EmergencyExecutiveOrders.Thegovernor'sauthorityisspecifiedintheConstitutionoftheStateofMinnesota,ArticleV,andin Minnesota Statutes§4.035.EmergencyExecutiveOrders,forprotectionfromanimminentthreattohealthandsafety,becomeeffectiveimmediately,arefiledwiththesecretaryofstate,andpublishedintheState Registerassoonaspossibleaftertheyareissued.OtherExecutiveOrdersbecomeeffective15daysafterpublicationintheState Registerandfilingwiththesecretaryofstate.Unlessotherwisespecified,anexecutiveorderexpires90daysafterthedatethegovernorwhoissuedtheordervacatesoffice.

Office of the GovernorEmergency Executive Order 20-82: Authorizing and Directing the Commissioner of Education to Require School Districts and Charter Schools to Provide a Safe and Effective Learning Environment for Minnesota’s Students during the 2020-21 School Year

I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:

TheCOVID-19pandemicpresentsanunprecedentedchallengetoourState.MinnesotahastakenproactivestepstoensurethatweareaheadofthecurveonCOVID-19preventionandresponse.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.AfternotifyingtheLegislature,onApril13,2020,May13,2020,June12,2020,andJuly13,2020,IissuedExecutiveOrdersextendingthepeacetimeemergencydeclaredinExecutiveOrder20-01.InExecutiveOrder20-01,Idirectedallstateagenciestosubmitproposedordersandrulestoprotectandpreservepublichealthandsafety.

ThehealthandsafetyofMinnesotansismytoppriority.InresponsetotheCOVID-19pandemicandinconsultationwiththeCommissionerofEducation(“Commissioner”)andtheCommissionerofHealth,IissuedExecutiveOrders20-02and20-19,firstclosingschoolstoplanforasafeeducationenvironmentandthenimplementingadistancelearningperiodforMinnesotapublicschooldistrictsandcharterschools.IalsoissuedExecutiveOrder20-41toextendthedistancelearningperiodtotheendofthe2019-20schoolyear.Mostrecently,IissuedExecutiveOrder20-57toallowpublicschooldistrictsandcharterschoolstheoptiontooffersummerlearningthroughahybridmodelordistancelearning.

OnJune18,2020,theMinnesotaDepartmentofEducation(“MDE”)andtheMinnesotaDepartmentofHealth(“MDH”)issuedguidancetohelpschooldistrictsandcharterschoolsplanforthe2020-21schoolyearinlightoftheCOVID-19pandemic.MDEandMDHdirectedpublicschooldistrictsandcharterschoolstocreatethreeeducationaldeliveryplansbasedondifferentinstructionalmodels:in-personlearningforallstudents;hybridlearningwithstrictsocialdistancingandcapacitylimits;anddistancelearningonly.Districtsandschoolsweredirectedtodothisplanningbecauseitisimperativethat,asthispandemicevolves,ourschoolsarepreparedtoturnthedialinresponsetoanychangingenvironmentduringthe2020-21schoolyear.

Schoolsarecriticaltoourcommunitiesandimpactthephysicalandmentalhealth,economicsuccess,growth,anddevelopmentofstudentsandfamilies.Educationisafundamentaldeterminantofhealth.Itcultivateslifeskills,knowledgeandreasoning,social-emotionalawarenessandcontrol,andcommunityengagement;alloftheseskillsservepeopleoverthecourseofalifetime.Schoolsalsofunctionastoolsandresourcesforpublichealthinterventionbyaddressingcoreneedslikenutrition,accesstohealthandsocialsupportservices,andsupportforfamiliesandcommunities.Thehealth,safety,andwellnessofourstudents,staff,andfamiliesisalwaysatthecenterofourdecisions.

Throughrobustengagementandongoingdialogue,stateandcommunityleaderscontinuetohearfromourstudents,families,educators,andschoolstaffmembers.Minnesotanshavemademanysignificantsacrificestocreateequitabledistancelearningopportunities.Whileitispossiblethatprotectingpublichealthmayrequirefutureperiodsofdistancelearning,wemustrecognizeandaddressthechallengeitcreatesforeveryoneinourschoolcommunities.These

Executive Orderschallengesincludemissedconnectionstopeers,educators,andstaff,aswellasalackofaccesstotechnology,in-schoolmeals,mentalhealthsupports,andotherservices.Suchchallengeshavemadedistancelearningdifficultforeveryoneinourschoolcommunities,andespeciallyourstudentsofcolor,Indigenousstudents,Englishlanguagelearners,studentsreceivingspecialeducationservices,studentsexperiencinghomelessness,migrantstudents,andstudentsfromlow-incomefamilies.

Withstudentandschoolstaffsafetyasthepriority,theCommissionerandI,inconsultationwiththeCommissionerofHealth,haveconcludedthataschooldistrictorcharterschoolmustadheretoparameterssetforthinthe“SafeLearningPlanfor2020-21”(“SafeLearningPlan”)inimplementingthethreeinstructionalmodels.Circumstancesmayrequireturningthedialbackward(lessin-schoolinstruction)orallowforturningthedialforward(morein-schoolinstruction).Whilereopeningschoolbuildingsforin-personinstructionisourultimategoal,andwerecognizethatmanychildrenandfamilieshaveexperiencedadditionaleconomichardships,socialisolation,andotherstressorsthroughdistancelearning,themainprioritymustcontinuetobethehealth,safety,andwellnessofourstudents,staff,andcommunity.DuringtheCOVID-19pandemic,ourschooldistrictsandcharterschoolsmustcontinuetocollaboratecloselywithMDE,MDH,andlocalpublichealthauthorities.

TheCommissioner,incollaborationwiththeCommissionerofHealth,continuestoretaintheauthoritytocloseschools,charterschools,andschooldistrictsortocurtailschoolactivities.However,thisExecutiveOrderalsogiveslocalschooldistrictsandcharterschoolstheabilitytodialbackordialforwardactivitiesconsistentwiththelatestdata,guidance,andparameterssetforthintheSafeLearningPlan.Ourstateagencies,alongwithlocalandregionalpartners,willprovideourlocaleducationagenciestheproperguidanceandparameterstosupporttheminmakingtheseimportantdeterminationsfortheircommunities.Incollaborationwithcommunitypartners,educators,families,andstudents,aschooldistrictorcharterschoolmaychoosetobemorerestrictivethanwhatisrecommendedbythemostup-to-dateparameterssetforthintheSafeLearningPlan.Wewillalsoensurethatdistancelearningcontinuestobeawidespreadoptionforfamiliesconcernedaboutin-personlearning,andthisoptionmustmeettheneedsofallstudentswhochooseit.

AsprovidedinMDEguidance,careforschool-agedchildrenofcertainworkersincriticalsectors(“EligibleChildren”)mustcontinueduringtheimplementationofdistanceandhybridlearningmodels.Iamgratefulforthecarethatschooldistrictsandcharterschoolshaveprovidedduringthispandemic.InconsultationwiththeMinnesotaChildren’sCabinet,MDEwillcontinuetoprovideguidanceregardingchildandschoolagecare,enrichment,andlearningduringthe2020-21schoolyear.Allprogramsservingchildrenmustfollowpublichealthguidelinesonmasking,socialdistancing,personalhygiene,screening,andcleaningpractice(“PublicHealthGuidelines”).Iencourageschooldistrictsandcharterschoolstocontinuetoprioritizeinnovationanddirectoutreachtostudents.

InMinnesotaStatutes2019,section12.02,theMinnesotaLegislaturerecognizedthe“existingandincreasingpossibilityoftheoccurrenceofnaturalandotherdisastersofmajorsizeanddestructiveness”andconferredupontheGovernortheemergencyanddisasterpowersprovidedinChapter12to“ensurethepreparationsofthisstatewillbeadequatetodealwithdisasters,”to“generallyprotectthepublicpeace,health,andsafety,”andto“preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2019,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontroltheState’semergencymanagementaswellascarryouttheprovisionsofMinnesota’sEmergencyManagementAct.

UnderMinnesotaStatutes2019,section12.21,subdivision3(11),theGovernormayauthorizetheCommissioner“toalterschoolschedules,curtailschoolactivities,ororderschoolsclosed.”Pursuanttosubdivision3(1)ofthatsamesection,theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”ofMinnesotaStatutes2019,Chapter12.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthependencyofapeacetimeemergency.AnyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionoftheStatearesuspendedduringthependencyoftheemergency.

Forthesereasons,Iorderasfollows:

1. PreviousCOVID-19ExecutiveOrdersrelatedtotheCommissionerofEducationremainineffectexceptasmodifiedorsupersededbythisExecutiveOrder.

Executive Orders2. ThisExecutiveOrderappliestoallschoolsassetforthinMinnesotaStatutes2019,section12.21,

subdivision3(11).IcontinuetoencouragetribalandnonpublicschoolstofulfillthespiritanddirectivesofthisExecutiveOrder.

3. NothinginthisExecutiveOrdershouldbeconstruedtoencourageorrequireMinnesotansincategoriesatriskofsevereillnessfromCOVID-19toactinconsistentlywithpublichealthrecommendationsortheadviceoftheirdoctors.AllMinnesotansshouldcontinuetoregularlycheckandfollowtheadviceonMDH’sCOVID-19website(https://www.health.state.mn.us/diseases/coronavirus/).

4. Tobeginthe2020-21schoolyear,schooldistricts(“districts”)andcharterschoolsmustimplementanappropriateinstructionalmodelthatadherestoparameterssetforthintheSafeLearningPlan.Theinitialdeterminationofwhichinstructionalmodeladistrictorcharterschoolimplementstostartthe2020-21schoolyearmustbemadeatleasttwoweekspriortothestartoftheirrespectiveschoolyearcalendar.IdirectMDHtoupdatetheSafeLearningPlanasneededtorespondtotheevolvingCOVID-19environment.PursuanttoMDEandMDHguidance,alldistrictsandcharterschoolsmustofferadistancelearningmodelthatmeetstheeducationalneedsofallstudentsoffamilieswhochoosenottoreceivein-personinstruction.

5. ConsistentwithMDHguidanceandinconsultationwithlocalpublichealthofficials,MDH,andMDEtotheextentpossible,adistrictorcharterschoolmaydialbacktoaninstructionalmodelthatismorerestrictivethanwhatisrequiredundertheSafeLearningPlanifthedistrictorcharterschooldeterminesthatdialingbackisnecessaryforaschoolbuildingorparticulargradesofinstruction.Suchactionsmustbeconsistentwithguidanceoutlinedinparagraph8.IfadistrictorcharterschoolchoosestodialbacktoamorerestrictiveinstructionalmodelthanwhatisrequiredbytheSafeLearningPlan,itmustnotifytheCommissionerwithin24hoursofimplementingthemorerestrictiveinstructionalmodel.

6. PursuanttoMinnesotaStatutes2019,section12.21,subdivision3(11),theCommissionerisauthorizedtoorderadistrictorcharterschooltodialbacktoamorerestrictiveinstructionalmodeliftheCommissioner,inconsultationwithMDHandthedistrictorschool,determinestheinstructionalmodelbeingutilizedbythedistrictorcharterschoolisnolongerappropriatepursuanttotheSafeLearningPlan.

7. Morerestrictivemodelsofinstructionmaybenecessaryforindividualclassroomswithinaschoolbasedonthecircumstances.MDHwillworkinconsultationwithMDEandschoolstoensureclearpublichealthguidance,notification,andprocessesareimplementedtoprotectthesafetyofstudents,staff,andtheoverallschoolcommunity.

8. IntheSafeLearningPlan,MDHmustprovideparameterstodistrictsandcharterschoolsthatindicatewhenadistrictorcharterschoolmustdialbacktoamorerestrictiveinstructionalmodelandtailormodelsbasedonagegroupandgrade.Adistrictorcharterschoolmustconsiderthisguidancewhendeterminingwhethertolimitin-personinstructionpursuanttoparagraph5.TheCommissioner,inconsultationwiththeCommissionerofHealth,mustworkwitheducationpartnerstodeveloptrainingtoassistdistrictsandcharterschoolsinmakingdecisionstodialbackinstruction.

9. Adistrictorcharterschoolthathasdialedbackitsinstructionalmodelpursuanttoparagraphs4or5maysubsequentlydialforwardtoalessrestrictiveinstructionalmodelifdoingsoisinadherencewiththeSafeLearningPlan.Ifadistrictorcharterschoolchoosestodialforwardtoalessrestrictiveinstructionalmodel,itmustnotifytheCommissionerwithin24hoursofimplementingthelessrestrictiveinstructionalmodel.

10. IencouragetheServiceCooperativestobeavailabletoprovidesupporttodistrictsandcharterschoolswithintheirregionthatareworkingwithMDH,MDE,andlocalpublichealthofficialstodeterminewhethertodialbackordialforwardinstructionalmodelspursuanttoparagraphs4,5,or9.IalsoencouragetheServiceCooperativestoprovidesupporttodistrictsandcharterschoolswithintheirregionastheyimplementsuchmodels.

14. Ifadistrictorcharterschoolwillbeimplementingin-personlearningorahybridlearningmodeltocommencethe2020-21schoolyear,itseducatorsandotherworkers,inaccordancewithPublicHealthGuidelinesandparagraph13,willreporttotheirrespectiveschoolbuildingsnolaterthantwobusinessdaysbeforethestartofthe2020-21yeartoplanandprepareforstudents’returntoschoolbuildings.

15. Pursuanttoparagraph17ofExecutiveOrder20-57,IdirecttheCommissioner,inconsultationwiththeCommissionerofHealth,tocontinuetoupdateguidanceforin-personlearning,hybrid-learning,anddistancelearningduringthe2020-21schoolyear.

16. DistrictsandcharterschoolsmustcomplywithPublicHealthGuidelines,applicableMDEguidance,andthisExecutiveOrder.

17. Districtsandcharterschoolsmustprovidestudents,teachers,andstaffwithateachingandlearningenvironmentthatcomplieswithPublicHealthGuidelines,including,butnotlimitedto,creatingasmuchphysicalspacebetweenstudentsandteachersasisfeasible.

Duringthe2020-21schoolyear,alldistrictsandcharterschoolsprovidingin-personlearningforallstudentsmustdosoaccordingtotheplansdevelopedduringtheSummerLearningPeriod,asdefinedbyparagraph2ofExecutiveOrder20-57,revisedasneeded,pursuanttoapplicablefederalandstatestatutes.Alldistrictsandcharterschoolsmustalsocreatecontingencyplansfordistancelearningandhybridlearningtobeusedifthedistrictorcharterschoolchoosestodialbackin-personinstructionpursuanttoparagraph5orisrequiredtodialbackin-personinstructionpursuanttoparagraphs4or6.Districtsandcharterschoolsarestronglyencouragedtoengagetheirschoolcommunity(staffandfamilies)anddocumentthatengagementintheirplans.

21. hybridlearning,anddistancelearningplanstostudentsandtheirfamiliesnolaterthanoneweekbeforethebeginningoftheirrespective2020-21schoolyear.Districtsandcharterschoolsmustmakeallreasonableeffortstoprovidesuchcommunicationsorallyandwritteninlanguagesspokenintheirrespectivedistrictorcharterschool.Thecontingencyplansmustaddress,butnotbelimitedto,communicationpathwayswithstudentsandfamilies,communityinputonstudentandfamilyneeds,andotheroutreachopportunities.Thisisinadditiontoaddressingcoreinstruction,supportsforallstudentgroups,nutrition,school-agecare,technologyneeds,andeffectivedeliveryofeducationalmodelstostudentsinadistancelearningorhybridmodelsetting.TheCommissionermayreviewwhetheraplanadequatelyaddressestechnologicaldisparitiesinaccessandlearning.TheCommissionermayrecommendchangesandprovidetechnicalassistancetodistrictandcharterschoolprogrammingtoaddressanysuchdisparities,toassistinmeetingtheneedsoftheirstudents,staff,andcommunities.

23. Adistrictorcharterschoolthatchoosestodialbackin-personinstructionpursuanttoparagraph5orisrequiredtodialbackin-personinstructionpursuanttoparagraphs4or6,mustprovidecontinuouseducationbasedonitsdistancelearningandhybridlearningcontingencyplans.

24. Subjecttoparagraph3,districtsandcharterschoolsthatchoosetodialbackin-personinstructionpursuanttoparagraph5orarerequiredtodialbackin-personinstructionpursuanttoparagraphs4or6,incooperationwithstateagencies,aredirectedtosupportcommunitiesdisproportionatelyimpactedbydistancelearningandhybridlearning,includingbutnotlimitedto,historicallymarginalizedordisenfranchisedfamiliesandfamiliesexperiencinghomelessness.Whereappropriate,districtsandcharterschoolsshouldprioritizeprovidingin-personinstructionandservicestostudentsfromsuchcommunitiesandfamilies.MDEwillcontinuetoprovideadditionalguidancetodistrictsandcharterschoolsaboutthisprovision.

25. Whenprovidinginstructioninperson,adistrictorcharterschoolmustcontinuetorunitsearlychildhoodprogramspursuanttoPublicHealthGuidelines,includingcommunityeducationprograms,andmaychargefeesonitsnormalslidingfeescale.Adistrictorcharterschoolmayalsocontinuetoprovidebeforeandafterschoolcareandmaychargefeesonitsnormalslidingfeescale.

26. Adistrictorcharterschoolthatdialsbackin-personinstructionpursuanttoparagraph5orisrequiredtodialbackin-personinstructionpursuanttoparagraphs4or6,mustprovidecareforEligibleChildrenatnocostduringthetimethosechildrenarenotreceivinginstructionintheschoolbuildingduringregularschoolhours.WorkersrequiredtoprovidecaretoEligibleChildrenunderthisExecutiveOrder,whichextendstherequirementunderExecutiveOrder20-02,paragraph11,andExecutiveOrder20-19,paragraph18,continuetoenjoythepresumptionprovidedunderMinnesotaLaws2020,Chapter72,section1.Adistrictorcharterschoolmaycontinuetorunearlychildhoodprograms,includingcommunityeducationprograms,andmaychargefeesonitsnormalslidingfeescale.Icontinuetoencouragedistrictsandcharterschoolstoprovidebeforeandafterschoolcare,andtheymaychargefeesforsuchcareontheirnormalslidingfeescale.Inprovidingthiscare,schoolsmustfollowPublicHealthGuidelines.Schoolsarenotrequiredtoprovidecareduringpreviouslyscheduledbreaksreflectedonaschool-boardapprovedcalendar.MDEwillprovidefurtherguidancetodistricts,charterschools,andthepublicaboutthisprovision.

27. UponapprovalbytheExecutiveCouncil,adistrictorcharterschoolthatchoosestodialbackin-personinstructionpursuanttoparagraph5orisrequiredtodialbackin-personinstructionpursuanttoparagraphs4or6,mustallow2020-21graduatingseniorstocompleteanytestingrequiredtoattainastatebilingualormultilingualsealunderMinnesotaStatutes2019,section120B.022,subdivision1b.

28. Consistentwithtribalconsiderations,guidancefromMDE,andthefederalEveryStudentSucceedsAct(“ESSA”),allconsultations,collaborations,andpartnershipswithTribalNations,AmericanIndianParentCommittees,andIndigenousEducationstaffmustcontinue.AmericanIndianEducationAidProgramPlansmustbeconsideredwhencreatingcontingencydistancelearningandhybridlearningplans.

UponapprovalbytheExecutiveCouncil,therequirementtoperformin-persondevelopmentalscreeningsunder MinnesotaRules2019,part3530.3400,iswaivedifadistrictorcharterschoolchoosestodialbackin-personinstructiontoadistancelearningmodelpursuanttoparagraph5orisrequiredtodialbackin-personinstructiontoadistancelearningmodelpursuanttoparagraphs4or6.MDEmustdevelopguidanceonaparentreporttoolinplaceofthein-persondevelopmentalscreening.

31. UponapprovalbytheExecutiveCouncil,therequirementtocompleteearlychildhooddevelopmentalscreeningwithin30daysunderMinnesotaStatutes2019,section121A.17,isextendedto90days.Thiswillallowchildrentoremainenrolledinkindergartenifadistrictorcharterschoolchoosestodialbackin-per-soninstructiontoadistancelearningmodelpursuanttoparagraph5orisrequiredtodialbackin-personinstructiontoadistancelearningmodelpursuanttoparagraphs4or6.

32. Ifadistrictorcharterschoolisprovidinginstructionthroughadistancelearningmodelpursuanttopara-graphs4,5,or6,IauthorizetheCommissioner,inconsultationwiththeCommissionerofHealth,toexpandin-schoolprovisionofactivitiesandprogrammingthattheCommissionerdeemsnecessaryandthatcanbeoperationalizedincompliancewithPublicHealthGuidelines.Thisexpansionofin-schoolactivitiesmustbewherethoseservicescannotbeprovidedthroughadistancelearningmodelandthoseservicesareneededtoaccessthatstudent’sdistancelearninginstruction,providesupportsorservicesschoolscansafelyoffer,andcreateopportunitiesformeaningfulconnectionsbetweenstudentsandteachers.

33. TheCommissioner,inconsultationwiththeCommissionerofHealth,mustestablishaprotocolinaccordancewithPublicHealthGuidelinestoallowforhomevisitsbyschoolstafftobuildandpreserverelationshipswithstudentsandtheirfamiliesforwhenadistrictorcharterschoolisprovidinginstructionthroughadistancelearningmodelpursuanttoparagraphs4,5,or6.Nothinginthisprotocolshouldbeinterpretedasarequirementorshouldbeusedtoreplaceservicesprovidedbycountiesorsocialservices.

34. Iencouragedistrictsandcharterschoolsthatchoosetodialbackin-personinstruction,pursuanttoparagraph5orarerequiredtodialbackin-personinstructionpursuanttoparagraphs4or6,toallowstudentstoretainanytechnologyprovidedtothemthroughtheremainderofthe2020-21schoolyear.Ialsoexpectdistrictsandcharterschoolstocontinuetoprovidemaintenanceforthistechnology.

35. Nosupplierorbusinessshouldlimitorrestrictreasonableordersofpersonalprotectiveequipmentorcleaning,hygiene,orsanitationsuppliesbychildcareproviderswhoareservingEligibleChildrenasdefinedinthisExecutiveOrderandasprovidedbyfurtherguidance.

36. UponapprovalbytheExecutiveCouncil,thefollowingpaymentsreceivedbyMinnesotansastheresultoftheCOVID-19pandemicmustnotbecountedasincomewhendeterminingeligibilityfortheearlylearningscholarshipsprogramadministeredbyMDE,pursuanttoMinnesotaStatutes2019,section124D.165:

AdeterminationthatanyprovisionofthisExecutiveOrderisinvalidwillnotaffecttheenforceabilityofanyotherprovisionofthisExecutiveOrder.Rather,theinvalidprovisionwillbemodifiedtotheextentnecessarysothatitisenforceable.

3.
