1. Introduction Punjab Judicial Academy (PJA) was established under The Punjab Judicial Academy Act, 2007 (Pb. Act XV of 2007) for

imparting pre-service and in service training to the judicial officers and court personnel with a view to developing their

capacity, professional competency and ethical standards for efficient and even handed dispensation of justice.

Sealed bids/proposals will be invited from the suppliers who deal in Equipment, Furniture, Fixture & Machinery

(hereafter called as bidders) fulfilling the criteria provided. All interested and eligible bidders are requested to go

through complete document and provide the required information and documents mentioned in this document.

2. Instructions The bidders are required to furnish bid security of 2% of the estimated price (refundable) in the shape of CDR/pay order/Bank draft in favor of the “JUDICIAL TRAINING FUND”. In case of warranty, Successful bidders will be asked to furnish the performance guarantee 10% performance guarantee or amount will be deducted from the bills of the firms at the time of payment and be released as per rules. All reputable and established firms are invited to apply for the participation in the Tender Process and submit the attached Tender forms. Tender documents are available on a written request on payment of Rs:500/:(Non-refundable and non-adjustable) from the Punjab Judicial Academy, 15-Fane Road Lahore. PJA will process all the procurements in accordance with the policy defined and specified under PPRA Rules by the Government of Punjab. The sealed proposals must be delivered to Director General, Punjab Judicial Academy, 15- Fane Road, Lahore, (marked on envelope) “TENDER NOTICE FOR THE PURCHASE OF EQUIPMENT, FURNITURE, FIXTURE & MACHINERY” till 22nd April, 2019 by 11:30 AM and the same bid shall be opened publically on 22nd April, 2019 at 12:00 PM in the Committee room PJA Lahore, in the presence of the interested bidders or their representatives who may wish to attend.

After evaluation as per evaluation criteria, the technically qualified vendors will be formally informed for the f inancia l opening . The competent authority may reject all bids or proposals at any time prior to the acceptance of a bid or proposal. The procuring agency shall upon request communicate to any bidder, the grounds for its rejection of all bids or proposals, but shall not be required to justify those grounds. Following instruction must keep in mind for the submission of the tender proposal;

Any applicable taxes will be deducted from the bill.

The equipment supplied by the supplier shall be brand new, in original manufacturer packing and complete in all respects. Cost of transportation of supplied equipment to the site of PJA and cost of installation and commissioning of equipment shall be the responsibility of the supplier.

Supply of material should be made within stipulated period of the Purchase Order positively; in case of failure purchase will be made at the risk and cost of the defaulter or any penalty will be imposed that may lead to blacklisting of the firm

The buyer shall notify the supplier in writing/through telephone immediately of any defects that occur during the warranty period. On receipt of such notification/telephonic message the supplier shall attend the breakdown call within a maximum of 6 working hours.

The firm offering prices for supply of machinery and equipment should have sufficient qualified technical staff and be equipped and having capability to undertake the maintenance or replacement for the equipment supplied to this PJA.

The quantity of the items may be increased/decreased as per availability of funds.

The competent authority reserves the right to accept or reject all tenders without assigning any reason.

The bidder will also indicate the gross value (Including all the applicable taxes) of his bid including optional items (if any) separately in the covering letter of the Tender.

No offer shall be considered if it is:

Received after the date and time fixed for the receipt of tenders. Is unsigned Is ambiguous Is conditional Is given by the firm black listed, suspended or removed from the approved list by any Government,

Semi Government, Autonomous Bodies or other firm. Is received by Telegram. Is received with a validity period shorter than the required in the tender enquiry. Does not conform to general conditions of the enquiry i.e. it is not accompanied by sample or

manufacturers literature where required. Is for store materially and substantially different from that required in the tender enquiry. Received from non-active tax payer Not registered for sales tax/PRA & Income Tax Departments Quoted rates are not valid till 90 days. Warranty period is not up to the desired period.

PJA will Follow the single stage two envelops biding procedure of PPRA Rule-38. The organization/companies will be evaluated technical first then assessed on the basis of financial. Financial Bid will be opened only for the firms qualified in Technical Bid. Technical evaluation criteria are attached at Annex-A & B. (Annex-A for Furniture & Annex-B for Electronics).

5. Conditions of Purchase Punjab Judicial Academy (PJA is hereinafter termed as “PJA”. The person, firm, or Company supplying the goods/services is hereinafter termed as “the Supplier/Bidder”. Following conditions of Purchase are agreed by the Vendor.

1. Acceptance of the Purchase Order: The bidder will confirm the Acceptance / Acknowledgment of its receipt by e-mail fax or by return post soon after the receipt of the Purchase Order from the PJA.

2. Advice Notes and Delivery Challan: All items must be accompanied by Advice Note or Delivery Challan on which the Order No., quantity & name is clearly shown. Non-compliance with this condition renders the goods/Service liable to non-acceptance. Such goods will be held the PJA solely at bidders RISK.

3. Delivery: The period of delivery shall not be more than 40 days of receipt of the Purchase

Order by the supplier or as specified on the Order.

4. Delivery Location: Unless otherwise ‘agreed’, delivery of the items against the Order shall be made at Punjab Judicial Complex, Near Moazza Kallar, Kala Shah Kaku,

5. Delivery Date: This Order is liable to cancellation if the Delivery shall not be effected within the

time specified on the Order. In instance where Delivery Date is not specified, same must be advised when confirming acceptance of this Order as required by clause 2 above. If the items are not supplied within the period specified, same would be procured from alternate source at the expense of the supplier without any notice.

6. Should delivery be hindered or delayed by the PJA instructions or by any cause beyond the supplier reasonable control including Strikes, Lockouts, War, Fire, Accidents, reasonable extensions shall be granted at the sole discretion of the PJA.

7. INSPECTION: a. The PJA reserves the right to inspect any item after or before dispatch from the premises

or ask for the sample, but such inspection/sample shall not relieve the vendor from responsibility or liability nor be interpreted so as in any way to imply acceptance of such items.

b. Items delivered have to meet the entire satisfaction and approval or the PJA Authorization Person on delivery at the Academy or as stated on the order.

8. QUANTITY DELIVERED: No quantity over and above requested, by Order will be received or paid for without prior written authority obtained from the PJA.

9. When required by the PJA, the supplier shall mark the items ordered in accordance with

reasonable instructions of the PJA Authorized Person.

10. Delivery of Items: Items supplied must correspond in all respect, with, this Order and must conform in every respect to sample specification. In the absence of sample, items must be the best and of first class workmanship, failure to comply with this Clause will render the items liable to be rejected.

11. Condition of Items: All items must meet in all respects with the specifications and conditions of the Order, and must be in good condition on receipt, otherwise they will be liable to rejection.

12. Delivery of items to Authorized Person: The supplier will deliver the items ordered to the

authorized person of PJA who will sign on each delivery note, otherwise the PJA will not be held responsible for the items delivered contrary, to this instruction.

13. Rejected Items: In case of rejection of items as per Clause 10 above, it will be at suppliers risk and expense. Any item receive damaged will not be accepted and will be replaced by supplier at his expense.

14. Accountancy: All bills, Advice notes, Delivery Challans and Correspondence must show the

Order number and the address at which the items the goods have been delivered.

15. Sub-Contracting: The supplier will not transfer or assign directly or indirectly to any person or persons whatsoever any portion of the Order. Sub-letting is prohibited.

16. Disclosure of Confidential Info: Any material/info supplied by the PJA to the supplier in pursuance of any enquiry for quotations shall remain the property of PJA and any information derived there from or otherwise communicated to the bidder in connection with any such enquiry shall be regarded by the bidder as secret and confidential and shall not, without the consent in writing of the PJA, be published or disclosed to any third party or made use by the bidder except for the purpose of implementing this Order.

17. Advertising: The supplier will not, without the prior written consent of the PJA, advertise or announce or allow be advertising or announcing that items have been supplied in pursuance of this Order.

18. Termination: If the supplier fails to comply with any of the above conditions, this Order may be terminated by the PJA authorized person without any notice and at supplier’s expense.

19. Submission of Bills: Bills shall be submitted at the Store, PJA with Advice Notes / Challans / Purchase Order No. and Date.

20. Arbitration: In case of any dispute arising between the PJA and the Supplier, the decision of the DIRECTOR GENERAL of PJA or his nominee shall be final and binding on both the parties. The supplier cannot sue the PJA in the Courts of Law.
