Newsletter 2016-21 May 27, 2016 LEGISLATIVE SESSION CONTINUES AS LAWMAKERS DEBATE FUNDING MEASURES Legislators have recessed until next week after numerous attempts have failed to fill a $270 million gap in next fiscal year’s budget. Governor Earl Ray Tomblin called legislators into a special session Monday, May 16, to propose a three-pronged approach to fill the budget gap: Tax increases, spending cuts and one-time monies through expiration of special accounts or contributions from the Rainy Day Fund. The Senate passed along party lines the governor’s bill to increase the tobacco tax 45 cents a pack by a 17-16 vote. The House defeated the bill by a vote of 44-55 after a number of delegates who have signed a no tax pledge would not go along with the House leadership’s decision to support the tobacco tax increase. House and Senate Finance Committees went back to the drawing board to look at a number of options to increase revenue and reduce spending in lieu tax increases, including a number of construction-related spending accounts. Legislators have requested more money coming from the Rainy Day Fund - - $143 million in House and around $190 million in Senate -- a move the governor has not supported. The House today approved by a vote of 61-37-2 its budget which includes a number of reductions and sweeps funding from other accounts. The House Finance Committee version takes $1.2 million from the Contractors Licensing Board to help balance the budget. The board, which gets its funds from the annual license fee each contractor pays, has about $2 million in its account that is used to fund operation and enforcement of the state’s contractors licensing requirements. John Junkins, acting commissioner for the WV Division of Labor, spoke before the House Finance Committee and apparently agreed to divert licensing board fees. Two bills to divert construction funds were introduced and are currently on hold: $4 million from the School Building Authority and $10 million from the West Virginia Infrastructure Fund. It is hoped these bills are dead for the rest of the session. The House bill recommends eliminating within the WV Department of Transportation the Aeronautics Commission, Public Port Authority, Public Transit and State Rail Authority. Those agencies, which each have their respective staff, would be consolidated to into one. The bill also ends transfers to the Licensed Racetrack Modernization with the money going to the general fund. There was a bill, that did not pass, to redirect certain racing and gaming revenues from the Greyhound Development and Racing Fund to the State Road Fund. The Senate recessed today without taking up their version of the budget. They are expected to debate the House version Tuesday. The governor will have to decide whether to accept the budget as presented, veto the bill, or perform line item vetoes on certain aspects of the bill. If the governor vetoes the bill, the legislature must develop a budget bill by July 1 before a government shutdown will occur. ESOPs offer many advantages, tax and otherwise, to the selling shareholder, the sponsoring company, the employees and the community, including immediate liquidity (whole or part), no third party interests, significant corporate tax deductions, tax exemptions and capital gains tax deferrals/elimination. This presentation also discusses corporate governance, structuring alternatives, financing and related tax planning related to ESOPs. The presenter, Daniel Zugell, senior vice president, Business Transition Advisors (BTA), will inform members on how an ESOP may be the perfect succession plan for their business. HOUSE HOLDS HEARING ON OSHA’S NEW RECORDKEEPING RULE This week, AGC delivered a letter to the House Education and the Workforce Committee for a hearing that examined the Occupational Safety & Health Administration’s (OSHA) rule on Improved Tracking of Workplace Injuries and Illnesses. AGC is concerned the rule will significantly limit how employers are able to enforce policies that have been established to ensure timely reporting of incidents, as well as implement and enforce other safety and health policies. The rule could discourage employers from administering post-accident drug testing, and the rule would also place employer safety incentive programs in jeopardy. The committee hearing highlighted many of AGC’s concerns, and AGC is evaluating options for employers to comply with the rule as it’s fully implemented over the next several years. OVERTIME RULE DOUBLES SALARY THRESHOLD; INCREASES BURDEN ON CONTRACTORS On May 18, the U.S. Department of Labor released its final rule implementing changes to the Fair Labor Standards Act (FLSA) overtime regulations. The most significant change is a doubling of the standard salary threshold for exempt employees – from $455 per week ($23,660 per year) to $913 per week ($47,476 per year). The rule takes effect on Dec. 1, 2016. In 2015, AGC sent both individual comments and signed onto coalition comments on the proposed rule. These comments raised strong concerns that the proposed salary threshold of $970 per week ($50,440 per year) would be too large an increase for employers to absorb all at once. While not all of AGC’s and the coalition’s recommendations were accepted, the final rule does establish a lower salary threshold than originally proposed. The final rule’s concession for bonuses and commissions and its abstinence from changing the duties test are also consistent with AGC’s recommendations. Other key aspects of the rule include:

Employers will be able to use nondiscretionary bonuses and incentive payments, including commissions, to satisfy up to 10 percent of the standard salary level, provided payments are made on at least a quarterly basis.

The salary threshold for highly-compensated individuals will increase from $100,000 to $134,004. Bonus and incentive payments still may not count toward this threshold.

The salary thresholds (for both the standard and highly-compensated employee exemptions) will automatically increase every three years.

No changes were made to the highly-debated duties test. CAWV and AGC will continue to monitor any developments in Congress or the courts that stop or limit the rule, and will notify members accordingly. Meanwhile, members should begin carefully reviewing compensation practices to determine whether any employees currently classified as exempt are paid a salary of at least $455 per week but less than $913 per week, as such employees will no longer qualify for exemption. Under the new rule, employers must either (1) track such employees’ work hours and pay them overtime in accordance with FLSA mandates, or (2) increase their pay to meet the new salary threshold. WEST VIRGINIA PURCHASING DIVISION UPDATES TO AIA DOCUMENTS DUE TO PREVAILING WAGE REPEAL The West Virginia Purchasing Division recently asked the CAWV for comments on proposed changes to the AIA Supplemental Specifications that remove the prevailing wage requirements on state funded projects. The CAWV Joint Architects Committee members were sent copies of the proposed changes. The comments and questions that were submitted to purchasing, along with the answers sent back to the CAWV, are attached to this week’s Building Bulletin. AGC GETS LEGISLATION INTRODUCED TO SUPPORT PUBLIC BUILDINGS INFRASTRUCTURE AGC prevailed this week in securing the introduction of the Public Buildings Renewal Act of 2016. The legislation seeks to create a new class of projects eligible for financing through private activity bonds (PABs) including public buildings such as schools, post offices, libraries, and courthouses. In short, the bill would create $5 billion in Private Activity Bonds (PABs) for public buildings for states to access through the Treasury Department. Members can visit AGC’s Action Center by clicking here and urge your members of Congress to support this bill. AGC WEBINAR: WHAT’S DIFFERENT WITH LEED V4.0 THAT CONTRACTORS SHOULD KNOW? – JUNE 27, 2016 Members are invited to participate in the AGC webinar “What’s Different with LEED v4.0 that Contractors Should Know?,” which will be on June 27, 2016 from 2:00 pm to 3:00 pm. The cost is $79 for AGC members and $99 for non-members. In this webinar, overview of changes between LEED v 2009 and LEED v4.0 will be discussed, including new categories, prerequisites and credits as well as name changes to existing credits and revisions to credit requirements. Cost and benefit of these changes will also be discussed with examples. Integrative Process, Location and Transportation, Sustainable Sites, Water Efficiency, Materials and Resources, Energy Efficiency and Indoor Environmental Quality categories will be addressed. May 27, 2016 HURRY UP CAN HURT

Sports cars competing over race courses marked with racing stripes. People who race on the job are marked with cuts, bruises, and bandages. There are places to race and places not to race. Speed belongs on the race course, not in the workplace. Almost everyone has been guilty of speeding through a job. We forget, until it's too late, that "hurry up can hurt." In just about every instance, hurrying on the job does not do much to increase productivity. Usually it is simply an easy way to get a job done, get a tough job out of the way, or try to get off the job as soon as possible. When we hurry on the job, we accomplish little more than to increase our chances of an unsafe act happening. Let's look at some hurry up acts. Which ones have you caught yourself doing?

Didn't wear safety glasses because the job would only take a few minutes. Used the wrong ladder because the proper one was too far away. Didn't use proper lockout procedures because you could fix it yourself and wouldn't have

to bother anyone else. Took a short cut between machinery or stockpiles of materials. Used a wrench instead of a hammer because your hammer was in your toolbox on the

other side of the room. Climbed a ladder with tools stuck in your pocket, or in your hand, because you didn't

have a tool belt. Cut the grounding prong off a three-way ground wire plug because you didn't have an

adapter. Removed a guard to repair your machine, or for a special run, but haven't got around to

putting it back yet. Reached "just-a-little-bit-further" on the ladder so you didn't have to get down and move

it. Didn't unplug a power tool before making adjustments because you would only have to

plug it in again. Used a dull saw blade for just one more cut. Gave the fork lift truck just a little more "pedal" so you could get one more load in before

lunch. Didn't completely brace the scaffold because one of the braces was missing. Laid a board down, full of nails, with the intention of bending the nails over "in a minute". Climbed up the side of a bin instead of getting a ladder. Didn't slow down this time at a blind corner because you never saw anyone there before.

The list is endless. Do they sound familiar? Too familiar? Sometimes when you hurry, nothing bad happens. Other times there may be "near misses", but eventually a serious injury will occur. It is only a matter of time. Is it really worth your eyesight, your limbs or even your life to save those few minutes? When hurrying on the job, you don't end up speeding up the work, you just speed up your chances of an accident. Hurry up can hurt. HOUSE PANEL APPROVES TRANSPORTATION FUNDING BILL The U.S. House Appropriations Committee this week unanimously passed legislation that would increase highway investment by $900 million in FY 2017 and boost transit spending by $670 million. The FY 2017 transportation appropriations bill not only adheres to the highway investment level called for in the 2015 FAST Act surface transportation program reauthorization, but would provide $160 million more for transit capital spending than the FAST Act authorizes. The House proposal would also continue Airport Improvement Program (AIP) investment at the $3.35 billion level that has been in place since FY 2012 and provide $450 million for the Obama Administration’s TIGER Grant Program that supports a variety of multi-modal transportation projects. The measure has not yet been scheduled for consideration by the full House of Representatives. The Senate overwhelmingly passed its version of next year’s funding bill for the U.S. Department of Transportation May 19. The specific transportation investment levels proposed by each chamber are listed below:

Like its Senate counterpart, the House bill also includes common sense limitations—sought for the second consecutive year by ARTBA and AGC of America— on an Obama Administration push to allow state and local governments to impose geographic, economic and other hiring preferences on federal-aid highway and public transportation projects. The measure would allow the U.S. Department of Transportation to approve such hiring preferences only if the recipient agency certifies: the existence of a sufficient qualified labor pool in the jurisdiction; that no existing workers would be displaced; and no planned projects would be delayed due to associated cost increases. West Virginia’s congressional delegation supported the industry’s position on the jobs issue. STATE HIGHWAY FUNDING PROBLEM STILL UNRESOLVED: MEDIA THIS WEEK While state lawmakers continue to meet to approve a budget for the upcoming fiscal year, state funding for the transportation system remains unresolved and unaddressed. Contractors and residents continue to express concern on this issue which has resulted in higher auto maintenance costs, a ranking of second highest highway fatality rate in the nation, loss of revenue and employee layoffs. The work includes lock, dam, port, levee and inland waterway projects. House action comes less than a month after the Senate Environment and Public Works Committee passed similar water legislation April 28. While many provisions in the two bills are similar in nature, the Senate measure also included funding to assist cities like Flint, Michigan that have been affected by underground clean and drinking water system failures. Democrats on the T&I Committee vowed to raise the issue again when the bill reaches the House floor after offering and then withdrawing amendments as part of the committee action on the legislation. While next steps in both the House and Senate are unclear as the election year calendar gets shorter and shorter, a water infrastructure bill is considered one of the few, bipartisan pieces of legislation that could get done before voters head to the ballot box in November.
