Regulatory Scope • MAWA initiative under co-ordination of the European Defence Agency

(EDA) achieved completion of all planned EMARs.

• EMARs now covering Design/Make Phase and addressing Use Phase of a product’s lifecycle.

• Status of EMAR completion marks substantial achievement and is very welcomed by ASD.

• ASD continue full commitment to support MAWA in the adoption and the future development of a regulatory framework based on the civil framework.

Regulatory Implementation • One of the key challenges to the success of the MAWA initiative is how

effectively the EMARS can be integrated within National legislation and regulations.

• Common and consistent implementation of EMARs into national regulation is now the most important issue for the success of the MAWA initiative.

• There needs to be a non-dogmatic approach by Governments, the Authorities and Industry.

• Our preference would be for the EMARs to be ‘Adopted’ by the participating Member States (pMSs).

• However this can only be implemented practically if the National Military Airworthiness Authorities grant approvals as per the EMAR (or National equivalent) and recognise approvals granted by the other National Military Airworthiness Authorities.

The need for a Common Approach • Common Implementation consistent with the objectives of the MAWA

initiative is initially defined in the Basic Framework Document (BFD) – Harmonisation of Military Airworthiness Arrangements across Europe.

• Common approach - Key enabler of the regulatory philosophy and of effective operation of the military regulatory system, including mutual recognition of different NMAAs.

• Concentration on common approach as opposed to getting stuck with the recognition of too many national differences.

• Is there scope for EDA to lead / facilitate common implementation?

Organisation Approvals • New approvals be granted following a single review of the organisation’s

capability by a group of assessors agreed by the pMSs.

• Progressive mutual recognition by respective pMSs until such time that a tipping point was achieved that allowed for a single pan pMSs approval to be granted for existing approvals (JAA type model).

• Once initial pan pMSs organisation approvals have been granted we would envisage that a similar approach would be followed for the continuation of such approvals whereby the audits to maintain such would be undertaken by a group of assessors agreed by the pMSs.

• ASD would wish that NMAAs were able to accept organisation approvals from the Civil Authorities without the need for further initial or repeat assessments and/or audits.

• Rather than pursuing alternatives, ASD prefer to support and work within the EMAR framework.

Privileges • ASD believe that granting of common privileges is essential to operate an

efficient and effective pan pMSs organisation approval framework.

• Privileges granted by one NMAA should be accepted by another NMAA through the process of mutual/multi-lateral recognition.

• Privileges should be granted in a common manner by the respective pMSs to avoid any potential problems with mutual/multi-lateral recognition.

• ASD does not see the need for a permanent GQA presence in Industry production lines as evidenced through successful, efficient and safe application of the Civil POA criteria and privileges in the Civil Regulatory System.

Certification • Common certification code and process including clarification of content

of military certification.

• In order to deliver the full benefit of the MAWA Initiative, ASD would prefer industry holds the (M)TC for A/C, Engine and Propellers, in line with civil construct. This would not preclude the nation holding an overall MTC.

• ASD would also like to see the acceptance of civil certification of engines and propellers in military registered aircraft with minimum further military certification effort.

• ASD’s desire is that airworthiness certification (fitness for flight) and qualification (fitness for purpose) are kept distinct to maintain an appropriate focus on flight safety.

• European centralisation of Type Certification independent from the Contracting Agency including continued airworthiness would help to maintain standards and standardise Continuing Airworthiness activities.

Mutual Recognition • Mutual recognition across pMS deemed critical to success of MAWA

Initiative.

• Common Implementation to minimise differences in national regulation allows to uncover full opportunity for mutual recognition.

• A strategy and plan is required outlining how to achieve mutual recognition across all pMS, and who should lead implementation of the strategy.

• Could MAWA coordinate necessary arrangements such that activities in the field of design, manufacture or maintenance to be performed only once in a way satisfactory to all member Authorities?

• Is there scope for EDA to act as a sponsor to facilitate mutual recognition?

Evolution of the MAWA Initiative • Is there scope for a true single European Military Airworthiness

Organisation that co-exists with existing NMAAs?

• Could the role of EDA include involvement in outlining a strategy leading up to the formation of a European Military Airworthiness Organisation under EDA/MAWA?

• As a first step could a central organisation have its powers enhanced particularly in the areas of facilitating mutual recognition, managing organisation approvals and privileges?

Summary • ASD welcome completion of EMARs as a substantial achievement and will

continue full commitment to support MAWA in the adoption and the future development of a regulatory framework based on the civil framework.

• Efforts directed towards Common Implementation are consistent with the objectives of the MAWA initiative initially defined in the BFD.

• Common Implementation with minimal differences into national regulation allows to uncover full opportunity for mutual recognition, being a key aspect of an effective and efficient military regulatory system.

• Enhanced role of EDA as the lead organisation integrating key aspects of MAWA initiative could help the European Military Airworthiness Harmonisation to gather further momentum.

• We in ASD are committed to support the National Military Airworthiness Authorities and EDA to achieve this task.
