MISSION
The Idaho Volunteer Lawyers Program (IVLP)provides a safety net for low-income
individuals and families in Idaho who require civil legal services and cannot afford to pay for
them. IVLP recruits attorneys from local communities who volunteer their time and expertise to
assist those in need.
PROGRAM INFORMATION
Prospective clients apply on-line or over the phone. To qualify, they must be low-income
and have a legal matter that falls within IVLP priorities. Successful applicants are scheduled for
an interview with the Case Coordinator, who collects their relevant documents and then conducts
the interview of the phone. The Case Coordinator generates a written case summary for the file.
The Director then reviews the case and determines whether it is appropriate for placement with a
volunteer attorney.
Attorneys are recruited through direct outreach and also through IVLP’s secure attorney
portal, idahoprobono.org (PBOW). IVLP posts case and legal clinic opportunities on PBOW for
attorneys to select. All licensed attorneys are registered with PBOW and need only activate their
account and set their password to access the pro bono opportunities.
IVLP provides malpractice insurance for all volunteer attorneys as well as free CLE’s to
attorneys who have a case or agree to volunteer in the future. IVLP also provides mentor
attorneys, forms and other resources. In addition, filing fees are automatically waived pursuant to
court rule for IVLP cases.

IVLP FUNDING OVERVIEW
The Idaho Volunteer Lawyers Program (IVLP) is a project of the Idaho Law Foundation
(ILF), which is a 501(c) (3) organization. It primarily is funded through grants and donations
given directly to IVLP, and it is also supported by ILF’s operating budget.
I. GRANTS
IOLTA Funds: Currently, the largest grant received by IVLP is from the Idaho Law
Foundation’s Interest on Lawyers Trust Accounts (IOLTA) funds. This grant has historically
been IVLP’s most significant source of funding; however, it is dependent on interest rates and,
following the Great Recession of 2008, funding from this grant plummeted. This funding has
recovered somewhat, although it remains at only 20% of IVLP’s funding. IVLP has not been
required to compete for IOLTA funding over the last several years; however, the Idaho Law
Foundation has indicated that it likely will reinstate the competitive grant process in the near
future. For 2020, IVLP will receive $51,000.
Bank of America Settlement Funds: IVLP also receives grant funds through the Idaho Law
Foundation’s Bank of America Settlement Fund. IVLP has received these funds since 2016 and
anticipates that this funding will be available for the foreseeable future. IVLP anticipates
receiving approximately $50,000.
Subgrant of Legal Services Corporation Funds: IVLP receives this funding from Idaho Legal
Aid Services. The 2020 grant is for $95,000, which funds IVLP’s operations and requires IVLP
to adhere to various federal regulations and to submit quarterly and year end reports.
Additional Grants: IVLP applies for various smaller grants to gain additional funding. For
2020-2022, IVLP will receive approximately $6000 per year through a grant obtained by ILAS
to serve seniors.
II. DONATIONS
IVLP participates in the Access to Justice campaign, a fundraising effort directed at
Idaho’s legal community and which benefits IVLP, Idaho Legal Aid Services (ILAS), and
Disability Rights Idaho (DRI). IVLP receives 25% of the funds raised through Access to Justice.
In 2019, Access to Justice raised approximately $150,000. IVLP’s participation in Access to
Justice limits the amount of independent fundraising IVLP can conduct. The Joint Fundraising
Agreement between IVLP, ILAS, and DRI is included with these materials.

WRITTEN STATEMENT OF PRIORITIES
IVLP’s analysis of the information and data collected and analyzed as part of IVLP’s
priority setting process indicates that IVLP should prioritize matters related to three broad areas
of concern for low-income residents of Idaho. These areas and the related matter types, which
IVLP has adopted as its priorities are set forth below:
1. Health, Safety and Stability of Individuals and Families:
• Custody (initial determination and modification): IVLP will take matters where there are
domestic violence or child endangerment issues. IVLP may also consider matters where
other compelling issues exist related to health, safety, and stability.
• Divorce: IVLP will take matters where there is domestic violence. IVLP may also
consider matters where other compelling issues exist related to health, safety, and
stability.
• Guardianships for minors: IVLP will take matters where the child has been abandoned,
abused, or neglected. IVLP will represent both petitioners and wards.
• Guardianships for adults: IVLP will take matters where there has been abuse or neglect or
where there is a risk of abuse or neglect without guardianship. This includes
guardianships for disabled adults who are unable to protect their own health and safety.
In the case of older clients, providing services for guardianships and conservatorships
where necessary will addresses the elder law issues considered a priority by the
stakeholders. IVLP will also consider matters involving requests to modify or terminate
guardianships where appropriate.
• Consumer matters for elderly clients and/or under compelling circumstances.
• Immigration: LSC qualifying VAWA and U-Visa. IVLP may also consider matters where
other compelling issues exist related to health, safety, and stability. (As most of IVLP’s
funding is not provided by LSC, this particular priority will most often be implicated by
non-LSC matters.)
• Wills and estate planning, including power of attorney and advanced directives.
• Civil Protection Orders.
2. Issues Related to Housing or Lack of Housing:
• Landlord/Tenant (private, subsidized, and public): IVLP will consider matters that
involve evictions that are not expedited habitability cases, cases to obtain return of a
security deposit, and cases that fight unsubstantiated charges by landlords. This category
also includes matters involving mobile home owners’ disputes over their rental
agreement with the mobile home park owner.
• Wills and Estates/Probate: Matters where heirs need to preserve housing by transferring
deeds through the probate process or where individuals seek to make provision of their
real property to ensure housing for heirs.
• SSI matters for homeless individuals and others who struggle to secure housing because
of lack of income.
• Other Housing: IVLP will continue to maintain a legal clinic at the Interfaith Sanctuary
and consider matters that may impact an individual’s or family’s ability to secure
housing.
• Home repair/scams.
• Foreclosure and predatory lending practices.
3. Maintaining and Securing Income for Individuals and Families:
• Consumer Matters:
o Collection (including repossession/deficiency/garnishment) and debt collection
harassment
o Identity Theft
o Unfair and Deceptive Trade Practices
o Predatory Lending
o Contracts/warranties
• Bankruptcy/Debt Relief
• Matters to maintain or secure public benefits: IVLP will focus on SSI cases, but may
consider other cases where compelling circumstances exist and the private bar or other
agencies do not offer services.
• Wills and Estates: Simple wills and estate planning, powers of attorney. This includes
special needs trusts.
• Immigration: for example, medical waiver cases for legal permanent residents seeking
citizenship.
4. Miscellaneous and Grants and Income from non-LSC Funders:
IVLP may take matters as approved by the Director where serious injustice would occur
without legal assistance and other sources of assistance are not readily accessible. In addition,
IVLP receives most of its funding from non-LSC sources. These sources typically fund activities
that are fully consistent with these priorities. Where a funding source expands client income
eligibility or requests additional services in certain types of matters not prohibited by law, ILAS
will provide the services contracted for by the funder.

DisAbility Rights Idaho has been
helping Idahoans with disability since 1977.
DisAbility Rights Idaho will use Access to
Justice Idaho funds to help people with mental
illnesses receive the support they need to avoid
hospitalization, contest guardianships that are
harmful, and help people with disabilities stay
in their homes and communities.
Access to Justice Idaho helps
Idaho’s most vulnerable residents:
veterans, seniors, people living with
disabilities, women, children, and
survivors of violence.
Providing them with the civil legal help
they need is an uphill battle.
Only one out of five Idahoans living in
poverty receive the civil legal help they
need when their most basic
human right are at stake.
As many as two-thirds of civil
litigants appear in court without a
lawyer.
Idaho is one of three states that does not
provide funding for free civil legal aid.
In response, Idaho Legal Aid
Services, Idaho Volunteer Lawyers
Program, and DisAbility Rights
Idaho created an annual fundraising
campaign, Access to Justice Idaho.

POLICY COUNCIL
The Policy Council is a group of individuals appointed by and accountable to The Idaho
Law Foundation Board of Directors. The Council provides oversight of The Idaho Volunteer
Lawyers Program on behalf of the Idaho Law Foundation Board of Directors.
The Council has several key responsibilities. In broad outline, these are:

Composition:
The Policy Council is comprised of 12 – 15 attorney and nonattorney volunteers
nominated throughout the 7 District Bar organizations of the state.
Members appointed to the Council are persons of stature and influence, reflecting the
legal community, community-at-large, business, government, and human services. Council
members shall possess:

Relationship to ILF Board of Directors:
The IVLP program is one of several major programs conducted by the Idaho Law
Foundation (others including Continuing Legal Education, Interest on Lawyers Trust Account
program, and law-related education programs). Each of these programs has an oversight
committee that reports to the Idaho Law Foundation Board of Directors. A member of the ILF
Board is assigned as a liaison to the IVLP Policy Council and will work to carry the policy
recommendations of the Policy Council to the Board of Directors.
Policy decisions and budget approval belong to the Board of Directors, though
tremendous deference is given to the recommendation of the oversight board. The Executive
Director of the Idaho Law Foundation is the chief administrative officers of the Foundation and
has hiring, firing, and supervisory authority over all staff, including the staff of The Idaho
Volunteer Lawyers Program. The Director of IVLP has day-to-day management of IVLP
operations and staff, subject to the supervision of the Executive Director.
The IVLP Policy Council will be instrumental in setting the tone and direction of IVLP
and in recommencing policy changes to the ILF Board of Directors. The Council is also
instrumental in developing the resources to operate IVLP and in determining the needs and
priorities of delivering volunteer legal services to Idaho’s communities.
Terms of Office:
Terms of office on the Policy Council are for three (3) years, with appointments on a
rotating basis.
Meeting Dates:
Policy Council meetings will be scheduled to meet quarterly at a date two weeks in
advance of the Idaho Law Foundation Board of Directors meetings.
Role of Council Members:
- Accept the basic beliefs and principles that support IVLP
- Reflect these beliefs and principles in oversight and policy review
- Be informed about the work of the Council and IVLP
- Participate actively in Council discussions and debates
- Be willing and available to attend all meetings
- Be willing to support the majority decisions of the Council
- Know IVLP’s financial position and budgets well enough to access the impact of
Council decisions
- Participate actively in developing the Program’s resources by supporting fund
development, recruitment, recognition, and community relations efforts.
Committees and Task Forces:
The Policy Council will establish committees and task forces accountable to the Council
to assist it in carrying out its many responsibilities.
Committees and task forces may be composed of both Council members and
nonmembers, selected by the Chair and approved by the Council, to do specific jobs for the
Council.
Committees will act as vehicles for:
o Accomplishing organizational objections
o Exchanging views and generating alternative courses of action
o Increasing quality of decisions by pooling information
o Providing continuity
o Utilizing specific talents and knowledge of Council members and
nonmembers.
As the range and complexity of Council affairs change, short-term task forces may be
formed to research particular issues and propose recommendations to the Council and will be
terminated with the assigned task is completed.
Responsibilities that may be assigned to committees include:
o Planning
o Budget review and formulation
o Legal needs/community needs assessment
o Fund development planning
o Recruitment & recognition planning
o Public/community relations
o Program development
o Policy review and planning

POLICY COUNCIL MEMBER EXPECTATIONS
Actively Participate at All Meetings: Policy Council will meet bi-monthly for one hour over
the lunch hour on the second Wednesday of the month or at such other date/time as scheduled
and convenient to Policy Council members. The meetings will take place at the Idaho State
Bar and a conference line will be opened for those who are unable to attend in person. In person
attendance is encouraged for local members. Attendance and participation are essential to the
success of the Council.
Serve on a Committee: Policy Council members should endeavor to chair or serve on one of
the priority focused committees (Infrastructure, Attorney, Client).
Make a Personal Contribution: Policy Council members should endeavor to contribute
financially to Access to Justice Idaho (which benefits IVLP and partner organizations
Disability Rights Idaho and Idaho Legal Aid Services) and/or volunteer their time to IVLP pro
bono cases or clinics.
Be a Good Advocate: In an effort to increase program awareness amongst volunteer attorneys,
the council will host community outreach events. Policy Council members should attend the
events and assist with volunteer recruitment and recognition.

COMMITTEES
1. Attorney Committee: The primary focus of this committee is increasing the number of
attorneys engaging in pro bono work through IVLP.
Members: Alyson Foster, Tim Murphy, Lessie Brown, Judge Kibodeaux, Sue Pierson
2019 Goals:
• The committee goal is to have 55 new attorney volunteers in one year
• The committee will work on increasing attorney volunteers statewide by
developing a series of family law CLEs to be delivered by magistrate judges in
the various districts.
• The committee will work on creating resources for attorneys.
• The committee will develop the idea of creating partnerships with law schools
2. Client Committee: The primary focus of this committee is to improve services for clients.

2019 Goals:
• Comprehensive Plan for Community Outreach
3. Infrastructure Committee: The primary focus of this committee is to increase IVLP’s
revenue and to improve IVLP and Policy Council systems and processes
