked if the person ’s employment with a medicalcorporation is terminated for any reason.

(b)iiThis section takes effect September 1, 2003.(c)iiA person commissioned before the effective date of this section by a

private nonprofit medical corporation under Section 51.214, Education Code,must obtain a peace officer license issued by the Commission on LawEnforcement Officer Standards and Education not later than September 1, 2004.If that person does not obtain the license by that date, the person ’s commissionand any authority to act as an officer under Section 51.214, Education Code, asamended by this section, are automatically revoked.
