Newsletter 2015-49 December 11, 2015 CAWV MIDYEAR MEETING APPROACHING, SPONSORS NEEDED Associate Division Chairman Eric Ramey will this week be reaching out to Associate Division members to solicit sponsorships for the Saturday evening reception and cocktail party being held during the CAWV Midyear Meeting, February 12 - 17, 2016, at the Grand Floridian Resort & Spa in the Walt Disney World Resort. Members of the Associate Division who wish to participate will be listed in the convention program, Newsletter, CAWV website and in the West Virginia Construction News magazine. “This is a great opportunity to show that your firm supports the CAWV and its membership,” said Chairman Ramey. “The Saturday evening reception is always very well attended and is a great time for members to network with their peers and catch up with friends. This year’s reception will feature your favorite Disney characters Mickey and Minnie and friends. I wholeheartedly encourage every member of the Associate Division to support this function.” Additional sponsorship opportunities will also be available for various functions The sponsorship form will be mailed to members next week and is due back to the CAWV office by December 30. Plan to join with others interested in the future of West Virginia’s transportation system and show support for a long-term solution for the state’s roads, bridges and highways. Members are urged to gather at the state Capitol, meet with new legislators and help educate lawmakers about the challenges facing transportation across the state. A limited number of exhibit spots will be available at the West Virginia Capitol as part of Transportation Day. There is no cost to exhibit, but pre-registration is required (these are available on a first-come, first reserve basis). A registration form is attached to this week’s Newsletter for those interested in attending or exhibiting. For additional information, call the CAWV at (304) 342-1166. CAWV ANNUAL REPORT TO BE SENT TO MEMBERS NEXT WEEK The 2015 CAWV Annual Report will be mailed to members next week. “Even though this year presented many challenges for the construction industry, the CAWV is committed to prioritizing the issues facing contractors in West Virginia and to growing the construction economy,” writes President Cooperrider. “This year’s annual report is a small sampling of the issues addressed this year by this association for the good of our industry. We could not be successful if not for the support and participation of every member of this great organization. I encourage everyone to become involved in a committee, task force or attend a meeting. I think you will see the positives of belonging to the Contractors Association of West Virginia.” STRATEGIC PLANNING PROCESS TO BEGIN The CAWV meets every three years to chart future goals and action plans for the association. Chairman Dan Flesher has scheduled January 11 for the next planning session. The Strategic Planning Committee has been successful in developing a thorough action plan for the association. Many of the CAWV’s accomplishments over the past few years are attributable to the committee’s deliberations. Any member wishing to suggest goals and objectives for the committee to consider can send them to the CAWV at [email protected]. LAST CALL FOR PHOTOS FOR WVCN ANNUAL CONSTRUCTION FORECAST ISSUE The CAWV is calling all members to share their photos with the readers of West Virginia Construction News. The photos are to be included in the November/December annual construction forecast issue. It is requested that electronic images be at least 300 DPI and in tiff, jpeg or pdf format. Hard copy photos should be 8 ½” by 11” and can be returned, if requested. Members are asked to include captions detailing the name of the project and its location, name of photographer and the submitting company in their entries. Please send all photographs to Cassidy Webb at [email protected]. Photos may also be sent on a CD by mail to CAWV headquarters. CONTRACTORS “CAN” HELP THIS HOLIDAY SEASON On Monday, December 14, radio station WQBE, in conjunction with Kroger and other partners, will be launching the annual WQBE/Kroger Food Drive to help eradicate hunger this holiday season. The Union Mission has a goal to provide food to over 35,000 individuals this year. Food will be collected through Friday, December 18, at area Kroger Stores and at the parking lot of the Dunbar Kroger. The food collected will be distributed by Union Mission on Saturday, December 19, as they stage a massive food distribution across 38 outreach sites in 21 counties. Stop by Dunbar Kroger on December 14 and make a difference in the lives of needy West Virginia families. Caught In/On/Between

Each year, workers suffer approximately 125,000 caught or crushed injuries that occur when body parts get caught between two objects or entangled with machinery. These hazards are also referred to as "pinch points". The physical forces applied to a body part caught in a pinch point can vary and cause injuries ranging from bruises, cuts, amputated body parts, and even death. Here is some training to learn about the caught/crush hazards and pinch points specific to your tasks, tools, and equipment so you can take precautions. Dress appropriately for work with pants and sleeves that are not too long or too loose. Shirts should be fitted or tucked in. Do not wear any kind of jewelry. Tie back long hair and tuck braids and ponytails behind you or into your clothing. Wear the appropriate, well-fitting gloves for your job. Look for possible pinch points before you start a task. Take the time to plan out your actions and decide on the necessary steps to work safely. Give your work your full attention. Don't joke around, daydream, or try to multi-task on the job-most accidents occur when workers are distracted. Read and follow warning signs posted on equipment. If you value all that your hands can do, THINK before you put them in a hazardous spot. Machinery can pose a hazard with moving parts, conveyors, rollers and rotating shafts. Never reach into a moving machine. Properly maintain and always use the machine and tool guards provided with your equipment; they act as a barrier between the moving parts and your body. Don't reach around, under or through a guard and always report missing of broken barriers to your supervisor. Turn equipment off and use lockout/tagout procedures before adjusting, clearing a jam, repairing, or servicing a machine. Vehicles, powered doors, and forklifts can pose a crush hazard unless they have been blocked or tagged out. Never place your body under or between powered equipment unless it is de-energized. Doors, file drawers, and heavy crates can pinch fingers and toes. Take care where you place your fingers. Test the weight before lifting, carrying, and placing boxes; an awkward or heavy load can slip and pinch your hands or feet. Get help or use tools to move large and/or heavy items. If you have ever slammed your finger in a door, you can appreciate the pain associated with this common type of caught/crush injury. Take the time to learn about the caught/crush hazards in your workplace so you don't learn about the consequences first hand.

CONGRESSIONAL COMMITTEE DEVELOPS WATER AUTHORIZATION DRAFT The House Transportation and Infrastructure Committee has reviewed all comments on the Clean Water SRF reauthorization bill and redrafting is underway. According to Committee staff, given the Committee’s immediate focus on the recently passed highway bill, the Clean Water SRF effort will likely spill over until next year’s consideration of another Water Resources Reform and Development Act (WRRDA) bill. When the Committee was developing its 2014 WRRDA bill, there was some discussion about including in it reauthorization of the Clean Water SRF. That never happened but next year’s effort could become the vehicle for addressing the issue. Democrat members on the House Transportation and Infrastructure Committee have drafted a bill that would reauthorize the Clean Water SRF at $13.8 billion in CSWRF over a 5-year period. It would also authorize the sewer overflow control grant program at $500 million for each of FY16-20, and an alternate water source pilot project at $50 million for each of FY16-20. FY16 HOUSE ENERGY AND WATER APPROPRIATIONS BILL To review, on May 1, the House passed H.R. 2028, its version of the FY16 Energy and Water Appropriations Bill. The FY16 budget request for the Civil Works program of the Corps of Engineers is $4,732,000,000, a decrease of $722,500,000 from FY15. After adjusting for the rescission of $28,000,000 of prior-year appropriations in the FY15 Act, the budget request represents a reduction from FY15 of $750,500,000, or 14%. Each of the four main project-based accounts would see a sharp decrease under the budget request. The Construction account would see the largest dollar reduction ($467,489,000) and largest percentage reduction (29%). FY16 SENATE ENERGY AND WATER APPROPRIATIONS BILL Also to review, on May 21, the Senate Committee on Appropriations approved its version of the FY16 Energy and Water Development Appropriations bill, a $35.4 billion measure that represents a $1.2 billion increase over the FY15 enacted level and $668 million below the President’s budget. WVDOH BIDDING UPDATE: PROJECT EXPEDITE OUT---PROJECT BIDS IN A BIG change is in the works for how contractors submit their bids to the WVDOH. The WVDOH is one of the first agencies to replace the existing AASHTOWare Project Expedite software, which is now more than 20 years old, with the new Project BIDS software. The modernized code base will reportedly provide many benefits to the agency. The WVDOT will be implementing the AASHTOWare Project BIDS software on or about December 22, 2015. The WVDOT, after upgrading to the new software, will begin immediately advertising projects for lettings in 2016. The DOH has been unable to advertise 2016 projects during this transition phase. John Taylor, Assistant Director, Contract Administration, advises contractors wanting to submit bids on future WVDOT projects that they will be required to conduct the following steps AFTER the WVDOT implements Project BIDS: 1. Download the AASHTOWare Project Bids™ Bid component. 2. Create a user profile for the Bid component. 3. Create a new Digital ID certificate for the Bid component. 4. Request to bid with the WVDOT agency AFTER the Digital ID certificate has been approved and enabled by the Bid Express customer support team. 5. After completing all previous steps, test the software. An email will be sent out by InfoTech to each contractor that currently holds a digital ID AFTER the DOH completes there upgrade on or about December 22nd. The email will contain detailed instructions on how to perform these steps. You may also email or call the Bid Express customer support team for assistance at 888-352-BIDX (2439) or [email protected]. Again, use of this new software and Digital ID will be required for all future lettings, beginning with the January 12 letting. The soon to be released 2016 Supplemental to the Standard Specifications will also be applicable to all projects bid on or after January 12, 2016. WVDOH AWARDS AGGREGATES AGENCY PURCHASE ORDER CONTRACT The DOH has awarded their agency aggregate PO contract for Delivery to Non-Established Locations, which has an effective date of December 15, 2015. The term of this contract for the first time in several years is for a period of one year. As you will recall, this contract was made a separate “Agency” contract this year. The contracts for material and delivery by the vendor to established locations and the contracts for material and pickup by WVDOH forces are not complete thru the Purchasing Division at this time. TIME RUNNING OUT TO REGISTER FOR THE 2016 CAWV/WVDOH TECHNICIAN AND INSPECTOR COURSES The CAWV is pleased to announce Technician Certification Training Courses, which are offered annually to help individuals prepare for WVDOH certification examinations required under their

Quality Assurance Program. Thousands of individuals have attended courses in Compaction, Aggregates, Asphalt and Portland Cement Concrete over the last several years. Test comparisons prove that those persons who attend the CAWV/WVDOH courses have a higher success rate for passing the exams. This year’s courses include several changes and attendees should read the registration forms carefully to make sure they are attending the correct course to fit their needs. Class Training Dates Test Date Soil and Aggregate Compaction Inspector (see note below) January 4-7 January 8 Beginning in 2016 this certification will only include soil and aggregate Inspector certification. If you need to test asphalt compaction, you will need to take the Asphalt Field Technician course. If you are currently certified as a Compaction Inspector you may still test for asphalt compaction.

Aggregate Inspector January 11-14 January 15 Asphalt Field and Compaction Technician (see note below) January 18-21 January 22 A certified Asphalt Field Technician will be required on all paving projects starting in 2016. This course is also required to test Asphalt Compaction if you are not currently Compaction certified.

Asphalt Plant Technician (Note Location Change) January 25-28 January 29 This Course will be held at the WVDOH Materials Division Headquarters in Charleston. PCC (Combined Courses- see form #5) February 1-4 February 5 Portland Cement Concrete Technician and Inspector- This course will have a test for PCC Technician and a separate test PCC Inspector. This is a great opportunity to get both certifications in one week.

The state’s leaders in politics, business, economic development, education and health came together Tuesday in Charleston for a day-long “Leading the Change” pre-legislative conference hosted by the West Virginia Business and Industry Council (WVBIC). The event featured status briefings on topics ranging from the challenges facing the coal industry and the need to develop and diversify the state’s economy to the widespread problem of methamphetamine use, the state's education system and other issues such as workplace freedom. “Our goal in hosting this conference was to provide our Legislators an opportunity to get together with the state’s leaders from across the spectrum and hear updates on the issues facing the state,” said Chris Hamilton, chairman of WVBIC. “We want to get everyone together and make sure we are all pulling in the same direction. I think we were able to do just that.” More than 120 people attended the conference, including Senate President Bill Cole, Senate Majority Leader Mitch Carmichael and House Speaker Tim Armstead. A number of senators, delegates and announced candidates for the West Virginia Legislature also attended.

Looking at a political perspective on 2016, Mark Blankenship, of Mark Blankenship Enterprises, a state-based polling and research firm, said the number one issue for voters today – and for the past 15 years – has been jobs and the economy and that has become even more important lately as the state has watched more tens of thousands of coal and coal-related jobs evaporate as a result of the policies of the national Democratic Party. The candidate who successfully convinces voters that he has the right plan to grow the economy and create jobs will win the governor's race, he said. Job creation through infrastructure investment was presented by CAWV Executive Director Mike Clowser. He gave attendees an overview of the Blue Ribbon Commission on Highways report and talked about the CAWV’s report, “The Economic Impact of an Annual $500 Million Increase in Highway and Bridge Construction Investment in West Virginia,” and the nearly 10,000 jobs that would be created through increased highway spending. He noted that 47 percent of the jobs would be in the non-construction sector of West Virginia’s economy. Other speakers talked about the need to increase the state’s college-going rate and focus more on workforce preparedness so a high school diploma means students are ready to be successful in life. Lawmakers and those in attendance also heard an update on the status of the state’s methamphetamine problem as well as other drug-related issues. The last presentation of the day was on workforce freedom, a topic often called "right to work" which is expected to dominate the early days of the 2016 session.
