Page 1 of 3 The council Business meeting of the Borough Council of the Borough of Caldwell was called to order in the Council Chambers at 7:02PM. PRESENT: Mayor Dassing, Councilman Hauser, Durkin Capozzoli, Brown and Cascarano ALSO PRESENT: Borough Administrator, Paul Carelli and Borough Attorney, Greg Mascera ABSENT: Council President O’Donnell and Deputy Clerk, Lisa O’Neill Adequate notice of this Council Business/Conference meeting was given on January 1, 2015. Notice was posted on the bulletin board on the first floor of the Borough Hall, One Provost Square, Caldwell, New Jersey. Official newspapers of the Borough were notified of this meeting by mail. Notice was posted and all persons requesting notice were sent same. PLEDGE OF ALLIGENCE APPROVAL OF MINUTES: October 20, 2015 Moved by Councilman Cascarano, seconded by Councilman Hauser. Consent Agenda Moved by Councilman Brown, seconded by Councilman Capozzoli. Discussions Ensued. On roll call, all present voted in the affirmative. Resolutions approved 11/05/15. COUNCIL COMMITTEE REPORTS: Councilman Brown thanked all the volunteers on behalf of the Environmental Commission that came out on October 24th for Paver Day at the Personette Street Park Property. The Commission members, thirty-one Home Depot volunteers from the Montville, Clifton, Secaucus, East Hanover, Parsippany, Roxbury and North Bergen stores laid down perennial pavers at the proposed site Personette Street Garden. The project was a team Home Depot event and in addition the Borough received a $1500.00 from the Home Depot foundation for this project and we greatly appreciate the Home Depot support on this. In addition we had the Environment friendly Caldwell University representative, the Caldwell Council, the Mayor, many local citizens that participated and we thank all the volunteers that day. Councilman Brown thanked Mr. Haas who oversaw the project and assisted and planted some native trees on the property. On November 14th there will be more planting and the time will be announced. Councilman Hauser reported that on Monday he attended a Senior Transportation meeting and they discussed the bid specs for the bus. Councilman Hauser asked Paul if Maria had reached out to him and Paul responded that he is in the process of writing them and will have them out next week. There is a good chance that they could have the bus in December. They also discussed having a ribbon cutting but doing it in the spring when the weather is warmer. On the Recreation Committee he received feedback from the West Caldwell Governing Body and they discussed what we had discussed in private session and the feedback was positive and he would like to talk about this in Executive Session.

REPORT OF MAYOR: Mayor Dassing congratulated Lincoln School who celebrated their 100th Anniversary on October 23rd. This was a great program and the children sang songs of every decade. The Mayor thanked Councilman Hauser for joining her and they presented them with a proclamation. The Mayor thanked Home Depot for all their help that they gave us on the Personette Street Garden. REPORT OF BOROUGH ADMINISTRATOR: Paul Carelli reported on the following:

• He will be redistributing the Road Ordinance to Council. • The sewer clarifier was awarded tonight. • Paul had discussions with Greg Seaman and Tom Paterson from Hatch Mott they will be providing a

proposal for upgrading the sand filters. • Bids were open today for Brookside and there were seven bidders for this project. The lowest bidder

was Reviax Construction at $226,000. We received a grant for $230,000. • Academy and Elizabeth are under construction. • Hatfield and Erwin will start on Monday to finish up. • Tilcon will be going over the milling and paving tomorrow with Mario and Glenn.

• The Borough received a letter that Bloomfield is terminating our contract with Animal Control services and currently he is looking for a new provider.

• Judge O’Conner called to remind us that the assignment judge will be there on Monday at 3PM and he is hoping for a good turnout.

• A reminder from our Tax Collector advising everyone that the Borough has an accelerated tax sale and urging everyone to pay their bills by November 10th.

REPORT OF COUNTY LIAISON: Patricia Keenan reported there are two upcoming events for the Environmental Center on November 21st there will be an event for Thanksgiving center piece in which adults and children can make a center piece. On November 27th at 12:00 there will be a fall harvest camp fire where families can go and roast marshmallows and eat popcorn and have cider. Councilman Hauser announced that there is a Thanksgiving Dinner on November 19th at the Grover Cleveland Senior Center that is open to Caldwell, West Caldwell and Roseland and she will need a head count so you can contact Maria Burak. REPORT OF BOROUGH ATTORNEY: Greg Mascera reported that he spoke to Counsel in Bloomfield in reference to the animal control and Bloomfield tried to keep their contract with Caldwell but Bloomfield will now be with Clifton and Clifton turned down Caldwell because geographically it is too far. OPEN PUBLIC MEETING: Moved by Councilman Capozzoli seconded by Councilman Cascarano to open meeting to the Public. Anthony Castillano, 311-313 Bloomfield Avenue he has concerns about the special fee that the property owners will be accessed with this fee and they have not heard anything about this. Mayor Dassing responded that there were letters that went out a year ago asking for volunteers and we have had a feasibility study committee for over a year and they have met twice a month and you could have easily been a part of it. On a motion made by Councilman Cascarano and seconded by Councilman Hauser unanimously affirmed, the Council moved into Executive Session at 7:59P.M. Mayor Dassing read the following statement: BE IT HEREBY RESOLVED in accordance with the provisions of N.J.S.A. 10:12 and 13, the public shall be excluded from the Executive Session of the Governing Body which is being held for the discussion of the following subject matters: 1. Pending or anticipated litigation or contract negotiation; 2. Personnel matters; 3. This Executive Session shall continue for an indefinite period of time and upon termination of the Executive Session, the Governing Body may choose to resume the public portion of the meeting. The discussion, which shall be conducted in closed session, shall be disclosed upon termination of litigation or contractual matter, upon resolution of the personnel matter with consent of said person or persons and as provided by N.J.S.A. 4-12 but in no case later than two (2) years from this date. These minutes shall be available as soon as the matter is resolved or not later than two years hence. The Executive Session will be discussion of Recreation contract. The Executive Session was adjourned and upon a motion by Councilman Brown seconded by Councilman Cascarano, the Council Business Conference Meeting was opened to the public and the press at 8:15P.M. There being no additional business to be conducted a motion to adjourn the meeting was made by Councilman Capozzoli, seconded by Councilman Hauser unanimously affirmed by all members present, the meeting was adjourned at 8:15P.M. . Section130–1Purposes

Thepurposeofthisarticleistoprovideamethodbywhichtolocateandidentifyhistoricdistricts,historicalstructuresandlandmarkswithintheBoroughofCaldwellandtoregulatetherepair,alteration,replacement,removal anddemolitionofhistorical structuresand tootherwiseprevent theabuse, loss, removal anddestructionofhistoricalstructuresandlandmarkswithinthecommunitybyreasonofneglect,improperrepairandalterationanddevelopment;totherebypreservethehistorical,cultural,architecturalandsocialheritageofthecommunity;andtotherebyfostercivicprideandtheeconomic,socialandeducationalwell‐beingofthecommunity.

Section130‐2Interpretations

A.ItistheintentionoftheCaldwellgoverningbodytomaintainanagencytoassistintheidentificationofhistoricdistricts,historicalstructuresandlandmarkswithinthemunicipalityandtocreateasystembywhichtoadministerregulationsdesignedtopreserveandregulatesuchhistoricdistricts,historicalstructuresorlandmarksbaseduponarationalplanandobjectivewhichwillcomplementexistinglanduselegislation.

B.Nothinghereincontainedshallsupersedethepowersofotherlocallegislativeorregulatorybodiesorrelieveanypropertyownerofcomplyingwiththerequirementsofanyotherstatestatuteormunicipalordinanceorregulation.

C.Intheeventofanyinconsistency,ambiguityoroverlappingofrequirementsbetweenthisarticleandanyotherrequirementenforcedbythemunicipality,themorerestrictiveordinanceorrequirementshallapply,totheextentthatstateorfederallegislationpermits.

D.Thisarticleshouldnotbeviewedasrequiringorprohibitingtheuseofanyparticulararchitecturalstyle.Instead,theintentionofthisarticleistopreservethepastbymakingthepastcompatiblewiththepresent.

Section130‐3Definitions

Asusedinthisarticle,thefollowingtermsshallhavethemeaningsindicated:

ADDITIONThe construction of a new improvement as part of an existing improvement when suchimprovementchangestheexteriorappearanceofanylandmark.

ALTERATIONAnyworkdoneonanyimprovementwhichisnotanadditiontotheimprovementandwhichchangestheappearanceoftheexteriorsurfaceofanyimprovement.

DEMOLITIONTherazingofanyimprovementortheobliterationofanynaturalfeatureofalandmark.

LANDMARKAny historic structure or sitewhich has been designated by ordinance pursuant toN.J.S.A.40:55D‐65.1orwhichhasbeenidentifiedinanycomponentoftheMasterPlan.Asusedinthischapter,"landmark"maybesubstitutedfor"historic,""historicpreservation"and"historicsite."

MAJORAPPLICATIONAnyapplicationforapermitrequiredbythisarticlewhichinvolvesdemolitionorremovalofalandmark,additiontoalandmark,ormodificationtoalandmarkwhichwillsubstantiallyaffectthecharacteristicsofthelandmark.

A.ThegoverningbodyshallmakeprovisioninitsbudgetandappropriatefundsfortheHistoricPreservationCommission.B.TheHistoricPreservationCommissionmayemploy,contractforandfixthecompensationofexpertsandotherstaffandservicesasitshalldeemnecessary.TheCommissionshallobtainitslegalcounselfromtheMunicipalAttorneyattherateofcompensationdeterminedbythegoverningbody,unlessthegoverningbody, by appropriation, provides for separate legal counsel for the Commission. Expenditures by theCommissionshallnotexceed,exclusiveofgiftsorgrants,theamountappropriatedbythegoverningbodyfortheCommission'suse.S130‐6RegulationofHistoricStructuresandLandmarks;PermitsA.ThePlanningBoardandBoardofAdjustmentshallrefertotheHistoricPreservationCommissioneveryapplicationfordevelopmentsubmittedtoeitherBoardfordevelopmentofanypropertywithinanhistoricdistrict,alandmarkdesignatedontheZoningMaportheofficialmaporidentifiedinanycomponentoftheMasterPlan,inaccordancewithN.J.S.A.40:55D‐110.B.InadditiontosuchotherpermitsthatmightberequiredbyotherapplicableordinancesoftheBorough,apermitshallberequiredbeforeanyofthefollowingactivitiesarecommencedonanypropertywithinanhistoricdistrictoranypropertythathasbeendesignatedbyordinanceasahistoricsiteorhavinguponitanhistoricstructure:(1)Demolitionofanybuildingorstructurewithinanhistoricdistrictordemolitionofanhistoricstructureorlandmark.(2)Relocationofanyhistoricstructureorlandmark.(3)Changeintheexteriorappearanceofanybuildingwithinanhistoricdistrict,orofanyexistinghistoricstructureorlandmark.(4)Changesinoradditionofnewsignsorexteriorlighting,exceptthatnopermitshallberequiredforoneunlighted sign per premises if the surface area of such sign does not exceed one square foot for anidentificationsignor foursquarefeet foracommercialsign,providedthatsuchsign isattachedtoandparalleltothefacadeofthebuildingorstructure.(5)Anynewconstructionofaprincipaloraccessorystructure.C.Exceptions.(1) Apermitshallnotberequired if theproposedchangetothehistoricalstructureor landmarkwasapproved by the Planning Board or the Board of Adjustment in connection with an application fordevelopment,pursuanttoN.J.S.A.40:55D‐1etseq.andThePlanningBoardorBoardofAdjustment,asthecasemaybe,hadreferredtheapplicationfordevelopmentpursuanttopartAofthissection130‐7.(2)Apermitshallnotberequiredforanyrepaintingofthesamecolor,repairorexactreplacementofanyexistingimprovement.Intheeventthatthecolororexteriorsurfacematerialoftheimprovementshallbechangedasaresultofsuchrepainting,repairorexactreplacement,apermitshallnotberequiredifthenewcolororexteriorsurfaceisonethathasbeenpreviouslyapprovedbyregulationdulypromulgatedbytheCommissionforsimilarimprovements.D.ApplicationforapermitpursuanttothisarticleshallbefiledwiththeBoroughConstructionCodeOfficialonaformtobesuppliedbytheBorough.Atthetimeoffiling,theapplicantshallpayanapplicationfeeintheamountsetforthinChapterA270,Fees,oftheCaldwellCode.E. TheConstructionCodeOfficialshallreviewtheapplicationwiththeadministrativeofficerandshallclassifytheapplicationasaminorapplicationoramajorapplicationasdefinedinthisarticle.

F.Minorapplications.(1)IfthepermitapplicationhasbeenclassifiedbytheadministrativeofficerandtheConstructionCodeOfficialasaminorapplication,theConstructionCodeOfficialshallrefersuchapplicationtotheCommissionfor its report and its recommendation. In such instance, in accordance with NJSA 40:55D‐111, theCommissionchairpersonmayactintheplaceofthefullcommission.(2) The Commission shall report to the Construction CodeOfficialwithin 45days from the date suchapplicationwasreferredtotheCommission.Ifwithintheforty‐five‐dayperiodtheCommissionrecommendstotheConstructionCodeOfficialagainsttheissuanceofapermitorrecommendsconditionstothepermittobeissued,theConstructionCodeOfficialshalldenyissuanceofthepermitorincludetheconditionsinthepermit,asthecasemaybe.Failuretoreportwithintheforty‐five‐dayperiodshallbedeemedtoconstituteareportinfavorofissuanceofthepermitandwithouttherecommendationofconditionstothepermit.IftheCommissionrecommendsissuanceofthepermit,thentheConstructionCodeOfficialshallthereuponissuethepermit,andsuchpermitshallcontainsuchconditionsastheCommissionshallrecommend.G.Majorapplications.(1)Ifthepermitapplicationhasbeenclassifiedasamajorapplication,theConstructionCodeOfficialshallrefersuchapplicationtotheCommissionforitsreportanditsrecommendation.ThereferralshallstatethattheapplicationhasbeenclassifiedasamajorapplicationandthattheCommissionshallsubmititsreportdirectlytothePlanningBoard.(2) ThePlanningBoardshallhave theauthority to reviewmajorapplications forpermits, to considerrecommendations of the Historic Preservation Commission and to make recommendations to theConstructionCodeOfficialwithregardtosuchapplications.(3)ThePlanningBoardshallreporttotheConstructionCodeOfficialwithin45daysfromthedatetheapplication was referred to the Commission. If within the forty‐five‐day period the Planning BoardrecommendstotheConstructionCodeOfficialagainsttheissuanceofapermitorrecommendsconditionstothepermit tobe issued, theConstructionCodeOfficialshalldeny issuanceof thepermitor includetheconditions in thepermit,as thecasemaybe.Failuretoreportwithinthe forty‐five‐dayperiodshallbedeemed to constitute a report in favor of issuance of the permit andwithout the recommendation ofconditionstothepermit.IfthePlanningBoardrecommendsissuanceofthepermit,thentheConstructionCodeOfficialshallthereuponissuethepermit,andsuchpermitshallcontainsuchconditionsasthePlanningBoardshallrecommend.(4)TheapplicantshallbegivennoticeofallhearingsontheapplicationandshallhavetheopportunitytobeheardbythePlanningBoardontheapplication.

S130‐7StandardsForConsideration.

ThefollowingstandardsshallbeconsideredbytheHistoricPreservationCommissioninconnectionwithreferralspursuanttoN.J.S.A.40:55D‐110;andbytheHistoricPreservationCommissionandPlanningBoardinconnectionwithpermitsrequiredbythischapter;andbythePlanningBoardandBoardofAdjustmentinconnectionwithdevelopmentapplicationspursuant toN.J.S.A.40:55D‐1et seq.when thedevelopmentapplicationinvolvesapropertywhichhasbeendesignatedbyordinanceasahistoriclandmarkorhistoricstructure.

A.Demolitions. With regard to anapplication todemolisha structurewithinanhistoricdistrict, or todemolishanyhistoricstructureorlandmark,thefollowingmattersshallbeconsidered:(1)Itshistoric,architecturalandaestheticsignificance.(2)Itsuse.(3)Itsimportancetothemunicipalityandtheextentofitsvaluetoanhistoricdistrictandtheextenttowhichitshistoricorarchitecturalvalueissuchthatitsremovalwouldbedetrimentaltothepublicinterest.

(4)Theextenttowhichitisofold,unusualoruncommondesign,craftsmanship,textureormaterialthatitcouldnotbereproducedorcouldbereproducedonlywithgreatdifficulty.(5)Theextenttowhichitspreservationwouldpromotethegeneralwelfarebymaintainingandincreasingrealestatevalues;generatingbusiness;creatingnewjobs;attractingtourists,students,writers,historians,artists,artisansandnewresidents;encouragingstudyandinterestinAmericanhistory;stimulatinginterestandstudyinarchitectureanddesign;educatingcitizensinAmericancultureandheritage;ormakingthemunicipalityamoreattractiveanddesirableplaceinwhichtolive.B.Removalsoutofthemunicipality.Withregardtoanapplicationtomoveanhistoricstructureorlandmarktoalocationoutsideofthemunicipality,thefollowingmattersshallbeconsidered:(1)Thehistoriclosstothesiteoforiginallocation.(2)Thecompellingreasonsfornotretainingthelandmarkorstructureatitspresentsite.(3) The proximity of the proposed new location to themunicipality, including the accessibility to theresidentsofthemunicipalityandothercitizens.(4)Theprobabilityofsignificantdamagetothelandmarkorstructureitself.(5)TheapplicablematterslistedinSubsectionAabove.C.Removalswithinthemunicipality.Withregardtoanapplicationtomoveanhistoriclandmarkorhistoricstructuretoanewlocationwithinthemunicipality,theCommissionshallconsiderthecompatibility,natureandcharacteroftheproposedsurroundingareaintowhichthelandmarkorstructurewillbemovedastheyrelatetotheintentandpurposesofthisarticle.D.Considerationonotheractions.Withregardtoanapplicationforotherapprovalofanyproposedactionassetforthinthisarticle,thefollowingmattersshallbeconsidered:(1)Theimpactoftheproposedchangetothehistoricdistrictandonthehistoricarchitecturalcharacterofthelandmarkorstructure.(2)Thehistoricorarchitecturalimportancetothemunicipalityandtheextenttowhichsuchinterestwouldbeaffectedbytheaction.(3)Theextenttowhichtherewouldbeinvolvementoftexturesandmaterialthatcouldnotbereproducedorcouldonlybereproducedwithgreatdifficulty.(4)Theuseofthestructure.(5)Theextenttowhichtheproposedactionwouldadverselyaffecttheviewofalandmarkorstructurefromapublicstreet.E.Visualcompatibilityfactors.Inassessingtheeffectofanyproposedchangeunderapplicationforanylandmarkoranystructurewithinanhistoricdistrict,thefollowingvisualcompatibilityfactorsshallbeusedtoanalyzetheeffectthatthechangeappliedforwouldhaveonthelandmarkandonthosestructurestowhichthelandmarkisvisuallyrelated:(1)Height.Theheightoftheproposedbuildingshallbevisuallycompatiblewithadjacentbuildings.(2)Proportionofthebuilding'sfrontfacade.Therelationshipofthewidthofthebuildingtotheheightofthefrontelevationshallbevisuallycompatiblewithbuildingsandplacestowhichitisvisuallyrelated.

(3)Proportionofopeningswithinthefacility.Therelationshipofthewidthofwindowstotheheightofwindowsinabuildingshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(4)Rhythmofsolidstovoidsonfacadesfrontingonpublicplaces.Therelationshipofsolidstovoidsinsuchfacadesofabuildingshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(5)Rhythmofspacingofbuildingsonstreets.Therelationshipofthebuildingtotheopenspacebetweenitandadjoiningbuildingsshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(6)Rhythmofentranceand/orporchprojections.Therelationshipofentranceandporchprojectionstothestreetshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(7)Relationshipofmaterials,textureandcolor.Therelationshipofmaterials,textureandcolorofthefacadeandroofofabuildingshallbevisuallycompatiblewiththepredominantmaterialsusedinthebuildingstowhichitisvisuallyrelated.(8)Roofshapes.Theroofshapeofabuildingshallbevisuallycompatiblewithbuildingstowhichitisvisuallyrelated.(9)Wallofcontinuity.Appurtenancesofbuildings,suchaswalls,open‐typefencingandevergreenlandscapemasses,shallformcohesivewallsofenclosurealongastreet,totheextentnecessarytomaintainvisualcompatibilityofthebuildingwiththebuildingsandplacestowhichitisvisuallyrelated.(10)Scaleofbuilding.Thesizeofabuilding,themassofabuildinginrelationtoopenspaces,thewindows,dooropenings,porchesandbalconiesshallbevisuallycompatiblewiththebuildingsandplacestowhichitisvisuallyrelated.(11)Directionalexpressionoffrontelevation.Abuildingshallbevisuallycompatiblewithbuildingsandplacestowhichitisvisuallyrelatedinitsdirectionalcharacter,whetherthisbeverticalcharacter,horizontalcharacterornon‐directionalcharacter.S130–8IdentificationandDesignationofHistoricDistricts,HistoricStructuresandLandmarks;procedureA.TheHistoricPreservationCommissionshallperformacomprehensivesurveyoftheBoroughofCaldwelltoidentifypotentialhistoricdistricts,historiclandmarksandhistoricstructuresthatareworthyofprotectionandpreservation.B.Inevaluatingandidentifyinghistoricstructuresandlandmarks,theHistoricPreservationCommissionshall be generally guidedby theNationalRegister criteria.TheHistoricPreservationCommissionmayidentifyandrecommendfordesignationanyrealpropertyorimprovement,suchasabuilding,structure,ruins,foundation,route,trail,placeorobject,includingbutnotlimitedtoacave,cemetery,burialground,camp or village area or a natural object or configuration, geological formation or feature, which is ofparticular,historic,cultural,scenicorarchitecturalsignificancetothemunicipalityandinwhichthebroadcultural,political,economicorsocialhistoryofthenation,state,ormunicipalityisreflectedorexemplified;orisidentifiedwithhistoricalpersonagesorwithimportanteventswithinthemaincurrentofnational,stateorlocalhistory;orshowsevidenceofhabitation,activity,orthecultureofprehistoricman;orembodiesadistinguishingcharacteristicoranarchitecturaltypevaluedasrepresentativeofaperiodorastyleormethodof construction; or presents a work of a builder, designer, artist or architect whose individual stylesignificantly influenced the architectural history of the municipality; or is imbued with traditional orlegendarylore.C.TheHistoricPreservationCommissionmayinitiatetheidentificationofapotentialhistoricdistrict,historicstructureorhistoriclandmark.Otherswishingtonominateadistrict,structureorlandmarkforidentificationmaycontacttheHistoricPreservationCommissionregardingconsiderationoftheproposedhistoricdistrict,

landmarkorstructure.TheHistoricPreservationCommissionshallhavethepowertoestablishandpublishformalnominationprocedures.D.TheHistoricPreservationCommissionshallscheduleapublichearingtoconsidertheidentificationofanypotentialhistoricdistrict,landmark,historicstructureorhistoricsite.Suchhearingshallbeonatleast10days'writtennotice,bycertifiedmail,returnreceiptrequested,totheownerofpropertywhichisbeingconsidered for identification. At the hearing, the Historic Preservation Commission shall consider thecommentsandquestionsoftheownerofsuchpropertyorpropertiesandofanyinterestedpartiesandcommentsofthepublic,alongwithotherrelevanttestimony,exhibits,orotherphysicalevidencewhichaddressestheworthinessofsuchpropertyforidentificationassetforthherein.E.Duringthecourseofthepublichearingorhearingsontheidentificationofapotentialhistoricdistrict,landmark,historicstructureorhistoricsite,theHistoricPreservationCommissionshallmakewrittenrequestoftheownersofallpropertieswithinaproposedhistoricdistrictandoftheownerofanysuchotherpropertybeingconsideredfor identificationasa landmark,historicstructureorhistoricsiteforsuchowner’sorowners’writtenconsenttothecreationbyordinanceofanhistoricdistrictorthedesignationofanypropertybyordinanceasalandmark,historicstructureorhistoricsite.F. At the conclusion of the public hearing on the identification of a potential landmark, the HistoricPreservationCommissionshallmakeitsrecommendationintheformofawrittenreporttobeadoptedbyresolutionoftheCommission.G.IftheHistoricPreservationCommissionshalldeterminethatanhistoricdistrictshouldbecreatedorthatapropertyisworthyoflandmarkidentification,thentheHistoricPreservationCommissionshallforwarditsrecommendationtotheBoroughPlanningBoard.H.Iftheownerofapropertywithinaproposedhistoricdistrictorapropertywhichhasbeenidentifiedasapotential landmark or historic structure or historic site by the Historic Preservation Commission hasconsentedinwritingtothecreationofsuchhistoricdistrictorthedesignationofsuchhistoricpropertyasalandmark,thentheHistoricPreservationCommissionshallforwarditsrecommendationandthewrittenconsentoftheownerofsuchpropertytotheBoroughMayorandCouncil.UponreceiptofconsentandtherecommendationoftheHistoricPreservationCommissiontocreateanhistoricdistrictortodesignateanyproperty as a landmark, historic structure or historic site, theMayor and Council may consider suchdesignationbyordinancepursuanttoN.J.S.A.40:55D‐65.1.I.Thepropertiesanddistrictssetforthattheconclusionofthischapter,asamendedfromtimetotimeare,orwillbe,designatedas"Historic"andshallbeportrayedassuchontheBoroughZoningMap.Inaddition,theBoroughTaxAssessor,TaxCollectorandConstructionCodeOfficialshallidentifyallsuchpropertiesanddistrictsas"Historic“Historic”,“HistoricLandmark"or“HistoricStructure”onpublicrecordsmaintainedforsuchproperties.J.RegulationofanypropertiessetforthattheconclusionofthischapterinaccordancewiththischaptershallbeinadditiontosuchdesignationandregulationastheBoroughZoningOrdinance(Chapter250oftheCaldwellCode)mayotherwiserequire.S130–9NoticeofViolations;ViolationandPenalties.A.Ifanypersonshallperformorundertakeanyactivityuponanystructurewithinanhistoricdistrict,anylandmarkpropertyorhistoricstructurewhichrequiresapermitandsuchpersonhasnotfirstobtainedapermit,thensuchpersonshallbedeemedtobeinviolationofthisarticle.B.Uponlearningoftheviolation,theConstructionCodeOfficialshallpersonallyserveupontheownerofthelotwhereintheviolationisoccurringanoticedescribingtheviolationindetailandgivingtheowner10dayswithinwhichtoabatetheviolationbyrestoringthelandmarkorimprovementtoitsstatusquoante.Iftheownercannotbeservedpersonallywithinthemunicipalitywithsaidnotice,acopyshallbepostedonthe
