Suspect hires attorneyafter alleged ‘abuse’
Santa Barbara Police Chief Cam Sanchezmay be facing another maelstrom of controver-sy after clearing Officer Aaron Tudor of usingexcessive force in a Friday night traffic stop.
Tudor had pulled over 50-year-old TonyVincent Denunzio for allegedly making sever-al lane changes without signaling. Denunzioallegedly resisted arrest and Tudor struckDenunzio several times and used his Taser inan effort to subdue him.
The arrest had been recorded by a dash-board camera system the patrol car andSanchez said the footage has cleared Tudor.
“Based on what the video recording shows,witness accounts of the incident, and afterreviewing the corresponding police report,there is no apparent violation of departmentpolicy or law enforcement procedure thatwould warrant a formal administrative investi-gation of the incident,” Sanchez said in a writ-ten statement.
But a storm is already forming. A minute ofthe struggle happened outside of the cameraframe and Denunzio retained DUI attorney
Darryl Genis to represent himself in the case. After Sanchez’s statement, Genis derided
Sanchez’s statement and challenged him torelease the tape to the public.
“If the Dash Cam of the incident evenremotely supported the police propaganda con-tained within today’s press release, it wouldhave already been released to the televisionmedia for public viewing,” Genis said.
Sanchez acknowledged Tudor’s actionsmay have appeared harsh to onlookers, butsaid the 4-year SBPD veteran had not violatedany training procedures on the film.
“The use of force is never desirable,”Sanchez said. “It is difficult for members ofthe public to witness, particularly someone notfamiliar with police arrest [and] use of forcetraining.”
Genis said the department has releasedfootage that exonerated police in the past andif the camera has vindicated Tudor, the policeshould make it public.
“The SBPD has a history of releasing videointo the media even before a pending case isfiled,” Genis said. “They almost always do it

Before I was ever a mom, and even as a new mom, Iknew I would never have one of those picky eaters.There was no way that was going to happen to me. Iknew my child would happily eat whatever I put in frontof her and that I would never consider a bowl of pasta acomplete dinner.
As time has gone on, I had to toss my well laid outgame plan and just go with how my life was unfolding.
I really wasn’t prepared for the challenges that dinnertime has presented me.
I wasn’t prepared for a child who was so particular, orrather as I like to put it, selective.
As a baby and into her toddler years, Fia was reallygood eater and pretty much ate anything I fixed for her.Different flavors and textures didn’t seem to bother hermuch. Certainly there were favorites and rejected foods here andthere, but nothing that seemed out of the ordinary.
As Fia got older, things shifted. At four, she declared herself avegetarian. She made the connection that chicken dinos weremade from the same chickens that lived on farms. She learnedthe fish at the dinner table are the same fish that swam in theocean.
“It’s not nice to eat animals,” is what she said, and from thatpoint on it has been, no chicken, no turkey, no fish, no pork, or nobeef. She hasn’t wanted to admit that salami comes from animalsand that is the only meat that has crossed her lips in over a year.
The Husband and I are meat eaters; our 5 year old is not andfor moral reasons. I can’t tell her she has to eat it, because shehasn’t tried it and she might like it. I can’t tell her to eat it,because for her it’s a moral choice. And at 5 I know that soundscrazy, but it’s true.
She may be a vegetarian, but she also doesn’t eat vegetables.Not for any moral reason, but just because she doesn’t like them,at all. At one time, she would eat veggies. But slowly, one byone, she stopped eating them. For a while, I continued to put
them on her plate and they were left, uneaten and wast-ed, so now I don’t even put them out for her.
There’re basically 4 food groups that Fia likes.Anything white, anything sweet, fruit and dairy.
Much to my dismay, disappointment, frustration,pasta has become her meal of choice and I’ve beenbeaten down enough to be happy when she eats pastawith butter.
Never in my wildest dreams did I ever think that Iwould ever be happy with that.
And never did I think that I would have a child thatdidn’t enjoy a variety of food or be so unwilling to trysomething new.
My saving graces are fruit and dairy. She lovespretty much any kind of fruit. There’s a berry here or a
stone fruit there that she’s not fond of, but basically we are goodto go with the fruit. I can also get her to eat almost any form ofdairy, especially cheese.
I’ve stressed about her diet and have had major mom guilt thatshe isn’t getting what she needs. I’ve had guilt that she eats toomuch white pasta and sugar and she eats too little of the goodstuff. I’ve gotten advice, solicited and not, from family andfriends on how to deal with her eating habits, and I’ve tried mostof it. We’ve grown a garden, I’ve taken her shopping with me,we’ve made meals together, and we’ve bribed and almost begged.
But, now I’m getting to the point where I’m getting over it all.I’ve come to realize this is my child. She’s fine the way she is.She’s healthy. She’s growing. She has lots of energy and seemsto be getting on just fine with how she’s doing things.
That’s not to say I wish things were different, because I wishthey were.
But once again, this 5 year old has shown me that what I knewfor certain, just isn’t the way it’s going to be.

NEWS IN BRIEFVet critically injured in protest(Reuters) - An Iraq war veteran was listed in critical condition on
Wednesday from injuries he sustained at economic protests on thestreets of Oakland, triggering calls for renewed Occupy Wall Streetdemonstrations across the country.
Protest organizers say 24-year-old Scott Olsen, a former U.S.Marine, was struck in the head on Tuesday night by a tear gas canisterfired by police during a confrontation with demonstrators trying tomove back into a downtown Oakland plaza.
A spokesman for Highland General Hospital in Oakland confirmedOlsen was in critical condition there from injuries sustained during theprotest but could not confirm he had been hit by a tear gas canister.
Oakland Police spokeswoman Cynthia Perkins said the departmentwas investigating the incident. She declined further comment.
Keith Shannon, who said he served alongside Olsen in Iraq, toldReuters his friend was suffering from a two-inch skull fracture andbrain swelling and had been sedated in the hospital's emergency roomtrauma center while neurosurgeons decide whether to operate.Chrystler workers ratify contract
(Reuters) - Unionized workers at Chrysler Group LLC ratifieda four-year labor pact on Wednesday, closing out the first round oftalks since two of the three Detroit automakers nearly collapsedand took federal bailouts in 2009.
The deals struck by the United Auto Workers union and thethree U.S. automakers are not as lavish as in years past and helpthe companies bring their labor expenses closer to the costs paidby their Japanese, Korean and German rivals.
About 55 percent of Chrysler workers voted to ratify the deal,but in a rare twist, 56 percent of skilled-trades workers rejected thepact. Deals at General Motors Co and Ford Motor Co were ratifiedby a nearly 2-to-1 margin.
NSA helps banks battle hackers(Reuters) - The National Security Agency, a secretive arm of the
U.S. military, has begun providing Wall Street banks with intelligenceon foreign hackers, a sign of growing fears of financial sabotage.
The assistance from the agency that conducts electronic spyingoverseas is part of an effort by American banks and other financialfirms to get help from the U.S. military and private defense contractorsto fend off cyber attacks, according to interviews with U.S. officials,security experts and defense industry executives.
The Federal Bureau of Investigation has also warned banks of par-ticular threats amid concerns that hackers could potentially exploitsecurity vulnerabilities to wreak havoc across global markets and causeeconomic mayhem.
While government and private sector security sources are reluctantto discuss specific lines of investigations, they paint worst-case scenar-ios of hackers ensconcing themselves inside a bank's network to disabletrading systems for stocks, bonds and currencies, trigger flash crashes,initiate large transfers of funds or turn off all ATM machines.

Progress in plan forDe la Guerra Plaza
Santa Barbara city officials are makingprogress on a plan to spruce up De Le GuerraPlaza.
The proposal has bounced around variousSanta Barbara city boards and commissionsfor seven years.
The plaza is the site of a few popular com-munity events.
Fiesta and Cinco de Mayo celebrations areheld there.
But in recent years the appeal of the plazahas steadily declined as trees have grown oldand the flower bushes have overgrown.Parking spaces have also been crammed intothe small space, bottle-necking one exit andreducing the appeal of the green space.
The roundabout’s cracked pavement is alsoin need of repair.
The most recent designs calls for changesthat would address these issues such as elim-inating five parking spaces, replacing trees,removing the agapanthus, and repaving theroadway.
It also calls for further adjustments aimedat increasing the appeal of the plaza’s lookand usability. Eliminating the curb around thelawn, under-grounding all utilities, expanding

Not to alarm anyone, but the end is coming. Alittle over a week away, in fact. No, don't worry,it's not the Rapture. Thankfully, prominent radiohost and preacher Harold Camping's most recentprediction that the apocalypse would occur onOctober 21 did not come to pass. Unless, ofcourse, you consider it the end of the world whenKim Kardashian celebrates her 31st birthday byannouncing on Twitter that she's starring in thenext Tyler Perry movie. In which case you've got adecent argument.
No, what I'm talking about is the end ofDaylight Saving Time, for this year at least.Daylight Saving Time is, admittedly, one of thosethings that we all go along with even though we're not real-ly sure why, sort of like such other seemingly pointlessaspects of modern life as beauty pageants, televised golf andstate government.
Despite our willing acquiescence to the twice-annual timeshift, people generally don't have anything good to sayabout Daylight Saving Time. I mean, how often do you hearsomeone say, "Daylight Saving Time is a real help,""Daylight Savings Time knocked ten strokes off my golfgame" or "Daylight Saving Time pulled me from the burn-ing wreckage after a grisly highway accident?" Not oftenenough, I'm guessing.
[True fact: Daylight Saving Time was originally con-ceived by Benjamin Franklin. The idea was widely ignored,
however, because by this time Franklin was gettingon in years and his peers mostly viewed him asdelusional because he had a habit of flying kitesduring thunderstorms and going around utteringnonsense like "A penny saved is a penny earned."]
But much as people like to complain aboutDaylight Saving Time, the practice does actuallyserve a very important societal purpose: it gives usall something to complain about. For obvious rea-sons, most of this bellyaching occurs in the springwhen the clocks jump forward. We either gripe thatwe're "losing" an hour or we forget about the timechange entirely, and curse Daylight Saving Timewhen we show up an hour late for work on
Monday morning. But next week's time change is of the "fall back" variety,
when we gain the hour we complained about losing sixmonths ago. And except for those of us who arrive at workan hour early on Monday, there's a lot less to complainabout when you're gaining time. It's actually a pretty amaz-ing concept, when you think about it. Here we are, casuallywarping the space time continuum to grant ourselves anextra hour out of nowhere. What's to stop us from playingGod with time some more - maybe by giving ourselvesTWO extra hours? Or deciding that every fifth Tuesday isactually a Friday? Or how about declaring a new summermonth nestled in between July and August called "Beach-tember?"
For the near term, however, our monkeying with the uni-verse's basic functioning will remain limited to the one hourshift. This year, November 6th is the date when, come 2AM, we will all get the chance to live the previous hourover again. Unfortunately, most of us will squander this free60 minutes either sleeping, drunk or both.
I say "unfortunately," because I've always thought this

once-a-year event offered all kinds of interesting possibili-ties. Like, you could leave a voicemail message for yournot-too-swift friend at 1:50 AM and then call him again 30minutes later to say, "Hey, you're missing a great time-trav-eling party - where are you? I left you a message half anhour from now!" Then, when he checks his messages andrealizes that you were telling the truth, you'll blow his mind!
Or the time change could provide the key plot point in apopular movie, in which a crime is committed at 1:30 AMbut the defendant has an airtight alibi proving that he waselsewhere at that precise hour. Then, in the pivotal scene,the brilliant prosecuting attorney reveals to the jury that thecrime occurred on the day of the time change that featured
not one but (cue suspenseful music) TWO 1:30 AMs! I did-n't say it would be a good movie, just a popular one.Because there will also be a lot of sex.
So this year, instead of griping, why not have a little funwith the free hour? Send yourself an email you can readbefore you wrote it. For once in your life, finish a projectthat, according to the clock, you haven't even started yet.For me, I think I'll finally get cracking on that DaylightSaving Time-themed script I've always talked about writing.I bet if we can get Kim Kardashian and Tyler Perry attachedto the project, we'd be talking about the blockbuster of theseason next Beach-tember.

a portion of the sidewalk, adding a walkway and stage area, andmoving the stone monument and flag poles are additionalpieces of the plan.
The city has $2.4 million in redevelopment agency moneyset aside for the project, and the current proposal would cost 2.2million.
The project has seen various incarnations during its lengthyprocess. After viewing designs for a more extensive overhaul ofthe plaza in 2009, the City Council directed staff to “keep it thesame but make it better.”
Elizabeth Limon, a redevelopment specialist who presentedthe most recent design to the city parks and recreation commit-tee yesterday, said that the current model speaks to that inten-tion.
But while most praised the majority of the proposal, somewho attended raised concerns over removing the curb andreducing parking.
Removing the curbing and lowering the lawn to make itflush with the roadway would both make the space more open
and inviting, and increase safety during festivals when the plazais crowded, Limon said.
Activist Kellam DeForrest, however, said that historicalpreservationists are concerned about removing the curb, whichthey speculate has been there since before the current city hallwas built in 1923.
Dennis Rickard, who owns a building opposite the plaza,said business owners are against the proposal because of thereduction in parking and the possible increase in events heldthere.
He said that when it went before the City Council, 80 busi-nesses signed a petition against that plan.
Rickard also said he is passionate about the issue because hisfamily has a long history in Santa Barbara and the plaza wasnamed after his great, great grandfather.
But the commission seemed pleased with the proposal.Beebe Longstreet said it is about time the plaza received amuch needed face lift.
“We’ve ignored it,” she said. “Currently it looks like a park-ing lot with a lawn in the middle and I don’t think it looked likea parking lot with a lawn.”
She and other members were satisfied with the openness andsafety eliminating the curbs and dropping the lawn would pro-vide.
Chair Lesley Wiscomb said she remembered when therewere small concerts in the plaza regularly, and would like to seethe space become a welcome spot for people to lunch at. Someexpressed concern over the handful of homeless that sometimesuse the lawn.
“If it’s a more active space it becomes a better used space,”Wiscomb said, “and it might prevent some of the undesirableactivity.”

The hit television show MasterChef willhold a casting call this Saturday from 10 a.m.to 6 p.m. in Los Angeles.

the incident started at 9:40 p.m. last Fridaywhen Tudor saw Denunzio pulling out of theparking lot near Arroyo Burro Beach. Tudorfollowed Denunzio and allegedly observedhim make three lane changes without using histurn signal.
Tudor made a traffic stop as Denunziobegan pulling into Loreto Plaza. Denunzioparked his car and got out, allegedly ignoringTudor’s orders to get back in.
As Denunzio allegedly began walkingaway, Tudor grabbed him by the arm. WhenDenunzio allegedly tried to pull away, Tudorordered him to get on the ground. WhenDenunzio allegedly refused, Tudor called forbackup and tripped Denunzio making him fallto the back of the ground.
When Denunzio allegedly continued toresist, Tudor used his Taser, several open palmstrikes, and knees on Denunzio to get him tosubmit.
Sanchez noted in his statement that thestruggle moved out of the camera’s view for
one minute, during which additional officersarrived to assist Tudor, but insisted everythingon camera did not warrant additional investi-gation.
“All of the decisions made and optionsexercised by the arresting officer that werecaptured on the video recording were justifiedstandard law enforcement practices given Mr.Denunzio’s resistance,” Sanchez said.
Genis argued that the public would needmore than just assurances from the policechief.
“We the public do not need to take[Sanchez’s] or any officer’s word when we caninstead watch and listen with our own ears andeyes as if we were there,” Genis said.
After the arrest, police took Denunzio toCottage Hospital where he received treatmentfor a broken nose and rib pain. Police thenbooked him into county jail and took an invol-untary blood sample.
Denunzio had already been on probation fora previous DUI and allegedly did not have avalid driver’s license at the time of his arrest.Under the terms of his probation, Denunziomust submit to blood alcohol tests, must notcommit any crime, and may not drive with anyalcohol in his blood.
