2. No . bidder shall be admitted to ·.the auction unlesS he deposits the earnest money of Rs., 100;- separately, .in respect of each zone. 7. the amount of duty payable on quantity of liquor under­talten to be produced by the bidder shall be paid by him' ~ two equal instalments. The first instalment shall be paId by the bidder on the spot as soon i3S his bid is accepted and the second instalment shall be paid by him within fifteen {lays from the date of acceptance of bid price.,

S. Attention of the bidders is called to the provisions of the Rule 76 of the Excise Duty Rules, 1964. In case the bid<ier does not accept any juice supplied by juice extractors or fails to obtain this, supply from the juice extractors for any reason whatsoever he will not be entitled to claim for refund of duties .011. theSe grounds:and. therefore, the responsibility of getting the juice from zones bidded will fully rest upon him

In the event of failure to comply with the above condi­tions and the provisions of Rule 72 or failure to pay the first instalment of the bid price as required by sub-rule ( 3 ) of Rule 71, the deposits of Rs., 100/_ made by the, bidder with reference to sub-mle (4) of Rule 72 shall be forfeited. Simi­larly, the first instalment of .the bid price paid shall be forfeited if the second instalment is not paid within the period of fifteen days as prescribed above. Any loss in the bid price caused to the GoVernment by reason of fresh auction being held for non-j)ayment of any of' the instalments shall be recoverable from the first bidder as a arrears of Land Revenue.

As per the Goa, Daman &: Diu (Excise Duty) Rules, 1964, the accepted bidding price shall be the amount of Excise Duty for the zone put to auction and no. refund or rebate of the same shall be given even if the production falls short of the quantity undertaken to be produced by the .bidder or any other ground. However, in ca~e of, cashew zones disposed by way of tenders, additional . excise duty shall be payable by the tenderer with reference ,to excess production of liquors made.
