The Council of the Township of East Zorra-Tavistock met in the Council Chambers at the Municipal Office, Hickson, Ontario at 7:00 p.m. on Wednesday May 20, 2015.

Members Present: Mayor Don MCKAY, Deputy Mayor Maureen RALPH and Councillors Mike CAMPBELL, Linda FULTON, Shirley MCCALL HANLON and Mike ROUTLY. Members Absent: Jeremy SMITH

Tavistock Firefighters – Pavilion Rental Request

3. Moved by: Maureen RALPH Seconded by: Linda FULTON Resolved that Council approve a grant equivalent to the Queens Park Pavilion rental fee for the Tavistock Firefighters Association Chicken BBQ Event. CARRIED.

County Council – Updates and Questions

CAO Jeff Carswell provided background and clarification regarding the “County of Oxford Information Network” (COIN).

Staff Report #PW2015–16 re: Line Painting - Five-Corners Intersection

Director of Public Works & Development Dennis O’Neil attended Council to discuss Staff Report #PW2015–16, which provides background to Council on the proposed line painting at the five - corners intersection in Tavistock.

Maria Street Parking Director of Public Works & Development Dennis O’Neil spoke to Council regarding the Maria Street parking area (near the Post Office).

By-laws: 1st & 2nd Reading

4. Moved by Maureen RALPH Seconded by Mike ROUTLY Resolved that the following by-law be read a first and second time: 2015-23 Budget and Tax Rates By-law

6. Moved by Mike CAMPBELL Seconded by Mike ROUTLY Resolved that Council does now adjourn to Committee of the Whole, in camera, at 7:34 p.m. to consider a matter pertaining to:

Personal matters about an identifiable individual, including municipal or local board employees;

The Security of the property of a municipality or local board;

A proposed or pending acquisition or disposition of land by the municipality or local board.

Council Reconvenes 7. Moved by Maureen RALPH Seconded by Linda FULTON Resolved that the Committee of the Whole does now rise and Council reconvenes at 7:55 p.m. CARRIED.

Land Disposition 8. Moved by Mike CAMPBELL Seconded by Shirley MCCALL HANLON Resolved that Council declare a portion of Stonegate Park abutting 226 Blandford Street, Innerkip, surplus to the needs of the Township and authorize the CAO to proceed with disposition as set out in report #CAO2015-27. CARRIED.

9. Moved by Linda FULTON Seconded by Mike ROUTLY Resolved that Council adopt the recommendations in staff report #CAO2015-028. CARRIED.

The Government of Ontario Process for Ministers’ and Parliamentary Assistants’ Delegations at the

AMO Combined Conference

Sunday August 16 – Tuesday August 18 Niagara Falls, Ontario

Individual Ministers and Parliamentary Assistants are being asked to participate in municipal delegations. Please note that not all Ministers and Parliamentary Assistants will be taking delegations. If your municipality wishes to meet with a Minister or Parliamentary Assistant, we ask that you complete and submit the online form. Please note all request forms must include the name of a contact person who is knowledgeable about the issue and available to respond to ministry inquiries in a timely manner. The Ministry of Municipal Affairs and Housing (MMAH) will respond to delegation requests for the Minister of Municipal Affairs and Housing. MMAH will advise other Ministers and Parliamentary Assistants of delegation requests and decisions on delegations will be made and given to you by the Ministers requested. To assist in expediting your delegation request, we ask that you use the Municipal Delegation Request Form rather than going through your MPP or directly to the Ministers’ Offices. In order to facilitate municipalities in planning their delegation schedules we will advise municipalities of their delegation times prior to the conference. As a result, no delegation requests will be accepted after the DEADLINE of MONDAY, July 06, 2015. Municipalities will be contacted by the respective Ministries about their requests and, if applicable, the meeting time and location, approximately one week before the Conference. To request a delegation meeting with a Minister, please include all the issues that you wish to discuss with that Minister on a single form. If you are requesting delegation meetings with more than one Minister, each meeting request should be made on a separate form. We ask that delegates not meet with more than one Minister on a given issue. To make the most of the delegation time available (delegations usually run 15 minutes), please ask to discuss your issue only with the Minister or Parliamentary Assistant responsible for that issue. Dear Mayor and Members of Council,

In the past three decades, passenger rail and intercity bus services have diminished in many Southwestern Ontario communities (please see the attached infographic). While the Ontario government supports GO Transit, High Speed Rail and Metrolinx projects, VIA Rail continues to struggle. Advocacy groups have begun to form in St. Marys, Sarnia and Stratford in response to reductions in VIA Rail service.

The Southwestern Ontario Transportation Alliance (SWOTA) has proposed a practical solution that combines passenger rail and bus services: the Network Southwest Action Plan. Now SWOTA needs our support so their message can be heard by all levels of government.

We invite you to join our coalition of municipalities in support of VIA Rail and Network Southwest, by passing the attached resolution.

Resolution in Support of VIA Rail

Whereas, reductions in VIA Rail service led to the formation of advocacy groups such as Save VIA (www.savevia.ca); and

Whereas, citizens of all ages and backgrounds, especially those with no license or vehicle, rely on VIA Rail; and

Whereas, passenger rail provides safer and more eco-friendly transportation than driving; and

Whereas, enhanced VIA Rail service heightens connections between communities, thereby promoting tourism and economic development; and

Whereas, the Southwestern Ontario Transportation Alliance, with the support of advocacy groups, businesses and municipalities in the region, has published the Network Southwest Action Plan to address the need for reliable and sustainable rail-based passenger transportation in Southwestern Ontario; and

Whereas, it is time for all levels of government to stop thinking passenger rail service is only a federal responsibility, and begin providing support for intercity transportation services in communities beyond the Greater Toronto and Hamilton Area (GTHA);

Now, therefore, I, Mayor of _______, do hereby proclaim that VIA Rail is important to my municipality; and urge my fellow citizens as well as all levels of government to consider the Network Southwest Action Plan as presented March 18, 2015 and available at www.swota.ca.

Bill 73: Amendments to the Development Charges Act and Planning Act

RECOMMENDATION

1. That the Director of Community and Strategic Planning provide the County ofOxford’s formal submission to the Ministry of Municipal Affairs and Housing inresponse to the Environmental Bill of Rights Registry posting 012-3651 for Bill 73 -“Smart Growth for Our Communities Act, 2015”, as outlined in ReportNo. CASPO 2015-114.

REPORT HIGHLIGHTS

In late 2013, the Province began a review of the Planning Act and Development Charges Act,1997. As a result of a review process that included feedback from the public and variousstakeholders (including the County of Oxford), the Province has posted Bill 73 “Smart GrowthFor Our Communities Act, 2015” to the Environmental Bill of Rights (EBR) for a 90-day publicreview and comment period.

The key proposed changes to the Planning Act include requiring upper tier municipalities toestablish a Planning Advisory Committee (PAC), additional public notification andconsultation requirements (e.g. inclusion of public consultation policies in Official Plans andproviding an explanation of the effect of public input, if any, on Council’s/Committee’sdecisions on planning applications), and requiring appellants to provide more detailedreasoning as part of an appeal to the Ontario Municipal Board (OMB). Further, the proposedchanges would allow Council to utilize various techniques to attempt to resolve disputes priorto forwarding an appeal to the OMB, and prohibit applications to amend an Official Planand/or Zoning By-law for a period of 2 years after a new comprehensive Official Plan and/orZoning By-law comes into effect. Applications for minor variance from the provisions of a sitespecific zoning amendment would also be prohibited for 2 years from the approval of theamendment.

Proposed changes to the Development Charges Act, 1997, include among other matters, theintroduction of waste diversion as an eligible service, service standard calculationamendments, relationship of development charges to Asset Management Plans andadditional requirements for the Annual Report of the Treasurer.

Implementation Points The proposed legislation “Bill 73, Smart Growth for Our Communities Act, 2015” has received first reading of the Legislative Assembly of Ontario. The Bill is subject to two more readings prior to Royal Assent when it will finally be enacted. At that time, the County and Area Municipalities will be required to comply with any revisions to the Planning Act and/or Development Charges Act that may result from this proposed legislation. Financial Impact The current consultation process will have no direct financial impacts and it would be premature to speculate on the potential financial impacts from any resulting amendments to the Planning Act or the Development Charges Act. The Treasurer was involved in the preparation of this report. Risks/Implications There are no risks or other implications anticipated from County involvement in the current consultation process. Strategic Plan County Council adopted the County of Oxford Strategic Plan in March 2013. The following strategic directions of the County would be affected by a number of the legislative amendments proposed by the Smart Growth for Our Communities Act, 2015 and related recommendations as contained in this report: 3. i. A County that Thinks Ahead and Wisely Shapes the Future – Influence federal and

provincial policy with implications for the County by: - Advocating for financial fairness for rural and small communities

iii. A County that Thinks Ahead and Wisely Shapes the Future – Apply social, financial and

environmental sustainability lenses to significant decisions by assessing options in regard to: - Life cycle costs and benefits/costs, including debt, tax and reserve levels and implications

4 i. A County that Informs and Engages – Better hardness the power of the community through

conversation and dialogue by: - Enhancing opportunities for public participation and a meaningful voice in civic affairs

DISCUSSION Background A province-wide review of the Planning Act and Development Charges Act occurred between October 2013 and January 2014, with the stated intent of determining whether the existing legislation was responsive to the changing needs of Ontario’s communities. Although many of the issues and concerns under consideration by the Province at that time pertained more to larger urban municipalities, Oxford County did submit comments with respect to the issues that were relevant to the County and the Area Municipalities within the County. These comments were contained in Planning Report No. 2014-01 which was considered by County Council on January 8, 2014. The comments included a number of suggested improvements and adjustments to both the Planning Act and the Development Charges Act.

As a result of the provincial review, the province tabled Bill 73, known as the “Smart Growth for Our Communities Act, 2015”, and posted it to the E.B.R. Registry on March 5, 2015 for a 90 day comment period. The deadline for submission of comments to the EBR is June 3, 2015. The draft legislation can be accessed on the Government of Ontario’s Environmental Registry at: http://www.ebr.gov.on.ca/ERS-WEB-External/displaynoticecontent.do?noticeId=MTI0NTU0 According to the EBR posting, the intent of the proposed changes to the Planning Act is to “give residents more say in how their communities grow, set out clearer rules for land use planning, give municipalities more independence to make local decisions and make it easier to resolve disputes.” The proposed changes to the Development Charges Act, 1997, are intended to “help municipalities recover more costs, enhance transparency and accountability, and support higher density development.” The following commentary section of this report is intended to serve as the basis for the County’s formal submission with respect to the current consultation on the Bill 73 draft legislation. Comments County staff have reviewed the draft version of Bill 73 (dated March 5, 2015) and have identified a number of comments with respect to the proposed changes to both the Planning Act and the Development Charges Act. These comments are outlined as follows: a) Proposed Amendments to the Planning Act A number of the County’s comments with respect to the initial Provincial consultation process appear to be reflected in the proposed legislative changes. These include requiring specific rationale to be provided as part of an Ontario Municipal Board (OMB) appeal, limiting OMB appeals with respect to municipal decisions that involve comprehensive updates to an Official Plan or are required solely to comply with specific direction established in Provincial legislation and/or plans, better coordinating of Provincial legislative and policy review processes to reduce the burden such reviews place on municipal resources, and providing municipalities with the flexibility to establish alternative public consultation measures that are responsive to social changes and evolving use of technology. Following is a summary of the key proposed changes to Planning Act and related staff comments: Planning Advisory Committees The draft legislation retains the option for local municipalities to appoint a Planning Advisory Committee (PAC). However, it would become mandatory for upper-tier municipalities (e.g. Oxford County) and single tier municipalities to appoint a PAC. The draft legislation also stipulates that all PACs (both mandatory and optional) would be required to include at least one member who is neither a member of a municipal council nor an employee of the municipality.

Currently, the Planning Act allows for any municipality (upper or lower tier) to appoint a PAC. Although PACs can play an important role in planning decision making, they also insert an additional step into the decision making process which may not be necessary or advisable in a particular municipal context and can impact the timeliness and cost of local planning processes. The Planning Act does not prescribe, or limit, the role or function of the PAC (e.g. can advise

Council on all planning matters or only those matters determined by Council). Therefore, it is difficult to determine what the intended objective or benefit of making PACs mandatory for upper tier municipalities would be. Further, it is unclear how adding the requirement for one member of the public to be on the PAC would enhance public engagement in any meaningful way.

The Planning Act already requires extensive public engagement and consultation, which it appears will only be further enhanced by various other changes being proposed through this legislation (e.g. establishing policies for public consultation and notification, indicating how public input was considered in planning decisions etc.). Municipalities are in the best position to determine whether the establishment of a PAC will improve public engagement and/or benefit local decision making in their particular context and what the scope, role and membership of the PAC should be. As such, it is unclear why the Province would specifically mandate the establishment of this additional administrative body for upper tier and single tier municipalities.

As there does not appear to be any clear rationale or benefit for making a PAC mandatory for upper tier and single tier municipalities, it is recommended that the Province remove the mandatory PAC requirement for upper tier municipalities so that local discretion and autonomy on such decisions is maintained.

Official Plan Reviews A number of changes have been made to the sections that deal with Official Plan (OP) reviews, some of which appear to address comments made by the County in response to the previous Planning Act consultation process.

The review interval for OPs would be increased from 5 years to 10 years for the first review

after the plan comes into effect and 5 year intervals thereafter. This proposed change reflects a similar extension to the review interval proposed for the Provincial Policy Statement (PPS). Further, an existing requirement to review OP policies dealing with employment lands as part of each 5 year review is to be removed. As part of the previous Provincial review process, many smaller municipalities indicated that OP reviews place considerable pressure on municipal staff and other resources and often extend well beyond the 5 year time frame. This can place municipalities in a constant state of review, potentially at the expense of other important planning initiatives. The proposed 10-year review cycle may provide for a better balance between ensuring the stability of planning documents, while still ensuring such documents are regularly updated to reflect changes in legislation, policies and trends. However, staff question the rationale for extending the review cycle for the first review of an official plan from 5 years to 10 years, but then requiring subsequent reviews to be undertaken at 5 year intervals. Given that the review interval for the PPS is to be extended from 5 years to 10 years (Note: the previous PPS took 9 years to update) and that the primary purpose of mandatory official plan reviews is to allow the Province to ensure consistency of the OP with provincial legislation and policy, it would seem logical to also extend the interval to 10-years for all OP reviews. Municipalities would still have the option of reviewing all or parts of their OP earlier than the 10-year timeframe if they deemed it to be necessary or advisable, such reviews just wouldn’t be subject to Provincial approval. If the review interval for the PPS is to be increased to 10 years, planning staff would recommend that the Province also increase the review interval for OPs to 10 years for both the first and subsequent reviews. Planning staff support removal of the requirement to specifically review the policies pertaining to employment lands as part of an OP review as such direction does not need to be mandated by legislation.

Ontario Municipal Board Appeals A number of changes have been made to the sections that deal with appeals to the Ontario Municipal Board (OMB), some of which appear to be an attempt to address suggestions made by the County and others in response to the previous Planning Act consultation process.

Appellants who intend to argue to the OMB that a decision is inconsistent with the PPS,

provincial plans and/or the Official Plan must explain how such decision is inconsistent with such documents in their notice of appeal. If the appellant fails to do so, the OMB may dismiss all or part of the appeal without a hearing.

Planning staff generally support this change as it should help to eliminate ‘generic’ or ‘frivolous/vexatious’ type appeals by ensuring there is additional onus on an appellant to establish the specific land use planning basis for their appeal at the time it is filed. Under the current process, an appeal may be submitted with ‘generic’ planning reasons just to get a ‘foot in the door’ and allow the appellant to come up with their specific planning grounds at the time of the OMB hearing. Given the considerable staff time and financial resources involved in preparing for an OMB hearing, it seems reasonable to expect an appellant to identify the specific planning basis for their appeal before a hearing will be considered by the OMB. It is hoped that this change in the legislation will assist in reducing the costs and time associated with OMB appeals by ensuring they are clearly based on and limited to specific planning grounds.

Global appeals of new official plans (e.g. appeal of ‘all of the decision of Council to adopt all

of the Plan’) and appeals of certain Official Plan amendments (e.g. the identification of the boundary of a ‘vulnerable area’ from a Source Protection Plan) would no longer be permitted.

Planning staff generally support the concept of limitations on ‘global appeals’ for reasons similar to those provided with respect to ‘generic’ notices of appeal. Planning staff also generally support the concept of limiting appeals of amendments that are required to implement policies mandated by Provincial legislation or Plans, where identified in the Planning Act. However, the Province should consider adding a provision to allow for additional appeal restriction, as prescribed, to provide the flexibility to add further appeal exemptions in the future, through regulation. This would allow for further and/or ongoing consultation with municipalities to determine if additional appeal restrictions may be warranted.

New provisions would allow Council to use mediation, conciliation or other dispute resolution

techniques to attempt to resolve appeals, prior to the OMB convening a formal hearing. Current legislation (OMB Act) enables only the OMB to use such techniques, not Council. If Council decides to utilize such techniques, then the requirement to forward the appeal package(s) to the OMB is extended to 75 days (from 15 days) after the 20-day appeal period closes. In theory, if such local approaches to dispute resolution are successful, the time and costs involved in resolving a dispute could be less than for a full OMB hearing. However, the participation of appellants in such processes is voluntary and they do not provide any guarantee of resolution. Further, such processes may still involve considerable staff time and other professional/legal services to undertake properly and ensure they are ‘without prejudice’. Although Planning staff generally support the concept of local dispute resolution, without an understanding of all the potential implementation and legal considerations, it is difficult to

determine whether such processes will be of benefit to municipalities and, if so, under what circumstances. Therefore, it is recommended that the Province provide additional clarification as to how such local techniques would be implemented, so that municipalities can better assess the potential benefits and identify any additional matters that the Province may need to consider, prior to approval of the legislation.

Official Plan & Zoning By-Laws

A number of the proposed revisions to the Planning Act are intended to limit appeals on ‘new’ Official Plans and Zoning By-laws.

During the two-year period following the date of adoption of a ‘new’ official plan or the global

replacement of a municipality’s zoning by-laws, no applications for amendment are permitted. The specific intent of these proposed amendments is not clear. For instance, the MMAH backgrounder on Bill 73, dated March 5, 2015, states that, once a municipality establishes a new official plan, it would be frozen and therefore not subject to new amendments for two years unless changes are initiated by the municipality, while the proposed legislation states that ‘no person or public body shall request an amendment...’. Under the Planning Act public body includes a municipality. Therefore, the wording of the proposed legislation appears to indicate that no amendments to such documents, including those by a municipality, would be permitted within the two years following their approval.

Presumably, the intent is to ensure policies and provisions that have recently been established by a municipality through a comprehensive review and public consultation process are provided some degree of certainty/stability (e.g. to prevent submission of an amendment to allow for a development that is not consistent with the intent and purpose of such policies or provisions immediately following their enactment). This ‘stability’ period, would allow Council (and staff) to begin monitoring the effect of new policies or provisions without having to deal with new amendment applications that may challenge the new policy framework or zoning provisions. It would also provide some assurance to the public and other stakeholders who invested their time and effort in the comprehensive review processes that the policies and provisions that they helped to develop are legitimate and will be implemented.

To date, the ‘stability’ of new Official Plan policies and Zoning provisions has not been a particular concern in Oxford, as it has in some larger urban municipalities. Of greater concern to Oxford, is impact that the proposed 2 year restriction on amendments would have on a municipalities ability to undertake amendments to their own documents. For instance, often a number of ‘housekeeping’ type amendments are identified following the approval of new planning documents and important development opportunities may arise that were not anticipated at the time the planning documents were approved and would require a site specific amendment to accommodate. Therefore, staff would recommend that the Province be requested to clarify the intent of these provisions and, in particular, the definition of ‘new’ and whether municipalities would also be prohibited from amending their own documents during this 2 year period. It would seem that the intent of these changes would be better achieved by simply adding a provision that would prohibit the appeal of a Council decision to deny an application to amend such documents during the 2 year period following their approval.

Minor Variances A number of the proposed revisions to the Planning Act would affect the provisions relating to minor variances, these changes are summarized as follows. During the two year period following approval of an owner initiated site-specific rezoning,

applications for minor variances are permitted only where approved through a resolution of council.

The intent of this change is not clear and seems to be an unnecessary complication of the planning process without any perceived gain. In the Oxford context, such a change would simply result in delays in the processing of Minor Variance applications following a site specific zoning approval. As such, Planning staff would recommend that this proposed revision be removed, or revised so that municipalities are given the option of implementing such provisions, if they deem them to be necessary or advisable.

A new provision stating that a Committee of Adjustment “shall authorize a minor variance …

only if the variance conforms with prescribed criteria, if any,” in addition to minor variance tests currently referenced in subsection 45(1) of the Planning Act. Again, the intent and rationale for this proposed change is not clear. In Oxford, comprehensive planning reports are prepared for the Area Municipal Committees of Adjustment and Land Division Committee to assist them in determining whether a particular minor variance meets the required tests set out in the Planning Act. Planning staff are not aware of any concerns or issues with the current review process or Planning Act tests that would benefit from additional ‘prescribed criteria’. Further, the Province has not provided any indication as to what such criteria may entail, therefore, it is difficult to determine if this proposed change would be beneficial or detrimental to local discretion and decision making. As such, Planning staff would recommend that the Province be requested to provide further rationale and draft regulations for municipal review and comment prior to incorporating any such changes into the Planning Act

Public Consultation A number of the proposed changes to the Planning Act appear to be intended to improve communication with and engagement of the public on planning related matters. These changes are summarized as follows: A new mandatory requirement to include descriptions of measures and procedures for

informing and obtaining the views of the public with respect to certain planning matters in Official Plan policy (e.g. Official Plan amendments/revisions, zoning by-laws, plans of subdivision, consents and ‘other matters as may be prescribed’). Municipalities will also have the option of including a description of measures and procedures in the Official Plan for obtaining the views of the public on other planning matters. The proposed changes would allow for alternative public notification measures (e.g. notification period, form of notice etc.) to be established for plans of subdivision and consents, similar to the alternative notification requirements already established in the County Official Plan for Official Plan and Zoning By-law Amendments.

As part of the previous consultation process, Oxford County had suggested that the Province consider changes to the Planning Act to allow municipalities to keep pace with societal changes and the evolving use of technology by establishing alternative approaches for public notification and consultation on planning matters in their Official Plan policies. Oxford’s Official Plan already includes policies that address public participation measures

and procedures and alternative notification procedures for Official Plan and Zoning By-Law amendments, however, these policies would benefit from review and revision if these proposed legislative changes come into effect.

Planning staff support the changes to the Planning Act to allow municipalities to establish alternative public notification procedures for a broader range of applications in their Official Plan policies. Planning staff also support establishment of Official Plan policies to identify local measures and procedures to inform and obtain the views of the public with respect to various other planning matters. However, these Planning Act provisions should simply enable, rather than mandate, such policies so that municipal discretion and autonomy on such matters is maintained. Further, the Province should be requested to provided an indication of what ‘such other matters as may be prescribed’ is intended to capture (e.g. is it just to provide flexibility for the Province to establish additional OP requirements in the future or does the Province already have additional measures in mind that they intend to establish by regulation).

All notices of decision with respect to Planning Act applications would require inclusion of a

brief explanation of the effect, if any, that written and oral submissions (made at the public meeting) had on council’s/committee’s decision. This proposed change will require additional time and effort by the County and Area Municipalities to ensure that their Notices of Decision on planning applications include such an explanation. This may require the taking of more detailed minutes of public meetings to accurately capture the nature of any oral submissions and subsequent Council/committee deliberations.

In Oxford written submissions received with respect to an application in advance of the public meeting are typically included in the associated planning report to Council and, if they have an impact on the planning recommendation, are specifically addressed in the report. With respect to oral submissions, current practice in Oxford is typically for Council/committee to defer their decision on the application if it is determined that oral submissions at the public meeting may have an impact on their decision and can’t simply be addressed through the conditions of approval. While it is recognized that this proposed amendment is intended to enhance public accountability, doing so may result in delays to the current planning review and approval process (e.g. increasing the time to issue notices of decision and/or more decisions being deferred).

Although planning staff do not oppose the concept of such accountability measures, it is unlikely that the proposed changes will result in any substantive improvements in public accountability in Oxford for the above noted reasons. Further, it should be recognized that this change will result in additional administrative process for both the County and Area Municipalities on every Planning Act application.

Planning staff recommend that the Province be requested to provide further direction on the content and expected level of detail that would need to be included in explanation in the notice of decision. This information would allow municipalities to better assess the potential impacts of this proposed change and provide a more informed response.

Parkland and Increased Height/Density Provisions

Before a municipality adopts official plan policies allowing it to pass by-laws under

subsection 42 (3) (alternative parkland dedication requirement), it must first have a parks plan that examines the need for parkland in the municipality. Oxford’s current Official Plan policies enable the alternative parkland requirement. However, the alternative requirement is not often utilized as it typically only exceeds the standard Planning Act parkland dedication requirement (e.g. 5% of land area) in the case of higher density residential development sites. With the proposed changes, a municipality would be required to have a parks plan in place if they wished to enable the alternative parkland requirement through Official Plan policy and it would require even higher density residential development before the alternative requirement would be advantageous for a municipality to utilize.

Planning staff do not have any specific concerns with respect to these proposed changes other than to request that the Province provide the rationale for these changes and, in particular, to the parkland-to-dwelling unit ratio. This would allow municipalities to better assess the potential impacts of these changes and provide more informed comments and responses.

Money collected under a Section 37 by-law (Height and/or Density Bonus) must be held in a

special account exclusively for the purposes for which the money was collected, similar to what is currently required for cash-in-lieu of Parkland. Further, the Treasurer would be required to provide an annual financial statement to Council relating to these special accounts (e.g. opening and closing balances, the facilities and services on which any money was spent etc.) and ensure it is made available to the public.

Planning staff have no specific comments or concerns with respect to these proposed changes. However, it should be noted that the changes would be place additional administrative responsibilities on municipal Treasurers with respect to managing related funds and preparing the annual report to Council.

Other Proposed Changes There are a number of other proposed changes to the Planning Act that are not specifically related to any of the above noted topic areas, these are outlined as follows: A new requirement that municipalities provide the Minister of Municipal Affairs and Housing

with a 90 day notice before adopting new Official Plan. This additional notice period will delay the adoption of a new Official Plan, after it is ready to be considered by Council, by adding 3 months to the review period. The intent and rationale for this proposed change has not been provided. Planning staff would recommend that Province provide adequate justification as to the need for this additional notice period, to ensure it is not simply introducing unnecessary delay into the Official Plan approval process.

The review period for Official Plan amendments may be extended from 180 days to 270 days if specific criteria are met. Planning staff have no specific concerns with this proposed change, but would request additional clarification as to the rationale for the change, as it is unclear why it would be unique to Official Plan amendment applications.

For municipalities with upper tier and lower tier Official Plans, the right to appeal a lower-tier OPA would be removed in the case where the upper-tier approval authority deems the lower tier Official Plan to be non-conforming with the upper tier Official Plan policies. Further, the upper tier approval authority would be prohibited from approving lower-tier Official Plans that

do not conform with upper-tier Official Plans and allows the upper-tier to modify any non-conforming lower tier Official Plan policies to ensure conformity. Planning staff have no specific comments with respect to these proposed changes, as they do not apply in Oxford given that there are no lower tier Official Plans.

A number of other “minor” changes to the Act that mostly involve changing section references caused by other changes to the respective Acts. Planning Staff have no specific comments or concerns with respect to these changes

It should be noted that certain Official Plan policies and County and Area Municipal procedures with respect to development application review and processing would be affected by the proposed changes to the Planning Act. Therefore, once the proposed amendments and related regulations have been enacted by the Province, the County and/or Area Municipalities will need to review any impacted Official Plan policies and administrative procedures to determine what, if any, new policies or procedural amendments may be required. b) Proposed Amendments to the Development Charges Act Following is a brief summary of the proposed changes to the Development Charges Act and proposed responses with respect to their effective impact on the County of Oxford. New Definitions “Prescribed” – a reference to what may be contained in the Regulation “Regulations” – used to specifically refer to regulations under the DCA Ineligible Services Removed definition of ineligible services from DCA - moved to the regulations for ease of

amending this list of services Transit Service Removed 10% mandatory deduction from the growth-related costs More detailed supporting studies to define growth need and benefits will be required – i.e.

transportation master plans Waste Diversion Would become an eligible service for recovering capital costs for waste diversion May require background studies to clarify service standards and relationship to growth Does not include landfill or incineration Service Standard Calculations For a prescribed service, the estimate for the increase in the need shall not exceed the

planned level of service over the 10-year period immediately following the background study Methodology for determining the planned level of service will be set out in the regulations Voluntary Payments New provisions to prohibit municipalities from imposing voluntary payments for requiring

Conclusions With respect to the proposed changes to the Planning Act, a number of concerns have been identified by County staff that they are recommending the Province be requested to address, prior to final approval of the legislation. The focus of the comments is on providing the specific Provincial rationale for the various changes, maintaining municipal discretion and autonomy with respect to various implementation measures (e.g. PACs, public consultation and notification and limitations on Official Plan and/or Zoning amendment and minor variances) and releasing draft regulations for review for any matters to be prescribed (e.g. additional criteria for minor variances). With respect to the proposed changes to the Development Charges Act, based on the information provided to date, the proposed changes that are most likely to have an impact on, or to be considered in, the County’s development charge program include: introduction of waste diversion as an eligible service; service standard calculation amendments; relationship with the County’s Asset Management Plan; and, the Annual Report of the Treasurer. This statement is qualified by the fact that the details are yet to be set out by regulations. County staff will continue to monitor the progress of the proposed legislation and will advise County Council of any relevant changes and/or opportunities for comment on matters that may be of particular interest or concern to the County. ZONING BY-LAW: Existing Zoning: Special Residential Zone 1 (R1-14, R1-15, R1-16) &

Open Space (OS) PROPOSAL: An application has been submitted seeking to extend the conditions of the draft approved plan of subdivision SB 10-05-2 for a minimum of two (2) years. The existing draft approved plan, which is commonly referred to as the Pond’s Subdivision, was originally draft approved in May 2012. The plan of subdivision comprises 75 lots for single-detached dwellings, 2 blocks for storm water management and an open space/wetland block as well as a number of reserve blocks. The first phase has been registered providing a number of single detached dwellings and a storm water management pond. For Council’s information, the above-noted plan of subdivision was scheduled to lapse prior to the matter being considered by Township Council. The County of Oxford granted the applicant an interim extension to June 30, 2015 to ensure that the draft plan does not lapse prior to the Township’s consideration of extending the plan. Plate 1, Existing Zoning and Location Map, shows the location of the subject lands affected by the original draft plan of subdivision as well as the zoning in the immediate vicinity. Plate 2, Applicant’s Sketch, illustrates the extent of the lands that remain as part of the draft approved plan of subdivision and the lands that have been registered since 2012. Comments AGENCY REVIEW: The development proposal was circulated to various agencies considered to have an interest in the proposal. The Township of East Zorra-Tavistock staff and County of Oxford Public Works Department indicated that they had no objections or concerns with the proposal. Planning Analysis County Council granted draft plan approval to a residential plan of subdivision on the subject property in May 2012. The first phase within the subdivision has been registered as shown on Plate 2. This is the applicant’s first request for draft approval extension. Given the size of the subdivision and current market demands, the applicant has requested an extension of a minimum of two (2) years to, in part, minimize the number of future extensions as they work towards registering and developing the area that is within the draft approved plan of subdivision. In light of this request, Planning staff note that two (2) year extensions are typically granted to ensure that the applicant is actively working towards registration of the approved plan as well as

A resolution from Township Council in support of the owner’s request is necessary in order for the County to grant an extension of the draft approval. RECOMMENDATION It is recommended that the Council of the Township of East Zorra-Tavistock advise Oxford County that the Township supports a 2-year extension to the draft approval of the Ponds Subdivision (SB 10-05-2), for lands described as Part of Lots 21 & 22, Concession 6 (South Easthope), Part Lot 64, North of Hope Street and West of William Street, Plan 307 and Part of Block A, Registered Plan M-70, Township of East Zorra-Tavistock to June 3, 2017. To: His Worship the Mayor and Members of Council From: Will Jaques, Corporate Services Manager Subject: New amendments to the Smoke Free Ontario Act (SFOA) Date: May 28, 2015

Background:

The Smoke-Free Ontario Act came into force on May 31, 2006. In the almost 10 years since that time, the Act has already banned:

Smoking in restaurants and bars; Smoking in or on school property; Smoking in private clubs, sports arenas and entertainment venues; Smoking in the common areas of apartments and other multi-unit

housing; Smoking in workplaces and work vehicles; Smoking or holding lit tobacco in a vehicle carrying children under

the age of 16; The displays of tobacco products in retail outlets; The sale or supply of tobacco products to anyone under 19.

Now, effective January 1, 2015, the Act has further expanded to ban:

1) Smoking on and within 20 metres of children’s playgrounds. This

includes slides, swings, climbing apparatuses, splash pads, wading pools, and sand boxes open to the public, whether or not there is a fee attached.

2) Smoking on sports fields, in spectator areas and a 20 metre area around these. Sports fields include soccer, baseball, basketball, tennis, etc. However, the new legislation does not apply to golf courses. Further, this applies to spaces:

o Owned by the province, a municipality, colleges and universities. o Open to the public, whether or not a fee is charged to enter.

3) Smoking on bar or restaurant patios, whether covered or not. A restaurant or bar patio is defined as an area:

o Where the public is permitted access, or the area is frequented by employees during the course of their employment or not;

o Food or drink is offered for sale or for consumption; o That is not a private dwelling.

4) Cigarette sales on university and college campuses.

Under the legislation, the Township, as property owner/operator, is required to ensure for our own facilities that:

Notice is given to the public that smoking is not allowed in smoke-free areas;

“No smoking” signs are posted at entrances and exits to the smoke-free areas, in all other appropriate locations, and in sufficient numbers to ensure that the public is aware that smoking is not allowed;

No ash trays or similar items remain in smoke free areas People do not smoke in the smoke-free areas; Someone who refuses to comply with Ontario’s smoking laws does

not remain in a smoke-free area. Enforcement of the Smoke Free Ontario Act, including these most recent amendments, is completed in Oxford County by the Public Health Department. Public Health’s role includes such things as:

Ensuring that all mandatory signs are posted and visible; Determining what promotional tobacco material is acceptable; Ensuring that public places and other appropriate properties and

facilities, remain smoke-free; Take appropriate legal actions against anyone violating the Smoke-

Free Ontario Act.

An individual who contravenes the legislation may be charged with an offence and upon conviction, could be subject to a maximum fine of $1,000 (for a first offence) or $5,000 (for any subsequent offence). However, an owner, operator or manager of a property, facility etc. that fails to comply with their obligations under the Smoke Free Ontario Act may be charged, and if convicted, could be subject to the following maximum fines:

For individuals: $1,000 (for a first offence) or $5,000 (for any further offence);

For corporations: $100,000 (for a first offence) or $300,000 (for any further offence).

Discussion: It is impossible to deny that the Smoke-Free Ontario Act and its various amendments over the past 10 years have allowed the 75–80% of the population that does not smoke the opportunity to have a better quality of life. As we are advised that there is no safe level of second-hand smoke, many will certainly welcome these most recent amendments as it will allow them to better enjoy outdoor spaces, which would have previously allowed for smoking. At the same time, these amendments will bring about additional challenges for municipalities. For East Zorra-Tavistock, while it is true in one sense that the Township has a ‘Smoking By-law’ (#2012-15) already in place to enforce smoking on, around and within various indoor and outdoor facilities, there remains some key distinctions between this by-law and these most recent amendments, which will lead to some major changes within the Township’s parks. In particular:

1) By-law #2012-15 speaks to the required setback distance for smoking being 9 metres (approximately 30 feet) from playgrounds, sportsfields etc. The new legislative amendments now speak to a setback of 20 metres (66 feet), which is over double the distance in the by-law. As an example, for both the Hickson and Innerkip parks, there are now few areas on the entire property where smoking could in fact be permitted, other than ‘potentially’ some areas of the respective parking lots;

2) While By-law #2012-15 does not permit smoking under, or within 9 metres of a covered outdoor facility (ie a Pavilion), the by-law is silent in terms of smoking within an uncovered outdoor patio (ie outdoor fenced-in licensed area). With the new legislative amendments, these areas are considered to be “bar/restaurant patios” and as such, no smoking will be permitted within them. Given the current liquor licensing laws and best practices, it would appear that these recent amendments to the Provincial smoking legislation took little consideration of these requirements that have been developed and will now lead to the following challenges:

a. For event organizers, controlling smoking on their premises, especially after nightfall, could be a daunting task. Again, keep in mind that property owners, event organizers etc. have a role in ensuring smoking is not occurring on or within their premises;

b. Allowing patrons to exit and re-enter an outdoor licensed area

throughout an event (again, especially after nightfall) could be a huge challenge for event organizers. As there can be no designated smoking area that is operated in conjunction with an area in which food or drink is served, with patrons coming and going from the licensed area throughout an event, it will become much more difficult to control ‘extra-curricular activities’ occurring outside the licensed area (which, can also ultimately affect behaviour within the licensed area). This can certainly lead to additional liability for event organizers as they attempt to gain as much control as they can over their event, as well as for the Township, as owner of the property.

Regardless, event organizers have a duty and an obligation to monitor and have control over their licensed alcohol events, as they have always had in the past. As such, whatever resources are necessary (ie additional event personnel, licensed security, paid duty police officers etc.) to monitor and control the event, will be required. While the Alcohol and Gaming Commission of Ontario (AGCO) have always considered ‘fringe areas’ to a licensed event (ie parking lots, just off the property hosting the event etc.) to be related to the event itself, now, as patrons would be allowed to come and go from these areas throughout an event, required monitoring and control will now absolutely include these areas. The additional resources to monitor and control an event will have financial implications for event organizers, and may ultimately take away from the success of the event. Alternatively, having a policy of no re-entry to avoid some of these potential challenges is certainly an option, but it may also lead to a drop in event attendance (which may also take away from the overall success of the event).

3) Without a doubt, the largest challenge with the recent amendments

will be the interpretation of the new legislation related to smoking at public events. For Council’s benefit, I have provided the amendments directly from the legislation that pertain to bar/restaurant patios:

Restaurant and Bar Patios:

13. (1) Restaurant and bar patios are prescribed areas for the purposes of paragraph 7 of subsection 9 (2) of the

Act. O. Reg. 206/14, s. 2.

(2) Subject to subsection (3), a restaurant or bar patio is an area that is not an enclosed public place or an enclosed

workplace and that meets all the criteria set out in the following paragraphs:

1. The public is ordinarily invited or permitted access

to the area, either expressly or by implication, whether or not a fee is charged for entry, or the area

is worked in or frequented by employees during the course of their employment, whether or not they are

acting in the course of their employment at the time.

2. Food or drink is served or sold or offered for

consumption in the area, or the area is part of or operated in conjunction with an area where food or

drink is served or sold or offered.

3. The area is not primarily a private dwelling. O. Reg. 206/14, s. 2.

(3) With respect to a branch of the Royal Canadian Legion

that immediately before November 18, 2013 operated an area that would otherwise be a restaurant or bar patio as

described in subsection (2), a restaurant or bar patio is,

(a) that area, if any, that was a “covered or partially

covered restaurant or bar patio” within the meaning of this Regulation as it read at that time; and

(b) any area that the branch commenced to operate

on or after that date that is a restaurant or bar patio as described in subsection (2). O. Reg. 206/14, s. 2.

The major challenge is coming with the interpretation of clause 13(2).2 (above), which states that smoking is not permitted where:

“Food or drink is served or sold or offered for

consumption in the area, or the area is part of or operated

in conjunction with an area where food or drink is served or sold or offered.”

The part of the above clause which states, “…or the area is part of

or operated in conjunction with an area where food or drink is served or sold or offered…” is being interpreted by Health Units in the Province (including Oxford Public Health), to mean that it is actually now illegal to:

“Smoke tobacco or hold lighted tobacco at any part of the fair, festival or special/community event where food or

beverage is served, offered for sale, or offered for consumption.”

While designated smoking areas could be an option for some properties in other municipalities where these events are hosted, the layout for most of East Zorra-Tavistock’s parks will not cater to this opportunity. As such, regardless of the 20 metre setback distances from playgrounds, sportsfields etc. already built into the new legislative amendments, basically, no smoking will be permitted on Township lands/property hosting a fair, festival or special/community event, sporting event etc. that is serving food/beverage. Using the outdoor fenced-in licensed area again, as an example, this means that not only would a patron need to leave the licensed area to smoke, they would actually now need to leave the entire property. While it is entirely understood that “legality vs. reality” will certainly be in effect, again, as property owner, the Township cannot show any sign of encouraging this type of behaviour and is obligated to do everything that it can to keep smoking from occurring on its property, in order to avoid serious potential fines.

Given the confusion that the new “20 metre rule” vs. the “no smoking at all if there is food/beverage being sold/served/consumed rule” will cause for everyone involved, it certainly begs the question as to whether smoking just should simply be banned at all times on Township owned recreational lands. However, as the new legislative amendments fall short of requiring this, it would be entirely the responsibility of the Township to implement and enforce such a requirement, if brought about under by-law.

Over the next little while, Staff’s approach to the legislation will continue as

follows:

1) Add a link regarding the new legislative amendments from Public Health’s section of the Oxford County website, to the Township’s website: http://www.oxfordcounty.ca/Smoking/Smoke-Free-Ontario/New-rules-for-2015

2) Ensure all new required signage is installed in all appropriate locations; 3) Ensure local recreation committees, primary facility users, and event

organizers (where possible) are aware of the legislation. The primary purpose of this report has been to bring to Council’s attention the new amendments to the Provincial smoking legislation, including Staff’s

perspective on some of the perceived challenges with the amendments. However, it is important with such issues to also hear from those directly involved in interpreting and enforcing the legislation. As such, Public Health has been invited to the June 3, 2015, meeting to also review and discuss the legislation with Council. Questions from Council can also be directed to Public Health representatives at that time. Attachments:

CAO comments continued: Under our parks and recreation system, especially for Hickson and Innerkip where there is limited staff involvement related to the events taking place, there are significant challenges. We are reluctant to push this responsibility to the volunteer recreation committees and in many cases the events are run by the volunteer groups. This is just another regulatory burden being shifted to municipalities. Over recent years the insurance industry, AGCO, Police and others have shifted responsibility to the property owner (municipality) to maintain tight controls and responsibility for activity taking place on their property. This is just another regulation that threatens our current system of very limited staff involvement with park operations in Hickson and Innerkip. While staff have attempted become more involved with respect to some facility maintenance and inspection activities, involvement with event activities will be much more challenging. While each regulatory item (smoking, liquor licence, risk/liability, contracts/agreements) on their own are not overly significant, when compounded, they begin to cause significant challenges and potential exposure to the Township in this area.

Tree planting is complete. Tree removal should begin in mid-May. Stump grinding and cleanup is

tentatively scheduled for mid-June. Bridge washing is 50% completed and should be completed within the

next week. Street sweeping is complete. A second sweeping will be done in

Tavistock prior to the Fair and Tavistock and Innerkip will be done later in the year, after leaves fall.

Catch basin cleaning will be done in Tavistock and Innerkip in June or July depending on possible Larvacide treatments being done by Oxford County Board of Health.

Weather conditions have been favourable for road maintenance to date, and Calcium applications are currently working very well. A long, dry summer could cause dusting issues late in the year as applications were done a bit earlier than past years.

Gravel resurfacing is complete and roads have been graded with dust suppressant applied.

June projects will include guiderail installation on Braemar Side Road, some cleanup from storm washouts, ditch work, grass cutting and clean up from tree removals and stumping. Other normal day to day maintenance activities will be completed as well.

Completion of the work agreed to at the Kirby residence will also be a priority for the month of June. This work consists of the installation of a catch basin and some grading in front of the garage.

Government of Ontario to Launch Consultations on Infrastructure Priorities Last year, the Government of Ontario pledged to invest $130 billion over 10 years in public infrastructure under Building Ontario Up. A significant amount of that total investment, $31.5 billion, is allocated to Moving Ontario Forward, Ontario’s plan to improve public transit, transportation, and other priority infrastructure projects. Of that $31.5 billion, the government has allocated $15 billion for regions outside the Greater Toronto and Hamilton Area (GTHA). Earlier this week, the government announced that it will be launching consultations to inform the design of new infrastructure programs and a framework to prioritize needs for communities and regions outside the GTHA. For more information on this process, a discussion guide has been released. It can be found here. The deadline to submit feedback is September 18th, 2015. The government has also indicated that additional opportunities to provide advice will be available through regional roundtable meetings that will be held across the province in June and July. Feedback can be submitted online or in writing. Ontario Good Roads Association encourages all of its members outside the GTHA to participate in these consultations so the Province has the most accurate information when making decisions related to infrastructure investments. The mandate of the Ontario Good Roads Association is to represent the transportation and public works interests of municipalities through advocacy, consultation, training and the delivery of identified services.

To: His Worship the Mayor and Members of Council From: John Scherer, Chief Building Official Re: Innerkip Seniors Apartment - Permit Fees Date: May 27, 2015 Background: Grace Breen has submitted a letter on behalf of Innerkip Seniors Apartments Inc. requesting the Township waive fees and deposits associated with the proposed addition to the apartment building located at 30 Balsam Street in Innerkip. These fees include Building Permit Fees, Deposits, Site Security Fees and Site Plan Agreement Fees. Information:

Section 7.(1) of the Building Code Act (BCA) states Council has the authority to set Building Permit Fees. Section 7.(2) states fees must not exceed the anticipated reasonable costs to enforce the Act. Fees collected under the Township Building Bylaw should cover the direct and indirect costs required to enforce the BCA. Under Section 7.(6) of the BCA, if the Principal Authority wants to change any fee the Principal Authority would be required to serve public notice and schedule a public meeting as required by the BCA. As an alternative to the above, the Township can provide a grant to cover a portion of the entire cost of the required fees.

Discussion:

User fees collected by a municipality help to offset the cost of service delivery. Building departments attempt to fully cover costs associated with the enforcement of the BCA. While the Building Permit fee (approximately $11,000.00) may seem high, staff would expect to collectively spend 130 or more total hours on this project. **The chart above captures actual staff time and overhead, but does not include indirect costs such as Gas, Fleet wear, E&O insurance etc.

As an example of fees associated with a project similar in size and ‘difficulty’, the renovation and expansion of the former Tavistock library was charged a building permit fee of $9,883.80. When reviewing the time spent on site by Fire and Building, approximately 40 Hours of staff time was used. Other areas of staff involvement fall in line with the approximate hours in the table above. Waiving or subsidizing development fees is usually geared to larger municipalities who are wanting to redevelop downtown cores and other areas of concern. Projects outside of these areas would not receive these subsidies regardless of profit status. Deposits are taken to ensure a project is completed and generally meets approved plans and specifications at the time of permit issuance. The deposits can be used to enforce a certain aspect of the Building Code or can be used to repair/finish an item on Township property. Not having access to these deposits would mean the Township may be out of pocket if the need arises to repair or enforce an item. Deposits are also taken to ensure construction is fully completed with no major or minor deficiencies.

In recent years, the County of Oxford was denied a fee reduction for a project within East Zorra – Tavistock and numerous other “Geared to Income” projects did not receive fee reductions. Ultimately, not collecting anticipated building permit fees could result in a shortfall in Township Revenue. Recommendation:

1. That council not waive Building Permit Fees, Deposits or Agreement fees associated with the Innerkip Seniors Apartment addition project.

As you are aware, lnnerkip Seniors Apartments is proposing to construct 16 additional apartment unitson its site at 30 Balsam Street in lnnerkip. Our goal is to increase the supply of affordable housing forolder adults and seniors, a goal shared with the Township of East-Zorra Tavistock and the County ofOxford.

ln February, Township Council approved the zone change application that-was required to increase thenumber of apartment dwellings on the site and reduce the parking requirements for the development.We have also submitted a site plan application and are awaiting comments from Township and County

staff regarding the submitted site plans.

Currently, we are working towards starting construction in July 20L5 as our development teamconsisting of Reid and Deleye, Nicholson Sheffield Architects, Strik Baldinelli & Moniz and lntegratedEngineering complete the full set of building and site drawings. lnnerkip Seniors Apartments is also closeto finalizing the details surrounding the re-mortgaging of the existing property to help finance theconstruct¡on of the proposed units.

As we move through the final pre-construction stages, lnnerkip Seniors Apartments would like toformally request the following assístance from the Township of East-Zorra Tavistock in creating new

affordable housing:

1) Waiver of Building Permit Fees; and

2l Waiver of Site Security Fees required by the Township as part of the Site Plan Agreement.

For your information we have also formally requested assistance from the County of Oxford and on May

t3, 2015 Oxford County Council approved :

1) Capital funding of 5688,0002l Waiver/offsetting grant of the County's development charges;3) A property tax rate for the 1-6 new units equivalent to the single family residential rate; and

4l Continuation of the current subsidies for the RGI apartments at our existing apartment building.

It is our understanding that a project-specific housing facilities by-law will be established by the Countyof Oxford to provide the above incentives for the new affordable housing addition. Our non-prof¡t willthen enter into a new long term housing contribution agreement with the County.

Creation of monitoring and review of operations, OFM aim is to audit and review every fire department in Ontario

Bill 8 (Public Sector and MPP Accountability and Transparency Act, 2014): The Ontario Gazette notes that Bill 8, Public Sector and MPP Accountability and Transparency Act, 2014 and related regulations affecting municipal governments are to be proclaimed in effect on January 1, 2016. Schedules 6 and 9 of the Bill relate specifically to municipal governments. The Bill’s key features include:

o The Ontario Ombudsman will become the default ombudsman for municipal governments that do not appoint a municipal ombudsman, except in the City of Toronto.

o The Ontario Ombudsman will have ‘final oversight’ of individual complaints where a municipal ombudsman has been appointed, except in the City of Toronto.

o The Ontario Ombudsman will have oversight of municipal auditors general and integrity commissioners. The government has not provided clarification on the scope of the Ontario Ombudsman’s powers in these areas.

o The Ontario Ombudsman will be able to conduct ‘systemic’

investigations of all municipal governments, including the City of Toronto.

o The existing closed meeting investigation regime will be maintained. The Ontario Ombudsman will continue to be the default closed meeting investigator where a municipality has not appointed a closed meeting investigator. The definition of ‘meeting’ will fall to the Municipal Act review. (AMO’s Bill 8

submission provided advice on this definition.) o By regulation, boards of health, library boards, long-term care

homes, and police services boards are to be excluded from an Ombudsman’s oversight.

o The new Patient Ombudsman will have oversight of long-term care homes.

Ontario Trillium Fund

The Ontario Trillium Foundation (OTF) has released the registration and application deadlines for the first granting round of 2015, with registrations from potential applicants being accepted starting July 22, 2015. The new Investment Strategy is evidence based, and focussed on creating measurable, positive impact in Ontario communities. The new strategy works to make changes in six different Action Areas: Active People, Inspired People, Prosperous People, Promising Young People, Green People and Connected People. The names of these Action Areas reflect the changes that OTF is working to see in the lives of the people of Ontario. Organizations will have access to applications for each Investment Stream: Seed (for new ideas); Grow (for scaling up ideas that work), Capital (for community infrastructure) and Collective Impact (for bringing fundamental change with collective action). The grant application deadlines for each stream are as follows:

• Grow Grants: Aug 26, 2015 • Seed and Capital Grants: Sept 2, 2015 • Collective Impact Grants: there are no deadlines for submitting applications and they will be accepted on an ongoing basis.

Background:

The Township has been recently advised of the “Canada 150 Community

Infrastructure Program” grant program. This is a $150 million national program that is part of the Federal government’s coordinated approach to

celebrating Canada’s 150th anniversary. In Southern Ontario, $44 million (of the $150 million) will be delivered over 2 years for eligible projects, through the Federal Economic Development Agency for Southern Ontario (FedDev Ontario). These are the key aspects of the grant program:

1) The types of eligible projects (from the application form): a. Community centres (including Legion Halls); b. Cultural centres and museums; c. Parks, recreational trails such as fitness trails, bike paths and

other types of trails; d. Libraries; e. Recreational facilities including local arenas, gymnasia,

swimming pools, sports fields, tennis, basketball, volleyball or other sport-specific courts, golf courses, ski hills or other types of recreational facilities;

f. Tourism facilities; g. Docks; h. Cenotaphs; and, i. Other existing community infrastructure for public benefit such

as, but not limited to, local roads, connectivity and broadband, drinking water treatment and distribution systems, local airports, solid waste management and wastewater infrastructure (please describe)

2) Further, these types of projects seem to be consistent with the sample project titles in the Application Guide, which include:

a. Improvements to the municipality's recreational trail b. Renovation of the community centre's gymnasium c. Expansion of the community hall's auditorium d. Repair of the cultural centre's roof e. Rehabilitation of the playground

3) The project cannot increase the existing asset’s footprint by more than

50%;

4) The more inclusive the project (the more people that can enjoy it), the better;

5) Regional partnerships for projects, if they can be incorporated, could

be considered an asset;

6) While the program can provide up to 50% of the funding for the project, priority may be given to those seeking no more than 33.3%. Further, the amount of grant funding requested cannot exceed $1 million, per project;

7) Multiple projects per Municipality ARE acceptable. However,

prioritization of projects is required to be completed (as per #6 in the application form);

8) In order to complete the application form, a fairly accurate project

budget is required, including costs for: a. Planning/Design/Engineering b. Repair/Construction c. Project Management d. Other (specify) e. Contingency (up to 10% of the project subtotal)

9) Further, the budget for funding the request must also be included:

a. Amount of grant funding requested b. Amount of applicant funding being contributed c. Other government funding being contributed/ applied for (need

to specify) d. Other funding being contributed (need to specify)

10) Eligible Program Costs:

a. Costs that are incurred between April 1, 2016, and March 31, 2018;

b. costs to rehabilitate, renovate or expand fixed capital assets of community infrastructure;

c. fees paid to professionals, technical personnel, consultants and contractors specifically engaged for the purpose of the rehabilitation, renovation or expansion work;

d. costs of environmental assessments, monitoring and follow-up activities as required by the Canadian Environmental Assessment Act (CEAA) 2012 or equivalent legislation;

e. costs of any public announcement and official ceremony or of any required temporary or permanent signage that includes the cost of creation and posting of signage;

f. other costs that are considered to be direct and necessary for the successful implementation of the project and that are approved in advance; and

g. Employee salaries and other incremental costs (i.e. materials or equipment) of the recipient may be included in eligible costs under the following conditions:

i. the recipient is a local, regional or Aboriginal government; and

ii. the recipient confirms and substantiates that it is not economically feasible to tender a contract; and

iii. costs are employed directly in respect to the work that would have been the subject of the contract; and

iv. the costs are approved in advance and are included in the contribution agreement.

In other words, only projects involving fixed capital assets/

community infrastructure that are already present and in place

are eligible (ie a brand new facility is not eligible).

11) Ineligible Costs:

a. project costs incurred before April 1, 2016, or after March 31, 2018;

b. temporary installations and moveable equipment, including but not limited to, motorized vehicles, furniture, computers and sports equipment;

c. services or work that is normally provided by the recipient or a related party;

d. salaries and other employment benefits of any employees of the recipient except as outlined above in Eligible Project Costs;

e. a recipient's overhead costs, its direct or indirect operating or administrative costs, and more specifically its costs related to planning, engineering, architecture, supervision, management and other activities normally carried out by the recipient's staff;

f. in-kind contributions; g. the cost of feasibility and planning studies; h. taxes, such as GST and HST, for which the recipient is eligible

for a tax rebate and all other costs eligible for rebates; i. the cost of land or any interest therein, and related costs; j. cost of leasing of equipment by the recipient except for as

indicated in eligible costs, above; k. legal fees; and l. routine maintenance costs.

12. The Application deadline is 5:00 pm on Tuesday June 9/15. In

order to apply, a resolution of Council supporting each project being applied for is required. As well, and as noted above, Council must also prioritize projects, if multiple projects are being submitted for funding. The Council meeting of Wednesday June 6, 2015 is the one and only opportunity for this to occur.

To provide some further context and perspective for Council to consider, given the nature of this funding program, it would seem reasonable that the Federal government would wish to see this funding spread across as many communities in Canada as possible. As such, Council should be aware that FedDev Ontario represents approximately 12.3 million people living in 288 communities, with a jurisdiction that stretches from Ottawa to Windsor and as far north as Simcoe County. Further, with a total grant program of $150 million spread over 35.2 million people (Canada’s approximate total

population) equalling $4.26 per person, with $44 million available to approximately 12.3 million people (equalling $3.57 per person), a reasonable “per person” value could be established at approximately $3.90. Given all of this, with a current total population of approximately 6,300, if the Township were to receive funding somewhere in the order of $25,000 would seem to be reasonable and fair, again, given the nature of this funding program.

Discussion: Based on the nature of the sample projects and the required timing for submissions, the Township’s Recreation Committees were circulated with this information, with the request to provide any recommended projects that they might have. Additionally, both the Tavistock Minor Ball Association and Innerkip Lawn Bowling Club requested this information in the event that they wished to apply, and were circulated. While the Committees were initially advised to provide their recommendations back to the Township by Friday May 29th, given the short turn-around for providing this information, the Committees were provided with additional time to provide this information. As such, this is the information available for Council to consider at this time, with more information available for the meeting: Township Applications:

1) Innerkip Recreation Committee – The Committee is meeting on

Sunday May 31st to finalize the requirements for development of a 4th Diamond (for practice/younger players). This was identified during the budget review and they were planning to explore over the summer, but based on a funding opportunity, they have moved it forward. The proposal, with a budget estimate, will be available before the meeting. The Innerkip Park reserve has a balance of $34,000 so there would be Township funding for this project. The main concern with this project is whether it will be considered “new”.

2) Hickson Recreation Committee – The Committee is contemplating replacement of the fencing around the ‘tennis courts’ (part of the Pavilion). Quote(s) for this work will be forthcoming for the June 3rd meeting for Council consideration, as part of the project prioritization process. The Hickson Park reserve has a balance of $58,000 so there would be Township funding for this project.

3) Tavistock District Recreation and Facilities Board – The Board is contemplating lighting replacement at the Arena. The estimate for this work is about $100,000. The TDRC Reserve currently has a balance of $188,000, so the Township’s share could be funded.

4) Innerkip Community Centre – Staff have considered an HVAC refurbishment project, which would change over the current electric based system to a natural gas system. This project would include natural gas being supplied to the facility as well. Staff estimate the total project costs to be approximately $100,000. The ICC Reserve is only at $24,500, so additional funds would have to come from taxes or other reserves. While this project is important and will reduce costs in the long run, it will not really be seen by anyone (the natural gas line will be underground and new furnaces will be hidden away in a mechanical room) so I can't imagine it will rank very high based on the parameters of this program.

Associated Organization Applications:

1) Tavistock Minor Ball Association – Please see attached for a

detailed summary of the project(s) being proposed. Although TMBA is not part of the Township, given that the project(s) they are proposing would involve work on Township owned lands, as well due to the nature and request within their proposals, Council will still be required to give consideration to this proposal. In terms of the loan proposal, the Township could help facilitate financing of the project. The Township has done this in the past for various organizations for projects like this.

In addition to these projects noted, Council may certainly have other project ideas. However, given the very tight turn around with application submissions, the projects would need to be very well detailed (with budget) and straightforward enough for staff to compile in this short time period (only 4 business days available to complete the applications, following the June 3rd Council meeting). Summary:

As noted above, Council needs to provide its support, through resolution, for its desired project(s). If more than one Township project is submitted, they must be prioritized. Also, based on the proposal from Tavistock Minor Ball being at Queen’s Park and needing Township assistance with financing, there needs to be an indication of Council support. While all the projects are important and justifiable, this is a competitive program with limited funding. As well, if the program intends to spread the

funding amongst many areas, it is questionable whether a small rural population of about 7,000 will be able secure a significant amount of funding. As well, with the program being open to “non-municipal non-profits”, the funding could be further diluted from a geographic perspective. While Township support of the Tavistock Minor Ball application makes sense and should be viewed positively, it could have a detrimental effect on the Township applications. While that may be the case, staff would recommend supporting it, as it appears to be most closely aligned with the program background. With respect to the Township applications, staff believe the park and arena applications would be worth submitting. While the ICC HVAC project has merit, it appears to be a significant long-shot based on the program. As for ranking the applications, staff would suggest submitting them based on amount of grant requested (highest to lowest), as there is the possibility that there may be more likelihood of the top priority being selected. While multiple submissions can be made, each one takes time and effort and I am concerned that the overall funding to a Township like East Zorra-Tavistock may be quite limited compared to the possible projects.

Jeff, Will, As requested, I have attached the Tavistock Minor Ball Association's project submissions (2 separate projects) for the Canada 150 Community Infrastructure Program. There are multiple attachments within each submission that are required per the application guidelines. TMBA is asking for 50% federal funding on both projects. At the time of this e-mail, TMBA had not yet received the landlord authorization form from the Optimist Club of Tavistock. President Jim Bender has verbally authorized the work to be completed at Optimist Park, however he was unable to send it electronically at the time of this e-mail. TMBA will attach the completed form prior to final submission. In addition, I have added a brief description/background of each project below: Project 1 (Priority Ranking 1) - Improvement of Optimist Park Ball Diamond, Fencing, and Batting Cage Background: The Tavistock Minor Ball Association would like to install clay to the infield and warning track at the Optimist diamond to help prolong field life, decrease maintenance costs, increase player safety, as well as to help TMBA better compete with other centers when bidding to host fastball tournaments meant to be used to generate fundraising revenue. Currently, Hickson, Shakespeare, and Innerkip have clay installed at their diamonds. The batting cage is no longer being used and is considered an eyesore because of it's current state of disrepair. It's refurbishment would allow teams to practice pitching and hitting within a safe, contained environment as well as adding to the aesthetics of Optimist Park. The fencing has become a safety issue. The fence is curling up in several places which exposes players to sharp, exposed edges. There are also multiple gaps in the fencing that allow balls to leave the playing surface. OASA officials complained to TMBA about the condition of the fencing during an elimination tournament in 2014. To link the project with Canada's 150th anniversary of Confederation, the proposal has been made to name the ball diamond at Optimist Park 'Dominion Diamond' in honor of the creation of the Dominion of Canada in 1867. Project 2 (Priority Ranking 2) - Improvement of Queen's Park Ball Diamond Background: The Tavistock Minor Ball Association would like to install clay to the infield and warning track at the main diamond at Queen's Park to help prolong field life, decrease maintenance costs, increase player safety, as well as to help TMBA better compete with other centers when bidding to host fastball tournaments meant to be used to generate fundraising revenue. Currently Hickson, Shakespeare, and Innerkip have clay have clay installed at their diamonds. To link the project with Canada's 150th anniversary of Confederation, the proposal has been made to name the diamond 'Confederation Diamond' in honor of the anniversary of Canada's Confederation. The historical relevance of the proposed diamond name is even more significant considering it is within Queen's Park and Canada came under Sovereign rule in 1867. Subject: Ball Diamond Lease Agreement with Tavistock Minor Ball

Date: May 28, 2015

Background:

In 2007, the Township and Tavistock Minor Ball entered into a lease agreement for use of the Ball Diamond. At the time, this was needed to facilitate an application by Tavistock Minor Ball to the Ontario Trillium Foundation for a grant application.

Tavistock Minor Ball is currently pursuing a grant application under the CIP150 Program. This application also requires organizations that do not own the land where the project takes place to demonstrate they have a long-term agreement to use the facility.

Discussion:

The previous lease agreement is attached. Staff would recommend extending the lease agreement until March 31, 2024 as per the CIP150 Program Requirements. While this is many years away, history has shown that Tavistock Minor Ball usage of the ball diamond facility is a long-term endeavour and it is highly unlikely the Township will require the facility for another purpose.

If Tavistock Minor Ball is successful with the CIP150 Application, it becomes even more unlikely that the ball diamond would be used for anything other than a ball diamond.

Recommendation:

1. That Council authorize the Mayor and Clerk to extend the leaseagreement with Tavistock Minor Ball until March 31, 2024.

Between

The Corporation of the Township of East Zorra-Tavistock, hereinafter called the"Township"

And

Tavistock Minor Ball Association, hereinafter called the "Association"

Whereas the Township owns lands located at 1 Adam Street, Tavistock, Ontario

And Whereas such lands are operated as a community park, including BallDiamond, Pavilion, Playground and Open Space Facilities;

And Whereas the Association is the primary user of the Ball Diamond Facility;

And Whereas the Township and Association work in partnership to providerecreational opportunities for the community;

And Whereas the Association is seeking to make improvements to the BallDiamond facility at Tavistock Queen'sPark;

And Whereas iUs necessary for the Township and Association to have anagreement with respect to use of the Ball Diamond facility so the Association canaccess funding to assist with improvements to the Facility;

Now there the parties mutually agree as follows:

1. Definitions:

a. Association shall mean the Tavistock Minor Ball Association

b. Township shall mean the Corporation of the Township of EastZorra-Tavistock

c. Park shall mean Tavistock Queen's Park

d. Program shall mean the baseball program operated by theTavistock Minor Ball Association

e. Tavistock & District Recreational Facilities Board shall mean theBoard established by the Council of the Township of East Zorra­Tavistock to operate the Tavistock Recreational Facilities.

f. Facility Manager shall mean the person or company engaged bythe Tavistock & District Recreational Facilities Board to maintainand operate the recreational facilities in Tavistock.

2. The Township is the owner of Tavistock Queen's Park, 1 Adam Street,Tavistock, Ontario.

3. The Township is responsible for maintenance and operation of theTavistock Queen's Park facility.

4. The Association is responsible for operation of the ball program.

5. The Township grants access to the Ball Diamond facility, including parkingand related areas to the Association for operation of its programs.

6. The Association shall be recognized as the primary user of the BallDiamond facility.

7. The Association is responsible for organizing, booking and scheduling alluse of the Ball Diamond facility.

8. The Association recognizes the use of Tavistock Queen's Park for theAnnual Tavistock Fall Fair, including any grounds preparation requiredand shall permit the Tavistock Agricultural Society to conduct the fairunimpeded.

9. The Association recognizes that Tavistock Queen's Park is used for otherevents from time to time and agrees to work with the Tavistock & DistrictRecreational Facilities Board to facilitate and permit the operation of otherevents.

10.The Township operates Tavistock Queen's Park through the Tavistock &District Recreational Facilities Board and all operational matters withrespect to use of the facility are to be directed to the Facility Manager.

11.The Association agrees to pay the rental rates and user fees establishedfrom time to time by the Township.

13.The Township and Association shall both maintain insurance coverage inthe amount of at least $1,000,000 to cover their respective activities at thepark.

14.This Agreement may be extended, amended or modified at any timeduring the life of the Agreement, subject to mutual agreement from bothparties to the Agreement.

15.This agreement may be terminated, subject to mutual agreement fromboth parties to the Agreement; however, termination cannot take placeuntil after August 1, 2012 and any amendment to the agreement shall notmake the termination date earlier.

16.Unless this agreement is amended, as provided for in Section 14 orterminated as provided for in Section 15, this agreement shall not have atermination date.
