A regular meeting of the Freeport City Council was convened at 7:00pm by Mayor Rodney Atkinson with

Councilmembers Mike Eveslage, Ken Goebel, Tim Hennen and Ben Ettle Present.

Maretta Van Beck was recognized by city council for receiving honorable mention for the League of MN

Cities “Mayor for a Day” essay contest.

Agnes Job and Laura Hoeschen recognized for serving a combined total of 933.21 hours between Sept 2014

and Jan 2015 in the Foster Grandparent Program.

provided Sales packets that will be used for the LBAE meeting. Johnson spoke briefly on commercial,

agricultural and industrial properties.

Schirmer provided a recap on Ryan’s request.

Public Forum

Gary Pierskalla, requested street lighting to be added on 7th

St. of the Industrial Park for security purposes.

Council members agreed Schirmer should look into it.

Mayor Atkinson mentioned having speed monitoring signs on the east side of town. Council members

agreed to have Schirmer look into speed monitoring signs.

Consent Agenda

Ettle motioned to move ‘d. February 24, 2015 Meeting Minutes’ to ‘n’ under ‘New Business’ and to move

‘a. Clerk-Treasurer Report’ to ‘o’ under ‘New Business’. Seconded by T. Hennen. Motion carried 5-0.

Old Business

January 27, 2015 Meeting Minutes

T. Hennen moved to have whoever takes the minutes now will write action minutes, effective now.

Eveslage seconded. Motion carried 5-0.

Ettle presented Schirmer with an example of action minutes. Eveslage moved to resubmit January 27, 2015

meeting minutes and February 24, 2015 meeting minutes as action minutes and separate the AFSA meeting

minutes into a separate document, seconded by Ettle. Motion carried 5-0.

Main Street Lights

Advised to get proposals from Dan Roering (Freeport Electric) on options and pricing.

Alee Photography Revised Estimates

T. Hennen moved to have Weber take pictures for the website and do the wall mounted pictures in-house.

Ettle seconded. Motion carried 5-0.

EDA Bylaws

Eveslage moved to rescind the EDA bylaw changes. T. Hennen seconded the motion. Advisement from City

Attorney Scott Dymoke. Discussion followed. Motion carried 5-0.

Resolution 2014-007

Goebel moved and Eveslage seconded to rescind Resolution 2014-007. Discussion followed. Motion carried

4-0 (Atkinson abstained).

Goebel moved and Eveslage seconded to approve Resolution 2015-07. Discussion followed. Motion carried

Resolution 2015-08 Re: Closing fund 409

Goebel moved and T. Hennen seconded a motion to approve Resolution 2015-08. Motion carried 5-0

Resolution 2015-09 Re: Early voting

T. Hennen moved, seconded by Eveslage to table Resolution 2015-09 until more information was gathered.

Discussion followed. Motion carried 5-0.

1-Ton Truck Box

T. Hennen moved, seconded by Eveslage to have Bayer repair the truck box. Discussion followed. Motion

carried 5-0.

Maintenance Shop

Goebel moved and Rodney seconded a motion to approve authorizing Dave Blommel (SEH, Inc. engineer)

to conduct a feasibility study. Discussed that it was important for council to know the cost of rebuilding a

maintenance shop in case the opportunity to sell the maintenance building arose. Motion carried 5-0.

Middendorf Property

Eveslage moved and Ettle seconded to table topic until more information was gathered. Discussion

followed. Motion carried 5-0.

Al Williams Re: Ice skating rink

Atkinson advised Williams to get estimates on possible ice skating rink locations in town.

Dan Austing (as requested by Mayor)

This line item was not addressed at the meeting, being Dan Austing was not in attendance.

Mayor Atkinson called a 10 minute recess at 9:30. Called meeting back to order at 9:40.

Clara Michaels Opinion Letter Re: Fire Service

Eveslage moved and seconded by Ettle to table the topic until more information can be gathered, and to call

Michaels and inform her that the letter has been received. Motion carried 5-0.

Pick-up Truck Offer

T. Hennen moved and Eveslage seconded a motion to table discussion to next month. Motion carried 5-0.

Ettle asked for Jon Stueve to be at the next meeting.

Winterizing Softball Park

T. Hennen moved and seconded by Eveslage to pay Atkinson Well and Pumps invoice. Discussion

followed. Motion carried 4-0 (Atkinson abstaining).

Dollars Spent on Nuisance Ordinance Enforcement

T. Hennen questioned the amount of money being spent to resolve public nuisances in town.

The Clerk/Treasurer Report not approved.

Clerk-Treasurer Performance Evaluation

Motion to include Atkinson’s evaluation was made by Ettle and seconded by Eveslage. Discussion

followed. Motion carried 4-0 (Atkinson abstaining).

Council members were given the opportunity to speak about their own decision on the Clerk-Treasurer’s

performance.

Atkinson called a recess at 11:13pm. Atkinson called the meeting back to order at 11:20pm

Schirmer was given the opportunity to discuss his performance over the past year.

T. Hennen moved and Atkinson seconded a motion to have the performance evaluation calculated to two

decimal points. Discussion followed. Motion carried 5-0.

T. Hennen moved and Eveslage seconded a motion to give the Clerk-Treasurer a ‘less than satisfactory’

performance evaluation Motion carried 5-0.

Adjourn

T. Hennen moved and Ettle seconded a motion to adjourn the meeting at 11:26pm. Motion carried 5-0.

April 6, 2015 – Meeting Minutes

An emergency meeting of the Freeport City council was convened at 8:37pm at the location of Hennen

Lumber Co. by Mayor Rodney Atkinson with Councilmembers Mike Eveslage, Ken Goebel, Tim Hennen,

and Ben Ettle present.

The meeting was called to discuss the concerns of Clerk-Treasurer, Mason Schirmer’s actions.

Roll-call taken by Councilmembers to state their presence and they understood the rules of an emergency

meeting: Atkinson-yes, Eveslage-yes, Goebel-yes, Hennen-yes, Ettle-yes.

Hennen stated the reason for the meeting was because Councilmembers had been informed that Mason

Schirmer, Clerk-Treasurer had gone through Administrative Assistant’s emails, printed them off and gave

them to a Freeport citizen. Council expressed concern for the security of Freeport City Hall.

Atkinson explained the activities that happened at Freeport City Hall on April 3, 2015 at 4:15pm. Atkinson,

Hennen, a staff member, and a technology professional went to Freeport City Hall to make back-ups of the

server. For security purposes they felt this needed to be done, since procedure to do so had not been

followed. Atkinson stated the back-ups that were done were still being held at Scott Dymoke’s law office.

It was suggested that they locks on City Hall be changed and that no one have a key, but instead keys would

be dropped off at the outside safety deposit at the Freeport Credit Union and Freeport City Hall would be

closed until Thursday’s Special City Council Meeting. It was also discussed that Mason Schirmer, Clerk-

Treasurer be placed on Administrative Leave until Thursday’s Special City Council Meeting.

Eveslage moved to changed City Hall locks as soon as possible, seconded by Hennen and Ettle

simultaneously. Roll-call: Ettle-yes, Eveslage-yes, Hennen-yes, Goebel-yes, Atkinson-yes.

A phone call was made to Locksmith Al Ernst who agreed to be at Freeport City Hall at 6:00am Tuesday,

April 7, 2015 to change the locks and drop them off at the Freeport Credit Union.

Hennen moved and Ettle seconded a motion to adjourn. Motion carried 5-0. Meeting adjourned at 8:57.

A special meeting of the Freeport City Council was convened at 7:00pm by Mayor Rodney Atkinson with

Councilmembers Mike Eveslage, Ken Goebel, Tim Hennen and Ben Ettle present.

Opening Explanation from City Attorney Scott Dymoke

City Attorney Scott Dymoke began the meeting explaining to council the three options they were able to

proceed with. One being, Council could allow the paid administrative leave to be disciplinary action enough

and reinstate Schirmer to the Clerk-Treasurer position. Second, Council could terminate Schirmer from the

Clerk-Treasurer position. Third, Council could begin the process of entering into a separation agreement

with Schirmer. It was suggested by City Attorney Scott Dymoke for the City to enter into a separation

agreement with Schirmer.

Discussion was had to better understand each of the options.

Decision of Separation Agreement

T. Hennen moved to begin the process of a separation agreement, seconded by Ettle. Discussion followed.

Roll-call vote: Ettle-yes, T. Hennen-yes, Atkinson-yes, Goebel-no, Eveslage-yes. Motion carried 4-1.

Appointment of Negotiators in Separation Agreement

Eveslage moved to appoint Atkinson and T. Hennen to represent the City of Freeport in the negotiation

process of the separation agreement, seconded by Ettle. Discussion followed. Roll-call vote: Eveslage-yes,

Goebel-abstain, Atkinson-yes. T. Hennen-yes, Ettle-yes. Motion carried 4-0.

Appointment of Legal Consulting

Ettle moved to authorize Scott Dymoke in the preparation of a separation agreement, seconded by Eveslage.

Roll-call vote: Eveslage-yes, Goebel-yes, Atkinson-yes, T. Hennen-yes, Ettle-yes. Motion carried 5-0.

Update from City Attorney Scott Dymoke

City Attorney Scott Dymoke began the meeting by giving an update to council. He stated that he worked

with Mayor Atkinson and T. Hennen on Monday to draft a separation agreement offer. Attorney Dymoke

mailed the offer to Schirmer and Schirmer’s lawyer Monday. By law Schirmer has up to 21 days to make a

decision on the offer. Nothing has been received from Schirmer or Schirmer’s lawyer. Attorney Dymoke is

hopeful for an update for the April 28th

regular city council meeting.

Re: Clerk-Treasurer Report

On April 15 and 16, Schlenner Wenner & Co. was here to conduct the audit that was scheduled for the week of April 6-10, but was rescheduled due to City Hall being closed that week. It went very well considering the circumstances and was told by Jonathan Archer and Ryan Schmidt (auditors) that they were very pleased with how everything went and that I was able to get all of their questions answered. Overall, it was a successful audit. Things around the office are going pretty well. Trying to pick-up the pieces left behind and either continue with them or get them wrapped up, but overall things are going well. I’m feeling very supported by the town, councilmembers, and surrounding cities. I was in contact with Kathleen Murphy. She was our consultant who was working on putting together a pay scale range for the City, which had begun in 2013. You saw an invoice from her, which is for all of the work she has done thus far. I explained to her the situation the City is currently in and we decided to hold off on any further development until the City has decided what they would like to do next. I am attaching an email conversation had between Mason Schirmer and Christopher Smith, Risk Management Attorney with the League of MN Cities. I’m uncertain if any action needs to be taken on this item at this time, but I thought it was something council should be aware of. It can be put on the upcoming months’ agenda if council would like to address it. As an FYI, myself, Jon, Sam, and JoAnn are now all in possession of keys to city hall. Rodney has expressed that he does not want a key until everything is resolved with the separation of Mason Schirmer, so until then his key is being kept in city hall. There is a page attached from Mike Brethorst of Melrose. Once you have read through the page, understand that no action needs to be taken on this matter right now, but instead Mike is encouraging the council to start getting the word out and brainstorming individuals who you feel would be good people to apply to this program. Once again, no action needs to be taken, this is just informational right now. Rodney reminded me to look into the digital speed signs. I’m currently waiting to hear back from Stearns Co. on the cost of those signs.
