1. SUMMARY OF REPORT:
This report incorporates the VCAT appeals update and decisions made by Council officers under delegation. This report also details some performance indicators.
1.1 Performance
Included within this report are bar charts illustrating the following key performance indicators:
Planning applications received and determined in the previous month.
Outstanding applications.
Average gross days in dealing with planning applications.
Percentage of applications issued in 60 days or less.
Percentage of applications issued in 60 days or less based on difficulty of applications.
The number of applications received in June was the highest since December last year. The number of permits issued for June increased by approximately 8% compared to May. Given the high number of applications received, outstanding applications for June increased by approximately 7.5% compared to the previous month. The average number of gross days taken to determine planning applications is similar to the previous month and still significantly better than the average number of gross days taken by growth and metropolitan Councils. The number of applications decided in 60 days or less increased by 7.5 percent. The percentage of “simple applications” issued in 60 days or less increased significantly by approximately 28%. For “average applications” the figure increased slightly compared to the previous month. There were too few applications of a complex nature to warrant inclusion in the report.
1.2 Delegated matters
The table within Section 4 of this report further details applications that have been determined under delegated authority and planning applications that receive 2 objections or less, applications to amend planning permits or plans, applications to extend planning permits, applications to certify plans of subdivision, and the issuing of Statements of Compliance under the Subdivision Act and Section 173 Agreements signed under delegation.

3. APPEAL DECISIONS TO DATE.
3.1 This report includes all VCAT decisions received within the month prior to the Council meeting and includes the current month to give Council a more up to date report on VCAT decisions.
3.2 VCAT struck out an appeal by an objector for a child care centre at 1661-1665 Sydney Road, Campbellfield (P18398) due to the non-payment of the application fee within 30 days of making the application.
3.3 VCAT affirmed Council’s decision not to support an application for the redevelopment of an existing dwelling and construction of an additional double storey dwelling at 30 Childers Crescent, Coolaroo (P17642). VCAT agreed that the proposal is in fact an overdevelopment of the site and in contrast to the neighbourhood character of the area.
3.4 VCAT has set aside Council’s decision to refuse an application for a floodlit major promotion sign at 1435-1437 Sydney Road, Fawkner (P18182). The Tribunal was of the opinion that the area being a commercial and industrial precinct dominated by large arterial roads is not a high amenity area and the sign would have little impact on the nearest residential properties.
3.5 In an appeal against Council’s failure to determine an application for a staged multi-lot subdivision and vegetation removal at 745-765 Mickleham Road, Greenvale (P18139), consent orders were made directing that a permit be issued in accordance with the conditions agreed to by both the applicant and Council.
3.6 VCAT set aside Council’s decision to refuse an application (P17506) for 10 dwellings in a double storey building above a basement car park at 59-61 Macedon Street, Sunbury finding that the built form and landscaping proposed will contribute to the neighbourhood character design objectives and will not be too intensive for the site.
