LIST OWNERSHIP AND CONFIDENTIALITY AGREEMENT FOR GOP DATA CENTER USERS

1. ________________________, (Hereinafter User) agrees to abide by all terms and conditions of this Agreement.

2. User agrees that the Oklahoma Voter File (hereinafter Voter File) and all other information and lists therein are,

and shall remain, the exclusive property of the Oklahoma Republican State Committee (ORSC) and the

Republican National Committee.

3. User acknowledges that they are registered to vote as a Republican.

4. User agrees that it shall acquire no property or ownership interest in, or rights with respect to, any of the

foregoing. Furthermore, User acknowledges that the Voter File and all information, updates and enhancements

thereto which are provided to, generated by, or otherwise become known to User in connection with, or incident

to, this Agreement are privileged and confidential. Additionally all information gathered in relation to the

utilization of the Voter File shall be updated directly into GOP Data Center per the policy statement that

accompanies this user request form. Moreover the campaigns that are granted access to GOP Data Center shall

disclose all individuals who are given access to the voter file.

5. User further agrees that neither it nor any of its directors, officers, employees, consultants, or agents will disclose,

rent, lease, sell, or enter into joint ownership agreements concerning any list(s), information, updates or

enhancement(s) of the Voter File in any form, or for any purpose, nor will they retain, duplicate, or use any of

such information in any fashion or for any purpose whatsoever. Nor shall any of this information be used for any

commercial purpose.

6. User agrees that the Oklahoma Republican State Committee and the Republican National Committee have the

right to proceed directly against User or User’s agents if this Agreement is violated, and may obtain injunctive

relief, as well as monetary damages.

7. User agrees that all provisions of the Agreement will also apply to any successor organizations and the user has

read and initialed the accompanying two pages of the GOP Data Center Access Policy.

8. User will not disclose the contents, functionalities, and images of GOP Data Center. These are highly

confidential and the sharing of GOP Data Center information without prior consent is strictly prohibited.

9. User acknowledges that the information found in the GOP Data Center is developed from a compilation of

different sources and therefore has potential for error.

10. User will never knowingly make or intentionally permit inaccurate or malicious changes to any record.

11. User will under no circumstances share login name or password with anyone other than the Committee’s Voter

File Coordinator or his or her designee.

12. User is aware that any login, edit, download or any other action performed within GOP Data Center can be and is

frequently monitored by the Oklahoma Republican Party.

GOP Data Center User Access Policy

Access –Once a request has been received, then a portion of the district will be made available. Full access to all areas of

the district voter file and full functionality of the GOP Data Center program will be contingent upon satisfying the

reciprocation section below. Furthermore, it is strictly forbidden for access to be given to any individual who is not a

registered Republican.

Signed User Agreement – No access will be granted in any situation until a signed copy of the user agreement is on file.

By signing this agreement the user will agree that under no circumstances will the information obtained be used for any

commercial purpose and that it will not be used to help any non-Republican candidate.

District, Statewide, County and Precinct GOP Data Center access can be granted by the state GOP Data Center Director or

the State Chairman once a signed and completed form is on file with the state office.

Reciprocation of Data– the Republican National Committee and the Oklahoma Republican Party jointly own GOP Data

Center (also known as the Voter File). The future usefulness of this list is contingent upon continually updating the

individual records that comprise this database. Therefore, future access will continue to be provided once the following

conditions are fulfilled.

Mail: Return service must be requested on all mailings. This information will be entered directly into the GOP

Data Center system by the candidate’s campaign.

Walking lists: When walking lists are generated the candidate/staff/volunteer will agree to verify occupant names

and party affiliation. This information will be entered directly into the GOP Data Center system by the

candidate’s campaign.

Phone lists: When phone lists are generated the candidate/staff/volunteer will agree to verify the name and party

affiliation of the person they are calling. This information will be entered directly into the GOP Data Center

system by the candidate’s campaign.

Voter ID & Registration: Continued participation in GOP Data Center will also be contingent upon the

candidate’s campaign participation in voter identification and registration projects that the Oklahoma State

Republican Party initiates within the candidate’s respective district. The information that is generated from these

projects will be directly entered into the GOP Data Center system by the candidate’s campaign.

Precinct Level Users –The county Chairman should select and provide the name, phone number and e-mail address of

the county GOP Data Center coordinator to the State GOP Data Center Director in writing. The County GOP Data Center

Director will then administer county and precinct-level access requests.

County Level Users – Access will be available only to county central committee officers and the County 72-Hour

Director. The State GOP Data Center Director should coordinate county access requests.

Statewide Level Users – Access will be granted on a case-by-case basis for staff associated with statewide campaigns at

the discretion of the state Chairman.

Candidate Usage – Republican candidates will only be granted access to their district. During primary elections in which

there are more than one Republican candidate, equal access and assistance will be offered to all Republican candidates.

After a primary election is decided, the losing candidate(s)’ access will be revoked. Candidates must notify the state GOP

Data Center Director of all users and all users must have a signed agreement on file.

Candidate Staff Usage – Each candidate should directly provide the name, phone number and e-mail address of their

GOP Data Center Coordinator to the State GOP Data Center Director in writing.

Staff Usage – Oklahoma State GOP staff will be granted full access.

Vendors & Consultants: Political consultants, direct mail vendors, telephone vendors and other miscellaneous vendors

will only be provided access through the campaigns that they represent. The Oklahoma Republican Party shall receive

prior notification and approval before information is released to a vendor/consultant. The ORP shall be provided with the

name of the vendor and a written description of exactly what this access will be used for.
