MOTION TO STAY WITH CONCURRENCE
II II NOW COMES the Defendant Davidson Rubber Company, Inc.,
1 by and through its attorneys, and makes the following Motion
li to Stay this matter pending the Court's review and approval
1 of the proposed consent order:
11 1. On October 18, 1985 the United States Department of
j: J ustice fil e d its complaint in this matter naming over 100
r defendants as generators of waste allegedly liable for the
1 r e imbursement of cos ts incurred by the United States for the
~~ investigation, and cleanup of the J< eefe Environmental
j Services site in Epping , New Hampshire,
1 2. All of the named defendant s, including Davidson t• !j Rubber Company, Inc ., have signed a Consent Decree settling
!, the claims ml!lde by the United States in its complaint .

3 . The Department of Justice requires that the Consent
Decree be published in the Federal Register and s ubject to a
thirty (30) day public comment period before it may be
approved by the Court.
4. J udicial economy and fairness to the defendants
require that they not be required to file any answers or
other responses to the complaint or discovery r equests
unless the Court rejects the Consent Decree and for thirty
(301 days thereafter.
5 . Attorney Sheila Jones , United State s Department of
11 Justice has stated her concurrence with this motion.
I 11 WHEREFORE, the Defendant respectfully requests that
this Court issue an order staying the filing of all answers ,
I discovery requests , or pleadings responsive to the complaint
