II. BINDING REQUIREMENTS

1. The dwelling must not be located in a restricted area or zip code, or conflict with Avatar’s general

rules and under writing guidelines.

2. Proof of continuous prior Homeowners coverage must accompany the application. Risks with lapses

in coverage cannot be bound without prior underwriting approval. Exception may be made for first

time home buyers.

3. The risk must be insured for 100% of the replacement cost, be well kept, and meet the requirements

listed on the following pages.

4. Applications must be complete, signed by the applicant, and the premium collected by the agent,

unless a new purchase. If a new purchase, the closing agent may collect premium and forward to

company within 10 days. Incomplete applications are unacceptable. Flat cancellations are not

allowed unless the insured fails to close on the new purchase.

5. The dwelling must be one family and owner occupied.

6. Dwellings for sale, under renovation or under construction are not eligible.

7. Two photos are required for any dwelling with a replacement cost less than $150,000.

8. The named insured must be an individual or an individual and resident spouse to be eligible.

9. Policies listing any insured with a prior criminal conviction are not eligible.

III. NON BOUND APPLICATIONS

When submitting a non bound application:

1. Accept no money, and do not have the applicant sign the application.

2. Policy will be bound only when accepted by Avatar.

IV. REPLACEMENT COST

1. Use the Avatar replacement cost software to determine exact replacement cost. The policy must be

written for Full Replacement Cost. Use ISO’s 360 Value found in our rating system.

2. Please assure rating information drawn automatically from the county property appraiser’s websites

is accurate. In-ground pools and spas must be added to the valuation in the “Additional Features”

section.

3. Avatar is not required to provide coverage in excess of replacement cost to meet or satisfy mortgage

lenders or mortgage loan requirements. (Refer to F.S. 626.9551 and F.A.C Rule 4-167.009)

V. CONSTRUCTION DEFINITIONS

Frame

Exterior wall of wood or other combustible construction, including wood ironclad, stucco on wood or plaster

on combustible supports. Frame dwellings must be built in 2002 or newer (and conform to FBC 2001) to be

eligible for coverage. See the following page for acceptability requirements for frame homes built prior to

2001.

Masonry Veneer

Exterior walls of combustible construction veneered with brick or stone. Masonry Veneer is rated as Frame.

Masonry

Exterior walls constructed of masonry materials such as adobe, brick, concrete, gypsum, block, hollow

concrete block, stone, tile or similar materials.

Mixed Masonry/Frame

A combination of both frame and masonry construction is classified as frame when the exterior walls of

frame construction (including gables) exceed 33.3% of the total exterior wall area.

Fire Resistive

Exterior walls of masonry or reinforced concrete with floors and roof of brick or tile arches, reinforced

concrete, poured or precast concrete slabs or similar types of fire resistive or noncombustible supports.

The floor slab must be on non combustible supports.

Roof Shape

Hip – Roof having sloping ends and sloping sides down to the eaves line.

Gable – The portion of the roof above the eaves line of a double-sloped roof; the end section appears as an

inverted V.

Flat – A horizontal roof with a pitch less than 10 degrees.

Predominant Roof Shape - To determine the roof shape, use the following standards:

Porches or carports that are attached only to the fascia or wall of the host structure and not

structurally connected to the main roof system are not considered in the roof geometry

determination.

HIP roofs must not have any other roof shape greater then 10% of the total building perimeter.

Non-Hip roof is any other roof shape or combination of roof shapes including hip, gable,

gambrel, mansard and other roof shapes not including flat roofs.

Flat Roof greater than 100 square feet or 10% of the entire roof, whichever is greater.

Where 4-point or other inspections are required per the guidelines in this manual, the inspection must be less

than 1-year old, completed for the applicant of insurance and must demonstrate no deficiencies. The policy

may not be bound by the agent until the company has given written approval.

Wind Mitigation Inspections are good for 5-years per statute.

VI. UNACCEPTABLE RISKS

HOUSES

1. Houses greater than 40 years old unless the house has been completely updated for electrical,

plumbing, and heating / cooling to current state and local building codes. The application for homes

greater than 40 years old must be submitted non-bound, with a complete four (4) point inspection, for

underwriting approval.

2. Houses that have been vacant for more than 30 days.

3. The roof must be in acceptable condition.

Shingle: < 15 years old and be in visibly good condition.

Roofs that are not in visibly good condition will have patchwork and may have cracks, broken

tabs, buckling, curling or blistering of the tabs, and tabs with most of the surface granules worn

off. These are signs of aging and are indicators that there will be shingle loss during high winds.

Shingles that are in good shape should lie flat and the lower edges should be well adhered to the

top surface of the shingle below.

Tile roofs: < 25 years old and be in visibly good condition.

Metal roofs: must be submitted non-bound and are subject to pre-inspection.

4. Houses with Built-up, Flat, or Low Pitch roofs.

5. Houses with unconventional material or construction design, or structures not originally intended as

a dwelling. (Unconventional examples include steel or sod materials and Geodesic or Quonset).

6. Houses with EIFS (Exterior Insulation and Finish Systems) as the exterior wall material.

7. Houses with asbestos siding.

8. Frame houses built before 2002 must have ALL EXTERIOR wall and roof openings such as doors

(including garage doors), windows, skylights, and vents fully protected with storm shutters as

outlined on page 18, or retrofitted to meet the windstorm mitigation elements of the 2001 Florida

Building Code for opening protection. These risks must be submitted non-bound with documentation

from a licensed building inspector or professional engineer verifying the opening protection and a

four-point inspection showing all systems meet our guidelines for acceptability.

9. HO-4 and HO-6 risks are not eligible in Frame buildings.

10. Houses with galvanize plumbing components.

11. Houses with knob & tube or aluminum wiring.

12. Houses with flood break away walls.

13. Houses with room additions after the original structure was completed require prior Underwriting

approval. (For consideration to be given, additions must meet current state and local building codes.)

Submit non-bound with interior and exterior photos, building permits with final inspections and

photos.

14. Mobile Homes, Duplexes, Log homes and Manufactured or Prefabricated homes.

15. Townhouses without structural firewalls extending above the roof line between each unit. The

townhouse must be of Masonry construction. In addition photos showing the firewall above the roof

line are required.

16. Houses that are for sale, in the course of construction, or are in isolated areas.

17. Houses with open foundations or crawl spaces.

18. Houses with wood burning & coal stoves; freestanding, freestanding with inserts & open fireplaces;

kerosene, base-board heating, gas & electric space heaters.

19. Houses with Chinese drywall or other defective materials.

20. Houses built on pilings, stilts, over water or floating homes.

21. Houses that had a foreclosure within the past three (3) years must have a four (4) point inspection for

the electrical, plumbing, and heating / cooling systems completed and submitted with the application

non-bound for underwriting approval.

22. Houses with more than two mortgages.

23. Premium financed policies.

24. Houses with existing damage.

25. Houses with burglar bars which do not have a “quick release” feature.

26. Houses located in an AE Zone (Flood) which do not carry a separate flood policy.

27. Houses with over hanging tree branches or trees in declining health.

UNACCEPTABLE EXPOSURES

1. Risks with swimming pools, spas and hot tubs not completely fenced or enclosed.

2. Risks with swimming pool slides, diving boards and /or trampolines.

3. Risks with areas for potentially dangerous sport activities such as archery, target practice, or rock

climbing on premises.

4. Risks with Skate Board or Bicycle Ramps or All Terrain Vehicles (ATV’s)

5. Risks with business exposures unless incidental to the use of the property.

6. Risks with a swimming pool, hot tub, spa, pond or lake on premises if there are any day care

services.

7. Risks with commercial exposure such as, but not limited to: farming, manufacturing, or professional

services. This includes day care nurseries, baby sitting for compensation, tutoring etc.

8. Risks with liability extension to rental properties.

9. Risks with animal breeding, boarding, training or riding on premises.

10. Risks with livestock.

11. Risks which have flooded in the past five (5) years.

12. Risks exhibiting lack of pride of ownership evidenced by, but not limited to: lack of maintenance;

disrepair; peeling paint; landscaping containing junk cars, appliances and interior furniture; lack of

landscaping etc.

UNACCEPTABLE ANIMALS

1. Pit bulls, American Pit Bull Terriers, Boxers, Bull terriers, Brazilian Mastiffs, English Bulldog,

Rottweilers, German Shepherds, Akitas, Chows, Presa Canarios, Great Danes, Dobermans,

Doberman Pinschers, Huskies, Straffordshore Terrier, Wolf Hybrids or any mix of any of these

breeds.

2. Horses or saddle animals, exotic animals, zoo animals.

3. Animals in excess of 75 lbs, except Golden Retrievers, Labradors and Irish Setters.

4. Any animal with a prior biting or attack incident or aggressive in nature.

UNACCEPTABLE LOCATIONS

1. Houses located within 2500 feet of any tidal waters. (Tidal waters include, but not limited to:

Atlantic Ocean, Gulf of Mexico, Intercoastal & Intracoastal waterways, bays, harbors, inlets, sounds,

canals with direct access to large bodies of water and mouths of rivers).

2. Houses located on Barrier Islands.

3. Houses located East of I-95 or East of U.S. Highway 1, whichever is more Westerly, in Dade,

Broward and Palm Beach Counties unless within the Florida wind pool boundaries.(Houses within

the Florida wind pool boundaries must be written EX-WIND if otherwise eligible).

4. Houses located west of I-75 in Charlotte, Lee and Collier counties.

5. Houses located within the Citizens Property Insurance Corporation Wind Only Eligible or Wind Pool

Areas are not eligible for wind coverage.

6. Houses with a prior sinkhole occurrence.

7. Houses on more than 5 acres of land must be submitted non-bound. No more than 10 acres is

acceptable. Houses not located along a paved road and set back more than 200 feet from the road.

8. Houses within a mile of a brush fire unless the fire has been out for 3 days. Risks located within one

half mile of brush (thick growth of tree, ground cover, pine trees, palmettos, etc) are not eligible.

9. Coverage may not be bound in any area where there is a hurricane or tropical storm watch, warning

or occurrence. If there is a disturbance, hurricane or tropical storm located north of 15° latitude,

south of 35° north latitude, west of 70° west longitude, and east of 95° west longitude, call

underwriting for binding approval.

SECONDARY / SEASONAL RESIDENCES

Secondary and/or seasonal residences are eligible only when equipped with central monitoring fire and

burglar alarms, main supply water shut-off valves, located outside of the home, and if located within 2

miles of any coast must meet FBC 2001 for opening protection. The house must not be located in an

isolated area, the owner must agree to activate alarms, turn off water to the dwelling and secure opening

protection prior to traveling to another owned location. In cases of emergencies, the owner must have a

local contact able and willing to perform these requirements in his/her absence.

Secondary or seasonal dwellings are defined as being unoccupied two (2) or more consecutive months

during any one (1) year period.

Rental homes are not eligible.

PRIOR INSURANCE

1. Risks without 1 year of current homeowners insurance, immediately prior to the Avatar Policy

inception are not eligible. (Exception for first time homeowner, new Florida residents and new

purchases).

2. Risks that were previously canceled or non renewed, except due to risk reduction or wholesale

cancellation by a company leaving the state are not eligible.

UNACCEPTABLE OCCUPANCY

1. Only single family, owner occupied dwellings are eligible for coverage.

2. Policies listing someone other than the named insured or resident spouse as the insured, as well as

policies with more than one individual listed as the named insured.

3. Policies listing a Trust or Estate as the insured are not acceptable. (When a living trust exists, these

can be accommodated by listing the insured c/o name of trust or estate).

4. Policies listing corporations, associations etc. as additional insureds.

5. Houses with more than one roommate.

6. Properties with any rental or second residences on premises.

7. Houses with more than six residents

8. Transfer or Assignment is not acceptable.

PRIOR LOSSES

1. Applicants with two or more losses during the past three (3) years and/or three or more losses during

the past five (5) years are not eligible. Submit non bound with a detailed description of the losses.

(Hurricane claims are not considered for renewal eligibility purposes).

2. Applicants with any prior liability claim in the past five (5) years are not eligible.

3. Risks with any prior theft or vandalism claim that have not installed a Central Station Monitored

Burglar Alarm System.

4. Houses with two or more water losses in the past five (5) years are not eligible.

5. Houses with any prior sinkhole loss.

6. Houses with prior mold and/or fungi claim in the past five (5) years.

7. Houses that have experienced total losses, or where policy limits were paid in the past, are not

eligible.

8. Risks with any prior “Falling Object” claim in the last five (5) years.

9. Any applicant with a prior conviction for fraud or any prior claim denied for fraud or

misrepresentation.

VII. PROTECTION CLASS 9, & 10

Protection class 9 and 10 risks are eligible if all of the following are met:

a. Located within 15 minutes of a recognized fire station that would respond to a fire at the insured

location and which has tanker trucks capable of carrying water of sufficient capacity for fire

fighting purposes in that area and;

b. Located on a paved road and no more than 200 feet from that road and;

c. No prior fire losses and;

d. Equipped with smoke detectors and a fire extinguisher on every floor and;

e. Not of Frame Construction and;

f. The coverage A value is not more than $250,000.

The rating software automatically pulls the Protection Class from ISO and may not be changed by the agent.

In areas where two or more classifications are shown, (eg 6/9) the classification is determined by the system

as follows:

VIII. RENTAL POLICIES

A separate renters policy must be written for each adult in the household other than the named insured,

spouse and children of either. Adult means age 21 or over. Single renters residing in a single-family

dwelling are not eligible.

a. Applicants with a prior theft loss in the past 5 years are not eligible.

b. Applicants who have been previously canceled, non-renewed or had insurance refused by another

insurer are not eligible unless wholesale cancellation by a company leaving the state.

c. Do not bind any applicant with items to be scheduled without prior underwriting approval.

d. Applicants with a roommate are not eligible unless the roommate meets all of the foregoing

requirements and separate policies for each are written with Avatar Insurance. No more than two

occupants (one roommate) are acceptable.

IX. IN HOME BUSINESS

This optional coverage provides property and liability coverage for Homeowners and Condominium

owners with an acceptable In Home Business. The limit of liability must be the same as the Coverage E

limit up to a maximum of $300,000. Coverage for physical damage to business property is limited to a

maximum of $10,000.

XI. DEDUCTIBLES

Hurricane Deductible

The minimum hurricane deductible is $500. Higher hurricane deductibles of 2%, 5% and 10% are available.

The availability of the $500 hurricane deductible is based on Coverage A or C limit.

Available Hurricane deductible options depend upon the applicable Coverage A limit or the Coverage C

limit for HO-4 and HO-6 policies. Hurricane deductible options are as follows:

PURSUANT TO FLORIDA STATUTE, ALL HURRICANE LOSSES MUST BE REPORTED TO THE

COMPANY, REGARDLESS IF A CLAIM IS MADE, FOR PURPOSES OF COMPUTING THE

ANNUAL HURRICANE DEDUCTIBLE.

Non-Hurricane Deductible

The minimum non hurricane deductible is $500. Higher non hurricane deductibles of $1,000 and $2,500 are

Coverage B

This coverage may be increased up to 20% of the Coverage A limit.

This coverage may only be increased with prior underwriting approval. Any coverage B increase is

contingent on the structure meeting all the dwelling requirements listed on pages 5-6.

PERSONAL PROPERTY

Coverage C

This coverage may be increased up to 75% of the Coverage A limit or decreased to 0%, 15% and 25%

with a corresponding decrease in premium for HO-3. (See pg 11 for HO4 & HO6). Personal property

coverage is provided on an actual cash value basis.

Optional replacement cost coverage is available.

PERSONAL LIABILITY

Coverage E

This coverage is written with a basic policy limit of $100,000. Increased limits of $300,000 and

$500,000 are available.

Coverage E is limited to $100,000 on Renters policies.

MEDICAL PAYMENTS

Coverage F

The basic policy provides $1000 coverage. Increased limit of $5,000 is available.

LOSS ASSESSMENT

Coverage L

The basic policy provides $1,000 coverage or $2,000 for the HO-6. Increased coverage up to a

maximum of $10,000 is available.

This coverage is excess over any insurance collectible under any association’s policy. It does not

provide protection for that part of the assessment that is subject to a deductible under an association’s

policy.

FIRE DEPARTMENT COVERAGE

This coverage increases the limit applicable to expenses paid for fire department charges.

BUILDING ORDINANCE OR LAW COVERAGE

1. If this option is purchased, the policy will provide up to 25% or 50% of the Coverage A limit to

pay the increased costs necessary to comply with the enforcement of an ordinance or law.

2. Additional Information

a. This coverage provides protection for costs necessary to meet applicable laws regulating the

construction, use, or repair of the insured property or requiring the tearing down of the

property. It is 25% or 50% of the Coverage A amount. Use the Building Ordinance or Law

endorsement to accept or reject this optional coverage.

b. Per Florida Statute 627.7011 (b), coverage of 25% will automatically be provided unless the

insured has rejected the coverage completely on Avatar’s Building Ordinance or Law

selection /rejection form. The signed selection/rejection form must be returned to Avatar at

the time of application and at least once every 3 years thereafter.

MOLD COVERAGE

Avatar’s Homeowners policies include a maximum of $10,000 per incident/$25,000 aggregate per

policy for Mold, Fungus, Wet and Dry Rot remediation for any covered water loss. For an additional

premium, increased limits up to $25,000 per incident/$50,000 aggregate per policy and $50,000 per

incident/$50,000 aggregate per policy can be purchased.

SINKHOLE COVERAGE

The base policy covers Catastrophic Ground Cover Collapse as defined by Florida Statute 627.706.

Sinkhole Coverage is excluded in the base policy but may be purchased for an additional premium.

BACK UP OF SEWER OR DRAIN COVERAGE

For an additional premium coverage can be purchased for accidental direct physical loss caused by

water from outside the plumbing system that enters through sewers or drains, or water which enters into

and overflows from within a sump pump, sump pump well or other type of system designed to remove

subsurface water which is drained from the foundation area.

The maximum limit available under this option is $5,000.

DEDUCTIBLE: The policy deductible will be deducted from each back-up of sewer or drain loss

covered by this optional coverage.

ANIMAL LIABILITY COVERAGE

For an additional premium this extends coverage to losses arising from animals owned by an insured,

subject to the exclusions and conditions listed in the policy. This coverage does not cover losses from

the unacceptable breeds of dogs listed on page 7.

GOLF CART COVERAGE

For an additional premium we cover losses, up to the limits shown below, arising from the ownership

and operation of a golf cart for recreational purposes. Coverage does not apply when the golf cart is:

1. Used outside the boundaries of a retirement community or restricted access community unless

being used for recreational golf on a golf course.

2. Used for business purposes, rented or lent to other persons.

3. Used to carry persons for a charge or for delivery purposes.

DEDUCTIBLE: The policy deductible, but in no event less than $500, will be deducted from each loss

SCREENED ENCLOSURES AND SCREENED ROOMS

Avatar’s Homeowners policies exclude coverage for screened enclosures and screened rooms from wind

and wind related damage. Coverage for these structures can be purchased separately.

Coverage options of $10,000; $25,000 and $50,000 are available.

Coastal Counties: Brevard, Broward, Charlotte, Collier, Citrus, Dade, Dixie, Duval, Escambia, Flagler,

Franklin, Gulf, Hernando, Hillsborough, Indian River, Lee, Levy, Manatee, Martin, Monroe, Nassau,

Okaloosa, Palm Beach, Pasco, Pinellas, Sarasota, St Johns, St Lucie, Taylor, Wakulla, Walton,

Washington, Volusia.

All other counties are Inland.

IDENTITY THEFT OR IDENTITY FRAUD

For an additional premium we cover:

1. Costs of executing affidavits or similar documents, attesting to theft or fraud, required by credit

grantors, credit agencies, or similar financial institutions.

2. Costs for certified mail to credit grantors, credit agencies or similar financial institutions and law

enforcement agencies.

3. Lost income resulting from time taken off work to complete theft or fraud affidavits, talk to or

meet with credit grantors, credit agencies or similar financial institutions, law enforcement

agencies and or legal counsel, up to a maximum of $250 per day. Total payment for lost income

is not to exceed $5,000.

4. Loan application fees for reapplying for a loan or loans where the original application is rejected

solely because the lender received incorrect credit information.

5. Reasonable attorney fees incurred by you as a result identity theft or identity fraud to:

a. Defend lawsuits brought against an insured by financial institutions, merchants, or collection

agencies;

b. Remove any civil or criminal judgments wrongly entered against an insured; and

c. Challenge the completeness or accuracy of any information in a consumer credit report.

6. Charges incurred for long distance telephone calls to law enforcement agencies, merchants,

credit grantors, credit agencies or similar financial institutions to report or discuss an actual

identity theft or identity fraud.

The maximum limit of coverage is $25,000.

SCHEDULED PERSONAL PROPERTY

Items valued or costing less than $500 will not be scheduled. Appraisals are required for items in excess

of $1,500:

1. For jewelry, an appraisal by a certified gemologist is required. For furs, a certified appraisal

from a furrier is required. Appraisals must be less than 3 years old and include photos.

2. For other items, a photocopy of a current price listing along with photos is acceptable.

3. Evidence of prior insurance is required if the appraisal is 30 days old or older.

4. The maximum limit per policy for all scheduled items is $50,000.

5. The house must have a central monitored alarm system.

6. Scheduled jewelry must be secured when not being worn.

7. Furs must be kept in cold storage when not in season

8. The risk may have no prior theft claims.

9. Submit required documents non-bound for written approval from Underwriting. Coverage cannot

be bound without written approval by the Company.

DEFINITIONS

1. Roof Cover

FBC Equivalent – Roof cover in compliance with ASTM D-3161 modified to 110 mph, or in

compliance with 1994 SFBC.

2. Roof Deck Attachment

a. Level A – Plywood / Oriented Strand Board (OSB) nailed with 6 penny common nails at 6”

spacing on the edge and 12” in the field on 24” truss spacing.

b. Level B – Plywood / Oriented Strand Board (OSB) nailed with 8 penny common nails at 6”

spacing on the edge and 12” in the field on 24” truss spacing.

c. Level C – Plywood / Oriented Strand Board (OSB) nailed with 8 penny common nails at 6”

spacing on the edge and 6” in the field on 24” truss spacing.

d. Level D – Dimensional Lumber.

3. Roof to Wall Connection

a. Toe Nails – approximately 3 nails are driven at an oblique angle through the rafter and into

the top plate.

b. Clips and Diamond Connectors – Clips are pieces of metal that are nailed into the side of the

rafter / truss and into the side of the top plate or wall stud. The metal does not wrap around

the top of the rafter / truss, and the clip is only located on one side of the connection. A

Diamond is a piece of metal that has a slot in the middle to accept the rafter, and the nails to

the outside edge of the top plate.

c. Single Wraps and Double Wraps – attached to the side and / or bottom of the top plate and

are nailed to the rafter / truss. Straps that are wrapped on both sides have double the capacity

of a single wrap.

4. Opening Protection

a. Class A (Hurricane Impact) – All exterior wall and roof openings in buildings (doors,

windows, skylights and vents, other than roof ridge, gable, soffit and plumbing vents) must

be fully protected with impact resistant coverings (e.g. shutters), impact resistant doors,

and/or impact resistant glazing that meet the requirements of one of the following:

(1) SSTD12;

(2) ASTM E 1886 and ASTM E 1996 (Missile Level C – 9 lb);

(3) Miami-Dade PA 201, 202 and 203; or

(4) Florida Building Code TAS 201, 202 and 203.

b. Class B (Basic Impact) – All exterior wall and roof openings in buildings (doors, windows,

skylights and vents, other than roof ridge, gable, soffit and plumbing vents) must be fully

protected with impact resistant coverings (e.g. shutters), impact resistant doors, and /or

impact resistant glazing that meet the requirements of ASTM E 1886 and ASTM E 1996

(Missile Level B – 4.5 lb).

5. Secondary Water Resistance

a. Wood Roof Decks

(1) Self – Adhering Modified Bitumen tape applied to the plywood joints. (Generically

known as Ice & Water Shield or Peel N Seal)

Tar used to cover any perforations in the deck associated with mechanical attachments of the

deck to the underlying joist structure.

6. Internal Pressure Design

a. Enclosed – Building must have all its glazed openings being impact resistant, achieved either

by having qualified protection devices or using qualified impact resistant glazing.

b. Partially Enclosed – Building is designed assuming that one or more areas on the building are

open to allow wind to enter the building and pressurize the interior.

7. Terrain

a. B (Inland) – All existing buildings neither on a barrier island nor within 1500 feet of the

mean coastal high water line.

b. C (Coastal) – All existing buildings on a barrier island or within 1500 feet of the mean

coastal high water line.

c. High Velocity Hurricane Zone (HVHZ) – Miami –Dade and Broward Counties.

8. Wind-Borne Debris Region

Includes all areas where the basic wind speed is 120 mph or greater. Areas of Citrus, Hernando,

Jefferson, Levy, Taylor and Wakulla Counties that are within 1 mile of the coast.

9. Fastest Mile Design Speed

Based on the design wind speed map of the design standard –SBC 1976, SBC 1988, and ASCE

7-88.

10. Wind Speed Location

FBC peak gust wind speed corresponding to building location.

Building Code Effectiveness Grading

General Information

The Building Code Effectiveness Grading (BCEG) Schedule develops a grade of 1 to 10 for a

community based on the adequacy of its building code and the effectiveness of its enforcement of that

code. Policies which cover Windstorm or Hail may be eligible for special rating, subject to the criteria

in the following paragraphs.

In some communities, two Building Code Effectiveness Grades may be assigned. One grade will apply

to 1 and 2 family dwelling buildings and/or personal property contained in such buildings. The other

grade will apply to all other buildings occupied for residential, commercial and/or manufacturing

purposes including personal and business property contained therein. The Public Protection

Classification Manual will indicate the application of each grade.

The Building Code Effectiveness Grades for a community, and their effective dates, are provided in the

Public Protection Classification Manual published by Insurance Services Office, (ISO).

A Building Code Effectiveness Grading credit does not apply when the peril of Windstorm is excluded

from the policy.

Community Grading

The Building Code Effectiveness Grade applies to any building that has an original certificate of

occupancy dated in the year of the effective date of the community grading, or later. Buildings having a

certificate of occupancy / completion dated prior to the effective date of the community grading will not

receive any BCEG premium credit and should be classified as “99”

If a community is re-graded subsequent to its initial grading, the factor for the revised grade applies to

buildings that have an original certificate of occupancy dated the year of the effective date for the

revised grading.

Where certificates of occupancy are not issued, equivalent documentation acceptable to the Avatar may

be used.

If, due to an addition or alteration, the original building is changed to comply with the latest building

code, the factor for the community grading applicable at the time the reconstruction is completed will

apply to such building.

Communities that decline to participate in the Building Code Effectiveness Grading Program will be

identified in the Public Protection Classification Manual as not participating.

Individual Grading

Where buildings have been built in full conformance with the natural hazard mitigation elements of one

of the nationally recognized building codes even though the community grade is greater than 1, or the

community is not participating in the program, exception rating procedures may apply.

Any building may be classified as Grade 1 for Windstorm/Hail upon certification by a registered or

licensed design professional, based on an on-site inspection, that such building is in compliance with

one of the three nationally recognized building codes with respect to mitigation of the Windstorm and

/or Hail hazard. This classification is effective only from the date of the certification. Costs associated

with this provision must be paid by the insured / applicant.

55 Years of Age Discount

If the following criteria are met, the insured will be eligible for this discount:

1. One of the Named Insureds must be age 55 or older.

2. The insured premises must be the principal residence of the applicant.

Fire Resistive Discount

If the insured dwelling qualifies as Fire Resistive, as outlined on page 4, a discount will be applicable.

Personal Property Exclusion Discount

If the policy includes the Personal Property Exclusion Endorsement, a discount will be applied.

(see page 13 of the rating manual for discount factors).

WINDSTORM OR HAIL EXCLUSION DISCOUNT

If the policy includes the Windstorm or Hail Exclusion Endorsement, a discount will be applied.

WATER DAMAGE EXCLUSION DISCOUNT

If the policy includes the Water Damage Exclusion Endorsement, a discount will be applied.

(see page 13 of the rating manual for discount factors).

LIMITED WATER DAMAGE COVERAGE

If the policy includes the Limited Water Damage coverage, a surcharge will be applied.

(see page 13 of the rating manual for discount factors).

PROTECTIVE DEVICE DISCOUNTS

Approved and properly maintained installations of:

1. Burglar and fire alarms in the dwelling may be recognized; and

2. Automatic sprinklers in the dwelling may be recognized.

For central alarm credits, certificates are required and must be less than 12 months old. Updated

certificates are required upon annual renewals.

GATED COMMUNITY DISCOUNT

The credit is 10% of the base premium for homeowners and 5% for condo or renter's policies.

For Homeowners the gated community must be completely surrounded by a fence, which is a minimum of

six feet high, with all entrances secured by either a 24 hour manned security guard station or a resident card

or key lock control. A picture of the entrance to the community is necessary to qualify for the discount.

The Condominium or Apartment must be located in a building or complex completely surrounded by a

fence, which is a minimum of six feet high and protected 24 hours a day by uniformed guards.

NOTE: If the Gated Community Credit is allowed, no Burglar Alarm Protective Device credits are

allowed.

NEW HOME DISCOUNT

Dwellings are eligible if less than 10 years of age. The age of the home is determined by subtracting the

year in which construction was completed from the year in which the policy begins or renews.

XIV. SURCHARGES

TOWNHOUSE SURCHARGE

A surcharge will be applied to all Townhouses and Villas that are eligible for coverage.

SECONDARY/SEASONAL HOME SURCHARGE

A surcharge will be applied to all Secondary and Seasonal homes that are eligible for coverage.

POOLS

A surcharge will be applied to every policy with a pool.

In-ground pools and spas must be added to the Replacement Cost Estimator in the rating system.

FIXED EXPENSE FEE

A Fixed Expense fee of $108.00 for HO-3; $48.00 for HO-4 and $50.00 for HO-6 policies is charged on all

new and renewal policies.

MGA FEE

A fully earned MGA fee of $25 is to be charged on each policy subject to 626.7451(11) Florida Statutes.

EMPAT FEE

An annual EMPAT (Emergency Management Preparedness and Assistance Trust Fund) surcharge of $2.00

will be imposed on every homeowner’s policy.

XV. CANCELLATIONS

The insured may cancel this policy at any time by notifying us in writing of the future date cancellation

is to take effect.

We may cancel this policy only for the reasons stated below by notifying the insured in writing of the

date cancellation takes effect. This cancellation notice may be delivered or mailed to the insured at the

mailing address shown on the Declarations. Proof of mailing shall be sufficient proof of notice.

1. When the insured has not paid the premium, whether payable to us or to our representative or under

any finance or credit plan, we may cancel at any time by notifying the insured at least 10 days

before the date cancellation takes effect.

2. When this policy has been in effect for less than 90 days and is not a renewal with us, we may

cancel for any reason by notifying the insured at least 20 days before the date cancellation takes

effect.

3. When this policy has been in effect for 90 days or more, or at any time if it is a renewal with us, we

may cancel if there has been a:

Material misstatement

Failure to comply with underwriting requirements established by us within 90 days of the date this

coverage takes effect;

Substantial change in the risk covered by this policy; or

Cancellation by us of all polices for a given class of insureds.

We may cancel this policy be notifying the insured in writing at least 100 days before the date

cancellation takes effect. However, we shall give at least 100 days’ written notice, or written notice by

June 1, whichever is earlier, for any cancellation that would be effective between June 1 and November

30. The notice will include the reasons for cancellation.

If we or our affiliate have continuously insured your property for, at least, a five (5) year period

immediately prior to the date of notice, we will provide you with written notice, at least, one hundred

eighty (180) days before the expiration date of this policy.

If we cancel this policy for underwriting reasons or non-payment of premium, the premium for the

period from the date of cancellation to the expiration date will be refunded. If this policy is canceled

for any other reason, the refund of premium, if any, will be less than a full pro rata refund. Any refund

of premium will be made by us when the policy is canceled, or as soon as possible after that. The

refund date will not affect the cancellation of the policy.

We may not cancel:

1. On the basis of Act of God claims unless we can demonstrate, by claims frequency or otherwise that the insured has failed to take action reasonably necessary as requested by us to prevent recurrences of damage to the insured property;

2. On the basis of filing a Sinkhole claim unless policy limits for Coverage A are paid or the insured has failed to repair the structure in accordance with the engineering recommendations upon which any payment or policy proceeds were based;

3. On the basis of any single water damage claim unless we can demonstrate, by claims frequency or otherwise that the insured has failed to take action reasonably necessary as requested by us to prevent a future similar occurrence of damage to the insured property.

XVI. RENEWALS / NON-RENEWALS

1. Renewals are mailed directly to the insured 45 days prior to the expiration date of the current

policy. Payment instructions are included with the renewal offer.

2. The Company may non renew the policy due to the following reasons:

a. The risk is no longer acceptable per our underwriting rules.

b. Risk reduction.

c. Any claim during the policy period. Exception:

(1) Act of God claims unless we can demonstrate, by claims frequency or otherwise that the insured has failed to take action reasonably necessary as requested by us to prevent recurrences of damage to the insured property;

(2) Sinkhole claims unless policy limits for Coverage A are paid or the insured has failed to repair the structure in accordance with the engineering recommendations upon which any payment or policy proceeds were based;

(3) Any single water damage claim unless we can demonstrate, by claims frequency or

otherwise that the insured has failed to take action reasonably necessary as requested by us

to prevent a future similar occurrence of damage to the insured property.

d. Any misrepresentation.

e. Failure to cooperate with the Company during a claim investigation.

f. Any other reason specified by law.

3. Non Renewal notices will be mailed at least 100 days prior to the effective date of the non renewal.

However, we shall give at least 100 days’ written notice, or written notice by June 1, whichever is

earlier, for any non renewal that would be effective between June 1 and November 30. The

notice will include the reasons for non renewal.

4. If we or our affiliate have continuously insured your property for, at least, a five (5) year period

immediately prior to the date of notice, we will provide you with written notice, at least, one

hundred eighty (180) days before the expiration date of this policy, except when the nonrenewal

is due to a “sinkhole loss” as permissible by Florida Statute 627.707 or due to a catastrophic ground

cover collapse.

XVII. ENDORSEMENTS

Changes to the policy mid-term are effective the day after we receive the request. Coverage changes are

effective the next annual renewal. New information regarding the rating or acceptability of the risk will

be made effective when the company becomes aware of the change.

All premiums due from endorsements will be billed to the insured.

On full payment policies, the full amount of the endorsement premium is due.

On policies with a payment schedule, the pro rata amount between the effective date of the endorsement

and the next premium due date will be due 15 days from the mailing date.

XVIII. POLICY PERIOD

The policy will be written for a period of one year and may be extended for successive policy periods by

renewal based on the premiums, forms, and endorsements then in effect.

XX. FEES

Each installment, except under the Full Payment plan, is subject to a $3.00 service fee charge. All

payments returned for insufficient funds are subject to a $10 Non-Sufficient Funds fee.

XXI. MISCELLANEOUS

1. All uprates on new business or renewals will be billed directly to the insured.

2. Any policy which has been cancelled for non-payment of premium within the policy term, the

remaining balance must be paid in full to reinstate the policy.
