The first deadline in the implementation phase of OSHA’s updated Hazard Communication Stan-dard is Dec. 1, 2013, only two weeks away. By this date employers must train workers on the stan-dard’s new label elements and safety data sheet.

OSHA revised its Hazard Communication Stan-dard (HCS) to align with the United Nations’ Globally Harmonized System of Classification and Labeling of Chemicals (GHS) and published it in the Federal Register in March 2012 (77 FR 17574). Two significant changes contained in the

revised standard require the use of new labeling elements and a standardized format for Safety Data Sheets (SDSs), formerly known as, Material Safety Data Sheets (MSDSs). The new label ele-ments and SDS requirements will improve work-er understanding of the hazards associated with the chemicals in their workplace. Capitol Connection Q & A for ContractorsBy Shauna Krause, President, Capitol Services, Inc.

As we gather for the Thanksgiving holiday many families take time to look back at the year past and ahead to the New Year coming. For our Capi-tol Connection ‘family’ of readers it has been a busy year for the Legislature in creating new laws, promoting new bills and adding to the complex nature of doing business as a contractor.

In 2013 we got new rules on Indemnity, Reten-tion, Insurance, Worker’s Compensation, Employ-ees, Public Works, Environment and, of course, new Licensing regulation.

Starting this year construction businesses re-sponsible for losses on commercial projects can’t ‘indemnify’ or share the blame for problems they caused with any other parties who may be con-nected to the job. (SB 474, Evans)

The politicos did extend the Zero Retention policy at CalTrans thru 2020. The law prohibits CalTrans from withholding retention proceeds in any amount when making progress payments for work by contractors. (AB1671, Huffman)

SB 863 (DeLeon) on Worker’s Comp reform, all 120 pages, was enacted in this year. The changes are extensive and we don’t have space, but you should take a look if you have employees.

Additional Worker’s Compensation changes af-fecting “C-39” (Roofing) contractors require filing Worker’s Comp coverage with CSLB, even if the

contractor has no employees. (AB2219)

Other new rules affect employee information and how it can be used, primarily as an enforcement tool. (AB 1794 Williams & SB 691 Lieu)

Another enforcement measure keeps the inves-tigatory jurisdiction for CSLB in cases where a license has been revoked, cancelled, expired, for-feited or surrendered. (AB 2254 Berryhill)

Construction managers now must be licensed for Home Improvement Contracts (HIC). A person who provides a bid, who arranges for or sets up work and maintains oversight, with HIC needs a license. This one carries substantial criminal pen-alties for violations. (AB2237 Monning)

With thousands of bills passed one, SB 341 Lo-wenthal, sounds the alarm for contractor work-sites. The law also applies to mines, but any ve-hicle over 14,000lbs must now have an audible backup alarm if it operates or delivers materials, to or from, a worksite. And, you better be able to hear it at least 200 feet away. Other rules on projects (AB1598/AB 1565/, special districts and schools also are a ‘must read’ in 2013.

Looking ahead thousands more bills will be cre-ated in the Assembly and Senate, but these few are dead, dying or may become law in 2014.

Among the dead is an effort by both parties

(AB2027 Valadao & AB 249 Berryhill) to reduce the penalties for legitimate contractors who are suspended for a short time.

A pilot program was scrubbed by veto as AB 2309 (Hill) a public/private pilot program for commu-nity colleges was set aside.

SB 975 Wright, intended to prohibit local gov-ernment and special districts from imposing ad-ditional licensing requirements was stopped by veto.

AB 2353 Knight intended to bolster subcontrac-tor’s status; requiring a notice be sent before a substitute ‘sub’ was brought in was considered dead on arrival.

While these, and hundreds more, new bills are set aside, vetoed or considered dead, don’t kid your-self some will be back, some revived and others created in regulating the work contractors per-form by law in California.

The first compliance date of the revised HCS is December 1, 2013. By that time employers must have trained their workers on the new label elements and the SDS format. This training is needed early in the transition process since workers are already beginning to see the new labels and SDSs on the chemicals in their workplace. To ensure employees have the information they need to better protect themselves from chemical hazards in the workplace during the transition period, it is critical that employees understand the new label and SDS formats.

The list below contains the minimum required topics for the training that must be completed by December 1, 2013.

Training on label elements must include information on:

December 1st, 2013 Training Requirements for the Revised Hazard Communication StandardOSHA revised its Hazard Communication Standard (HCS) to align with the United Nations’ Globally Harmonized System of Classification and Labeling of Chemicals (GHS) and published it in the Federal Register in March 2012 (77 FR 17574). Two significant changes contained in the revised standard require the use of new labeling elements and a standardized format for Safety Data Sheets (SDSs), formerly known as, Material Safety Data Sheets (MSDSs). The new label elements and SDS requirements will improve worker understanding of the hazards associated with the chemicals in their workplace. To help companies comply with the revised standard, OSHA is phasing in the specific requirements over several years (December 1, 2013 to June 1, 2016).

There will only be one signal word on the label no matter how many hazards a chemical may have. As referenced in Dr. Michaels’ OSHA Training Standards Policy Statement (April 28, 2010) – with all training, OSHA requires employers to present information in a manner and language that their employees can understand. If employers customarily need to communicate work instructions or other workplace information to employees in a language other than English, they will also need to provide safety and health training to employees in the same manner. Similarly, if the employee’s vocabulary is limited, the training must account for that limitation. By the same token, if employees are not literate, telling them to read training materials will not satisfy the employer’s training obligation.
