HOW TO MAKE THE MOST OF THE NEW DISPUTE SETTLEMENT PROVISIONS
WhenthenewCode of Civil Procedure(CCP)comesintoeffectinJanuary2016,itwillrequireadifferentapproachtodisputeresolutionandprevention. Essentially,itwillcallforavisionthatisresponsivetoachangingsocietyandthatputscitizensbackatthecentreofthejusticesystem.
Howarewetounderstandthesenewprovisionsandanticipatetheirimpactonourareasofpractice?Shouldwebequestioningourcurrentapproaches? Whatisbeingdoneelsewhere?
Comeandfamiliarizeyourselfwiththeseupcomingchanges:theyaregoingtoshiftthewaypeopleaccessjusticeinQuebecandwillsignificantlyimpactthewaythesystemevolves.Presentersatthesymposiumwillclarifythelaw,withregardforourdiverseareasofpracticeandvariedapproaches.

This new legislation obliges mediation practitioners and prosecutorstoshowthateffortshavebeenmadetotrytoresolveissuesindisputebeforeproceedingsareinstitutedintheFederalCourtofAustralia.Thisishowthelegislatorhasensuredthat“genuinestepstoresolvedisputes”aretakenbeforelegalaction.
