The petitioner prays that a writ ofQuo Warranto do issue directed tosaid George B. Norton enquiring bywnat autnority ne claims to noiu iuooffice of First Assistant Engineer ofthe Fire Department, and directinghim to file his answer within thetime limited by said writ: that upondue hearing the election for saidAssistant Engineer may be declaredillegal, null and void, and the saidNorton adjudged to : have usurpedsaid office and be ousted from thesame. etc.. etc.

Writ as follows:"Said defendant moves to quash

the writ issued in the above namedproceedings for the reason that thereis no authority of law for the issueof the same."

This matter has been very fullyargued by counsel on both sides, andshows that a great deal of work andresearch has been done by plaintiff'scounsel to sustain his position.

1 have given this matter very fulland careful consideration, and havecome to the conclusion that the casemust be decided and disposed of onthe first ground of demurrer, viz.:That the Board of Representativesof the said Fire Department are bylaw the judges of the validity ofelections of the officers of the Fire De-partment. .

The Act of 1888 relating to the FireDepartment of Honolulu is the lawunder wmcn tms ground r

comes.Section 4 reads: "The elections pro-vided for in Section 2 of this Actshall be conducted in such manneras the bye-law- s of ; the Departmentshall prescribe. In case there shallbe no election, or any office shall be-come vacant the Minister of the In-terior shall direct a new election."etc. etc. '

Section 10 provides that the Boardof Representatives shall have power"to hear and determine appeals fromdecisions of company matters andother appeals, and make rules andregulations in all matters of appeal."Also "to make all necessary rulesand regulations for the holding ofany election or elections under thisAct, to make rules, by-la- ws and reg-ulations for the Fire Department andfor carrying out the provisions ofthis Act."

These sections certainly give theFire Department full power todo " all things necessary for theholding, conducting, and determin-ing the result of elections, andmust of necessity include the powerto decide who is elected, where thereis any dispute. The Board of Repre-sentatives do not preside at the elec-tions. The secretary is chairman atthe election for engineers with twotellers to assist him at the polls.(Section 8, Bye-laws-.) It cannot becontended that his decision is final.If the chairman's decision is notsatisfactory, or there are irregulari-ties, or fraud in the voting, theremust be an appeal from him. Thequestion is to whom? It can onlybe to the Board of Representatives,for the Act provides that they shallhear and determine not only appealsfrom decisions, in company matters,but all other appeals, and make rulesand regulations in all matters of ap-peal. If it had been the intention ofthe Legislature to have only pro-vided for appeals in company mat-ters, they would not have made theseother sweeping provisions. It isclear to me the Legislature intendedto give and have given the Board ofRepresentatives full power-t-o act inall these matters. What can beclearer than the language used in thelatter part of Section 10? Viz.: " tomake all necessary rules and regula-tions for the holding of any electionor elections under this Act. to makerules, bye laws and regulations for.the Fire Department, and for carrv- -uiKuub me provisions oi wis Act.": One of the provisions of the Act isthat there shall be a chief engineerand two assistants, to be electedbiennially. Under Section4, in case of no election, the Ministerof Interior shall direct a new elec-tion." It "could not be saidthe' Minister of Interior could savthere was no election. Then who hasthe authority? It is clear to me thatthe Board of Representatives onlyhas that authority nnder the Act, andall appeals on election matters must

ernment and getting it to furnish agood share of the capital and assuming a considerable proportionof the risk. It is ridiculous that acoffee plantation could not bestarted here for want of a fewthousands of dollars from the Government.

The coming .Legislature nas asrreat task before it in further de- -

yeloping the resources of the country by costly works of a purelypublic nature, such as deepeningthe harbor. We want new roads,public parks, attractions for tour- -

ists, cable connections and a hundred other things which in spite ofthe need of them, we can not hopeto obtain lor some time to come.The capitalists of the country should

u lucii Duaio uj iuiaiuiu6the utmost energy private enterprise, and not look to the Government to start industries which theyare amply able to undertake alone.It is not too . much to ask of menwho have grown rich here to regard some part at least of theirwealth as a public trust and to return it to the country which hasenriched them, by spending it in away which will benefit that country, create new industries, widenits industrial opportunities, andafford a better and more variedmarket for labor. The capitalistsof the nation will not do their dutyby itr until they realize more fullythan most of them at present do,the responsibilities and obligationswhich the possession of wealthbrings with it.

This is a theme to which we havefrequently recurred, : and uponwhich we shall continue to descant,though it be to unlistening ears.

o'clock this morning, just as day wasbreaking, another alarm of fire wassounded. This time the location wasin the heart of the city, the fire hav.ing originated in the rear of thestore two doors above the Merchant'sExchange, on Nuuanu street. Thedepartment responded promptly, Engines Nos. 1 and 2 soon being at thespot. The first-name- d engine wasstationed at the corner of Nuuanuand King streets, and No. 2 betweenKing and Hotel streets, on Nuuanu.Both soon had powerful streams onthe fire.

As near as can be learned the fireoriginated in the rear of the store ofTom Gow, who carried on the drygoods business. It spread quicklyand the next store below, occupiedby Shuey Lun Co., as a- tailor shop,was soon enveloped in flames, whichshot up fiercely through the building. The fire, confined as it were tothe rear of the buildings, spread rapidly, but as soon as the firemen gottheir hoses on it was evident it wouldnot be long before they had the fireunder control. Within twenty-fiv- e

minutes after the alarm was giventhey had accomplished that object.The Merchant's .Exchange was dam-aged some, considerable glass beingbroken. Both -- Tom Gow and ShueyLun's stores were badly gutted.

The building is owned by L. Asea,of Kohala, and it is understood isinsured. Neither Tom Gow or ShueyLun had their stocks insured. FireMarshal "White" was making a tnorrough investigation when we went topress.

The brig Consuelo arrived at Ka- -hului from v ban rancisco, April28th. On the 24th. when about onehundred and twenty-fiv- e miles wind-ward of the islands, Capt. Robertsonsaw what he took to be a boat. Ongetting near, however, he found itwas a bell-buo- y, painted red andwhite, and the bell was ringingmerrily.
