Dear Fellow Conservatives,

We are pleased to present the American Conservative Union Foundation’s ratings for the 2016 meeting of the Virginia General Assembly. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Virginia legislators with the highest scores voted most consistently with the ideals articulated in the U.S. Constitution: limited and transparent government, individual rights, personal responsibility, and lasting cultural values.

In 2015, ACU Foundation was proud to make history by being the first organization to rate every single state legislature across the full spectrum of issues, helping each voter understand how his or her state ranks among the rest.

Ultimately, we are trying to help people understand what conservatism is and how it improves the lives of everyday Americans. Conservatism is the political philosophy that sovereignty resides in the person. We think that understanding this idea is essential if Americans are to successfully govern themselves again.

Working with our policy centers and fellows, the ACU Foundation engages in deep policy analysis to help create our annual state scorecards. We have enhanced the vote descriptions this year to show this effort more clearly.

By examining all 50 of our State Ratings, we can see which states have most effectively promoted conservative solutions and which have struggled. Our ratings also help identify legislators who have courageously fought against liberal majorities. We hope that this guide helps you learn how well, or poorly, your legislators work to preserve the values we share.

SELECTING THE VOTES

ACU researched and selected a range of bills before the Virginia General Assembly that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Virginia’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 111 Tort Reform. This bill raises the punitive damage cap for any action after July 1, 2016 from $350,000 to $500,000. ACU supports reforming the law to reduce frivolous lawsuits and opposed this bill as going in the opposite direction. The Senate passed the bill on February 2, 2016 by a vote of 24-16.

2. SB 117 Opening Vehicle Doors. This bill requires drivers to wait for a “reasonable opportunity” to open their vehicle door on the side adjacent to moving traffic, else they will be fined $50. ACU opposes vaguely worded laws that are subject to opinion and make common-sense judgements an offense and opposed this bill. The Senate passed the bill on February 2, 2016 by a vote of 24-16.

3. SB 153 Tax Assessments. This bill adds Orange County to the list of counties that can impose taxes on areas outside their jurisdiction to pay for street improvements, but only if a majority of property owners in that area agree. To do this, the county must obtain agreement of more than 50 percent of the property owners affected that own more than 50 percent of the land. ACU opposes taxation without representation and opposed this bill. The Senate passed the bill on February 8, 2016 by a vote of 31-9.

4. SB 41 Religious Freedom. This bill provides that no person shall be required to participate in the solemnization of any marriage or be subject to any penalty solely because of that person’s religious belief that marriage is between one man and one woman. The bill covers religious organizations – or those controlled by a religious organization – employees of these organizations and members of the clergy. ACU Foundation’s Center for Human Dignity engages heavily on these issues and supports the constitutional right of people to practice their religion and ACU supported this bill. The Senate passed the bill on February 12, 2016 by a vote of 20-19.

5. HB 4 Right To Work. This bill provides for a voter referendum on a constitutional amendment to prohibit any agreement requiring an employee to join a union in order to work. Although Virginia is a “Right to Work” state by law, this would make it a constitutional right. ACU supports the right to work and supported this bill. The Senate passed the bill on February 15, 2016 by a vote of 21-19.

6. SJR 6 Charter School Constitutional Amendment. This resolution provides for a referendum on a constitutional amendment giving the Board of Education permission to establish charter schools within school divisions of the Commonwealth. Although there are few charter schools in Virginia, they are allowed by law and this would embody charter schools in the Constitution. ACU supports school choice and supported this resolution. The Senate defeated the resolution on February 15, 2016 by a vote of 19-21.

7. HB 131 Homeschooler Regulations. This bill prohibits schools from joining interscholastic organizations that refuse the participation of home school students, even if the students qualify in all other aspects and would be eligible for free tuition in a public school. ACU supports school choice and the right of home school students to participate in team sports and supported this bill. The Senate passed the bill on February 22, 2016 by a vote of 23-17.

8. HB 259 Common Core. This bill requires approval of the General Assembly before the Commonwealth’s Board of Education implements Common Core standards. ACU supports local control of education and supported this bill. The Senate passed the bill on February 22, 2016 by a vote of 24-16.

9. HB 766 Concealed Carry. This bill allows persons protected by a protective order to carry a concealed firearm for 45 days after the protective order is issued and another 45 days if that person has applied for a concealed carry permit. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate passed the bill on February 22, 2016 by a vote of 31-9.

10. HB 264 Local Government Contracting Regulations. This bill prohibits local governments from requiring contractors to offer a certain level of wages or other compensation to employees above the wages required by state or federal law. The bill applies to new contracts as of January 1, 2017. ACU opposes artificial wage requirements that drive up the cost of projects to taxpayers and supported this bill. The Senate passed the bill on February 25, 2016 by a vote of 21-19.

11. HB 145 Prevailing Wage Regulations. This bill prohibits Commonwealth agencies from requiring contractors to use so-called “prevailing wage” rules on government projects. ACU opposes these rules, patterned after the federal Davis-Bacon Act, which set artificial wage requirements, usually union rates, that drive up the cost of projects to taxpayers, and supported this bill. The Senate passed the bill on February 25, 2016 by a vote of 21-19.

12. HB 382 Storing Firearms in Vehicles. This bill prohibits Commonwealth agencies other than the Corrections or Juvenile Justice Department or the Port Authority from preventing employees from storing lawfully possessed firearms in a locked private motor vehicle at their workplace. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate passed the bill on February 29, 2016 by a vote of 24-14.

13. HB 518 School Choice Pilot Project. This bill creates a pilot project to select 12 schools that will allow students to transfer to other schools in the same school division. The law is to become effective in 2017 after a study is conducted on the costs of implementation. According to the ACU Foundation’s Family Prosperity Index, educational attainment is an important cultural value that yields substantial economic returns-for families and for states. ACU supports school choice and supported this bill. The Senate passed the bill on February 29, 2016 by a vote of 24-14.

14. HB 1305 Renewable Energy Tax Exemption. This bill gives special tax exemptions for solar and wind energy equipment. ACU supports all forms of energy, believes that the government should not favor one form of energy over another, and opposed this bill. The Senate passed the bill on March 2, 2016 by a vote of 37-2.

15. HB 2 EPA Power Plant Regulations. This bill requires the Commonwealth’s Department of Environmental Quality to receive approval from the General Assembly before submitted to the EPA for approval any state plan to implement the federal EPA’s existing power plant emissions rule. ACU opposes this EPA rule that has been ruled unconstitutional in Federal court and has been delayed by the Supreme Court and supported this bill. The Senate passed the bill on March 3, 2016 by a vote of 21-19.

16. HB 481 Sanctuary Cities. This bill prevents the Commonwealth’s Department of Corrections or local officials from releasing illegal immigrants that are under a lawful detaining order by federal immigration officials. ACU opposes so-called sanctuary cities following policies that have led to murder and other serious crimes and supported this bill. The Senate passed the bill on March 3, 2016 by a vote of 21-19.

17. HB 834 New Grant Program. This bill creates a new bureaucracy called the Virginia Growth and Opportunity Board to administer grants that “enhance private-sector growth, competitiveness and workforce development.” The board administering the fund consists of politicians and members appointed by politicians and must set aside a portion of whatever funds the General Assembly appropriates for grants based on population rather than their value. ACU opposes these programs that interfere with the free market and are basically slush funds that are subject to political influence and opposed this bill. The Senate passed the bill on March 3, 2016 by a vote of 35-5.

18. HB 389 Education Savings Accounts. This bill allows parents of children with disabilities to apply for Parental Choice Education Savings Accounts that allow per-pupil funds to be used for fees or textbooks at private schools that are located in the Commonwealth. ACU supports school choice and supported this bill. The Senate passed the bill on March 7, 2016 by a vote of 20-19.

11. HB 193 Certificates of Public Need. This bill creates a process that will eventually end “Certificates of Public Need” for many aspects of medical care. The current process will be replaced by a permit process that would authorize permits based on conditions and would grant them if the conditions are met. The bill also eliminates regional health planning agencies. ACU opposes Certificates of Public Need that are designed to restrict competition and drives up the cost of health care and supported this bill. The House of Delegates passed the bill on February 15, 2016 by a vote of 52-46.

12. HB 48 Civil Asset Forfeiture. This bill requires that any action on the forfeiture of assets to the government be delayed until the person whose property is being forfeited is found guilty of the crime connected to the forfeiture. ACU Foundation’s Center for 21st Century Property Rights engages heavily on this issue and opposes the violation of property rights under current civil asset forfeiture laws and ACU supported this bill. The House of Delegates defeated the bill on February 16, 2016 by a vote of 47-50.

13. HB 773 Government Non-Discrimination Act. This bill prohibits the government from discriminating against any individual for their belief that marriage should be between one man and one woman. ACU Foundation’s Center for Human Dignity engages heavily on these issues believes that individuals should be able to abide by their beliefs without suffering discrimination from government programs and ACU supported this bill. The House of Delegates passed the bill on February 16, 2016 by a vote of 56-41.

14. HB 1305 Renewable Energy Tax Exemption. This bill gives special tax exemptions for solar and wind energy equipment. ACU supports all forms of energy, believes that the government should not favor one form of energy over another, and opposed this bill. The House of Delegates passed the bill on February 19, 2016 by a vote of 88-9.

15. SB 117 Opening Vehicle Doors. This bill requires drivers to wait for a “reasonable opportunity” to open their vehicle door on the side adjacent to moving traffic, else they will be fined $50. ACU opposes vaguely worded laws that are subject to opinion and make common-sense judgements an offense and opposed this bill. The House of Delegates passed the bill on March 7, 2016 by a vote of 70-25.

16. HB 259 Common Core. This bill requires approval of the General Assembly before the Commonwealth’s Board of Education implements Common Core standards. ACU supports local control of education and supported this bill. The House of Delegates failed to override the Governor’s veto of this bill on March 8, 2016 by a vote of 64-32 (a two-thirds vote was required).

17. HB 389 Education Savings Accounts. This bill allows parents of children with disabilities to apply for Parental Choice Education Savings Accounts that allow per-pupil funds to be used for fees or textbooks at private schools that are located in the Commonwealth. ACU supports school choice and supported this bill. The House of Delegates passed the bill on March 8, 2016 by a vote of 52-47.

18. SB 41 Religious Freedom. This bill provides that no person shall be required to participate in the solemnization of any marriage or be subject to any penalty solely because of that person’s religious belief that marriage is between one man and one woman. The bill covers religious organizations – or those controlled by a religious organization – employees of these organizations and members of the clergy. ACU Foundation’s Center for Human Dignity engages heavily on these issues and supports the constitutional right of people to practice their religion and ACU supported this bill. The House passed the bill on March 9, 2016 by a vote of 59-38.

19. HB 382 Storing Firearms in Vehicles. This bill prohibits Commonwealth agencies other than the Corrections or Juvenile Justice Department or the Port Authority from preventing employees from storing lawfully possessed firearms in a locked private motor vehicle at their workplace. ACU supports the founders’ belief in the Second Amendment and supported this bill. The House of Delegates failed to override the Governor’s veto of the bill on April 20, 2016 by a vote of 66-34 (a two-thirds vote was required).

20. HB 481 Sanctuary Cities. This bill prevents the Commonwealth’s Department of Corrections or local officials from releasing illegal immigrants that are under a lawful detaining order by federal immigration officials. ACU opposes so-called sanctuary cities following policies that have led to murder and other serious crimes and supported this bill. The House of Delegates failed to override the Governor’s veto of the bill on April 20, 2016 by a vote of 65-34 (a two-thirds vote was required).
