Dear Fellow Conservative,

On behalf of our Board of Directors, I am pleased to present the American Conservative Union’s 2013 State Legislative Ratings for members of the Tennessee General Assembly.

Since 1971, our Congressional ratings have become the gold standard in holding every member of Congress accountable for their voting record on the most important issues facing our nation.

In 2011, we brought that same commitment to conservative ideals to the states, rating members in five legislatures. I am pleased to report that, in 2013, we scored twenty states. This is a part of the ACU plan to bring our ratings to all fifty states – scoring every legislature in every state, every session.

There could not be a more critical time for conservatives to evaluate America’s leadership and hold them accountable for their actions. Our economy, our international standing, our very moral fiber are weaker because this administration has put us on a course to bigger government, less freedom, and an abandonment of traditional values.

With our government expanding faster now than at any time in our country’s history, the ACU intends to continue to play a major role in giving the American people the tools they need to make informed voting decisions at every level of government. While some may be disheartened by the results of November’s elections, conservatives found themselves in a similar situation after President Obama first took office in the spring of 2009. The cause of conservatism dramatically reasserted itself in the 2010 elections, with conservative legislators winning an unprecedented number of elections nationwide. Because of this, our 2013 State Legislative Ratings are vital for voters to make informed choices on the future of our nation.

We can come back even stronger in 2014, but only if we start our march toward victory now.

Tennessee House Vote Descriptions1. HB 850 Labor Law Reform. This bill removes certain Davis-Bacon style prevailing wage requirements

for the construction industry, except for highway construction. Although ACU opposes all prevailing wage requirements, ACU supported this bill as a good step toward reform. The bill passed the House on April 11, 2013 by a vote of 67-23.

2. HB 1341 Tax Increase. This bill is a sales tax surcharge by metropolitan governments on goods and services inside a “tourism development zone,” while exempting favored goods such as live event tickets and alcoholic beverages. ACU opposes these types of arbitrary tax increases and opposed this bill. The bill passed the House on April 16, 2013 by a vote of 66-30.

3. HB 9 Second Amendment Rights. This bill requires all information pertaining to a handgun carry permit application be kept confidential with some exceptions. ACU supports strengthening Second Amendment rights and supported this bill. The bill passed the House on March 11, 2013 by a vote of 84-10.

4. SB 142 Second Amendment Rights. This bill allows those with a valid handgun carry permit to transport and store a firearm or firearm ammunition in the permit holder’s privately-owned vehicle in public or private parking spaces under certain conditions. ACU supports these common-sense reforms and supported this bill. The bill passed the House on February 28, 2013 by a vote of 72-22.

5. HB 534 Religious Freedom. This bill prohibits public institutions of higher education from denying recognition to a student organization on the basis of religious content or speech. ACU supports strengthening religious freedom and supported this bill. The bill passed the House on March 18, 2013 by a vote of 75-21.

6. HB 1191 Livestock Protection. This bill requires those who intentionally record or photograph cruelty to livestock to turn over unedited photographs or video recordings to law enforcement authorities within 24 hours. ACU supports these efforts to protect property owners from being secretly photographed for public relations purposes and supported this bill. The bill passed the House on April 17, 2013 by a vote of 50-43.

7. HB 1112 Education Reform. This bill replaces the seniority rule for teacher layoffs with performance-based decisions. The bill also requires that only those teachers rated in the three highest categories of evaluations be placed on a reemployment list. ACU supports merit-based educational decisions and supported this bill. The bill passed the House on April 10, 2013 by a vote of 75-20.

8. SB 200 Labor Law Reform. This bill requires that the standard worker’s compensation claim for injuries be “primarily” from employment. Currently “injuries from employment” is not defined. ACU supports Worker’s Compensation Reform and supported this bill. The bill passed the House on April 11, 2013 by a vote of 68-24.

9. SB 125 Voter ID. This bill requires valid state or federal voter identification for voting purposes. ACU supports strengthening voter integrity and supported this bill. The bill passed the House on March 25, 2013 by a vote of 65-30.

10. HB 702 Charter Schools. This bill supports the expansion of charter schools by allowing the state Board of Education to approve charter schools in five counties where there are failing schools, regardless of the local board decision. ACU supports expanding school choice and supported this bill. The bill passed the House on April 18, 2013 by a vote of 62-30.

ACU opposes these types of arbitrary tax increases and opposed this bill. The bill passed the Senate on April 17, 2013 by a vote of 28-3.

3. HB 9 Second Amendment Rights. This bill requires all information pertaining to a handgun carry permit application be kept confidential with some exceptions. ACU supports strengthening Second Amendment rights and supported this bill. The bill passed the Senate on April 10, 2013 by a vote of 27-2.

4. SB 142 Second Amendment Rights. This bill allows those with a valid handgun carry permit to transport and store a firearm or firearm ammunition in the permit holder’s privately-owned vehicle in public or private parking spaces under certain conditions. ACU supports these common-sense reforms and supported this bill. The bill passed the Senate on February 11, 2013 by a vote of 28-5.

5. SB 802 Religious Freedom. This bill prohibits public institutions of higher education from denying recognition to a student organization on the basis of religious content or speech. ACU supports strengthening religious freedom and supported this bill. The bill passed the Senate on March 27, 2013 by a vote of 30-0.

6. SB 1248 Livestock Protection. This bill requires those who intentionally record or photograph cruelty to livestock to turn over unedited photographs or video recordings to law enforcement authorities within 24 hours. ACU supports these efforts to protect property owners from being secretly photographed for public relations purposes and supported this bill. The bill passed the Senate on April 16, 2013 by a vote of 22-9.

7. HB 1112 Education Reform. This bill replaces the seniority rule for teacher lay-offs with performance-based decisions. The bill also requires that only those teachers rated in the three highest categories of evaluations be placed on a reemployment list. ACU supports merit-based educational decisions and supported this bill. The bill passed the Senate on April 15, 2013 by a vote of 27-4.

8. SB 200 Labor Law Reform. This bill requires that the standard worker’s compensation claim for injuries be “primarily” from employment. Currently “injuries from employment” is not defined. ACU supports Worker’s Compensation Reform and supported this bill. The bill passed the Senate on April 1, 2013 by a vote of 28-2.

9. SB 125 Voter ID. This bill requires valid state or federal voter identification for voting purposes. ACU supports strengthening voter integrity and supported this bill. The bill passed the Senate on March 14, 2013 by a vote of 21-8.

10. SB 56 Tort Reform. This bill provides that the doctrine of joint and several liability, holding one party responsible for others at fault, does not apply in civil cases governed by comparative fault and other reforms. ACU supports tort reform and supported this bill. The bill passed the Senate on April 15, 2013 by a vote of 23-6.

The American Conservative Union

The American Conservative Union (ACU) is America’s oldest and largest grassroots conservative organization.
