TERMS & CONDITIONS The firms/companies (hereinafter called the “Service Provider”) hereby invited to submit their tender for

Hiring of vehicles, Machinery and Man Power for solid waste and waste water management

within the Jurisdiction of WSSC, Kohat, on rent/hiring of Man power (hereinafter called the

“Services”) subject to following terms and conditions: -

1. The service provider should quote rates of each vehicle per trip as mentioned below with

Driver and Man power on the attached form. Please quote rates inclusive of Driver, Man

power Wage/food, night charges, cleaning Tools and all applicable taxes and submit the

sealed tender at the place mentioned in the tender notice by 29th June, 2021, 02:00 PM

through registered courier services only and will be opened on the same day at

02:30 PM, in the presence of representatives of the firms/companies. In case if the bid

could not open on the same date and time, the tender will be opened on next working day at

same time and place as mentioned in NIT.

2. The service provider should be a registered operator with taxation authorities. The bidder

should have sufficient fleet to meet the demand of cleaning activities of dumps and drains

within Union Council of Water and Sanitation Services Company, Kohat. The vehicles

offered on rent should be in excellent condition and the Man power should be well trained

for such like cleaning activities. The client will be requiring the vehicles mentioned below,

which may vary according to demand for the initial period of 3 months which can be

extended according to the nature of work.

3. The service provider should quote rates of hiring of each vehicle on monthly rental basis

with fuel along with Man power for clearance of drains. The quoted rate should be inclusive

of Driver, the labor hiring will work for the clearance of the plot, wage/food, night charges

and cleaning tools etc. and all applicable taxes. The loading / unloading will be the

responsibly of the bidders and dumps will be disposed up to the designated dumping yard

identified by WSSC.

4. The Department will deduct all federal and provincial taxes as per prescribed rates and rules

as amended from time to time.

5. The rates should be valid till the contract expiration date. Contract shall be entered with the

bidder on least cost basis and no increase, due to any reason, in the rates shall be acceptable

during the validity of the contract period.

6. The rates should be mentioned in the prescribed form attached herewith. The rates will be

evaluated on lowest basis / model basis. The contract will be awarded to the single lowest

bidder based on overall evaluation / calculation of the rates. Conditional bids shall not be

accepted.

7. In case of repair if the vehicle takes more than 3 hours of work. The service provider shall

provide alternate similar vehicle.

8. The service provider should be registered with the Tax Department and also provide the

documentary proof of Tax Registration with bidding documents. The rates quoted should

include and mention all taxes.

9. Tenders will be received only along with bidding documents duly signed by Chief

Executive/authorized person of the firm.

10. Black listed service providers should not apply

11. The service provider shall be fully responsible for all work and services performed by

its employees, and shall for this purpose employ competent and well-trained

employees to perform the services under the Contract.

12. Competent Authority reserves the right to reject the tenders at any stage with cogent

reason.

13. Services should be according to the client’s requirement. No amendment in tender

form (in specification) will be accepted and such forms shall be rejected.

14. The payment shall be made upon completion of activity and verification of the

concern staff through crossed check. 5% mobilization advance payment on total /

approved bid cost may be made to the bidder, which shall be recovered / adjusted

proportionally through interim payment certificate (IPCS).

15. In case of provision of poor-quality service/not abiding by the instruction of the

client the penalty up to Rs. 5,000/- per day can be imposed to the service provider,

however, the total deducted amount should not exceed 10% of the total contractual

amount.

16. The period of services is for cleaning activities of dumps and drains within the

jurisdiction of WSSC Kohat. The period may vary according to the needs of the

client and the contract may be extended for future period with mutual consent of

both the parties.

17. The service provider shall provide the registered fleet to WSSC Kohat.

18. A rate contract (copy attached) shall be signed by the successful bidder and WSSC

and all terms and conditions would be binding on both parties.

THIS CONTRACT is made and executed on this ____________, 2021 by and between:

Water and Sanitation Services Kohat, a company duly incorporated under the provisions of Companies

Ordinance, 1984 having its registered office at House # 14, Sector 4, Kohat Development Authority, Kohat

through its Chief Executive Officer (CEO) on behalf of its Board of Directors (Hereinafter referred to as

“Client” which expression shall, where the context permits, includes its successors-in-interest and permitted

assigns)

AND

M/S______________________________________________ (Hereinafter referred to as “Firm” which

expression shall, where the context permits, includes its successors-in-interest and permitted assigns)

WHEREAS;

i. The Client advertised a Tender Notice in the national press to hire vehicles/ Machinery on rent as

defined in this Contract (hereinafter called the “Services”);

ii. The Firm, being the lowest bidder, has been selected and is willing to provide the Services on the

terms and conditions set forth in this Contract;

NOW, THEREFORE, the Client, represented by its Chief Executive Officer on behalf of its Board of

Directors and the Firm, represented by its Chief Executive Officer WSSC, Kohat, in order to synergize

their efforts for achieving the intended results, have decided to enter into this Contract today on

_________, 2020 on the terms and conditions agreed below.

1. The Firm shall provide the Rental Services of vehicle / Machinery and man power for Union

Council within the jurisdiction of Kohat Urban, KDA jurisdiction and designated Waste dumping

Sites, travelling on daily per trip. Rental basis as per details provided in the BOQ, as per

requirement of the Client.

2. That the payment to the firm shall be made after completion of the job and verification of Deputy

General Manager Operations & Planning and concern staff through cross check.

3. The Firm shall provide the fuel, oil and Lubricants of the vehicles hired under this Contract.

4. The Service provided under this Contract shall be at the disposal of Client and may be placed in

anywhere in the Jurisdiction WSSC Kohat and in this regard no extra cost will be paid by the

Client.

5. The service provider under this Contract shall provide vehicles which should be in good running

condition. The Daily and monthly Rental shall include fuel, Driver, Man Power, Wages/food,

accommodation, night charges and other cleaning and safety Tools and all applicable government

taxes.

6. The Daily and monthly Rental of Vehicles and Man power provided under this Contract shall

remain the same during the currency of this Contract. The Firm shall not demand for increase in

daily rental charges during the period of this Contract.

7. The Firm shall be fully responsible for all payments like E.O.B.I., Social Security, Health

Insurance, etc. of their staff/Drivers etc.

8. The Client will deduct income tax and sales tax or any tax, if applicable, as per prescribed rates of

the Government.

9. The Contract may be revoked by the Client at any time in case of unsatisfactory services or failure

to perform services without serving any notice and all payments will be withheld by the Client and

moreover, the legal action will be initiated against the firm.

10. The Client reserves the right to revoke the Contract at any time without assigning any reason

thereof and there shall be no appeal before any court or authority against it.

11. That the term of this Contract shall be for 12 Months for its sustainability, commencing from the

date of work order or as per direction of the Client. The client reserves the rights to reduce the

period of sustainability from 12 months to any period. This Contract may be extended with the

mutual consent of parties.

12. That the Firm shall be responsible for the maintenance of all vehicles provided under this Contract.

13. In case of theft, snatching or total loss to the vehicle through accidents the Firm will be responsible

for and WSSC Kohat would not be made a party to any legal act.

14. In case of repair, if the vehicles take more than one hour. The Firm shall provide alternate similar

vehicle on urgent basis without any delay and in this regard no extra charges shall be paid by the

Client.

15. The procuring authority reserves the right to cancel the Contract at any time regardless of time or

decrease of the work by percentage subjected to the approval of main Outsourcing Tender.

16. The Firm shall be fully responsible to employ the competent and well-trained drivers for the

performance of services under this Contract.

17. The Firm shall provide the Service according to the needs and requirements of the Client and in

case of poor-quality services, the Client has the right to deduct penalty @10% of the total contract

amount or cancel the contract.

18. WSSC Kohat have the right to Cancel this Contract upon the procurement of his own fleet at any

time of the contract period.

Annexure 01: Technical Specification of 1 m3 Mini Tipper (Suzuki)

Mini Dumper (Capacity 1 m3):

It will consist of 800cc Pickup with a superstructure with the following features:

Operation: Single action lifting and dumping into road side containers and

compactors.

Body construction: 2mm mild steel sheet for hopper

Hydraulic System: 2 ‐ 2.2 cc/rev with 12 Volt DC motor directly equipped with

Solenoid directional valve, pressure relief valve and 7‐ 9 Lit.

NOTICE FOR INVITING TENDER

Sealed Bids are invited from those firms / companies, who are registered with relevant taxation

authorities including Income Tax, Sale Tax Department & KPRA for the services “Hiring of

vehicles, Machinery and Man Power for solid waste and waste water management within the

Jurisdiction of WSSC, Kohat” on Single Stage Single Envelope procedure in accordance with

Khyber Pakhtunkhwa Public Procurement Regulatory Authority (KPPRA) Rules 2014 and will

includes:

i. Hiring of Mini Tipper Pickups (1 m3) and other vehicles relates to Solid waste Collection

and disposal.

ii. Hiring of Manpower for dredging of Primary and Secondary drains and open Garbage

dumps.

iii. Hiring of Vehicles during Eid Ul Azha, 2021.

Interested eligible bidders may obtain further information and bidding documents from the office

of undersigned on any working day during office hours. The bidding documents may be obtained

by the interested bidders on the submission of written application upon the payment of non-

refundable fee of Rs. 1500/- in favor of Water and Sanitation Services Kohat, Bank of Khyber

A/C# 0138000000712002 till one day before the closing date of submission of bids.

All bids must be accompanied by a Bid Security of not less than 2% of the bid price in favor of

Water and Sanitation Services Kohat.

1. The Bids complete in all respect must reach the office of undersigned by 30th June, 2021,

02:00 PM through register courier only and will be opened on the same day at 02:30

PM in the presence of procurement committee and the Bidders or their representatives,

2. WSSCK will not be responsible for any cost or expenses incurred by Bidders in

connection with the delivery of bids.

3. The NIT & Bid Solicitation documents (BSD) can also be downloaded from the website

of KPPRA and WSSC Kohat website www.wssck.org.pk for information purpose only.

4. All federal and provincial duties/stamp duty/taxes including sales tax & KPRA will be

recoverable as per directives of the government issued from time to time.

5. Incomplete / conditional and Late bids shall not be acceptable, Other detailed terms and

conditions are available with the bid documents.

6. The Competent Authority reserves the right to reject anyone or all the tenders, the reason

for rejection shall be communicated to the contractor/Firm upon request.
