THE CHESIDRE RUGBY FOOTBALL UNION RULES

NAME AND CONSTITUTION 1. The name shall be "CHESHIRE RUGBY

FOOTBALL UNION" hereinafter caUed "the County Union."

2. The County Union shall be in Membership with the Rugby Football Union.

3. The object of the County Union shall be the furtherance of the interests of Rugby Union Football.

4. The County Union being the constituent body for the Cheshire Area duly appointed by the Rugby Football Union, shall act as such consti­tuent body. The expression "the Cheshire Area" has such meaning as on request may be assigned to it by the Committee of the Rugby Football Union.

MEMBERSIUP S. There shall be elisible for Membership of

the County Union: (i) Rugby Football Clubs, including school

cbbs, in the Cheshire Area (hereinafter referred to as "clubs").

(ii) The Liverpool and District Rugby Union Referees' Society, the Manchester and District Rugby Union Referees' Society and any other Society of Rugby Union Football referees approved by the Com­mittee of the County Union (hereinafter referred to as Clsocieties").

(iü) Individuals. Provided that:

(a) No club. society or individual shan be eligible for membership which or who (uniess previously reinstated) has been expelled from membership or, being a player or official of a club or society, is onder suspension by the Committee of the Coonty Union (hereinafter referred to as the "Committee"), or the Rugby Football Union. or has committed any act of prof es­sionalism as specified in the Rules for the time being as to Professionalism of the Rugby Football Union.

(b) AD individual member must be a member of a Rugby Football Club or Union which itself is a member of the Rugby Football Union.

(c) Every candidate for election must be proposed and seconded by or on behalf of two Members entitled to vote by notice in writing given to the Hon. Secretary. Elections shall be by the Committee, and upon demand of any member of the Committee present elections shall be by ballot.

HONORARY UFE MEMBERS 6. Honorary Life Members May be elected

at any General Meeting upon the recommen­dation of the Committee provided that notice of intention to propose them has been included in the Agenda sent with the notice convenin!! the meeting.

ENTRANCE FEES AND SUBSCRIPTIONS 14. Clubs (otber than school clubs) shall on

election pay an entrance fee of t1.0s. 15. Annual Subscriptions, which shall fall due

on Seplember lst each year, shall be: (i) In Ihe case of each club (other than a school

club) and of each university club, tIS·OO, payable by Bankers Order to the Hon. Treasurer on Septcmber 1 sI each year.

(ii) In the case of each school club tS 00, plus such amount as may be needed to cover ils subscription 10 the RUlfby Football Union (which must be transmltted by the County Union).

(iii) In the case of individuals other than Hon. Life Members, t3·00.

GENERAL MEETINGS

19. The Hon. club, three duly appointed schoolboy represen­tatives nominated by the Schoolboys' Sub­Committee and one representative of the individual members immediately prior to the general meeting at which he is to act. (The duly appointed representative of each Club for the purpose of this rule will be additional to officers and members of the Committee).

21. lndividual members. save for the indivi­dual memher elected in accordance with Rule 20, may attend general meetings, but will not he entitled to vote.

22. A representative of a club (other than a school club) shall he a member of the appointing club: a school club representative shall he a memher of the staff of the school concerned.

23. For the purpose of attending and voting at Annual General Meetings, the name of a representative of a club or of a schoolboy representative shall he given by notice in writing under the hand of the appointing President, Chairman or Secretary to the Hon. Secretary of the County Union not later than the commencement of the general meeting which such representative shall be attending. If more than one alternative representative shall present him­self, that one of them whose name appears on the notice shall alone he entitled to vote.

24. The President or in case of his absence, the Vice-President who shall of those present have been longest in office, shall be Chairman at ail General Meetings. If the President and all Vice-Presidents shall all he absent the meeting shall appoint a Chairman.

ln case of an equality of votes, the Chair­maa shall have a second or casting vote.

25. The quorum for a General Meeting shaU be Meen persons entitled to vote.

26. No person shan be entitled to attend any general meeting whilst any entrance fee or sub­scription is owing to the County Union by such person or by the club he represents in the case of the representative of a club.

27. The accidentai omission to give notice to. or the non-receipt of notice by. any member shall DOt invalidate the proceedings at any general meeting.

SUB-COMMl'ITEES 34. The Committee shall have the power to

appoint any Sub-Commiuees and to delegate to any Sub-Cemmittee or to ether persons such matter. as it May determine.

35. The Commiuee shall appoint the follow­ing standing Sub-Committees, the quorum for meetings to be three persons entitled to vote: SELECTION SUBoCOMMTITEE, consisting of

six named members, not more than one from any one club, and the County Coach (to be appointed in January of each year). It shall be responsible for the selection of teams to represent the County, to nominate persons for the County Referees' Panel, and to make travelling and hotel arrangements for the teams subject to any directions of the Com­mittee as to finance.

EMBRGENCY SUB-COMMTITBE, consisting of the Officers of the County, who sha1l deal with all complaints against Clubs and all matters ofurgency.

FINANCESUB·COMMTITEE,consistingofthe President, the Hon. Treasurer, the Hon. Secretary, the Assistant Hon. Treasurer, the ,Assistant Hon. Secretary, the RugbyFootball Union Representative and the Chairman (or Hon. Treasurer) of each Sub-committee. The Finance Committee shall control all income and expenditure. It May borrow monies from the County Unions bankers and May determine who shall sign and endorse

cheques. It shall investigate and adviso upoo applications from clubs for loans and from time to time review and report to the Comm. ittee upon invested funds.

41. ACCOUNTS AND AUDIT 47. At every Annual General Meeting a

Chartered Accountant shall be appointed auditor, to hold office until the next succeeding Annual General Meeting. The retiring auditor shall he eligible for re-appointment.

48. A Revenue Account and Balance Sheet shall he made up to April 30th in each year, and signed by the Hon. Treasurer. They shall he audited by the Auditor appointed at the previous

Annual General Meeting. A printed copy of the signed Revenue Account and Balance Sheet and of the Auditor's Certificate thereon shall be sent to each member with the notice convening the Annual General Meeting, and the Revenue Account and Balance Sheet shall be submitted to soch meeting for its approval.

COPŒS OF RULES 49. A copy of the Roles for the lime being in

force shall be sent annuaUy to each mamber, who or whlch shall be bound thereby.

INTERPRETATION OF RULES 50. Any ditrerenœ of opinion which may arise

as to the interpretation of any of the Roles shaU be decided by the Committee, unless it occur at a General Meeting when the decision shaU be made by the Chairman thereof. Any soch decision shaU be recorded in the Minutes, and shall be acœpted as the true meaning of the Roles until otherwise interpreted at a General Meeting, due notice having been given.

REGULATIONS OF THE COMMITTEE GOVERNING CLUBS. MATCHES AND

PLAY ERS under the jurisdietion of the Cheshire Rugby Football Union

1. C lubs shall send to the Hon. Seeretary of the County Union the names and ad dresses of thcir Honorary Secretary and Honorary Treasurer not later than the Annual General Meeting of the County Union.

2. The home club must post a notification of the proposed lime of commencement of play to the visiting club ten c1ear days befare the match, and the visiting club must confirm this within twa da ys.

3. If a club ra ils without reason satisfactory to the Committee to ful fil a fixture it shall be Iiable ta suspension.

4. During September. October, February, March and April not less than fart y minutes cach \Vay shaH be played and during November. December and January not less th an thiny-five minutes, unless a shorter lime is sanctioned by the referee priar to the kick-off.

The Captains of the teams must inform the refcrec as to the lime agreed upon for play.

5. If a match is delayed for an unavoidable reason so as lO prcclude the chance of its bcing played according to the time agrecd upon by the Capla ins, the referee then has absolute power to dccide the length oftime of the match prior to the match starlÎng.

6. The referee shaH have power to terminate the match should he think fit. If the match be so termi nated the score at the time of termination shall be deemed to be the fina l score.

7. Both teams shall be on tbe ground ready to start at the time arranged. Should any club not be ready to start at the time arransed, it sball be Iiable to sUSpension. 8. Referees will wbere possible he appointed by a referees' society. In case the official Referee fails to tom up, the Captains should agree upon a Referee, and in case they fail to do 50 must toss for cboice. The non-attendanco of the official Referee should at once be reported to the Hon. Secretary of the County Union and the Secretary of the referees' society conœmed.

THE THORN EMI COUNTY CHAMPIONSHIP REGULATIONS 1982/83

1. DESCRIPTION The Competition shall be called "The

THORN EM! CGunty Cbampionsbip" (berein­aI\er referred to as "the Cbampionship'') and shall be between the 27 Constituent Bodies (bere­lnal\er referred to as ''The Counties") named in the next paragraph.

The 27 Counties taking part in the Championsbip shali be Berkshire, Buckingham­shire, Cheshire, Cornwall, Cumbria, Devon, Dorset &; Wilts, Durham, Eastern CoUDdes, East Midlands, Gloucestershire, Hampshire, Hertford-

shire, Kent, Lancashire, Leicestershire, Middle­sex, North Midlands, Northumberland, Notts, Lines & Derbyshire, Oxfordsbite, Somerset, Staffordshire, Surrey, Sussex, Warwickshire and Yorkshire.

All matches in the Championship shaU be played under the laws of Rugby Union Football and comply with the Bye-Laws, Ru1es and Regu1ations of the Rugby Football Union (here­inafter referred to as the "RFU").

2. ORGANISING COMMlTTEE The Championship will be organised by

the Committee of the RFU (hereinafter referred to as the "Committee"). The decisions of the Committee shall be binding and final on any matter not provided for in and on the interpret­ation of these regu1ations.

3. FORM OF CHAMPlONSHlP (a) The twenty-seven Counties will be divided

into four leagues of which leagues l, II and III will consist of eight Counties each and league IV will consist of three Counties.

(b) There will be promotion and relegation between these each season on the basis of two up and two down.

(c) The fust three leagues of eight will each season be divided into two groups of four bymeansofadraw.

(d) The Counties in the six groups of four will play each other involving three games for each County in these groups.

(e) The four Counties in each group will be replaced in order as a resu1t of their three matches, two points being awarded for a win, one for a draw and none for a loss. In the case of equality of points after playing the three matches, places will be decided by

placing a County with a larger points difference above a County with a lesser points difference, the difference being estab­lished by subtracting the points scored against from points scored for.

(f) The fourth match to be played between Counties in the first three leagues will be asfollows: (i) The top County in each group of four

will play the second County in the other group of four in the league concemed. The two winners of these matches in the league 1 will go forward to a final to decide the champion County for the current season. The two winners in each ofleagues II and III will be promoted to a higher league in the next season.

(ii) The third County in each group of four will play the fourth County in the other group of four in the league concelned. The losers of these two matches will be relegated to a lower league in the following season.

(g) The three Counties in league IV will play each other on a home and away basis involving each County in four matches. At the end of these matches Counties will be placed in order, two points being awarded for a win, one for a draw and none for a loss. In the case of equality the points difference will decide the placings. The top two Counties will be promoted to league III in the following season.

4. DRAW The draw for the two groups in each of

the fust three leagues will be made each year by 31st January. The first four Counties drawn in a

particular lea~e will comprise the tirst group, and the remainlng four Counties will comprise the second group in the league concemed.

S. DATES (a) The four matches to be played by each of

the Counties in leagues l, Il and III shall he played on Saturdays 6, 8, 10 and 12.

(h) The final will he played on Saturday X5 or Saturday X7 according to which is available each season.

(c) ln league IV the matches will he played un Saturdays 6, 7, 8, 9, 10 and 12.

6. VENUES (a) The venues for the three group matches in

the first three leagues will he decided according to the order Counties are drawn as first, second, third and fourth in each group' for the season concemed. Matches will 00 played, the first named having home advantage, as follows: Saturday 6 1 v. III Il v. IV Saturday 8 1 v. Il III v. IV Saturday 10 IV v. 1 Il v. III

(b) ln the first three leagues on Saturday 12 the home advantage will he in favour of those Counties who were placed tirst and third in thelr respective groups at the end of the preceding three matches.

(c) ln league IV matches will be played as follows: Saturday 6 . 1 v. Il Saturday 7 Il v. III Saturday 8 III v. 1 Saturday 9 Il v. 1 Saturday 10 III v. Il Saturday 12 1 v. III

(d) In the final the home advantage will be in favour of the County from the group drawn tirst where the final is between two group winners or between two group runners-up and in favour of the group winner where the final is between a group winner and its runner-up.

(e) In every case the County having home advantage shall decide on which ground within its Constituent Body area a match shall be played. '

7. ELlGmILlTY (a) A man may qualify to play for a County by

birth. residence or club. (b) No man may play for more than one

County in a Season. (c) To qualify by birth a man shall have been

bom within the Constituent Body area of the County concemed.

(d) To qualify by residence a man shall: (i) Actually be residing within the Con­

stituent Body area of the County con­cemed when he tirst plays for that County. provided that he has resided therein continuously for a period of three calendar months immediately preceding the date of playing. or

(ii) Shall be residing when at School or , College either as pupil, student or master provided that he is a bona tide • pupil. student or master of the school or college concemed during the full term of three months immediately preœding the time of playing.

(e) Wbere a man plays for a County by virtue of a qualification by residence under (d)(i) above sucb qualification shall hold good

until a man qualifies and plays for another County, but qualifications by residence and playing under (d)(ii) .above shaII terminate ID respect of a pupil or a student but not in respect of a master immediately his full­time period of instruction at the school or college ends.

(f) Residence taken up to attend school or college as a pupil or student shall not quaiify a player under (d)(i) above.

(g) A man shaH he held to he actually residing in a County oniy if: (i) His own home or ordinary place of

residence which comprise premises which he ordinarily and regularly uses as his home and which he ordinanly and regularly uses as a sleeping apartment be within the boundaries of the County concemedor

(ii) Having no other home or ordinary place of resiàence of his own his parents' or guardian's ordinary place of resid­ence is situate within the boundaries of the County concerned or

(Hi) Being in one of HM Forces he is stationed in the County, his station to count as his residence under (d)(i).

(h) To qualify through a club a man shall he a bona fide playing member as at the lst September or in the case of a university or student club as at the start of the academic year, in the current season of a club aIloc­ated under RFU Bye-Iaw 17 to the County concerned and shall have continued to remain a bona fide playing memher of that club up to the date of first playing for the County concerned in that season.

(j) Where a man is a bona fide playing membe

of two clubs aIIocated to different Counties under RFU Bye-Law 17 then he must state at the start of the season concemed the club which he considers to he bis 'home' club for the purpose of the County Championship.

(k) Where a man plays for a County by virtue of a qualification under (h) above such qualification shall hold goDd until a man qualifies and plays for another County except that qualification through a univers­ity or student club shall terminate when a man ceases to he a memher of that univers­ity or student club.

(1) Any County which receives an official com­plaint (whether verbal or otherwise) regarding the qualification of one of its players, must report the faets to the RFU within 48 hours. The complalning County must a1so within 48 hours of making the complaint report the details on which it bases it to the. RFU and to the County &gainst which it is making the complaint. If the County against which the complaint has been made, thereafter plays the main in question IUid the objection is upheld by the RFU, the County concemed shalliose the match.

8. DRAWNMATCHES (a) If in any match to be played on Saturday 12

in the first three leagues to decide pro­motion and relegation after 40 minutes of play each way the scores are still level, the County that has scored the most tries shall he the winner. If this does not produce a result the County that bas scored the most goals {rom tries shall he the winner. If this

still does not produce a result the visiting team shall be deemed the winner.

(b) In the final if at the end of 40 minutes play each way the scores be equal. the tries he equal and the goals from tries he equal. there shall he an immediate period of replay between the same teams of 10 minutes each way with a one-minute interval. If at the end of the further 20 minutes play the scores still be equal. then the match shall be adjudged a draw.

9. REFEREES AND TOUCH JUDGES (a) Referees for ail matches in the Champion­

ship shall be appointed by the RFU. (b) In ail matches other !han the final the

touch judge for the home team shall be a qualilied referee appointed by the Referees Society associated with the home County. The other touch judge shall be provided by the visiting County.

(c) In the final the touch judges shall be quali­lied referees appointed by the RFU.

10. REPLACEMENTS Replacements are permitted in the final of

the Competition in accordance with Law 3 and the International Board Resolution relating thereto as printed in the RFU Handbook. In ail other matches of the Championship replacements are permitted in accordance W1th the RFU Resolutions relating to the use of replacements.

Il. CLASH OF COLOURS In the event of Counties having sunilar or

clashing colours. the home County shall be responsible for changing its colours.

12. POSTPONED AND ABANDONED MATCHES If conditions prevent a match being

played or a match is abandoned it shall be played the following Saturday or such other day as may be authorised by the Committee.

13. NOTIFICATION OF RESULTS The Secretary of the home County shall

be responsible for informing the Secretary of the RFU of the result of a match within 48 hours thereof.

14. DELAYED ARRIVALS Matches shall be played during normal

daylight hours unless two Counties mutually agree to play under ftoodlights. AlI shall start at the agreed time and any delay may be reported by the non-olfending County to the Committee.

15. GROUNDS A home County is responsible for

correctly preparing its ground for a match. 16. FINANCE (a) At ail matches in the Championship ail

spectators (including members and season ticket. holders both of the Counties con­cemed and the club where a match is staged) must be charged the advertised entrance. stand and car park priees.

(b) In ail matches the two participating Counties shall share the gross gate which shall .include car park and programme receipts (less cost of printing) after payment therefrom of 15% thereof to the host club providing the ground.

Thereafter the home County shall bear ail match expenses and the visiting County shaH pay allits own travelling expenses.

17. PROTESTS, DISPUTES AND TRANSGRESSIONS

Any matters in dispute or any trans­gressions of these regulations, other than those reIating to the eligibility of players where the provisions of Regulation 7 (1) apply, shall be referred immediately ta the Secretary of the RFU by telephone if necessary, providing written confirmation follows immediately.

18. SEEDING FOR 1982/83 The 27 Counties shall for 1982/83 be

STANDING ORDERS OF THE COMMlTTEE GOVERNING ITS

MEETINGS

(to apply mutatis mutandis to General Meetings)

1. Every notice of motion shall be made in writing to the Hon. Secretary of the County Union to be included in the Agenda of the next meeting, such notice to be signed by at least two members.

Tbe Motions shall be taken iu the order in which they appear on the Agenda paper unless a majority of the Committee decide otherwise, and no motion will he put to the vote unless it is both moved and seconded.

2, A11 correspondence or business of import­ance which may have arisen too late for inclusion in the Ageuda paper shall be produced previous to any Motion on the Agenda paper being put, and the Committee may decide by a maiority to take any such business before proceeding with the Agenda paper.

3. The Chairman shall have power to prevent any member, except the moyer, speaking more than once on any one motion or question unless in explanation. The moyer shall in ail cases be entitled to speak once in making his motion, and once by way ofreply.

4. Whenever an amendment is moved on an original proposition and seconded, no second amendment shall he moved until the original amendment is disposed of.

ff an amendment he carried, the motion as amendment shaH take the place of the original

motion, and shall become the motion on which a second or further amendment may be moved.

Only one amendment shall be submitted for discussion at a time.

No reply is allowed to the mover of any amendment to a motion.

S. AlI resolutions shall be put to the meeting and decided by a show ofhands or by ballot at the discretion of the Chairman.

6. The Chairman shall have power to allow any member to rise and speak to a point of order at any point of a debate.

7. A declaration by the Chairman as to the resnlt of a vota shall be conclusive.

8. It is not intended to apply the standing orders to mattars which may arise for discussion apart from the Agenda paper, and the Chairman shall have power to enforce ail or part of them onlyat bis discretion.

9. AlI questions arising on the construction of the above standing orders shall be determined by the Chairman of the meeting for the time being and his decision shall bo final.

10. Any resolution or minuta passed or approved by the Committee which affects the Mlure Iist of clubs affiliated with the county will not become operative for three seasons following the data of tbe confirmation of the resolution or minuta.

RULl~S OF THE CHESHIRE CUP AND PLATE COMPETlTIONS

1. The Competitions shall be called "The Cheshire Cup" and "The Cheshire Plate".

2. All Clubs who are full members of the Cheshire R.F.U. shall he eligible to enter providing all outstanding debts have been paid to the Cheshire Unions, being:

(a) paid the entrance fee to the Competitions, (b) paid the current season's subscription to

theCounty, (c) paid any current loan interest and

repayment, (d) submitted a balance sheet and statement

of club accounts as required by the Rugby Football Union Bye-law 10,

Ce) has no outstanding payments in connec­tion with Disciplinary Hearings for the previous seasoD.

3. There shall be an Entrance Fee as decided by the Cheshire Cup and Plate Competitions Sub-Committee.

4. The competing tearos shall he bona-fide members of the Club represented by such teams. Members of other Clubs shall not be enrolled for the special purpose of playing in any Tie, and. no player may play for a club competing in the Cheshire Cup and Plate who has previously played for another Club in the same competition or any other County Cup or John Player Cup Competition in the siune season.

5. The Ties for the Competitions shall be drawn and the matches played by the dates deter­mined by the Committee. The first dra wn Club in each Tie (other than the Final) shall have a choice of ground. The Final will be played on a ground

decided by the Cup and Plate Sub-Committee. 6. The duration of each Tie will be one hour

and twenty minutes, unless the Referee considers that conditions will not allow the full length of time ta be played in which case the tie will be replayed on the same ground.

7. Drawn Matches. (a) If after 40 minutes each way the scores are

still level, the team that has scored the most tries shall go forward into the next round. If this does not produce a result. tbe team tbat bas scored the most goals from tries goes forward into the next round. If the scores still be equal, the tries still be equal and the goals from tries still be equal the visiting team shall go forward into the next round.

(b) ln the Quarter-Final and Semi-Final, if at the end of 40 minutes play each way, the scores be equal, the tries be equal, and the goals from tries be equal there shall be an immediate period of replay between the same teams of 10 minutes each way. with a one-minute interval. If the score still he equal. the tries still be equal and the goals from tries still be equal, the visitiog team shall go forward into the next round.

(c) ln the Final, if at the end of fort Y minutes play each way. the scores be equal. an extra ten minutes each way will be played, the score at the end of that period being the result. Should there still be no decision a replay will be staged, the venue and date to be decided by the Cup and Plate Sub-Committee.

8. Replacements-Up to a maximum of two players per team may be in attendance and be available as replacements in all ties played.

9. Where a Club is required to play a tie on a Sunday it must fulfil its normal fixture the previous day or be disqualified from the Competitions for the current season.

10. AlI entry proceeds, that being Gate, Stand, programmes and car park shall be shared equally between the two Clubs concemed. The gate money from the Final Tie, after deduction of expenses, shall go to the benefit of County Funds. The Members of the Home Club, including Ladies, must pay for admission to the Grounds, Stands and Enclosures, etc.

11. Ali Ties will be refereed by a member of either the Manchester or LiverPool Referees Society. The touch judges for the semi-finals and finals shall be members of either the Manchester or LiverPool Referees Society.

12. In the event of a clash of colours between competing Clubs, the Home Team must change its colours.

13. Ali questions affecting the qualifications of players and the interPretation of these rules shall be referred to the County Committee. No protest or appeal of any kind will be valid unless the Club making the protest or appeal does so within forty-eight hours of the termination of the Match to the County Secretary. A copy of the protest or appeal must at the same time be sent to the Secretary of the opposing Club, and the Referee also, should the matter so concem him.

14. The County Committee are the sole interPreters of these Rules, and from their decision, there shall be no appeal; either at law or otherwise.
