requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.

AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.

I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:

TheCOVID-19pandemiccontinuestopresentanunprecedentedandrapidlyevolvingchallengetoourState.TheWorldHealthOrganizationcharacterizedtheCOVID-19outbreakasapandemiconMarch11,2020.ThePresidentdeclaredanationalemergencyrelatedtoCOVID-19onMarch13,2020.Sincethen,andforthefirsttimeinhistory,thePresidenthasapprovedmajordisasterdeclarationsforallfiftystatesandtheDistrictofColumbia.Alongwiththesefederalactionsandtheactionsofstatesacrossthenation,MinnesotahastakenextraordinarystepstopreventandrespondtotheCOVID-19pandemic.

OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencyunderMinnesotaStatutes2020,section12.31,subdivision2.OnMarch16,2020,theExecutiveCouncilapprovedanextensionofthepeacetimeemergency.AfternotifyingtheLegislature,onApril13,2020,May13,2020,June12,2020,July13,2020,August12,2020,September11,2020,October12,2020,November12,2020,andDecember14,2020,IissuedadditionalExecutiveOrdersextendingthepeacetimeemergency.InthisExecutiveOrder,thepeacetimeemergencydeclaredinExecutiveOrder20-01andextendedinExecutiveOrders20-35,20-53,20-75,20-78,20-83,20-89,20-92,20-97,and20-100isreferredtoasthe“COVID-19PeacetimeEmergency.”

AsaresultoftheCOVID-19pandemic,all50stateshavedeclaredstatesofemergency,and49ofthemareinplacetoday.ThisisbecauseCOVID-19casesanddeathscontinuetoproliferate.AccordingtotheUnitedStatesCentersforDiseaseControlandPrevention(“CDC”),morethan22millionpeoplehavebeeninfectedintheUnitedStates,resultinginover375,000deaths.Asithaswiththerestofthenation,theCOVID-19pandemiccontinuestotakeitstollonMinnesota.Minnesotahashadover438,000positiveCOVID-19cases,nearly23,000hospitalizations,andrecentlysurpassed5,700fatalities.DespiterecentdecreasesinthenumberofCOVID-19casesinMinnesota,wecontinuetobeinanareaofhighriskforfuturespread.Wemustremainvigilantinoureffortstopreservehospitalcapacityandpreventdeaths.

IhavenotedinpreviousexecutiveordersthattheCOVID-19PeacetimeEmergencyopensourtoolboxtoallowustotakeswiftactiontoprotectthehealthandwell-beingofourfamilies,communities,andbusinesses.DuringtheCOVID-19PeacetimeEmergency,IhaveexercisedexecutiveauthoritythroughnumerousexecutiveorderstoprovidereliefandfurtherprepareourStatefortheCOVID-19pandemic.Suchactionshaveincludedtheclosureofschoolsandimplementationofadistancelearningperiod;enhancedprotectionsforveteransinourveteranshomes;activationoftheNationalGuardtoassistinreliefefforts;measurestopreservepersonalprotectiveequipment;temporaryclosureofbars,restaurants,andotherplacesofpublicaccommodation;effortstoprovideeconomicreliefandstabilitytothoseimpactedbythepandemic;regulatorychangesallowingourstateagencies,healthcareproviders,andlicensingboardstoensurefastrelieftoMinnesotans;andordersrequiringMinnesotanstostayathomeandtowearfacecoveringsincertainsettings.Ourcollectiveactionshavesavedlives,butthethreatremains,andourworkmustcontinue.

InitsJanuary3,2021reporttoMinnesota,theWhiteHouseCoronavirusTaskForcenoted:“Mitigationmeasuresto

Executive Orderslimittransmissioninpersonalgatheringsneedongoingstrengthening,includingcontinuingtoaskMinnesotanstolimittravel,wearmasks,physicallydistance,andavoidgatheringsinbothpublicandprivatespaces,especiallyindoors.”Recently,thankstoMinnesotans’compliancewithpreviousexecutiveorders,manykeymetrics—includingCOVID-19deaths,newhospitalizations,dailycasenumbers,andtestpositivityrate—arenowbelowwheretheywereatthemostseverestagesofourlatefallandearlywintersurge.Toprotectourrecentprogressandavoidanothersurge,wecontinuetoneedstatewidecoordinationandresourcestofightthepandemic.Emergencypowersareessentialforquick,equitable,andsafedistributionofthevaccine.Thepeacetimeemergencyallowsout-of-statepharmaciststoaddcapacityforCOVID-19vaccineadministrationinMinnesotaandenablestimelyacquisitionofsuppliesandtechnology.TheStateEmergencyOperationsCenterprovidesongoingsupporttolocalgovernments,and—astheappropriationofsignificantpublicfundstofightthepandemicplainlyshows—localresourcescontinuetobeinadequatetoaddressthethreat.

InMinnesotaStatutes2020,section12.31,subdivision2(a),theMinnesotaLegislatureauthorizedtheGovernortodeclareapeacetimeemergencywhenanactofnatureendangerslifeandpropertyandlocalgovernmentresourcesareinadequatetohandlethesituation.WiththeapprovaloftheExecutiveCouncil,apeacetimeemergencymaycontinueforupto30days.MinnesotaStatutes2020,section12.31,subdivision2(b),providesthemechanismfortheGovernortoextendapeacetimeemergencybeyond30days.IftheGovernordeterminesaneedtoextendapeacetimeemergencydeclarationbeyond30days,andtheLegislatureisnotsittinginsession,theGovernormustissueacallimmediatelyconveningbothhousesoftheLegislature.TheLegislaturecommenceditsregularsessiononJanuary5,2021andiscurrentlysittinginsession.TheLegislaturemayterminateapeacetimeemergencyextendingbeyond30daysbyamajorityvoteofeachhouse.

Minnesotalawdoesnotclearlyimposeadditionalrequirementsforanextensionofapeacetimeemergencybeyondtheinitial30days.Giventheimportanceofthisdecision,Ipreviouslyconcludedthattheprudentcoursewastolimitsubsequentextensionsto30-dayincrementsandseektheExecutiveCouncil’sapprovalofsuchextensions.Icontinuethatcoursetoday.

Forthesereasons,Iorderasfollows:

1. IhavedeterminedthattheCOVID-19pandemic,anactofnature,continuestoendangerlifeandpropertyinMinnesota,andlocalresourcesareinadequatetoaddressthethreat.TheCOVID-19PeacetimeEmergen-cymustthereforecontinue.

2. TheCOVID-19PeacetimeEmergencyisextendedthroughFebruary12,2021,untilthisExecutiveOrderisrescindedbyproperauthority,oruntilitisterminatedbyamajorityvoteofeachhouseoftheLegislaturepursuanttoMinnesotaStatutes2020,section12.31,subdivision2(b),whicheveroccursearlier.

3. TheCOVID-19PeacetimeEmergencymaybefurtherextendedbyanexecutiveorderonorbeforeFebru-ary12,2021.

PursuanttoMinnesotaStatutes2020,section4.035,subdivision2,andsection12.32,thisExecutiveOrderiseffectiveimmediately.

AdeterminationthatanyprovisionofthisExecutiveOrderisinvalidwillnotaffecttheenforceabilityofanyotherprovisionofthisExecutiveOrder.Rather,theinvalidprovisionwillbemodifiedtotheextentnecessarysothatitisenforceable.

Office of the GovernorEmergency Executive Order 21-05: Protecting the State Capitol from Potential Civil Unrest

I, Tim Walz, Governor of the State of Minnesota,bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:

Lastweek,violentprotestersattemptedaninsurrectionattheUnitedStatesCapitol.IncitedbythePresidentandenabledbymanypoliticalleaders,riotersstormedournation’sCapitolandconductedthefirstsiegeofthatbuildinginover200years.InSaintPaul,violentrhetoricechoedfromthestepsofourownStateCapitol.RecentreportsofplannedarmedprotestsaroundthecountryandatourStateCapitolmustbemetwithastrongandunequivocalresponse.Wewillnotcondoneviolence,andwewillprotectourStateCapitol.

TheMinnesotaStatePatrolisresponsibleforprovidingsecurityontheStateCapitolComplex.TheMinnesotaNationalGuardcansupplementtheStatePatrol’seffortstokeepthepeace,ensurepublicsafety,andallowforpeacefuldemonstrations.Baseduponmyearlierverbalorders,theNationalGuardhasalreadybegunpreparationsforpossiblecivilunrest.IntheeventofcivilunrestattheStateCapitol,ourresponsemayrequireactivationoftheNationalGuardtostateservice.

Forthesereasons,Iorderasfollows:

1. TheAdjutantGeneralmayordertostateactivedutythepersonnel,equipment,andfacilitiesneededtoprovidepublicsafetyservicesandsecurityassistancetotheStateCapitolComplexandnearbycommunitiesandgovernmentproperties.

2. TheAdjutantGeneralisauthorizedtoprocurethegoodsandservicesneededtoaccomplishthemission.

3. ThecostsofthisassistancewillbepaidfromthegeneralfundasallowedbyMinnesotaStatutes2020,section192.52.

ThisExecutiveOrderiseffectiveimmediatelyunderMinnesotaStatutes2020,section4.035,subdivision2.ItremainsineffectuntilsuchdateasNationalGuardresourcesarenolongerrequiredorJanuary27,2021,whicheveroccursearlier.

AdeterminationthatanyprovisionofthisExecutiveOrderisinvalidwillnotaffecttheenforceabilityofanyotherprovisionofthisExecutiveOrder.Rather,theinvalidprovisionwillbemodifiedtotheextentnecessarysothatitisenforceable.

Persons Affected.Thepossibleamendmentstotheruleswilllikelyaffectriskmanagersinpartnerstateandlocalagencies:theMinnesotaDepartmentofAgriculture(MDA),theMinnesotaPollutionControlAgency(MPCA),theMinnesotaDepartmentofNaturalResources(DNR),watersystemoperators,andlocalpublichealthagencies.PartneragenciesrelyonHRLvaluesasonestandardforenvironmentalassessmentandriskmanagementtoprotectgroundwaterresources.Industriesthatmanufactureorusetheidentifiedchemicalsandenvironmentalgroupsthatmonitorwaterqualityarealsoaffected.TheproposedamendmentsultimatelycouldaffectdrinkingwatersourcesforMinnesotanswhorelyongroundwaterastheirsourceofdrinkingwater.

Statutory Authority. TheGroundwaterProtectionActof1989(Minnesota Statutes,section103H.201)andMinnesota Statutes,section144.12,subdivision1(5),authorizeMDHtoadoptandrevisehealthrisklimitsforsubstancesdegradinggroundwater.The2001HealthStandardsStatute(Minnesota Statutes,section144.0751)specifiesadditionalrequirementsforestablishingsafedrinkingwaterstandards.

EffectiveJanuary20,2021,theDepartmentwillimplementtheMedicareresourcebasedrelativevaluescalecalculatedvaluesfor2021.TheDepartmentwillalsoadjusttheconversionfactorformentalhealthservicesto$28.43.TheDepartmentwillalsoadjusttheconversionfactorforevaluationandmanagementandobstetricsservicesto$25.18.TheDepartmentwillalsoadjusttheconversionfactorforallotherphysicianservicesto$25.16.

Becausemanyofthe2021relativevaluespublishedbyMedicarehavebeenincreasedtheDepartmentisdecreasingtheconversionfactorsinordertooffsetaportionofthepaymentrateincreasethatwillotherwiseoccur.Thereisnofiscalimpactanticipatedfromthesechanges.

NOTICE IS HEREBY GIVENthattheMinnesotaPollutionControlAgency(MPCA)isconductingaTriennialStandardsReview(TSR)toobtainpublicinputontheneedforamendmentsandrevisionstorulesgoverningstatewaterqualitystandards(WQS).

ThefederalCleanWaterAct(CWA)requiresthatstatesreviewtheirWQSeverythreeyearsandamendandupdatethemifnecessary.ThepurposeoftheTSRistoensureanopportunityforthepublictocommentupontheneedforrevisionstostateWQS.NotethatrulemakingtoimplementrevisionstostateWQSisconductedseparatelyfromtheTSR.
