TheSt.Mary’sAthleticDepartmentiscomprisedofmanyindividualsactingtogethertoachieveonecommongoal.DIRECTOROFATHLETICSTheDirectorofAthletics isresponsiblefortheadministrationandmanagementoftheDepartmentofAthletics inamannerthatisconsistentwiththemissionoftheUniversity.TheDirectorofAthleticsisresponsibleforoverseeingtheUniversity’sprogramsforintercollegiatesports,clubsports, intramuralsportsandrecreationalactivities,aswellasathleticsfacilities.TheDirectorofAthleticsisexpectedtoprovidetheleadershipnecessarytoachieveandmaintainasuccessful athletics program, ensurecompliancewithall governing authoritiesand establisha strongandpositivepresenceatthelocal,regionalandnationallevels.TheDirectorofAthleticsmustbecommittedtothemissionofSt.Mary’sUniversity.TheDirectorofAthleticsreportstotheUniversityPresident.SENIORWOMANADMINISTRATORServes as an additional resource for student-athletes and staffwith comments or concerns. She is responsible forensuringgenderequitywithinthedepartmentaswellasprovidinganoverallpositiveexperiencetostaffandstudent-athletes.TheSWAreportstotheDirectorofAthletics.ASSOCIATEDIRECTOROFATHLETICSFOREXTERNALOPERATIONSOverseesallstrategiccommunicationsforSt.Mary'sathleticsteams,includingmediarelations,socialmedia,marketing,promotions,andbrandingandlicensing.Healsosupervisesalloutward-facinginitiativessuchasthewebsite,RattlerNetwork,ticketoperations,theteamstore,andalsoassiststheDirectorofAthleticswithseekingsponsorshipsandcorporatepartners.TheAssociateADforExternalOperationsreportstotheDirectorofAthletics.ASSOCIATEDIRECTOROFATHLETICSFORINTERNALOPERATIONSANDCOMPLIANCEServesastheprimarycontactbetweentheathleticdepartment,UniversityandtheNCAA.S/heisresponsibleforallmonitoringandeducationoftheNCAA,LSCandUniversityrules.HealsoservesastheDepartmentofAthleticsliaisontotheOfficeofFinancialAssistanceandAdmissionsOffice.TheAssociateADreportstotheDirectorofAthletics.ASSISTANTDIRECTOROFATHLETICSFORATHLETICCOMMUNICATIONSServesastheprimarycontactbetweentheathleticdepartment,University,mediaandcommunitywithregardstoallvarsitysports.TheAssistantDirectorofAthleticsreportstotheAssociateDirectorofAthleticsforExternalOperations.The Graduate Assistant for Communications/Marketing, Sports Information Assistant/Statistics Coordinator andstudent workers within athletic communications report to the Assistant Director of Athletics for AthleticCommunications.BUSINESSMANAGERServesasthemonitorandenforcerofthedepartmentbudgetandeachsportbudgets.S/heisresponsibleformonitoringandreconcilingtheathleticdepartmentbudget.S/hearealsothecontactforcoachesandstafftoensuretherespectivebudgetsarefollowed.TheBusinessManagerreportstotheDirectorofAthletics.HEADATHLETICTRAINERServesastheprimarysourceofmedicalattentionforthestudent-athletes.TheHeadAthleticTrainerreportstotheDirectorofAthletics.AssistantandGraduateAssistantAthleticTrainersreporttotheHeadAthleticTrainer.DIRECTOROFOPERATIONSServesastheprimarycontactforallgame-dayactivitiesincludingjobdistributionofwork-studystudents.TheDirectorofOperationsisresponsibleforofficialcoordinationandfacilitymaintenanceasdirected.S/heisresponsiblefortheorderingofallSt.Mary’sathleticsequipmentandapparel.ThispositionreportstotheDirectorofAthletics.HEADCOACHServesastheprimarycontactfortheirrespectivesport.S/heisresponsibleforthecreation,development,budget,etc.oftherespectiveteam.TheHeadCoachreportstotheDirectorofAthletics.AnyAssistantCoach,GraduateAssistantorvolunteerreportstotheHeadCoach.

GOALSANDOBJECTIVES
St.Mary’sAthleticsstrivesto:• Providesupportservicesthatpromoteacademichealth,retentionandgraduationfromSt.Mary’sUniversity• Eachteamshouldstrivetocompeteatahighlevelthroughouttheplayingandpracticeseason.Ourteamswill
competeontheregionalandnationallevelforchampionshiphonors.• Anefficientandcost-effectivesupportsystemfortheoperationoftheexistingathleticsprogramshouldbe
developedandmaintained.

PERSONNEL*AdditionalinformationavailableonGatewayOFFICEHOURSTheexpectedhoursoftheUniversityare8a.m.to5p.m.Allemployeesmustestablish,communicateandmaintainregularlyscheduledofficehours.Exceptionswillbemadewhentraveling,basedonpart-time,full-timepositionsandin-season-outofseason.AllstaffmembersshouldmaintainanOutlookcalendarwiththeirdailyschedulesandensuretheDirectorofAthleticsandBusinessManagerknowstheirwhereabouts.Coachesshouldcommunicatehourswithstaffandteammemberswhenofficehoursarealtered.PleaseremembertocontacttheDirectorofAthleticsandBusinessManagertoleteachknowifyouwillbeoutsick.Pleaseremember,perUniversitypolicy,toenteryourvacationanddaysoffintoGatewaytoreceiveapproval.AnOutlookCalendarisaccessibletotheadministration,staffandcoaches.Allcalendarsaretobecurrentandupdatedonadailybasiswith,vacation,personal, sick, recruiting,etc.as this isa tool,whereby, theDirectorofAthleticsorBusinessManagercanviewthemonanasneededbasis.DRESSCODEAllemployeesareexpectedtodressinaprofessionalmanneratalltimesreflectiveoftheirpositionanddutiesatanygiventimeoftheday.This includestheoffice,atapractice,competitionandtravel.Universityexpectationswillnotconflictwithapplicablefederalandlocalstatutesincludingthoseprohibitingdiscriminationbasedonethnicornationalorigin.Employee’sdressandappearanceshouldbeappropriateatalltimestogiveapositiveimpressionoftheUniversity.Employees,inconjunctionwiththeirsupervisors,mayusetheirjudgmentregardingtheappropriatedressdeterminedbytheirscheduleofactivitiesandduties.Administrators,staffandcoachesmaybecomfortablydressedforwork,yetappropriateforanofficeenvironment.KEYS/AA&CCROOMSAllkeysforSt.Mary’sfacilitiesareissuedandcollectedbytheDirectorofOperationsortheBusinessManager.AllkeyrequestsandlocksmithworkordersmustbeapprovedbytheDirectorofAthletesordesignee.ToreserveanyclassroomortheHospitalitySuiteintheAA&CC,contacttheAdministrativeAssistant,AA&CC/CampusRecreationviaemail.HIRINGPROCEDURESAllvacanciesforallathleticdepartmentpositionswillgothroughaproperjobsearch.TheDepartmentofAthleticswilladvertisethepositioninaccordancewiththeOfficeofHumanResourcesandtheinstitutionalguidelines.Allapplicantsmustcompletethenecessarypaperworkandhavetheirbackgroundcheckcompletedandapprovedbeforebeginningthejob.Inaddition,allemployeesaretobeapprovedbytheDirectorofAthleticspriortoanyhiringagreementwhichincludesvolunteersorpart-timeemployees.STAFFEVALUATIONOnanannualbasis,theDirectorofAthleticswillevaluateeachathleticstaffmembertoreviewtheirperformance.ItwillbetheresponsibilityofeachHeadCoachtoevaluatetheircoachingstaffandsubmitareporttotheDirectorofAthletics.This processwill be in conjunctionwith the Office ofHuman Resources and the University policy concerning theevaluationofemployees.HEADCOACHESEVALUATIONAttheendofeveryacademicyear,theDirectorofAthleticswillmeetwitheachHeadCoach.ThisprocesswillbeinconjunctionwiththeOfficeofHumanResourcesandtheUniversitypolicyconcerningtheevaluationofemployees.Eachcoachwillreceivethreeevaluationsinthefollowingmanner:

1.CoachisevaluatedthroughouttheyearbytheDirectorofAthletics2.Coachisevaluatedbystudent-athleteseniorexitinterviewsandend-of-theseasonsurveyswithteam3.CoachmeetswiththeDirectorofAthleticsforfinalevaluationAllreviewsareonfileintheOfficeofHumanResourcesandareavailabletothePresidentuponhisrequest.ASSISTANTCOACHESEVALUATIONAttheendoftheyear,eachassistantcoachwillbeevaluatedbytheirindividualHeadCoach.ThisprocesswillbeinconjunctionwiththeOfficeofHumanResourcesandtheUniversitypolicyconcerningtheevaluationofemployees.Eachcoachwillreceivethreeevaluationsinthefollowingmanner.1.CoachisevaluatedthroughouttheyearbytheirrespectiveHeadCoach2.CoachisevaluatedthroughouttheyearbytheDirectorofAthletics3.Coachisevaluatedbyseniorexitinterviewsandend-of-theseasonsurveyswithteam4.HeadCoachmeetswithAssistantCoachforfinalevaluation5.HeadCoachsubmitsfinalevaluationtoDirectorofAthleticsGRIEVANCEPROCEDURESAnyemployeeoftheUniversitywhobelievesthathe/shehasnotbeentreatedfairlyinajob-relatedmattermaymakeuseofthegrievanceprocesswithinten(10)workingdaysoftheincident.Thisprocessprovidesthreelevelsofactionthrough which a grievance may be carried: (1) the grievant’s immediate supervisor; (2) the Director of HumanResources;and(3)theVicePresidentforAdministrationandFinance.Agrievancemustproceedthrougheachlevelbeforemovingtothenexthigherlevel.Inotherwords,nolowerlevelcanbebypassedbeforeproceedingtothenexthigher level.Workrelatedgrievancesoccurringmore than ten (10)workingdaysprior to the filingof thewrittengrievancewillnotbeacceptedandaredeemedtobewaived.EXITPROCEDURES Itisrequestedthatallemployeesprovidetheearliestpossiblewrittennoticeofarequesttoresign.AllresignationsaresubjecttoapprovalbytheUniversity.Theemployeeisexpectedtogivenotice,asacourtesytotheUniversity,tohis/hersupervisor,DirectorofAthletics,andtheDirectorofHumanResourcesnotlaterthan20workingdaysforanexemptemployeeor10workingdaysforanon-exemptemployeepriortohis/herlastdayofemployment.In the event an employee retires or leaves theemployment of theUniversity, theemployeewill schedule an “exitinterview”withtheDirectorofHumanResourcessothatallmatterspertainingtoretirement,insurance,healthbenefits,andmonetaryconcernscanbehandledinanorderlymanner.COACHES/STAFFMEETINGSAll Head Coaches, full-time assistant coaches and athletics staffmemberswillmeet on a regular schedule that isestablishedbytheDirectorofAthleticsafterconsultinggameschedulesandstaffavailability.Allstaffmeetingsaremandatory for full-timeemployees.Anystaffmembernotable toattendone-on-onemeetingswith theDirectorofAthleticsand/ortheCoachesmeetingsmustnotifytheDirectorofAthleticsinadvance.CONFERENCEMEETINGSHeadcoaches,athleticcommunications,complianceofficerandathletictrainersarerequiredtoattendtheconferencemeetingfortheirareaviaconferencecallorinperson.FailuretoattendameetingwithoutpriorapprovalbytheLoneStarConferenceofficemayresultinafinebytheLSCoffice,whichtheindividualwillberequiredtopay.EXTENDEDLEAVE(FamilyandMedicalLeave) Staffmembersleavingofficeforanextendedperiodoftime(FamilyandMedicalLeave)mustreportthisinformationtoHumanResources,DirectorofAthleticsandBusinessManagerattheearliestpossibletime.HumanResourceswillhelpwiththerequestforleaveofabsenceformandtoverifytheemployeequalifiesfortheFamilyandMedicalLeaveAct.

UNEXPECTEDLEAVE(e.g.sickness)Ifstaffmembersaregoingtobeabsentorlatebecauseofillnessoranyotherreason,itistheirresponsibilitytocalltheir immediate supervisor prior to the employee’s scheduled starting time to report the absence and the date ofexpectedreturn.Iftheemployeecannotreturnattheexpectedtime,thesupervisorordepartmentheadmustbecalledagainwith theemployee’sexpected lengthofabsence.TheUniversity requestsaphysician’snoteorothermedicalevidenceafterthethirdconsecutivedayofabsenceduetoillnessorinjury.Additionally,employeesareexpectedtomaintainanOutlookcalendarthroughcoordinationwiththeBusinessManager.Thecalendarshouldreflectwhentheemployeewillbeoutoftheoffice.EQUALOPPORTUNITY,NON-DISCRIMINATION,SEXUALANOTHERFORMSOFHARRASSMENTSTATEMENTSt.Mary’sUniversityaffirmsitscommitmenttopromotethegoalsoffairnessandequityinallaspectsoftheeducationalenterpriseinfullcompliancewiththerequirementsofTitleVIIoftheCivilRightsActof1964,TitleIXoftheEducationAmendmentsof1972,theCivilRightsActof1991,thePregnancyDiscriminationActof1978,theAgeDiscriminationinEmploymentAct,theOlderWorkersBenefitProtectionAct,theAmericanswithDisabilitiesAct,theEqualPayAct,theUniformedServicesEmploymentandReemploymentRightsAct,theGeneticInformationNondiscriminationAct,theImmigrationReformandControlActof1986,andotherfederal,state,andlocallaws.AllallegedviolationsofthispolicywillbehandledinaccordancewiththeUniversity’sEquityDiscriminationResolutionProcess.TheEquityDiscriminationResolutionProcessappliesregardlessofthestatusofthepartiesinvolved,whomaybestudentsoremployees(staff,faculty,oradministrators).TheUniversityreservestherighttoactonconductthatmayconstituteaviolationofthispolicyoccurringoncampusoroffcampus,whentheoff-campusconductcouldhaveanon-campusimpactorimpactonthemissionoftheUniversity.The Director of Human Resources serves as the Title IX Coordinator and oversees implementation of this policy.AllegationsofviolationsofthispolicymustbereportedtotheTitleIXCoordinatorimmediately.ReportingisaddressedmorespecificallyinthecompletePolicyandEquityDiscriminationResolutionProcessmaintainedinthePolicyLibraryonGateway.DEPARTMENTOFATHLETICSPOLICYONMEDICALPRIVACYINTHEWORKPLACEAn employee’smedical situation should be treated as confidential at all times and an employee has the right toconfidentialityregardinghis/hermedicalsituation.Suchsituationsshouldneverbediscussedamongemployees.Althoughanemployeemayrevealthenatureofamedicalconditiontohis/hersupervisor,suchanactionisnormallyatthediscretionoftheindividualconcerned.Someemployeesmayneedtoknowabouttheabsence,andmaybegenuinelyconcernedandaskquestionsabouttheMedicalabsence/condition.However,supervisorsandemployeesshouldnotgivedetailstootherstaffmemberswithouttheemployee’spermission.Anemployee’swishesmustberespectedunlessthereisalegitimatebusinessreasonforrevealingtheinformationtoothers–inwhichcase,theemployeemustexplainthattheinformationwillbereleaseddiscreetlyandonlytothosewhoneedtoknow.Anyemployeeabouttoembarkonanactionthatcouldinvadeemployee’sprivacyshouldconsidertheramifications.Iftheactionmakesanemployeefeeluneasy,theprobablyneedtogiveitcarefulandthoroughconsiderationbeforegoingforward.Allaspectsofanyemployees’medicalleaveshouldbechanneledthroughHumanResources.Thisisnotatopicforopendiscussionintheworkplace.EMERGENCYPROCEDURESANDUNIVERSITYCLOSUREIntheeventtheUniversityopeningisdelayedduetoanytypeofemergency,theemployeeisrequiredtoreporttoworkattheannouncedtime.Iftheemployeedoesnotreporttowork,he/shewillnotbepaidforthatentiredayunlesstheemployeehassickorvacationleaveavailable.Shouldinclementweatherbeginduringaworkingdayandthedecisionismadetocloseearly,alldepartmentswillbeappropriatelyinformedandpaymentwillbemadeforthehoursclosed.Shouldtheemployeefeelhe/shemustleaveearlyduetoinclementweatherwhenthedecisionhasbeenmadetokeepthecampusopen,theemployeewillonlybe

paidforsuchtimeiftheemployeemakesuphoursofabsencewithinthesameweekoftheemergencyandatatimemutuallyagreeabletotheemployeeandthesupervisororwithsickorvacationleavetheemployeehasavailable.PROFESSIONALETHICSInouroffices,weregardasnecessary thecreationofenvironments,whicharemarkedby the freeinquiry,mutualrespect,andcommonsupportthatencourageindividualgrowthanddevelopment.Inourpersonal interactionwithfellow staff members and student-athletes, we must respect an individual’s personal space and right toconfidentialityexceptwherethereisimminentdangertothatpersonortoothers.Inourrecognitionofthetrustandpower inherent in the professional-student relationship, we expect wholesome interactions that do not userelationshipsforprivateadvantage. Inourvisionof thebesthumanpotential,wepromote inourselvesand inourstudents thevalueofan integrated life– including intellectual,physical, spiritual, andemotional flourishing–asaworthyideal.Inoureffortstobuildcommunity,weaffirmtheneedforaclimateoftrustthatisfreeofmanipulation,coercion, or belittlement, and supportive of respect for one another’s integrity andworth. COACHINGSTAFFRESPONSIBILITIESThedevelopmentandmaintenanceofasoundprofessionalrelationshipwiththestudent-athleteisvital.Asamemberof the NCAA, St. Mary’s ascribes to the ethical issues of this governing organization. Adherence to all rules andregulationsastheypertaintoethical,moralandfinancialmattersistobefollowedtotheletter.AsamemberoftheLoneStarConference,St.Mary’sadherestoallrulesandregulationsthatgovernourprograms.Ifyouhaveanydoubts,consulttheDirectorofAthleticspriortotakinganyaction.HEADCOACHRESPONSIBILITYTheheadcoachisresponsibleforthetotalconductofhisorhersportprogramwithinthelimitsofauthoritydefinedby:

All violationswill be sent to the LSC and NCAA asmandated. The followingprocedurewas developed to support compliance,monitoring and oversight of the entire athletics program. STUDENT-ATHLETEPAPERWORKNopractice is tobeconducteduntil the teamhascompletedall student-athletepaperwork (NCAAStudent-AthleteStatement,NCAADrugTestingConsent,HIPPA,CAupdateandathleticmedical).Thosestudent-athleteswhojointheteamafterthefirstdayofpracticemustseetheComplianceOfficepriortoengaginginanypracticeactivities.MEDICALHARDSHIPWAIVERThe request for amedical hardshipwaiver is to be submitted to the compliance office alongwith all supportingdocumentationpriortothestudent-athlete’snextseasonofcompetition.ThisdocumentationwillbecollectedfromtheSportsMedicinestaffbytheComplianceOfficeandthensubmittedtotheLSCoffice.Hardshipisdefinedasanincapacityresultingfromaninjuryorillnessthathasoccurredunderallofthefollowingconditions:
• Theincapacitatinginjuryorillnessoccursinoneofthefourseasonsofintercollegiatecompetitionatanytwo-yearorfour-yearcollegiateinstitution;
• Theinjuryorillnessoccurspriortothefirstcompetitionofthesecondhalfoftheplayingseason thatconcludeswiththeNCAAchampionshipinthatsportandresultsinanincapacitytocompetefortheremainderofthatplayingseason;
• Theinjuryorillnessoccurswhenthestudent-athletehasnotparticipatedinmorethanthreecontestsordatesofcompetition(whicheverisapplicabletothatsport),or30percentofthemaximumpermissiblenumberofcontestsordatesofcompetition.Competition(excludingscrimmagesandexhibitioncontests)againstoutsideparticipantsduringtheplayingseasonthatconcludeswiththeNCAAchampionship,or,ifsodesignated, during the official NCAA championship playing season in that sport (e.g. spring baseball, fallsoccer),shallbecountableunderthislimitation.
SOCIALMEDIATheNCAAlooksatsocialnetworkinglessintermsofthetechnologybeingusedandmoreintermsofitsrecruitingimpact.ItisnotpermissiblewithinNCAArulestomakecommentsaboutpossiblerecruitsonaninstitution’ssocialmediapageorpagebelongingtosomeoneaffiliatedwiththeinstitution.Inaddition,itisimpermissibleforthesepagestofeaturephotosofprospectsandprohibitsmessagesfrombeingsenttoPSA’susingthesesocialmediatechnologiesotherthanthroughtheirdirectmessagefunction.PubliccommentsonaPSAcommittingtoNSUarenotpermissiblewithinNCAArulesuntilapprovalHASBEENRECEIVEDfromtheComplianceOffice.ThisincludesretweetingaPSA’spost.WritingonwallsisalsoimpermissibleuntilafterPSA’ssignanNLIorathleticawardletterorpayenrollmentdeposit.Facebook/Twitterdirectmessages(throughinbox)treatedlikeemail,isokayafter6/15precedingandPSA’sjunioryearofhighschool.AcceptingafriendrequestorfollowingaPSAispermissibleatanytimeincludingpriortothefirstpermissibledateto send electronic correspondence, even if the social networking website send an automatic electronicallygeneratednotification(i.e.,email,textmessage,pushnotification),providedthestaffmemberdoesnotmodifytheautomatically-generatedelectronicnotificationandnoadditionalcommunicationisincluded.NOTE:MonitoringPSAandstudent-athletesocialmediaaccountscanmakeyouliablefortheiractionsifyouseesomethingthatisillegaloraNCAAviolation.

activities3. Coachesshalldotheirbesttoarrangegameandtravelschedulesthatminimizemissedclasstime.Forsameday,
awaycompetitionscoachesshouldplan the travel scheduleso that student-athletesmissas little class timeaspossible,andgenerallyshouldaimtoallowstudentstoattendclassesthatconcludeatleast2hourspriortothescheduledtimeofdeparture.IfdeparturemustbeearlieritisexpectedthatthecoachwilldocumentthereasontotheDirectorofAthletics.
4. Forcompetitionwithovernighttravel,noteamshalldepartmorethan48hourspriortothetimeofcompetition.ExceptionstothisguidelinemustbedocumentedandapprovedbytheDirectorofAthletics.
5. Student-athletesmustregisterfortheirclassesinawaythatwillminimizemissedclasstime.Thereforeitiscriticalthattheymeetwiththeiracademicadvisorandcoachwellbeforetheinitialregistrationperiod.
6. TheAssociateAD/InternalOperationsmayrecommendtothecoachingstaffthatastudent-athletebeheldbackfromatriporcompetition,toattendclassesorfinishassignmentsifastudent-athlete’sacademiceffortsarefallingshortofgoodstanding.
7. For home competition, student-athletes shall not miss any classes prior to two hours before the scheduledcompetitiontime.
8. 12. Student-athleteswhobelievethattheyhavereceivedalackofreasonableaccommodationoftheprovisionsofthismissedclasspolicybyafacultymembershouldbringittotheattentionoftheAssociateAD/InternalOperationsandFacultyAthleticsRepresentative.
13. Student-athletesarerequiredtoattendallscheduledpracticesunlessthereisanunavoidableconflictwithaclassor an equally important academic event. Student-athletes who expect to miss a practice for this reason willcommunicatethatfacttotheircoachaheadoftime,andmaybeaskedfordocumentationoftheconflict.

• Thepolicyhasa$90,000deductibleandprovidesbenefitsinexcessofanyothervalidandcollectibleinsurance.

CONCUSSIONMANAGEMENTPre-ParticipationRequirements:Student-athletesatSt.Mary'sUniversityarerequiredtosigntheStudent-AthleteAcknowledgementoftheConcussionManagementPlanpriortoparticipatinginintercollegiatesportsatSt.Mary'sUniversity.Bysigningthisform,eachstudent-athleteisacceptingtheresponsibilitytoreportanypossibleconcussionstotheirAthleticTrainerandtofollowtheprotocolsetforthbytheConcussionManagementPlan.TheConcussionManagementPlanwillbemadeavailabletoallstudent-athletes.Student-athleteswillalsohaveavailabletothem,otherresourcesofeducationalmaterials,suchastheNCAAConcussionvideoandhandouts.ThesemaybefoundontheGATEWAYwebsiteandwithintheAthleticsDepartment.St.Mary'sUniversity’sAthleticTrainingDepartmentwillconductabaselineassessmentonallnewstudent-athletes(incomingfreshmenandtransferstudent-athletes).BaselinetestingwillconsistoftheSportConcussionAssessmentToolversion3(SCAT3)andlmPACT.TheSCAT3isatoolusedforevaluatingathletessuspectedofreceivingaconcussionandconsistsofasymptomscheck-list,cognitive(orientation, lmPACTisacomputerizedneurocognitiveassessmenttoolthatusesnormativedatatoassesscognitivefunction.Thesebaselineassessmentswillbeusedtoestablishwhenthereturn-to-playprotocolmaycommenceandtogainafullclearanceforreturntosportparticipation.Intheeventastudent-athletesuffersaconcussion,theywillberequiredtoretakeboththeSCAT3andlmPACTassessmentsthefollowingyeartoobtainanewbaselinescore.immediate/delayedmemoryandconcentration)assessments,andbalanceandcoordinationassessments.PreventionStrategiesforConcussionsTheAthleticTrainingDepartmentrecognizesthatmanyconcussionscannotbecompletelyprevented;however,bestpracticesprinciplesmayhelpdecreasethenumberofconcussioninjuries.Thefollowingarestrategiesthatmayhelppreventsomeconcussioninjuries:1. OperatingCommitteeonStandardsforAthleticEquipment)certified,thattheheadgearfitstheindividualandtheairbladdersworkandareappropriatelyfilled.Paddingshouldbecheckedtomakesuretheyareinproperworkingcondition.
3. Mouthguardsshouldfitandbeusedatalltimesforindividualswhohavepreviouslysustainedmultipleconcussions.4. Assesssafetyofplayingsurfaces/fields,makingsurethatpotentialhazardsareremediedorremoved(ie.cracksin
flooringthatanathletecantripon,defectivefencesaroundfieldsthatanathletecanruninto).AssessmentofaConcussionInanycircumstancewhereaconcussionissuspectedorastudent-athleteexhibitsanysignsorsymptomsofaconcussion,theymustberemovedfromfurtherparticipationandimmediatelyevaluatedbyahealthcareprofessional(teamphysicianorAthleticTrainer).Aninitialsidelineassessmentwillestablishthepresenceofaconcussion.Theassessmentshouldincludethefollowingassessments:1. ABCs(Airway,Breathing,andCirculation),2. Cervicalspineandskullforassociatedinjury,3. Symptoms,4. CognitiveAssessment:
a.Orientation:Date,dayoftheweek,month,locationofathlete,etc.b.Immediate/delayedmemory:Seriesofwordsimmediatelyanddelayedrecallingc.Concentration:Monthsinreverse,seriesofnumbersrepeatedbackwards
5. BalanceandCoordination:BESSassessmentorotherposturalassessmenttestandupperextremitycoordination,6. CranialNerveAssessment(CNI-XII),7. TimelineofSigns/Symptoms:Recorddurationofretro-/anterogradeamnesia,confusion.ImmediateManagementofConcussionOnceastudent-athletehasbeendiagnosedwithaconcussion,theymustberemovedfromcompetitionorpracticefortheremainderofthatdayandtheConcussionManagementPlanwillbeactivated.Everyconcussionscenariowillbemanagedinthesamemanner(withanexceptionofconcussionswithaprolongedlossofconsciousness).

4. Ifthestudent-athlete'sconditionstabilizeswithinanhourwithnodeteriorationofstate,theymaybereleasedhomeandreassessedwithin24-48hours.
a. Follow-upcareandinstructionsshouldbegiventothestudent-athleteandaresponsibleindividualtohelpmonitorthestudent-athlete'scondition.

Iftheyexperienceadeteriorationofstate,call9-1-1orhavesomeonetakethemtotheemergencyroomimmediately;avoidalcoholorothersubstancesthatwillimpaircognitivefunction;avoidaspirinandothermedicationsthatcanincreasetheirriskofbleeding;andreplenishfluidsandeatamealassoonaspossible.Ifpossible,explaintheseinstructionswitharoommate,teammate,orguardianorsomeonewhocanfollowtheseinstructions.Haveroommate,teammate,orguardianmonitorathleteathomeforatleast3hours.
ImmediateManagementofConcussionswithProlongedLossofConsciousness:1. Ifthestudent-athletehasalossofconsciousnessthatlastslessthan(<)1minute,theyaretobe

FOLLOW-UPCAREANDMANAGEMENTStudent-athleteswillreceiveserialmonitoringofdeteriorationofstateevery24hoursafterimmediatemanagementcareofaconcussion.TheywillcontinuetocompletetheSCAT3ateachfollow-upappointment.Thecornerstoneofconcussionmanagementisphysicalandcognitiverestuntiltheacutesymptomsresolve,followedbyasupervisedstepwiseprogram.Academic/CognitiveManagement:Minimizingcognitivestressanddemandsonastudent-athleteduringthepost-concussionsymptomaticperiodwillallowforabetter-balancedbrainenergydemandthatwillfacilitaterecoveryfromaconcussion.Iftheathletedevelopsincreasedsymptomswithcognitivestress,theymayrequireacademicaccommodationssuchasreducedworkloads,extendedtest-takingtime,daysofforashortenedschoolday.Ifneeded,theAthleticTrainingDepartmentmayprovidethestudent-athletewithawrittenlettertotheathlete'sprofessors,explainingtheaspectsofaconcussion(suchasmechanismorinjury,neededcognitiveandphysicalrest,etc).TheAthleticTrainingDepartmentmayalsocontacttheDisabilitySupportServicestorequestacademicaccommodations.TheAthleticTrainingDepartmentwillprovidetheDisabilitySupportServiceswiththeproperdocumentation.Belowaretheguidelinesforacademicmanagement.

PhysicalManagement:Onceaconcussionhasbeendiagnosed,thestudent-athletemustberemovedfromanycompetitionorphysicalactivitiesfortheremainderofthatday.Thestudent-athletemustbeasymptomaticfora24-hourperiodpriortobeginningtheGraduatedReturn-toPlayProtocol.Oncethe24-hourasymptomaticperiodhasbeenreached,thestudent-athletewillcompleteanImPACTpost-concussionexam.Ifthistestincreasestheirsymptomsortheydonotscoreasatisfactoryscore,theywillberequiredtorestanother24hoursandretaketheImPACTagain.Thiswillbedoneuntilthetestcanbesuccessfullycompletedwithnoreturningofanysymptoms.Itisimportanttorememberthatphysicalactivitymayexacerbateclinicalsignsorsymptoms;therefore,student-athletesthatsufferfromaconcussionmustbemonitoredbyaclinicianorhealthcareprovider(i.e.Certified/LicensedAthleticTrainer)duringtheGraduatedReturn-to-PlayProtocol.Below(Table2)aretheGraduatedReturn-to-PlayProtocolguidelinesasoutlinedbythe2013InternationalConferenceonConcussioninSport,Zurich,Switzerland.

(a)Appointments.TheDirectorofAthletics,asthecurrentchair,shallappointthemembersofthecommittee.TheDirectorofAthleticswillberesponsibleforcommunicatinginformationrelatedtothe“Program”tothePresidentandtheViceProvostforStudentDevelopment.ThiscommitteeshallbecomprisedoftheDirectorofAthletics(servesastheChair),SeniorWomanAdministrator,andSeniorComplianceAdministrator,HeadAthleticsTrainerandDirectorofStudentWelfareandIntegrity.IntheeventacommitteememberistheHeadCoachofastudent-athlete,thismemberwillrecusehimselforherselffromthespecificmatter.
(b)Terms.Membersshallbeappointedforstaggeredthree-yeartermsandmaybereappointedforoneormoreterms.Ifamembernolongerholdsthepositionthatqualifiedthememberforappointment,theappointingauthorityshallappointasuccessor.Likewise,theappointingauthorityshalldesignateaninterimmembertoreplaceamemberwhoistemporarilyunabletoserve.
(c)Chair.ThePresidentshalldesignatetheChairoftheCommittee,typicallytheDirectorofAthletics,onanannualbasis.TheChairhasauthoritytoactonbehalfoftheCommitteeathisorherdiscretion.TheChairalsohastheauthoritytoextendanydeadlinesetforthinthisProgram(exceptforthosedeadlinessetforthinpartVIIofthisProgramregardingAppeals)basedonextraordinarycircumstances.
(d)DrugTestingCoordinator.TheDrugTestingCoordinator,typicallytheHeadAthleticTrainer,shallsupportandcoordinateadministrationoftheProgramundertheprotocoldevelopedbytheCommittee.
(2)Duties.TheCommitteeshallmeetonanasneededbasis.
(a)DevelopmentofDrugTestingProtocol.TheCommitteeofthispolicy,informedbythebestavailableinformation,ondrugtestingmethodsandpracticesandondruguseinintercollegiateathletics,shall:(i)determinetheappropriatemethodsofdrugtestingtouse;(ii)establishthefrequencyofrandomtestingandthenumberofstudent-athletestobetested;and(iii)designateteamswhosestudent-athletes,orarandomselectionthereof,shallbesubjecttopre-participationorteamtesting.
(b)ImplementationofDrugTestingProtocol.TheCommitteeshallselectanon-memberUniversityphysicianor

athletictrainertoserveastheDrugTestingCoordinator.InconsultationwiththeDrugTestingCoordinator,theCommitteeshallidentifyanoutsideagencytoperformlaboratory-testingservicesonsamplescollectedunderthisProgram,andmayrecommendtothePresidentthattheUniversitycontractwithanoutsideagencytoassistintheadministrationoftheProgram.
(c)EvaluationofEducationalInitiatives.Onanannualbasis,theCommitteeshallgatherandevaluateinformationonUniversityandDepartmentofAthleticsinitiativesthateducatestudentsonthefollowingissues:thedangersofsubstanceabuse;theavailabilityofsubstanceabuseassistanceandtreatment;andtherequirementsandproceduresoftheNCAAdrug-testingprogramandthisProgram.
(d)AnnualReport.TheCommitteeshallprovideanannualreporttothePresidentandtheBoardofTrusteesconcerningimplementationofthisProgram.Suchreportshallincludethenumberofstudent-athletestestedduringthepastyearundertheNCAAdrug-testingprogramandthisProgramandaggregatetestresults.SuchreportshallalsoincludeinformationcollectedontheeducationalinitiativesandanyrecommendationsformodificationofthisProgram.
(e)DrugTestingAppealsBoard.TheDrugTestingAppealsBoard(“AppealsBoard”)shallconsistoftheFacultyAthleticsRepresentative(servesasChair),theViceProvostforStudentDevelopment(orhisorherdesignee),andamemberofthecampusfaculty/staffcommunity.TheDirectorofAthleticsshalldesignatetheChairoftheAppealsBoardonanannualbasis.
ProhibitiononUseofBannedDrugsandDietarySupplementsProhibitiononUseofBannedDrugs.Allstudent-athletesatSt.Mary’sUniversityareprohibitedfromusinganydrugbelongingtoanyoftheclassesofdrugsbannedbytheNCAA,unlessamedicalexceptionisgrantedpursuanttothispolicyforsuchuse.Theclassesofbanneddrugsincludestimulants,anabolicagents,diureticsandothermaskingagents,streetdrugs,peptidehormonesandanalogues,anti-estrogens,andbeta-2agonists,andanydrugschemicallyrelatedtotheseclasses.MedicalExceptions.TheNCAArecognizesthatsomebannedsubstancesareusedforlegitimatemedicalpurposes.Accordingly,theNCAAallowsexceptiontobemadeforthosestudent-athleteswithadocumentedmedicalhistorydemonstratingtheneedfortreatmentwithabannedmedication.Exceptionsmaybegrantedforsubstancesincludedinthefollowingclassesofbanneddrugs:anabolicagents*,stimulants,betablockers,diuretics,anti-estrogens*,beta-2agonistsandpeptidehormone*.Nomedicalexceptionreviewisavailableforsubstancesintheclassofillicitdrugs.
1.Alternativenon-bannedmedicationsforthetreatmentofvariousconditionsmayexistandshouldbeconsideredbeforeanexceptionispursued.
2.Intheeventthatthestudent-athleteandthephysician(incoordinationwithsports-medicinestaffatthestudent-athlete'sinstitution)agreethatnoappropriatealternativemedicationtotheuseofthebannedsubstanceisavailable,thedecisionmaybemadetouseamedicationthatfallsunderanNCAAclassofbanneddrugs.NOTEtheuseofan*anabolicagent,anti-estrogenorpeptidehormonemustbeapprovedbytheNCAAbeforethestudent-athleteisallowedtoparticipateincompetitionwhiletakingthesemedications.Theinstitution,throughitsdirectorofathletics,mayrequestanexceptionforuseofananabolicagent,anti-estrogenorpeptidehormonebysubmittingtotheNCAAmedicaldocumentationfromtheprescribingphysiciansupportingthediagnosisandtreatment.3.Theinstitutionshouldmaintaindocumentationthatsupportstheuseofmedicationinthestudent-athlete'smedicalrecordoncampus.Thedocumentationcanbealetterorcopiesofmedicalnotesfromtheprescribingphysicianthatdocumentshowthediagnosiswasreached,andthatthestudent-athletehasamedicalhistorydemonstratingtheneedfortreatmentwiththebannedmedication.Thelettershouldcontaininformationastothediagnosis(includingappropriateverificationofthediagnosis),medicalhistoryanddosageinformation.ADHDMedication:foramedicalexceptionrequestforapositivetestinvolvingstimulantmedicationtotreatADHD,theNCAArequiresthedocumentationbeaccompaniedbytherequiredform“NCAAMedicalExceptionDocumentationReportingFormtoSupporttheDiagnosisofAttentionDeficitHyperactivityDisorder(ADHD)andTreatmentwithBannedStimulantMedication,”locatedatwww.ncaa.org/drugtesting

4.Unlessrequestingareviewforthemedicaluseofananabolicagentorpeptidehormone,astudent-athlete'smedicalrecordsorphysicians'lettersshouldnotbesenttotheNCAAunlessrequestedbytheNCAA.Inaddition,studentsarenotexpectedtoreporttheuseofanysubstance(s)tothedrug-testingstaffatthetimeofanNCAAmandateddrugtest.5.Intheeventthatastudent-athleteistestedbytheNCAAandtestspositiveforasubstanceforwhichtheinstitutiondesiresanexception,normalproceduresforreportingpositivetestresultswillbefollowed(SeeSection8.0oftheNCAADrug-TestingProgramProtocol).Theinstitutionmayrequestanexceptionatthetimeofnotificationofthepositivedrugtest(“A”sample)bysubmittingdocumentationtoDrugFreeSport.IftheinstitutionfailstoprovidemedicaldocumentationtoDrugFreeSportbeforethe"B"sampleisreportedaspositivetotheinstitution,thestudent-athletewillbewithheldfromcompetitionuntilsuchtimethedocumentationisreceived,reviewedandthemedicalexceptiongranted.6.RequestsformedicalexceptionswillbereviewedbythemedicalpaneloftheNCAACommitteeonCompetitiveSafeguardsandMedicalAspectsofSports.7.TheNCAAwillinformthedirectorofathleticsregardingtheoutcomeoftheexceptionrequest.Intheeventthattheexceptionisnotgranted,theinstitutionmayappealthisactionaccordingtoSection8.0oftheNCAADrug-TestingProgramProtocol.
DrugClassifications.UnderthisProgram,theUniversitydistinguishesbetweenotherSubstances,StreetDrug:MarijuanaandStreetDrugsOtherthanMarijuana.Drugsincludedin,orchemicallyrelatedto,allclassesontheNCAAbanneddrugslistotherthanstreetdrugswillbetreatedasperformance-enhancingdrugs.
DietarySupplements:St.Mary’sUniversityDepartmentofAthleticspersonnelwillnotdistributeorencouragetheuseofanydietarysupplementsorergogenicaids.Manydietarysupplementsorergogenicaidscontainbannedsubstances.Oftentimesthelabelingofdietarysupplementsisnotaccurateandismisleading.Termssuchas“healthy”or“allnatural”donotmeandietarysupplementsdonotcontainabannedsubstanceoraresafetotake.Usingdietarysupplementsmaycausepositivedrugtests.Student-athleteswhoarecurrentlytakingdietarysupplementsorintendtotakeanyarerequiredtoreviewtheproductwiththeHeadAthleticTrainerand/ortheirassignedstaffAthleticTrainer.Student-athletesaresolelyresponsibleforanysubstancethattheyingest.Allstudent-athletesareencouragedtousetheDrugFreeSportResourceExchangeCenter(REC)toobtaincurrentandaccurateinformationondietarysupplementsorergogenicaids.AllinquiriestotheRECareconfidential.TheResourceExchangeCentermaybeaccessedatwww.drugfreesport.com/REC/.
Student-athletesmustunderstandthateventhoughtheathletictrainingstafforDrugFreeSporthasclearedanydietarysupplement,theathletictrainingstaffdoesnotcondonetheuseofdietarysupplementsandisnotresponsibleforanysupplementsthestudent-athleteintakes.Student-athletesshouldalsounderstandthattheyareresponsibleforanydietarysupplementstheyingest.
TheNCAAdoesallowaninstitutiontoprovidepermissiblesubstances(bars,recoverydrinks,etc.)toitsathletes.However,itisstilltheathlete’sresponsibilitytomakesurethosepermissiblesubstancesareacceptableandifingestedisthesoleresponsibilityoftheathlete.SafeHarbor
(1)SafeHarbor.Ononeoccasionduringthestudent-athlete’seligibilityforintercollegiateathleticsatSt.Mary’sUniversity,astudent-athletewhohasusedthestreetdrugMarijuanamayseeksafeharborunderthisProgrambydisclosinghisorheruseofthestreetdrugMarijuanatotheHeadAthletictrainerorAssistantAthleticTrainer.Ifastudent-athletedisclosestoanAthleticsDepartmentStaffmember,underthisprogram,thisstaffmember(includingcoaches)mustnotifytheHeadAthleticTrainerwithin24hoursofthisstudent’sdisclosure.ThesafeharbordoesnotapplytotheNCAAdrugtestingprogram.
(2)Eligibility.TobeeligiblefortheSafeHarbor,thestudent-athletemustnothavepreviouslytestedpositiveforanystreetdrugundertheNCAAdrugtestingprogramorthisProgram.Adisclosuremadeafterthestudent-athletereceivesnotificationofarandomtestorafteranon-randomtestunderthisProgramshallnotcreateSafeHarborwithregardtosuchtest.

(3)ConsequencesofSafeHarborRequest
(a)TheAthleticsDepartmentemployeeshallpromptlynotifytheDrugTestingCoordinatorofthesafeharbordisclosure.TheDrugTestingCoordinatorshallarrangetohavethestudent-athletetestedtoestablishabaselineforre-testingpurposes.Ifthebaselinetestresultsinapositivetestforthestreetdrugdisclosedbythestudent-athlete,theresultshallnotbetreatedasapositivefinding.Ifthebaselinetestresultsinanegativetest,theone-timesafeharboroptionisnotreturnedtothestudent-athlete.(b)Astudent-athlete’srequestforsafeharborshallnotresultinsanctionsaffectingthestudent-athlete’sparticipationinteamconditioning,practice,and/orcompetition,exceptthattheDirectorofAthleticsmaysuspendthestudent-athletefromconditioning,practice,and/orcompetitionuntiltheDirectorofAthleticsissatisfiedthatthestudent-athleteisphysicallyandmentallyfittoresumesuchactivities.
ProgramTestingforUseofBannedDrugsA.ConsentForm.TheAthleticsComplianceOfficeshallprovideeachstudent-athletewithinformationonthisProgramandtheNCAAdrugtestingprogram,includingformsstatingthatthestudent-athleteconsentstotestingunderthisProgramandtheNCAAdrugtestingprogram.Eachstudent-athletemustsigntheconsentformsbeforeheorshecanparticipateinanycountableathletically-relatedactivityor,formembersofthecheerleadingsquad,practice.B.TestingMethods.TheUniversitymayconductdrugtestingusinganymedicallyrecognizedandscientificallyreliablemethodoftesting,includingbutnotlimitedtourinetestingandhairtesting.C.MethodsofSelection.Allstudent-athletesaresubjecttoyear-roundtesting,fortheuseofanybanneddrug,underaprotocolestablishedbytheCommitteewithinthefollowingparameters:
(1)RandomTesting.Allstudent-athletesaresubjecttorandomtesting.Onanannualbasis,theCommitteeshalldesignatethenumberofrandomtestingwindowsandthenumberofstudent-athletestobetestedduringeachwindow,butthereshallbenofewerthanfour(4)suchwindowsduringtheyearwithtestingofatleast8%ofthestudent-athletepopulationduringeachwindow.
(2)Pre-ParticipationTesting.TheDirectorofAthletics,inconsultationwiththe“Committee”shallhavetheauthoritytodesignateteamssubjecttodrugtestingaspartofapre-participationphysicalrequiredofallincomingstudent-athletes,includingwhethertotestallincomingstudent-athletesonthedesignatedteamorarandomsamplethereof.
(3)TeamTesting.TheDirectorofAthletics,inconsultationwiththe“Committee”shallhavetheauthoritytodesignateteamssubjecttodrugtestingatanytimeduringthecourseoftheyear,includingwhethertotestallstudent-athletesonthedesignatedteamorarandomsamplethereof.
(4)For-CauseTesting.IftheDirectorofAthleticshasareasonablesuspiciontobelievethatastudent-athleteisusingabanneddrug,heorshemaynotifytheDrugTestingCoordinator,whoshallarrangetohavethestudent-athletetested.(SeeAppendixB:BestPracticesforreportingReasonableSuspicion)
5)ProbationaryTesting.Followingapositivefindingorasafeharbordisclosure,astudent-athleteshallbesubjecttoperiodicannouncedandunannouncedtestingforthedurationatthediscretionoftheDirectorofAthletics,inconsultationwiththeDrug,AlcoholandOtherSubstanceTestingCommittee.
D.ImplementationofDrugTestingProtocol
(1)Notification.Astudent-athleteselectedfortestingshallbeprovided,inwrittenorelectronicform,thefollowinginformation:

(a)Astatementofthemethodbywhichthestudent-athletewasselectedfortesting(random,pre-participation,team,for-cause,orprobationarytesting);
(b)Adescriptionofthetypeoftesttobeconducted(urine,hair,and/orother);
(c)Informationonthedesignatedtestsitetowhichthestudent-athletemustreportfortesting;and
(d)Informationontheappointedtimeatwhich,orwindowwithinwhich,thestudent-athletemustreporttothedesignatedtestsite.
(2)Conflict,Illness,orInjury.TheDrugTestingCoordinatorshallexcuseastudent-athletefromadrugtestconducted,pursuanttothispolicy,andshallarrangealternativetestingofthestudent-athleteineachofthefollowingcircumstances:
(a)thestudent-athletenotifiestheDrugTestingCoordinatorofanacademicobligationorathleticcompetitionthatconflictswiththescheduledtestandtheDrugTestingCoordinatorverifiestheconflict;and(b)theDrugTestingCoordinator,inhisorherdiscretion,determinesthatthestudent-athletehaspresentedacompellingjustificationforreschedulingthetest.Inaddition,theDrugTestingCoordinatororhisorherdesigneemayexcuseasickorinjuredstudent-athletefromthedesignatedtestsiteevenifthestudent-athletehasnotcompletedthetest.Insuchacase,theDrugTestingCoordinatororhisorherdesignee,beforereleasingthestudent-athletefromthesite,mustdocumentappropriatearrangementsforalternativetestingofthestudent-athlete.
(3)PositiveIdentification.Uponarrivingatthedesignatedtestsite,astudent-athleteshallprovidevalidphotographicidentificationenablingthecollectionagenttopositivelyidentifyhimorher.(4)ProvisionofSpecimen.Thestudent-athleteshallprovideaspecimeninaccordancewiththecollectionagent’sdirections.Inthecaseofurinetesting,thecollectionagentshallmonitorthefurnishingofthespecimenbydirectobservationtoensuretheintegrityofthespecimen.Ifthespecimenisincomplete,thestudent-athletemustremainunderdirectobservationuntilthestudent-athleteproducesanadequatespecimen.Thestudent-athleteshallhavetherighttowitnessthesealingofthespecimencontainerinaccordancewithcollectionprocedures.(5)FailuretoAppear;RefusaltoSubmit;FailuretoCooperate;ManipulationorTampering.Failingtoappearfororrefusingtosubmittoascheduleddrugtest,failingtocooperatewiththetest,failingtoprovideanadequatespecimen,manipulatingortamperingwithatestsample,orotherwiseattemptingtosabotagethecollectionprocessortomateriallyaffecttheresultsshalltriggerapositivefinding.(6)Laboratory.AlltestingshallbeperformedbyalaboratorydesignatedbytheCommittee.Informationonthelaboratory’stestingmethodologyshallbeprovidedtothestudent-athleteathisorherrequest.(7)PositiveResults.ThetestinglaboratoryshallnotifytheDrugTestingCoordinatorofanypositivetest.TheDrugTestingCoordinatorshalldeterminewhetheranymedicalexceptioniswarrantedundertheNCAA’sMedicalExceptionprotocol.IftheDrugTestingCoordinatorfindsthatnomedicalexceptioniswarranted,theDrugTestingCoordinatorshalldocumentconfirmationofthepositivetest.VI.PositiveFindingSanctionsA.PositiveFindings(1)“PositiveFinding”Defined.Apositivefindingresultsfrom:
(a)atestconductedandconfirmedunderthisProgramortheNCAAtestingprogramdemonstratingevidence

oftheuseofabanneddrug,wherenomedicalexceptionisgrantedforsuchuse(“positivetest”);
(b)afailuretoappearfor,refusaltosubmitto,failuretocooperatewith,orfailuretoprovideanadequatespecimeninadrugtestunderthisProgramortheNCAAtestingprogram;or
(c)manipulationofortamperingwithatestsampleorotherwiseattemptingtosabotagethecollectionprocessortomateriallyaffecttheresultsinadrugtestunderthisProgramortheNCAAtestingprogram.
(2)PositiveFindingDuringProbation.Duringaperiodofprobation,apositivetestforthedrugforwhichthestudent-athletepreviouslytestedpositivewillbetreatedasapositivefindingifthelevelofthedrugpresentinthestudent-athlete’ssystemdemonstratescontinueduseofthebanneddrug.B.ConsequencesofPositiveFindings(1)Notification.Within24hoursofconfirmingapositivefinding,theDrugTestingCoordinatorshallnotifytheDirectorofAthletics.
(a)WrittenConfirmation;NoticeofAppeal.TheDrugTestingCoordinatorandtheDirectorofAthletics(orhisorherdesignee)shallmeetinperson,telephonically,orbyotherappropriatemethodwiththestudent-athleteandHeadCoach,assoonaspracticable,butwithinfivebusinessdaysoftheDrugTestingCoordinator’sinitialnotificationtotheDirectorofAthletics,todiscussthepositivefindingandthesanctions(includinganyperiodofprobation,participationsanctions,orlossofathleticseligibility)tobeimposed.Atthismeetingorwithinthreebusinessdaysthereof,theDirectorofAthleticsshallprovidethestudent-athletewithwrittenconfirmationofthesanctionsandnoticeofthestudent-athlete’srighttoappealunderpartVIIofthispolicy.
(b)RequestforMitigatingCircumstancesReview.Ifastudent-athletecandemonstratethat(a)apositivefindingintestingunderthisProgramresultedfromuseofabanneddrugpriortothestudent-athlete’sinitialenrollmentatSt.Mary’sUniversity;or(b)afirstpositivefindingintestingunderthisProgramforaperformance-enhancingdrugresultedfromunintentionaluseofthedrug,thestudent-athleteshouldpresentcredibleevidencetosucheffecttotheDrugTestingCoordinatortoseekrelief.Withinthreebusinessdaysofreceivingtheevidence,theDrugTestingCoordinatorshallreviewtheevidenceanddeterminewhethertheevidenceiscredible.Uponreceiptofthisrequest,theDrugTestingCoordinatornotifiestheDirectorofAthletics.ArequesttoreviewsuchevidenceshallstaytheobligationoftheDepartmentofAthleticsrepresentativetoissuethewrittenconfirmationandnoticeofappealdescribedinparagraphVI.B.1.auntiltheDrugTestingCoordinatorand/ortheCommitteeresolvestherequest.
(c)DiscretionaryNotification.Tofurtherthewell-beingofthestudent-athlete,theDirectorofAthletics,inconsultationwiththeViceProvostforStudentDevelopment/DeanofStudent,maynotifythestudent-athlete’sparents(orlegalguardian(s))andteampersonnel(suchastheheadcoach,sportadministrator,teamphysician,orathletictrainer)ofthepositivefindingandsanctions.Likewise,theDirectorofAthleticsmayprovideotherappropriateUniversityofficialswithanyinformationnecessarytofurtherthewell-beingofthestudent-athleteorthesafetyoftheUniversitycommunity.
(d)StayofSanctions.AnysanctionsimposedunderthisProgramshallbegintorunwhenthetimeframeforrequestinganappealunderpartVIIexpiresor,ifsuchappealistimelyrequested,whentheAppealsBoardnotifiesthestudent-athleteofitsdecision.Notwithstandingthisprovision,theDirectorofAthleticsmaysuspendthestudent-athletefromconditioning,practice,and/orcompetitionduringthetimeframeforrequestinganappealorpendingresolutionofatimelyrequestedappealuntiltheDirectorofAthleticsissatisfiedthatthestudentisphysicallyandmentallyfittoresumesuchactivities.
(2)ReferralforDrugCounselingAssessment.FollowingaSafeHarbordisclosureorapositivedrugtestfinding,theDrug,AlcoholandOtherSubstanceTestingOversightCommitteeshallreferthestudent-athletetotheStudentCounselingCenterforsubstanceabuseassessment.ThedirectoroftheStudentCounselingCenter(ordesignee)shall

determinetheinterventionthatwouldbestmeetthestudent-athlete’sneedsandshallprovidehisorherrecommendationtothestudent-athlete,theDrugTestingCoordinator,and,uponrequest,theathletictrainerorphysicianassignedtothestudent-athlete’steam.(3)Probation
(a)DurationofProbation.Followingasafeharbordisclosureorapositivefinding,thestudent-athleteshallbeplacedonprobationfortheperiodoftimespecifiedinConsequencesforaPositiveFinding.
(b)ConditionsofProbation.Duringtheperiodofprobation,thestudent-athleteshallbesubjecttoperiodicannouncedandunannouncedtesting,asdeterminedbytheDirectorofAthletics,inconsultationwithDrug,AlcoholandOtherSubstanceTesting,foranybanneddrug.Apositivetestwillconstituteapositivefinding,exceptthatapositivetestforthedrugforwhichthestudent-athletepreviouslytestedpositive(or,inthecaseofasafeharbordisclosure,providedabaseline)willbetreatedasapositivefindingonlyifthelevelofthedrugpresentinthestudent-athlete’ssystemdemonstratescontinueduseofthebanneddrug.
(4)OtherSubstances
(a)General.UponthefirstpositivefindingforuseofaOtherSubstances(i.e.Performance-EnhancingDrugsorDietarySupplements),thestudent-athleteshallbesubjecttothesanctionsspecifiedintheConsequencesforaPositiveFinding
(b)FailedNCAATest.Ifthestudent-athlete’spositivefindingistheresultofaconfirmedpositivetestintheNCAAdrug-testingprogram,participationsanctionsimposedunderthisProgramshallrunconcurrentlywithNCAAparticipationsanctions.
(5)StreetDrugsOtherthanMarijuana(a)General.Uponthefirstpositivefindingforuseofastreetdrug,thestudentathleteshallbesubjecttothesanctionsspecifiedintheConsequencesforaPositiveFinding(SeeAppendixA).
(b)FailedNCAATest.Ifthestudent-athlete’spositivefindingistheresultofaconfirmedpositivetestintheNCAAdrugtestingprogram,participationsanctionsimposedunderthisProgramshallrunconcurrentlywithNCAAparticipationsanctions.
(6)StreetDrug:Marijuana(a)General.UponthefirstpositivefindingforuseofthestreetdrugMarijuana,thestudent-athleteshallbesubjecttothesanctionsspecifiedintheConsequencesforaPositiveFinding(SeeAppendixA).
(b)FailedNCAATest.Ifthestudent-athlete’spositivefindingistheresultofaconfirmedpositivetestintheNCAAdrugtestingprogram,participationsanctionsimposedunderthisProgramshallrunconcurrentlywithNCAAparticipationsanctions.
(7)AggravatingCircumstances

AppealsA. GroundsforAppeal.Withinfivebusinessdaysofreceivingthewrittenconfirmation,thestudent-athlete,througha
writtensubmissiontotheFacultyAthleticsRepresentative(ChairoftheAppealsBoard),mayappealapositivefindingorsanctionunderthisProgramononeofthefollowinggrounds:(1)aproceduralirregularityordefectmateriallyaffectedtheoutcomeofthetestonwhichthepositivefindingwasbased;(2)apositivefindingwasotherwiseinerror,asdemonstratedbycompellingevidence;(3)anexerciseofdiscretionaryauthorityexpresslyconferredunderthisProgramwasarbitraryandcapricious;or(4)adeterminationconcerningusepriortoastudent-athlete’sinitialenrollmentorunintentionaluseofaperformance-enhancingdrugwasinerror,as

B. ConsiderationofAppeal.TheAppealsBoardshallhavetheauthoritytoestablishtheprocedures,rules,andlimitationsunderwhichthestudent-athletemaypresentevidenceandtheauthoritytoestablishotherproceduralelementsoftheappeal.TheAppealsBoardmayrequireastudent-athletetoundergoadrugtestbeforemakingitsdecision.ExceptincasesinwhichtheAppealsBoardisawaitingtheresultsofanadditionaldrugtest,theAppealsBoardshallnotifythestudent-athleteinwritingofthedispositionoftheappealwithinfivebusinessdaysofreceivingthereviewrequest.IncasesinwhichtheAppealsBoardisawaitingtheresultsofanadditionaldrugtest,theAppealsBoardshallnotifythestudent-athleteinwritingofthedispositionoftheappealwithinfivebusinessdaysofreceivingtheresultsofthetest.
C. Astudent-athletewhotestspositivefora“banneddrug”otherthana“streetdrug”shallbewithheldfromcompetitioninallsportsforaminimumof365daysfromthedrug-testcollectiondateandshallloseayearofeligibility.Astudent-athletewhotestspositivefora“streetdrug”shallbewithheldfromcompetitionfor50percentofaseasoninallsports(atleastthefirst50percentofallcontestsordatesofcompetitionintheseasonfollowingthepositivetest);
2. Astudent-athletewhotestspositivehasanopportunitytoappealthepositivedrugtest.
3. Astudent-athletewho testspositivea second time for theuseofanydrugother thana “streetdrug” shall loseall
remainingregular-seasonandpostseasoneligibilityinallsports.Acombinationoftwopositivetestsinvolvingstreetdrugs(marijuana,THCorheroin),inwhateverorder,willresultinthelossofanadditionalyearofeligibility

NCAADrugTestingAppealsProcess Ifrequestedtodoso,aninstitutionisrequiredtobringanappealonbehalfofastudent-athletewhohasapositivedrugtestorwhoviolatesanNCAAdrug-testingprotocol.TheproceduresforappealarecontainedinSectionNo.8.0oftheNCAAdrug-testingprotocol.ThefollowinginformationisprovidedtoNCAAinstitutionsthatmaybeconsideringfilinganappealonbehalfofastudent-athlete.At least three members of the Drug-Education and Drug-Testing subcommittee of the NCAA Committee on CompetitiveSafeguardsandMedicalAspects of Sports hear appeals. TheChair of theNCAACommittee onCompetitive Safeguards andMedicalAspectsofSportsandotherdesignatedmembersoftheCommitteemayalsoserveonthesubcommitteetohearappeals.Intheeventthatamemberinstitutionbelongingtothesameathleticsconferenceoftheappealinginstitutionemploysamemberofthesubcommittee,thatsubcommitteememberwillnotheartheappeal.AppealsareconductedbytelephoneconferencearrangedbyTheNationalCenterforDrugFreeSport(DrugFreeSport)fortheNCAA.NCAAstaff,NCAAdrug-testingconsultantsandNCAAlegalcounselarenormallypresentduringthetelephoneconference,butdonotparticipateinsubcommitteedeliberationsorvoting.The subcommittee prefers not to know the identity of the institution requesting the appeal or the identities of any of theinstitutional representatives, the student-athlete or his/her representatives. Accordingly, during the telephone conferencepartiesshouldrefertothemselvesonlybytitleandshouldnotmentiontheinstitution'sname.Theinstitutionandthestudent-athletemayincludeanypartyonthetelephoneconferencetheywishafterreportingtheirnamesand telephone numbers to Drug Free Sport. The institution is required to include the student-athlete and the Director ofAthletics.TheDirectorofAthleticsmaydesignateaseniorstaffmembertoparticipateinhis/herabsence,subjecttoapprovalbythesubcommitteechair.Theheadcoachisrecommendedtobeonthecall.TheNCAAdoesnotrestrictthegroundsforanappeal,butaninstitutionbringinganappealmustcomplywiththerequirementssetforthinSection8.0.Appealconsiderationsareoutlinedbelow:
1. ProceduralChallenge:Eithertheinstitutionorstudent-athletemaychallengeanyprocedurerelatingtothecollectionor testing of the subject samples. If the institution or student-athlete proves it is more likely than not that anysubstantiatedproblemwiththecollectionortestingproceduresmateriallyaffectsasample'sintegrity,thedrug-testappealsubcommitteemayfindthatnodopingviolationhasoccurred.
2. KnowledgeChallenge:Thestudent-athleteisresponsibleforallsubstancesconsumed.However,iftheinstitutionorthe

student-athletedemonstratesthatthestudent-athletewasnotawaretheyhadbeenadministered(definedasplacedintothestudent-athlete’ssystemdirectlyorthroughfoodordrink)asubstancebyanotherpersonthatlaterisfoundtohavecontainedabannedingredient,thenthedrug-testappealcommitteemaydeterminethatnoviolationhasoccurred.Inthissituation,thestudent-athletemustshowthatheorshebothdidnotknowandcouldnotreasonablyhaveknownor suspected (evenwith the exercise of utmost caution) that he or she hadbeen administered by a third party asubstance that is later found to have contained a banned ingredient. Or if the institution or the student-athletedemonstratesthatthestudent-athleteaskedspecificandreasonablequestionsaboutaparticularsubstance,medicationorproductoftheappropriateathleticsadministratorandtheathleticsadministratorassuredtheinquiringstudent-athletethatthesubstancedoesnotcontainabannedingredient,thenthedrug-testappealcommitteemaydeterminethatnoviolationhasoccurred.Inthissituation,thestudent-athletemustshowthatheorshebothdidnotknowandcouldnotreasonablycouldhaveknownorsuspected(evenwiththeexerciseofutmostcaution)thattheinformationprovidedbystaffwaserroneous.INthecasewherethesubstance,medicationorproductreviewedandapprovedforusebytheinstitutiondoescontainabannedsubstance,thismayresultinaninstitutionalviolation.
3. ReductionofPenaltyBasedonMitigatingFactors:Thefollowingwillnotbeconsideredmitigatingfactorsinadrugtestappeal:thetypeoramountofbannedsubstancedetectedthroughthedrugtest;evidenceofthestudent-athlete’sgoodcharacter;thedegreeofremorsedemonstratedbythestudent-athlete;familyhardshiporhistoryoffamilydysfunction;andthedegreetowhichthebannedsubstancemayormaynotaffectathleticperformance.Thedrug-testappealcommitteemayreducethecurrentlegislativesanctiontothefirst50percentoftheregularseasoninallsportsiftheseasonofcompetitionhasnotyetbegunforthatstudent-athleteoraminimumoftheequivalentofthenext50percentofaseasonofcompetitioninallsportsifthestudent-athletetestspositiveduringhisorherseasonofcompetitionwhencircumstancesmightindicateareductioniswarranted.Forexample:Whereitisshownthattheinstitution'sdrugeducationprogramwasinadequateandsuchshortcomingsinfluencedthestudent-athlete’sjudgmentregardingtheproprietyoftakingaspecificproduct(areductionofpenaltynormallywillnotbeavailableinthecaseofadmittedstreetdruguse);orAstudent-athlete’sabilitytodiscernheorshewasusingabannedsubstancewasduetocircumstancesbeyondthestudent-athlete’scontrol.
4. EveryattemptwillbemadetodisseminatetothesubcommitteeanywrittenmaterialssubmittedbytheinstitutionandreceivedbyDrugFreeSportregardingtheappeal.
5. Theinstitutionwithintwobusinessdaysoftheconfirmationofthepositivedrugtestshallsubmittherequestforan
appeal.Theinstitutionwithin45daysoftheconfirmationofthepositivedrugtestmustsubmitrequireddocumentation.Atleastfivebusinessdaysbeforethescheduledappeal,theinstitutionisrequiredtosubmittoDrugFreeSportawrittensummarydescribingtheinstitution’sdrug-educationprogramandthegroundsfortheappeal.
6. Thechairofthesubcommitteeordesigneewillopenthetelephoneconferenceappealbyinvitingtheinstitutionandits
representativesand/orthestudent-athleteandhis/herrepresentativestoprovideorallyanyinformationtheywishtohave before the subcommittee. The subcommittee prefers that the student-athlete present his/her informationimmediatelyafteranyintroductorystatementsmadebythedirectorofathletics.Opportunitywillbegiventoallpartiestohavequestionsaskedandanswered.
7. Followingthepresentationbytheinstitutionandthequestionandanswerperiod,thechairwillasktheinstitutionandanydrug-testingconsultantstoleavethetelephoneconferenceandatthattimethesubcommitteewilldeliberateandrenderadecision.TheNCAAstaffwillcontactthedirectorofathleticstoreportthesubcommittee'sdecisionassoonaspossible.Itistheinstitution'sresponsibilitytoinformthestudent-athlete.
8. In theevent that theappeal is accepted and the student-athlete is not sanctioned, no further action regarding thestudent-athlete'seligibilityneedbetaken.Intheeventthatthesubcommitteedeniestheappealandimposesasanction,theprovisionsofNCAABylaw18.4.1.5.1willresultineitheraoneyearlossofeligibilityandbeingwithheldfromonefullseasonofcompetitioninallsports,orthestudent-athletebeingwithheldfromthenext50percentoftheseasonof

EMERGENCYACTIONPLANPurpose:Duetotheintensenatureofathleticparticipation,athleticpersonnelmustbepreparedtoprovideadequateandexpedientcare.Theathleticstafftohopefullypreventsomeemergenciesutilizepre-participationphysicalscreenings,adequatemedicalcoverage,safepracticeandtrainingtechniquesandothersafetyavenues.However,accidentsandinjuriesareinherentwithsportparticipation.Athleticorganizationshaveadutytodevelopanemergencyplanthatmaybeimplementedimmediatelywhennecessaryandtoprovideappropriatestandsofemergencycaretoallsportsparticipants.Thispreparationinvolvesformulationofanemergencyactionplan,propercoverageofevents,maintenanceofappropriateemergencyequipmentandsupplies,utilizationofappropriateemergencymedicalpersonnel,andcontinuingeducationintheareaofemergencymedicineandplanning.ComponentsoftheEmergencyActionPlan:Thesearethebasiccomponentsofthisplan:

EMERGENCYPERSONNEL:Withathleticpracticeandcompetition,thefirstrespondertoanemergencyistypicallyamemberofthesportsmedicinestaff.Ateamphysicianmaynotalwaysbepresentateveryorganizedpracticeorcompetition,thetypeanddegreeofsportsmedicinecoverageforanathleticeventmayvarywidely,basedonsuchfactorsasthesportoractivity,thesetting,andthetypeoftrainingorcompetition.Insomecases,thefirstrespondermaybeacoachorastudentathletictrainer.ThefirstresponderMUSTcarryacurrentCPR/AEDcertificationtoprovideprudentcareoftheathlete.Theemergencyactionplanshoulddesignaterolesforpersonnelontheemergencyteam.However,theserolesmayvarydependingonvariousfactorssuchasthenumberofmembersavailable,theathleticvenue,etc.RoleswithintheEmergencyActionPlan:FirstResponder:Willevaluatethescenetoestablishthatthesceneissafeorunsafeandtoprovideimmediatecareoftheathlete.Themostqualifiedindividualonthesceneshouldprovideacutecareinanemergency.Thosewithlowercredentialsshouldyieldtothosewithtrainingthatismoreappropriate.Ifneeded,theyshouldprovidebasiclifesupport(CPR).Activator:WillactivatetheEmergencyMedicalSystem(EMS)innecessarysituationswhereemergencytransportationisnotalreadypresentatthesportingevent.Thisshouldbedoneassoonasthesituationisdeemedanemergencyoralife-threateningevent.Timeisthemostcriticalfactorunderemergencyconditions.ActivatingtheEMSmaybedonebyanyoneontheteam.However,thepersonchosenforthisdutyshouldbesomeonewhoiscalmunderpressureandwhocommunicateswelloverthetelephone.Thispersonshouldbefamiliarwiththelocationandaddressofthesportingevent.Retriever:Willretrieveemergencymedicalequipment.Theymaybeanyoneontheemergencyteamwhoisfamiliarwiththetypesandlocationofthespecificequipmentneeded.Studentathletictrainers,managers,andcoachesaregoodchoicesforthisrole.Navigator:Willmeetemergencypersonnelastheyarriveatthesiteandnavigatethemtothelocationoftheemergency.Dependingoneaseofaccess,thispersonshouldhavekeystoanylockedgatesordoorsthatmayslowthearrivalofmedicalpersonnel.Astudentathletictrainer,manager,orcoachmaybeappropriateforthisrole.EmergencyCareTeamandChainofCommand:Theemergencycareteamwillconsistof,butisnotlimitedto,theTeamPhysician,Certified/LicensedAthleticTrainer,StudentAthleticTrainers,Coaches,andstudent-athletes.ChainofCommandwillbeasfollows:

conditionhasbeenstabilized.EMERGENCYCOMMUNICATIONCommunicationisthekeytoquickemergencyresponse.Athletictrainersandemergencymedicalpersonnelmustworktogethertoprovidethebestemergencyresponsecapableandshouldhavecontactinformationsuchastelephonenumbersestablishedasapartofpre-planningforemergencies.Communicationspriortotheeventisagoodwaytoestablishboundariesandtobuildrapportbetweenbothgroupsofprofessionals.Ifemergencymedicaltransportationisnotavailableonsiteduringaparticularsportingevent,thendirectcommunicationwiththeEMSatthetimeofinjuryorillnessisnecessary.Accesstoaworkingtelephoneorothertelecommunicationdevice,whetherfixedormobile,shouldbeassured.Thecommunicationsystemshouldbecheckedpriortoeachpracticeorcompetitiontoensureproperworkingorder.Aback-upcommunicationplanshouldbeineffect,shouldtherebefailureoftheprimarycommunicationsystem.Atanyathleticvenue,
