The American Conservative Union is taking our hightly touted Congressional Ratings program to State Legislatures for the second year in a row, grading members on their votes on key conservative issues. Last year, we graded State Legislators in the critical battle-ground states of Florida, Nevada, North Carolina, Ohio and Virginia. This year, we are expanding our ratings to fifteen states.
ACU first began rating members of Congress in 1971. Since then, our ratings system has become the most important conservative measuring stick in American politics- the gold standard for voters seeking more information on their representatives’ records.
This expansion of our Conservative Ratings program is part of Chairman Al Cardenas’ vision for building on successful ACU initiatives and taking the fight for conservative principles to the state and local levels. This is part of the ACU five-year plan to bring our ratings to all fifty states- scoring every legislature in every state, every year.

Dear Fellow Conservative,
On behalf of our Board of Directors, I am pleased to present the American Conservative Union’s 2012 State Legislative Ratings for members of the Florida State Legislature.
Since 1971, our Congressional ratings have become the gold standard in holding every member of Congress accountable for their voting record on the most important issues facing our nation. Last year we brought that same commitment to conservative ideals to the states, by rating members in five legislatures. I am pleased to report that this year we will score 15 states. This is part of the ACU five-year plan to bring our ratings to all fifty states- scoring every legislature in every state, every cycle.
It is important, now more than ever, that Americans have the information to elect true conservatives into office. Now approaching four years under the failed leadership of President Barack Obama, America needs to rein in reckless spending, restore our standing in the international community and return to the traditional values that made our nation so great. Starting in 2010, the liberal policies of the Obama administration have energized a national grassroots conservative movement, where we seek to bring change to state and local governments nationwide. Because of this, our 2012 State Legislative Ratings are vital for voters to make informed choices on the future of our nation.
We are dedicated to supporting the efforts of courageous conservative leaders fighting for limited government, promoting prosperity and individual freedom, and defending traditional values. Florida House Vote Descriptions1. HB 7087. Business Tax Reform. This bill cut numerous taxes on business, including the corporate income
tax, franchise taxes on banks and savings associations expanding sales tax exemptions and established a sales tax holiday for consumers. ACU supports pro-growth tax relief and supports this bill. The House defeated a motion to kill this bill on February 14, 2012 by a vote of 37-77 allowing the bill to be passed and signed into law. ACU opposed this motion.
2. HB 243. Expert Testimony. This bill provides for a stricter standard for the admissibility of expert testimony at state trials. It is designed to ensure that expert testimony is based on sound science and not speculation or opinion. ACU supports these legal reforms and supports this bill. The House passed the bill on February 24, 2012 by a vote of 77-34.
3. HB 277. Restrictions on Abortion. This bill would prohibit abortions in the third trimester and requires an abortion clinic to be owned and operated by a physician with specified training, among other provisions. ACU supports restrictions on abortion and supports this bill. The House passed the bill on March 1, 2012 by a vote of 78-33.
4. HB 1191. Education Reform. This bill allows parents of children in underperforming schools to petition to their school district to take action. The bill also requires notification to parents of teacher evaluations upon request and whether a teacher assigned to their child is teaching out-of-field or has received a poor evalua-tion. ACU supports parental empowerment in education and supports this bill. The House passed the bill on March 1, 2012 by a vote of 80-34.
5. HB 4001. Cap and Trade. This bill repeals the 2008 so-called cap and trade bill that would have capped greenhouse gas emissions. ACU opposes the cap and trade regulatory regime as an energy tax that would drive up the cost of utilities and stifle economic growth. The House passed the bill on March 1, 2012 by a vote of 82-34.
6. HB 1205. Drug-free Workplaces. This bill requires drug testing for state employees and authorizes agencies to refer employees at their or the insurance companies expense to rehabilitation programs. ACU supports these reasonable requirements for taxpayer-paid employees and supports this bill. The House passed the bill on March 2, 2012 by a vote of 79-37.
7. HB 1403. High School Athletics. This bill empowers local school districts to decide the eligibility of high school student athletes who transfer to another school rather than the Florida High School Athletic Association. The bill holds coaches financially accountable by requiring reimbursements of fines to schools before resuming their duties. The bill also requires Athletic Association investigators to undergo background checks. ACU supports increased local control of education and supports this bill. The House passed the bill on March 2, 2012 by a vote of 78-34.

8. HB 7059. Education Reform. This bill rewards educational achievement and student excellence by tying school funding to student mastery of course material. The bill also requires schools to offer accelerated graduation options to high school students among other provisions. ACU supports these needed reforms and supports this bill. The House passed the bill on March 5, 2012 by a vote of 82-33.
9. SB 98. Freedom of Speech. This bill allows an inspirational message to be delivered by students at a student assembly or sporting event. School officials are barred from monitoring or approving these messages. ACU supports freedom of speech and supports this bill. The House passed the bill on March 1, 2012 by a vote of 88-27.
10. HB 859. Educational Opportunity. This bill expands the Tax Credit Scholarship Program that allows businesses to help low income students attend private schools. ACU supports programs that expand educational opportunity and choice and supports this bill. The House passed the bill on March 7, 2012 by a vote of 92-24.
11. HB 119. Insurance Fraud. This bill aims to reduce fraud by overhauling Florida’s personal injury protection insurance laws. The bill reduces the maximum benefit for non-emergency medical procedures and establishes a fraud investigative unit among many provisions. ACU supports efforts to reduce fraud that drives up the cost of insurance for everyone and supports this bill. The House passed the bill on March 2, 2012 by a vote of 85-30.

ACU supports programs that expand educational opportunity and choice and supports this bill. The Senate passed this bill on March 9, 2012 by a vote of 32-8.
5. SB 1718. Education Reform. This bill allows parents of children in underperforming schools to petition to their school district to take action. The bill also requires notification to parents of teacher evaluations on request and whether a teacher assigned to their child is teaching out-of-field or has received a poor evaluation. ACU supports parental empowerment in education and supports this bill. The Senate defeated the bill on March 9, 2012 by a vote of 20-20.
6. HB 463. Second Amendment Rights. This bill provides that otherwise qualified members and veterans of U.S. Armed Forces be issued concealed weapon or firearm license regardless of age in certain circumstances. It provides additional methods for taking of fingerprints from such license applicants and provides that members & veterans of U.S. Armed Forces be granted reciprocity regardless of age. The ACU supports the expansion of Sec-ond Ammendment rights and supports this bill. This bill passed the Senate on March 2, 2012 by a vote of 40-0.
7. HB 119. Insurance Fraud. This bill aims to reduce fraud by overhauling Florida’s personal injury protection insurance laws. The bill reduces the maximum amount of money for non-emergency medical procedures and establishes a fraud investigative unit among many provisions. ACU supports efforts to reduce fraud that drives up the cost of insurance for everyone and supports this bill. The Senate rejected the House version of the bill and supported a watered down version instead. The Senate then voted to return the bill to the House, thus killing the bill on March 9, 2012 by a vote of 22-17. ACU opposed this motion.
