As we begin to prepare for spring and the start of the home building “season”, the phone lines heat up at the Chippewa Valley Home Builders Association with calls from homeowners looking for professional contractors to build the home of their dreams. Now is the perfect time to remind homeowners and others in the industry about copyright infringement.

Because there is so much work that goes into the design and construction of a home, there are also laws in place that protect each home’s unique design. Just as there has been copyright protection in place to safeguard the original works of authors of literary, dramatic, musical and artistic works, in 1990, copyright protection was extended to include architectural works. With respect to new home construction, the federal copyright laws protect the copying of all or a portion of a home design. Protection is found in two different areas:

• Theprotectionofthedesignplans(includingblueprintsandfloorplanlayouts).• The protection of the completed structure. This extends to its overall interior and exterior appearance.

This means that while you are welcome to gather a variety of home plans at events such as those presented by Chippewa Valley Home Builders Association and other organizations, you need to remember that the plans builders have available for you, detailing the layout and the exterior of the home, are for educational purposes only. You may not copy those plans. If you bring to a builder a plan you’ve found online, from events or elsewhere without purchasing the rights to the plan, asking him or her to duplicate the same home for you would be in direct violation of the 1990 Copyright law.

ManycopyrightinfringementcasesinWisconsinhaveresultedinextensivelitigationandsignificantjudgments.Theconsequencesforplanstealingareveryseriousandcanresultinsubstantialfinancialpenalties.Recentpartiesconvicted of architectural copyright infringement have been required to pay anywhere from $15,000 to $125,000. In future cases, penalties may be higher or lower depending on the extent of copyright infringement. Consumers interested in building new homes are encouraged to follow this advice to avoid copyright infringement claims:

• Neveraskonebuildertocopyallorpartofthedesignorfinishedappearanceofanotherbuilder.• When interviewing builders and shopping for different home designs, ask each builder you interview whether he or she has a home design that incorporates the style or features you are looking for. Explain the style or features by giving examples; but keep in mind that copying is prohibited.• Makesurethatyouarepurchasingtherightstoalegitimateplanbyaskingthebuildertoconfirmthatheorshe has the right to build the plan or design that you have selected.

Ifyouseeaspecificfeature,likeasunroom,inahomethatyoulike,youcouldaskthebuilderyouwouldliketowork with if they have something similar in one of their home designs or if they could design something similar. The key to avoiding copyright infringement is to understand that copying any part of another builder’s plan is against the law. If you ask your builder to construct the same exact feature found in another builder’s home, it is a violation. Keep in mind that individual standard features or design elements that are functionally required may not becopyrighted(suchasdoors,windowsandstairs).

One question frequently asked is how handwritten sketches are viewed with regard to the copyright law. Many homeownersbelievethatwhentheycontributetheirownsketchtoabuilder,detailingideasforafloorplanoraspecificdesignidea,thattheyhaverightstothefinaldesignofthehome.Inreality,thecopyrightisownedbythepersonwhoputstheideasintofinalform.Whenanowner’ssketchisincorporatedintoanarchitecturaldesignit

becomes part of the architectural design and becomes the property of the person who drew the plan. While the homeowner still has rights to his or her sketch, that is the only part of the plan he or she may take to another builder without having to worry about infringing on the copyright owned by another party.

Another common myth is that if you alter a plan by a certain percentage, you are not in violation of copyright laws. Simplyusinganotherbuilder’splanasastartingpointwouldplaceyouinjeopardyofviolatingthelaw.

Copyright infringement – two simple words brought on by one simple action – copying. If you want your home building experience to be a positive one, stick with the plans you know are legitimate.

Create an outdoorLiving Room

The backyard patio or deck has long been a favorite place for summer fun and cookouts, but more and more, people are discovering new ways to repurpose their outdoor space. An outdoor living room can expand the functional area of your home by taking advantage of your extra outside space. The advantages are many. Creating a living room outdoors can save energy, add living space to your home, enable people inside to be undisturbed while company is entertained outside.

Consider using the following elements to transform your deck or patio into a multipurpose living space - an outdoor extension of your living room. • Lighting can set the tone for a relaxing space, just as

you would indoors. Solar lights make this an easy, energy-efficient choice.

• At least one wall can anchor your space and make it feel more like a room. Try to imagine sitting indoors on your couch, with the walls taken away. Though the wide open area might seem nice, you may feel a little exposed. Aside from building a fence, creating privacy for your outside living room can be as simple as a wall of shrubs, a bamboo screen or an arbor with vines. It of course can be an actual wall (such as the side of your house or garage).

• A weather resistant rug will define your area as more of a room than just a corner of the yard with furniture.

• Nothing makes a room feel more like a room than having cover over your head. Your outdoor “roof ” can be anything from the shade of a large tree, an umbrella, a retractable awning, or even a permanent structure like a gazebo or pergola. It all depends on your budget and needs. Either way, keeping the sun and rain at bay will have an effect on what types of fabrics, building materials or electrical appliances you are able to safely use in your outdoor room.

• Furniture obviously belongs in your room. What type depends on how protected from the weather your furnishings will be. How they are placed is important too. The idea is to arrange your furniture in a way that people can face each other, creating a conversation area. Tables and end tables add practicality - making the room feel more complete.

As you assemble your new outdoor living room, there are a few things to keep in mind that will help you get the most out of it. • Like any other room inside your home, try to add the

“homey” touches that compliment your design tastes. Because it is outside, try to bridge your interior decor with the outdoor surroundings.

• Keep the size similar to an indoor counterpart. The temptation may be to take advantage of all that space, but you will lose the intimacy of a living room.

• Lay out your new outdoor space in such a way that it compliments your landscaping, while remaining practical. The point is to enjoy your time outside, so be aware that you may have to trim and mow around this new area. Try not to lay things out so it will make lawn maintenance more of a chore.

• Effective use of blinds, curtains and plants will both increase your privacy and add to the cozy intimate feeling you get from relaxing indoors.

• A focal point such as a fire pit, grill, fountain, or even a TV (above your outdoor bar, of course) will make the room that much easier to relax and enjoy company in.

As you can see, creating this space requires more than just throwing down a rug and putting your patio furniture on top. If you are planning on building any type of overhead structure like a pergola, setting up an arbor or lattice wall, or putting down a patio, it’s a very good idea to seek out assistance from experts such as professional contractors or companies that provide these types of services.

Hydrangea HappinessHydrangea happiness reaches its height at the end of summer. Many other varieties of shrubs and flowering plants lose their luster as summer heats up while the hydrangea comes on the scene with its spectacularly large flowers that are standouts in any landscape or flower bed. Recent breeding has translated into even more astounding varieties than ever

before. Spring is the time to plan for this spectacular display. It takes a summer of growing for the hydrangea to gain energy to produce amazing blooms that will make you smile through fall.

Recent year’s hydrangea varieties have given those of us in the northern regions of 3 and 4 hardiness zones an abundance of striking new colors, new habits and better plants from which to choose. That makes everyone happy!

The Endless Summer® Original might be thought of as the beginning of the hydrangea breeding explosion. This variety was a real breakthrough with a blue flower that would bloom after winters with lows of -30 degrees. Since then, a Lacecap Twist N Shout® Hydrangea has been introduced. Like the original Endless Summer®, this variety can bloom blue or pink depending upon the acidity of the soil in which it is grown. The most recent addition to the series that is hardy to -30 degree winters is Bloomstruck®. The flowers of Bloomstruck® are more toward the purple or a rose-pink color depending upon the acidity. The stems are stronger and it seems able to bloom better than the original. All three of these varieties are able to bloom through the summer. They do take some special care that the other varieties of hydrangea do not.

When caring for Endless Summer® Hydrangea, the acidity of the soil will affect the number and the color of your blooms. The proper acidity and desired blooms are achieved by simply adding an acidic fertilizer or amending the soil with Hi-Yield™ Aluminum Sulfate a couple times a season or Hi-Yield™ Soil Sulfur once a season.

New varieties of the snowball type of hydrangea have also arrived. You may know of the older variety call Annabelle®. Great flower power and large white blooms begin the end of July, but all the flowers bow to the ground and loose their appeal after the first rain. The new Incrediball® Hydrangea is the same style of plant, but has a much stronger stem and larger flowers--up to 10 inches in diameter! Next comes some new colors. The pink Invincibelle® Spirit Hydrangea. The 2015 season offers an even darker pink, almost red, Invincibelle® Ruby. These snowball type hydrangea are all hardy to -35 to -40 degrees, true Zone 3 hardiness.

The most popular hydrangea is the cone shaped flower type. Limelight wowed us a few years ago with its greenish buds that opened to nice white flowers. Pinky Winky® appeared

with its large flowers that turned a nice shade of pink as they matured. If you want color earlier, Quick Fire® Hydrangea performs. Recently a smaller version of Quick Fire® called Little Quick Fire® became available offering the same blooming habits, but less pruning since it grows only about 4 feet tall. A really short cone shaped flowering hydrangea, the new Bobo® offers white cone shaped flowers on a plant that grows only 30-36 inches tall at its tallest. A perfect addition to a small space! These are slower to bloom than the Quick Fires®, but they do age to a nice pink hue as they mature. If an even darker flower makes you smile, a nearly red hardy hydrangea, Fire Light®, is new this year. More good news follows these cone shaped hydrangeas. They are all hardy to -40 degree winter temperatures.

A number of the varieties have been grown in a short tree form. These tree forms only grow to about 12 feet tall and get around 10 feet wide. This makes a nice small tree for flower bed areas or near the house as it will not grow too

tall. Remember, hydrangeas bloom late summer into fall and create interest during a time when other plants have finished their bloom period.

There is no shortage of hydrangea varieties and forms and there are more to come! Show off a little in the dog days of summer by planting a hydrangea this spring to beautify your landscape. It’s sure to bring happiness to you and everyone that passes by.

The spring white flowers of Fire Light® turn a rich pomegranate pink/nearly red and they withstand our Wisconsin winters.

The Chippewa Valley Home Builders Association is excited to announce their most recent community outreach project! They are assisting in building the Pavilion at Jeffers Park, located on the north side of Eau Claire.

The mission of the Jeffers Park Development Project is to plan and construct Jeffers Park to feature a five field baseball and softball complex and include other such public park amenities as a playground, pavilion, and trails. The land is owned by the City, and the use is provided by City Council. The project is a collaboration of two youth sports leagues, the Eau Claire National Little League and Eau Claire Fast Pitch, plus the city of Eau Claire. This ball field complex will be the first co-ed fields in the City and expand the current limited access to available fields.

any surface? 9 Test the doorbell, the intercom system, the garage

door opener and any other optional items.

foundation walls? 9 Are there any obvious defects in exposed

components, such as floor joists, I-beams, support columns, insulation, heating ducts, plumbing, electrical, etc.?

house?

Some problems may not be readily apparent during the walk through. Even a professional inspector might miss a few. Most warranties cover problems that are the result of faulty workmanship. However, warranties usually exclude problems that result from owner neglect or improper maintenance. Be sure you’re comfortable with all the components of your home, how they operate, and how they are to be maintained before you take occupancy.

Home Renovation$: Get the Bigge$t Bang for Your BuckRenovations are a great way to add value to your home. Dollar signs may flash through your mind when you think about renovating, but you don’t have to update every part of your home to increase its value. Rather, you should focus on a few key areas and balance cost with value, giving you the best return on investment. Renovations create an up-to-date, convenient living space, as well as increase your home’s resale value. So, where should you focus your energy to get the most bang for your buck?

• Update the kitchenOn the cost versus value scale, a kitchen renovation requires a large investment, but also delivers a great deal of value. Large-scale renovations may include installing new countertops and cabinets, adding an island for storage and preparation space, replacing old appliances and incorporating a backsplash that complements the colors and style of your kitchen. A walk-in pantry is also a great addition if there is enough space to accommodate it. Because the kitchen is the nerve center of a home, upgrades will make a huge impact. The money you put in will be paid back in dividends when it comes time to sell.

• Remodel bathroomsOne goal of a bathroom remodel is to create an updated, clutter-free space. To achieve this, you can install new flooring, countertops and fixtures, and put a fresh coat of paint on the walls. If your master bathroom only has one sink, consider adding a double vanity. In addition, make sure there is adequate storage for towels and other accessories. Bathroom renovations require a fairly sizable investment, but they also increase the overall value of your home.

• Add storage spaceFor most, storage space is a necessity. If you don’t have enough room to store pots and pans in the kitchen or towels in the bathroom, your home becomes infinitely less functional. Carve out any additional storage space that you can—put up shelves in the basement or cut out a space between the studs to install a cabinet. Identify where the biggest problem areas are, and look for ways to create storage solutions.

• Maintain the yardYard maintenance doesn’t have to mean elaborate landscaping or expensive outdoor projects. Regular upkeep such as mowing the lawn, trimming bushes and pulling weeds will do the trick. A well-manicured yard is a signal to buyers that you put the same care and attention into the rest of the home, instantly making it more attractive.

• Basic home maintenanceJust as a properly maintained yard adds value, so does a properly maintained interior. This includes fixing leaky pipes and replacing old appliances, among many other small projects. Staying on top of these maintenance tasks will keep your home running efficiently, and potential buyers will be drawn in knowing they won’t have to deal with a mountain of repairs.

• Focus on energy efficiencyEnergy efficient windows, doors and climate control systems not only reduce your monthly utility bills, but they also increase the overall value of your home. In a 2012 What Home Buyers Really Want study conducted by the National Association of Home Builders’ (NAHB) Economics and Housing Policy Group, energy efficiency ranked high on the list. Energy-saving features include Energy Star®-rated appliances and windows, as well as an Energy Star® rating for the overall home. Nine out of 10 buyers indicated they would prefer to buy a home with energy efficient features to one that costs less but doesn’t include those features.

There is clearly a market for energy efficient homes, and incorporating some of these features will add a substantial amount of value to your home.

• Create space (or the illusion of space)Even if your current floor plan is divided into a number of rooms, you can still create a more open feel. You may go as far as knocking down a wall or two to open up the space, or you can work with what you have by rearranging furniture and maximizing the square-footage within each room. Eliminate wasted space and ensure that each room is functional. By reducing clutter and using a neutral color palate, you can also draw attention to architectural features or unique elements in your home (and away from room dimensions).

• Polish up the laundry roomAccording to the NAHB study, a large majority of buyers are looking for a laundry room along with storage and organization solutions. If you can maximize the functionality of your current laundry room, your home’s value will increase. Upgrades may include a bar to hang clothes, cabinets to store products or a folding surface. You should also ensure easy access to the washer and dryer for

loading and unloading. If the laundry room is located in the basement, you may consider moving it to the main floor for added convenience.

If you’re hesitant to jump into a large renovation project, rest assured that the remodeling market is steadily rebounding. With improvements in the job market and a more favorable economic outlook, homeowners are more likely to start and/or complete remodeling projects. According to the NAHB Remodeling Market Index (RMI), a report that measures current remodeling activity and indicators of future activity, the reading jumped three points to 56 for the second quarter of 2014. This is the fifth consecutive quarter that the RMI was above 50, indicating that remodelers are reporting higher market activity in comparison to the previous quarter.
